- Abstract
A «scaleup» company presupposes the next phase of expansion or growth of a «startup» company, taking into account parameters of employees and turnover growth. As the subsequent evolutionary phase of a «startup» company, the «scaleup» company is, also, considered to have an improved product or service. This paper analyses the "Scaleup Market", studying its legal and market configuration. Likewise, the figure of the Nominated Advisor and its legal regime are studied and analysed. At the time of development of this work, there are two companies trading on the «BME Scaleup » Market: ALFIL PATRIMONIAL SOCIMI, S.A. and SOLVENTO GROUP 2022 SOCIMI, S.A. [ABSTRACT FROM AUTHOR]

This paper analyzes the use in schools of private teaching platforms. They have had a boost with the COVID19 pandemic. The use of Google workplace for education has been considered an effective way both to adapt to the challenges of digitization and to face critical situations. The analysis carried out reveals a threat linked to the privacy of minors. Applying heuristic analysis, the results show the need to implement a principle of technological caution on the use of these platforms in education. It concludes with the need to deepen the analysis of the implications for kids and teenagers of the use of this software and the convenience of applying free and open tools. [ABSTRACT FROM AUTHOR]

VICTIMS , *RIGHTS - Abstract
In the last decade, it's become apparent how some social groups, heterogenous among them, have asked for and celebrated longer prison sentences for crimes against the values they defend. The aim of this paper is to reflect on the paradox that some movements involved in the struggle for the consolidation of fundamental rights denounce the cruelty and dysfunctions generated by the penal system in general and prison in particular, but justify them as adequate means to make visible, respond to and resolve social problems. These inconsistencies can feed and increase the slippery slope towards punitive and prison exceptionalism and consolidate as another type of punitive populism. [ABSTRACT FROM AUTHOR]

DIGNITY , *RIGHTS - Abstract
This paper deals with the question regarding the crisis of the effectiveness of human and fundamental rights. This is a challenge that requires commitment, vigilance, shared liability. Rights are an indispensable tool for expressing the value of dignity that is linked to vulnerability as a common human condition. Rights are a type of social practice aimed at their implementation and concretization. It is made up of principles, rules, institutions, procedures, attitudes, acts of interpretation. This practice plays an important role in countering and eliminating the situations that produce violations concerning the subjects in their multiple differences and specific existences. ANIMAL rights - Abstract
Philosophical reflection on justice for animals finds expression in a multiplicity of theories. In this context are fundamental the theories focused on suffering and compassion (developed among others by Peter Singer and Carol Adams), Tom Regan's theory of animal rights, Will Kymlicka's political theory of animal rights. This paper identifies three open questions, transversal to the different positions that make up this rich and important debate. It deals with the notion of person, the theme of gratuitous moral evil, the presumed principle of reciprocity between rights and duties. The belief underlying the article is that an in-depth study of these theoretical issues could be fruitful in consolidating the idea that justice for animals is an unavoidable goal for every democracy. INDIVIDUALISM - Abstract
In our time, we witness a true proliferation of rights. There is no conflict or human problem that doesn't lead to a debate about the rights we have and whose protection we demand. Such a scenario gives rise to the emergence of multiple challenges for a theory of human rights. These challenges can be both theoretical and practical. This paper points out a peculiar theoretical challenge: the need to clarify and determine very well the scope of any political ideology that contains a theory of human rights. Currently, the theory of the Common has been chosen in order to compare it with the political consequences of two theories that, in some way, have historically preceded it: J.J. Rousseau's General Will and C. Marx's proposal of a generic being. [ABSTRACT FROM AUTHOR]

The paper refers to the language of rights in the public debate, focusing the attention with the characters of imperativity, inviolability, absoluteness which are proper to the term 'right'. It focuses, on the one hand, on situations where every interest is claimed as a 'right', and, on the other hand, on situations where, on the contrary, fundamental human rights are not widely and unanimously recognized, which is typically the case of women's human rights. Despite the fact that the concept of inclusion is increasingly present in Spanish libraries, recent research has shown that libraries are normally still far from being inclusive. After reviewing the main definitions of the concept of inclusive library in the Ibero-American context, the library community is invited to broaden the scope and dimension of the term following the work done in the business sector and in libraries from English-speaking countries. This paper reviews some of the initiatives to achieve inclusion carried out in Spanish libraries and the differentiating aspects that make a library inclusive or not. The paper also offers some guidelines that may bring us closer to the creation of truly inclusive libraries. [ABSTRACT FROM AUTHOR]

Start-ups, due to their high growth potential, face the problem of raising finance. This paper reflects on the empirical evidence dealing with conflicts of interest that arise in the field of equity financing by new partners. When the firm wishes to make a new share issue, it faces the problem of information asymmetry when setting an issue price. As a result, the shareholder tries to protect himself through anti-dilution clauses. Empirical studies show an interest of the majority shareholder in enjoying and retaining the private benefits of control. Empirical evidence also supports the lack of alignment between the director and the owner. We can draw the conclusion that business reality is a complex reality in which conflicts of interest arise. These conflicts of interest bring financing difficulties when trying to attract new capital contributions from new partners and thus cause capital constraints. [ABSTRACT FROM AUTHOR]

Objective. Describe the quality of life of health personnel, the work environment, and interactions between employees and their work environment during the pandemic. Methods. A scoping review was conducted. The electronic databases PubMed, Cumulative Index of Nursing and Allied Literature Complete, and Google Scholar were used, as well as the repositories of the World Health Organization and the Centers for Disease Control and Prevention. Primary, secondary, and grey literature studies published between December 2019 and March 2021 in Spanish, English, and Portuguese were included. Methodological quality was assessed using the Authority, Accuracy, Coverage, Objectivity, Date and Importance (AACODS) checklist; a tool for the measurement of multiple systematic reviews (AMSTAR); and the Critical Appraisal Checklist for Text and Opinion Papers. A thematic analysis was carried out based on the quality-of-life and well-being model. Results. Of a total of 208 articles, 11 were included. The quality of life of health personnel during the COVID-19 pandemic was affected by the characteristics of health personnel, the work environment, and interactions between employees and their work environment. Problems related to psychosocial and occupational factors were observed. Discussion. The quality of life of health personnel was characterized by stigmatization, stress, anxiety, and fatigue. Organizational management and the implementation of psychological interventions appear to affect interactions between employees and their work environment, and improve their quality of life. Objective. The objective of this study was to investigate the funding received by papers of excellence on smoking at the global level between 2010 and 2014 through the Web of Science, and to find out if funding is associated with greater impact. Method. We searched the Science Citation Index Expanded (SCIE) and the Social Sciences Citation Index (SSCI) through the Web of Science platform on 20 May 2015 (typology consisting of originals and reviews for the period from 2010 to 2014). The search strategy was “smok*” OR “tobac*.” To select the papers of excellence, we picked those that had an h index (i.e., number of articles having at least that many citations) from among the papers in the overall sample generated by the strategy. Results. Of the 193 papers of excellence on smoking that were identified, 158 had received funding from 279 different financing institutions that intervened 522 times. The funding came primarily from government agencies, private foundations, and the pharmaceutical industry. Public funding declined and private funding increased over the years included in the analysis. Receipt of funding was not associated with greater impact at a later date. Conclusions. Most of the papers of excellence on smoking received external funding primarily from government agencies, private foundations, and the pharmaceutical industry. Public funding has decreased, while private funding has increased. Receipt of funding was not associated with greater impact at a later date. [ABSTRACT FROM AUTHOR]

The aim of this paper is to study the res judicata effect of sentences handed down against legal persons on subsequent criminal proceedings against members of the organisation. Despite the legislator's preference for the joint prosecution of natural and legal persons, it is possible that the natural persons whose criminal actions determine the liability of the entities may be identified after the proceedings against them. Will the judgement declaring the criminal acts proven in the proceedings against the legal person be effective in the subsequent proceedings against the natural person? [ABSTRACT FROM AUTHOR]

This paper provides a critical review of the measures that have recently been adopted in the Spanish legal system with the aim to avoid that the declaration of child victims of sexual violence may result in a short of secondary victimization. In this way, we support the implementation of the pioneering Barnahus model, taking into account that it is an empirically validated and highly effective system that responds to two major challenges of our criminal procedure system: reducing the sources of secondary victimization for the minor victim and offering greater guarantees of obtaining a testimony in safe and calm conditions, while it ensures a fair balance between the rights and interests that converge in the process. STATUTES , *CRIMINAL procedure , *CONDUCT of court proceedings , *PUBLIC prosecutors , *LEGAL procedure , *CRIMINAL act - Abstract
The attribution of the investigation to the Public Prosecutor's Office within the framework of the criminal process is, for many, a desideratum. Currently, however, the Public Prosecutor's Office itself arrogates this same attribution, under the pretext that the investigation carried out by it or under its direction is extra processum. In this regard, the Circular 2/2022 stresses that, in addition to the classic pre-procedural investigation proceedings regulated in the Organic Statute of Public Prosecutor's Office and in the Criminal Procedure Act, prosecutors can initiate what it calls «auxiliary investigation proceedings» and «post-procedural investigation proceedings». The aim of this paper is to analyze the regime designed for these newly baptized categories of proceedings and to highlight the risks involved in their use. [ABSTRACT FROM AUTHOR]

PHOTOVOLTAIC power systems , *ENERGY storage , *ELECTRICAL load , *SOLAR energy , *RENEWABLE energy sources , *ENERGY consumption - Abstract
Solar energy is a type of renewable energy that, due to its nature, it is intrinsically influenced by the variability of meteorological and geographical conditions of the site. To tackle variability, storage technologies such as batteries can be used, they enable the integration of renewable energy into the electricity network and a full supply of electrical loads at times of low generation. In this paper, a technical and economic analysis of a photovoltaic (PV) system including energy storage is carried out. Therefore, a model of a photovoltaic system with and without energy storage was developed in order to compare the technical and economic metrics for each case in the context of a residential system, while following a flat tariff. Based on the analysis, the results indicate that from the economic point of view, it is more profitable to install systems operating only with PV modules. On the other hand, the PV with storage systems allow a better use of the photovoltaic energy as can be seen from the metrics of self-consumption and autarky. Thus, this article contributes to the analysis of photovoltaic systems with energy storage through batteries, a relatively new technology in the country, collaborating with the generation of knowledge of systems that are expected to substantially change the electrical system. LOANS , *BUSINESS finance , *FINANCIAL crises , *FINANCIAL security , *INVESTMENT management , *INTERMEDIATION (Finance) , *CLOSED-end funds - Abstract
This paper analyzes the sources of business financing, focusing on those that are part of the broad concept of non-bank financial intermediation ("NBFI"), as an alternative to traditional bank financing. The origin and evolution of the NBFI is analyzed, how the organizations that ensure financial stability pointed out the need for regulation and supervision of these new forms of financing, and how the European Union has created a highly harmonized legal framework, particularly in the field of collective investment institutions. The paper deals in particular with debt or direct lending funds, which, being part of the collective investment CIIs, lacked ad hoc regulation in Spain, despite the fact that certain regulated entities, such as closed-end investment entities, could carry out the activity of debt funds. It has been Act 18/2022, of September, on the creation and growth of companies ("Create and Grow Law") that has expressly regulated closed-end collective investment entities for loans, incorporating them into Act 22/2014 by which venture capital entities, other closed-type collective investment entities and the management companies of closed-type collective investment entities are regulated. The purpose of the regulation has been to alleviate the debt situation of some companies and facilitate their growth again, particularly after the economic crisis resulting from the pandemic. PUBLIC libraries , *NONFORMAL education , *COVID-19 pandemic , *LIBRARY personnel , *LIBRARY users , *LIBRARIANS , *LIFE skills - Abstract
User-centered libraries allow for the development of life skills. The importance of this capacity lies in the fact that one of the main focal points of education in the 21st century is 21st century skills. Organizations such as Unesco, EU, P21, AT, Annex, OECD, Nets, Naep, enGauge, etc. support this perspective and propose lists of skills needed to perform in today's society. However, what is the right place to acquire these skills? Although the first answer would be the school, this paper aims at explaining how libraries are the right places for the development of skills when they are able to deploy their capacity to be informal education centers. Being this a personal report, the paper shows different examples based on my personal experience, both related to the influence libraries had on the author and to the way the author, as a librarian, influences other users. This paper reviews the configuration of FESABID's Observatory for the Defense of the Profession as well as the challenges faced by the profession that need to be tackled by professional entities. This paper examines the legal state of the professions of our sector and the situation regarding the access to the profession in the public sector. The access is done via a public examination and work contracts for the groups that require a university degree and also for inferior categories that do not require a specific qualification but have the possibility to establish a professional certification. In the private sector, a distinction is made between enterprises specific to the sector, and those of a general nature, and it is recommended to demand to the administration a socially responsible public recruitment. The paper reports on the state of the sectorial agreement recently approved in Gipuzkoa as well as on the situation of the education, the new professional roles and the public examination. Finally, a series of urgent demands are made to the administration and enterprises. [ABSTRACT FROM AUTHOR]

The objective of this paper is to explain how we understand business sustainability, the ethical foundation of sustainability and how all this connects with the financial objective of the firm (maximizing shareholder's wealth). Sustainable companies must be profitable, they must take care of their financial performance; moreover, the only way to meet the long-term financial objective of the firm will be to be sustainable: the result must be positive for the shareholders and for the rest of stakeholders. But for this to work, greenwashing and socialwashing must be avoided; sustainability cannot be cosmetic and therefore must be verifiable. [ABSTRACT FROM AUTHOR]

HEARTS in the Americas is the regional adaptation of the World Health Organization's Global Hearts Initiative, which will be the model for risk management for cardiovascular disease (CVD) in primary health care in the Region of the Americas by 2025. It has already been implemented in 21 countries and 1045 primary health care centers throughout Latin America and the Caribbean. It takes a public health and health systems approach to systematically introduce simplified interventions at the primary health care level and focuses on hypertension as a clinical entry point. This paper introduces a new, improved application (app), the main component of which is the calculator for CVD risk and hypertension management. The paper summarizes the risk assessment approach and the methodology used by the World Health Organization to update its cardiovascular risk charts in 2019; describes the app, its use, functionality and validation process; and provides a set of practical recommendations for optimizing CVD risk and hypertension management by using the app in clinical practice. The HEARTS app is a powerful tool to improve the quality of care provided in primary health settings. The creation and dissemination of the HEARTS app is an essential step in the journey towards eliminating preventable CVD in the Americas. [ABSTRACT FROM AUTHOR]

HEARTS in the Americas is the Pan American Health Organization flagship program to accelerate the reduction of the cardiovascular disease (CVD) burden by improving hypertension control and CVD secondary prevention in primary health care. A monitoring and evaluation (M&E) platform is needed for program implementation, benchmarking, and informing policy-makers. This paper describes the conceptual bases of the HEARTS M&E platform including software design principles, contextualization of data collection modules, data structure, reporting, and visualization. The District Health Information Software 2 (DHIS2) web-based platform was chosen to implement aggregate data entry of CVD outcome, process, and structural risk factor indicators. In addition, PowerBI was chosen for data visualization and dashboarding for the analysis of performance and trends above the health care facility level. The development of this new information platform was focused on primary health care facility data entry, timely data reporting, visualizations, and ultimately active use of data to drive decision-making for equitable program implementation and improved quality of care. Additionally, lessons learnt and programmatic considerations were assessed through the experience of the M&E software development. Building political will and support is essential to developing and deploying a flexible platform in multiple countries which is contextually specific to the needs of various stakeholders and levels of the health care system. The HEARTS M&E platform supports program implementation and reveals structural and managerial limitations and care gaps. The HEARTS M&E platform will be central to monitoring and driving further population-level improvements in CVD and other noncommunicable disease-related health. [ABSTRACT FROM AUTHOR]

ChatGPT is a language model that uses machine learning and natural language processing. Although it can process information, its potential for producing new knowledge is still to be evaluated. To produce knowledge, users must not only formulate the right questions but also analyze and discern the information obtained. This paper describes ChatGPT and evaluates its potential for producing knowledge through the analysis of a case study. [ABSTRACT FROM AUTHOR]

This paper starts from the observation of the symptomatic absence regarding the interpretation of the mytheme of the encounter with the Sphinx, both in Freud's analysis of Sophocles' Oedipus Rex and in his theory of the Oedipus complex. A detailed study is made of the allusions to the figure of the Sphinx in Freud's work and in the Sophoclean text, as well as their repercussions in the biography of the founder of psychoanalysis. A critical review is also made of later approaches to the subject, with particular emphasis on the work of Marie Delcourt and Didier Anzieu. Following a review of the concepts of castration and the primary scene in Freud's work, it is proposed to interpret the mytheme in question as a mythological manifestation of the primary scene, promoted to the status of gateway to the Oedipus complex and seen as the castration scene of the phallic mother. As the psychoanalytical reflection is developed, simultaneously the anthropological one is created. Freud's reflections on matriarchy are reviewed and the thesis is formulated that Sophocles' version of the Oedipus myth constitutes a precise manifestation of the patriarchal revolution, which put an end to a previous matriarchal regime in the Mediterranean world. LIFE sentences , *CAPITAL punishment , *PUNISHMENT - Abstract
This paper analyses the problematic relationship between death penalty and life imprisonment. The first part of the work examines the main steps that led to the replacement of capital punishment with life imprisonment. A topic that calls into question a comparative evaluation between the utilitarian conception of Cesare Beccaria and the thesis of Kant and Hegel in favor of capital punishment. From the basis of these assumptions, we proceeded to analyse the more recent institution of life imprisonment, by means of which the State takes the life of the condemned man, without taking it away from him physically, but socially. This paper analyzes the compensation system for pre-trial detention followed by acquittal or dismissal with prejudice after the jurisprudential change established in STC 85/2019, with special emphasis on the parameters that can be compensated via article 294 LOPJ. The main purpose is to determine, through the current judicial and administrative practice analysis, which are the main criteria and methods followed by the Courts in determining the compensation amount. Despite the high degree of discretion and subjectivity in which this research lies, it is intended to help determine the indemnity expectations an individual has after pretrial detention. SET-off & counterclaim , *JUSTICE administration , *COVID-19 pandemic - Abstract
The health emergency caused by COVID-19 has led to the legal «resurgence» of the clause rebus sic stantibus as a tool that makes it possible to modify contractual relationships and achieve a balance between the services rendered by the contracting parties, a balance which had come to a sudden end with the onset of the pandemic. The renewed operability of the rebus clause has a direct impact on the judicial system as it has resulted in a proliferation of lawsuits aiming to modify contracted legal obligations. The aim of the present paper is to respond to the practical questions raised in the daily life of our judicial bodies, which have to deal with claims from members of the general public or companies seeking, during an eviction trial, to reduce their economic burden or release them from it by applying the rebus clause. This can raise procedural questions that condition both the judicial response and the procedural processing, and which legal operators have to deal with on a daily basis. [ABSTRACT FROM AUTHOR]

The new 'Crea y Crece' Law explicitly recognizes European Long-Term Investment Funds (ELTIFs) as investment vehicles that can be set up, managed and marketed in Spain. This recognition is essentially a formal update of Spanish law, since this type of funds were already set up, managed and marketed in Spain. However, it comes at an important time for ELTIFs, given the imminent approval of a reform that will make its regulation more flexible and will promote this type of funds. This paper analyzes the current legal regime of ELTIFs, their future reform and the specific tax regime that exists for these funds in Bizkaia and Alava, in the absence of a special regime at national level. This paper presents the report resulting from the questionnaire launched by the “Grupo de Trabajo de Análisis y Prospectiva de las Bibliotecas en Andalucía” (Workgroup of Analysis and Prospective of the Libraries in Andalusia) of the AAB (Andalusian Librarians Association), in May and June 2021. It shows the situation of the Andalusian libraries during the lockdown and during the current world health alert situation caused by the COVID-19 pandemic. The data analyze the situation from the perspective of the transformation of the services and their innovation: changes in the opening times of libraries, new work modes, among others. The paper analyzes a representative sample of Andalusian libraries and documentation centers extracted from the regional administration official directories. The report ends with some conclusions and thoughts, which hopefully will help to understand and verify the new Andalusian library reality, with the aim that they are taken into account and that they help in the future to make decisions regarding the profession. This paper addresses, in an introduction and three correlated parts, the intertheoretical links between discourse ethics (Diskursethik) in its pragmatictranscendental version and Vicent Martínez Guzmán's philosophy of making peace. The first part highlights the influence of the German professor Karl-Otto Apel on the work of Martínez Guzmán and elucidates some issues that bear witness to it; the second part consists of a brief discussion about the transkantian relations that go from Apel to Martínez and vice versa, placing the issue of transcendental solipsism at the center; In a final part, the issue of intersubjectivity is addressed, as the necessary consequence of having subsumed the ethics of discourse in a philosophy of peace such as the one proposed by Martínez. At the end, some brief conclusions and a note are offered. [ABSTRACT FROM AUTHOR]

- Abstract
Introduction: The criteria for organ distribution in Colombia establish an initial local distribution, then regional and finally national. In December 2019, 2,822 people were on the kidney transplant waiting list in Colombia, assigned mostly to the Bogotá and IPS regions with the largest waiting lists. This high concentration of patients could be generating unwanted effects on the opportunity that patients have to receive a kidney transplant. Objectives: In this paper we seek to study, based on synthetic data generated with the information available from the INS, the probability of organ allocation, identifying the most informative variables and proposing a method to calculate the probability of allocation for a given patient on the waiting list of organs. Material and methods: The adjustment of a model based on decision trees is presented, which showed a high precision and allows the prediction of the probability of obtaining an organ. Results: Time, transplant IPS and blood group were identified as the most informative variables. Likewise, there are differences in the time it takes to obtain kidney transplants between regions and between transplanting IPS due to the effect of the size of their waiting list. Conclusions: The proposed method allows us to identify the importance of the variables that define obtaining an organ. Finally, for a given patient, it is possible to estimate the probability of being classified in one of the outcome categories. [ABSTRACT FROM AUTHOR]

PUBLIC libraries , *GOVERNMENT libraries , *LIBRARY science & society , *POLITICAL participation , *DISINFORMATION , *SOCIOECONOMIC factors - Abstract
The social and educational role of public libraries has been strengthened in the last years due to a series of economic, political, social and technological factors, which have entailed a crisis of values in society. However, this role is not new and, for a long time, public libraries all over the world have created programs and designed spaces and activities based on the social and educational needs of their community. The Network of Local Libraries of Salamanca has been a benchmark in this regard and, for more than thirty years, has had among its main aims to become a space for education, entertainment and citizen participation. This paper focuses on one of the key projects that the library has been developing for years: "Buscando aliados" ('Looking for allies'). Its main aim is to become a backbone for the community, thus strengthening its role within it and creating a solid foundation which allows it to resist both internal and external threats. It thus allows the community to survive in a world that is progressively more disinformed due to the abuse and excess of unverified information and the drifting direction of culture and socio-economy. This paper presents a model for the analysis of the digital challenge of university libraries. This model, which has in its core the generation of value for users, can be structured in five layers crosscut by digital transformation: the service model, the processes, the professionals and the applications, the contents and the buildings and infrastructure. The digitalization forces the alignment in the operation of every action area of libraries, which requires a constant effort in professional training and profile adaption. New opportunities emerge at the same time as new risks arise which need to be faced. [ABSTRACT FROM AUTHOR]
