This paper analyzes the compensation system for pre-trial detention followed by acquittal or dismissal with prejudice after the jurisprudential change established in STC 85/2019, with special emphasis on the parameters that can be compensated via article 294 LOPJ. The main purpose is to determine, through the current judicial and administrative practice analysis, which are the main criteria and methods followed by the Courts in determining the compensation amount. Despite the high degree of discretion and subjectivity in which this research lies, it is intended to help determine the indemnity expectations an individual has after pretrial detention.
