The aim of this paper is to study the res judicata effect of sentences handed down against legal persons on subsequent criminal proceedings against members of the organisation. Despite the legislator's preference for the joint prosecution of natural and legal persons, it is possible that the natural persons whose criminal actions determine the liability of the entities may be identified after the proceedings against them.
