WITNESSETH, THAT: WHEREAS, construction ofthe Brandon Road, Will County, Illinois Project for ecosystem restoration to control aquatic nuisance species (hereinafter the ''Project", as defined in Article I.A. of this Agreement) was authorized by Section 40 l (5) of the Water Resources Development Act (WRDA) of 2020; WHEREAS, the Government shall carry out construction and operation, maintenance, repair, rehabilitation, and replacement (OMRR&R) of the Project in accordance with the cost­sharing requirements specified in Section 3061 of WRDA 2007, as amended by Section 1142 of WRDA 2018, except that any OMRR&R related to the flushing lock shall be carried out by the Government at full Federal expense, and Section 402(a)(l) of WRDA 2020, as amended by Section 8337 of WRDA 2022; WHEREAS, the Non-Federal Sponsors have waived reimbursement for the value of real property interests, placement area improvements, and relocations that exceeds 10 percent of construction costs; WHEREAS, as of the effective date of this Agreement, the total amount of Federal funds allocated to date for the Federal share of construction costs includes $225,838,000 as provided in Division J, Title Ill, of the Bipartisan Infrastructure Law, Public Law I 17-58, $47,880,500 in the Fiscal Year 2023 regular

2024 Edition  ALONG THE RIVER 1 RIVER1Mississippi River Project’s Guide to Recreation 2024 Edition ALONGRiver US Army Corps of Engineers Rock Island District WELCOME W elcome to the 2024 edition of Along the River! This annual publication helps keep our visitors up to date on recreational and educational opportunities in the Rock Island District’s Mississippi River Project. The 2024 recreation season started with major flooding that affected opening of many of our recreation areas and delayed opening and the start of some of our planned infrastructure projects. Despite this temporary setback, there were many upgrades that were completed. The construction of the new Thomson Ranger Station within Thomson Causeway was finished and rangers have fully moved in now. Water utility work is done and now a hydrant can be found at all campsites within Thomson Causeway’s Hickory Point, Potters North and Potters South loops. A new playground was installed at Fisherman’s Corner North Recreation Area this past year. Across the river from there a new picnic shelter near the boardwalk at Lock and Dam 14/Smith’s Island Day Use Area was completed and is already being used. New electrical services and pedestals upgrades at Shady Creek was one of the big projects that needed to be pushed back this past year due to flooding. Work picked back up in the fall and all electrical upgrades will be ready for campers by opening day in 2024. Similar electrical upgrades are planned at all class A parks over the next several years. Over the course of 2024 many changes will occur throughout our recreation areas. These changes include a new shower/restroom facility at Blanding Landing, concrete sites and new electrical pedestals at the Thomson Causeway River Birch loop, concrete living pads and new electrical pedestals at Grant River, and the Rock Island Arsenal gate leading to the Mississippi River Visitor center will be relocated to allow access to all members of the public without entering the ar

CEMVR-EO December 27, 2023 MEMORANDUM OF RECORD SUBJECT: Establishment of Section 408 Categorical Permissions for the U.S. Army Corps of Engineers, Rock Island District When the Rock Island District (District) receives a request to alter an USACE project, the District implements a process outlined in the 2018 Engineer Circular (EC) 1165-2­220, Policy and Procedural Guidance for Processing Requests to Alter US Army Corps of Engineers Civil Works Projects Pursuant to 33 USC 408. These requests vary in complexity, scope, impacts to the USACE project, and environmental impacts. To expedite the review and approval process, EC 1165-2-220 states that USACE Districts can develop streamlined categorial permissions for modification requests that are alike in nature and impacts. Additionally, EC 1165-2-220 encourages USACE districts to develop new programmatic National Environmental Policy Act (NEPA) documents to provide a way to efficiently review for or ensure environmental compliance for categories of activities that have similar and minor environmental effects. In order to address the potential environmental effects of future proposed requests, as required under NEPA, as amended [42 United states Code (U.S.C.) 4321 et seq.], the Rock Island District prepared a Programmatic Environmental Assessment (PEA) in 2018. The PEA considers a suite of reasonably foreseeable categorical permissions that fall within the Rock Island District’s Civil Works boundaries. The District reviewed the 2018 PEA and the seven Categorical Permissions (CPs) in 2023 for environmental compliance updates and/or changes to the CPs as required in EC1165-2-220. The District determined the PEA’s Finding of No Significant Impact remains in environmental compliance. A minor modification to CP 5 (Section 1. D) did not warrant a new environmental assessment. This will move high velocity flows away from the bank, promote sediment deposition between weirs and adjacent to the longitudinal peaked stone toe protection, and promote natural revegetation in the areas of sediment deposition. The purpose of this project is to minimize future erosional damage, prevent the loss of land or land uses adjacent to the West Nishnabotna River due to anticipated future high water events, and minimize fine sediments that are currently being washed downstream of the project area. Wetland impacts are not anticipated. 4. Avoidance and Minimization: The applicant's original project plans minimize impacts to Waters of the United States by applying riprap only on the eastern shore and not both shorelines of the Nishnabotna River within the project area. The only avoidance measures considered by the applicant are "No Action" and "Proceed as originally planned." The proposed project includes an encased pipe crossing under Highway I 00, two open cut excavations of Indian Creek (using causeway construction methods), bedrock excavation, sewer and manhole installation, abandonment of an existing 36 inch and 42 foot sanitary sewer, stream bank stabilization, seeding and tree planting. A total of 2.42 acres of forested wetland and 2.5 acres of emergent wetland will be permanently impacted as a result of this project. The purpose of this project is to increase the capacity of the sanitary sewer system to better meet the needs of the population for the City of Marion, Hiawatha, Robins, and Cedar Rapids, Iowa. b. Avoidance and Minimization: Alternate alignment options for replacement of the sewer increase impacts to the wetlands and flood plains. The "No Action" approach includes boring and other methods that don't require a Department of the Army Section 404 permit. These methods have not been adequately analyzed yet but will be prior to permit issuance.

Project Description and Purpose: The applicant proposes to install 2,043 feet of bank stabilization on the shoreline of Catfish Creek. NRCS practice code 580 will be utilized in design, construction, and installation of riprap. Streambanks will be shaped to 2: 1 slope or flatter. A second practice known as Longitudinal Peaked Stone Toe will be implemented along a stretch of 748 feet within the project area of 2,043 feet. After construction is complete, the bank and disturbed areas will be seeded and mulched. The purpose of this project is to minimize future erosional damage and prevent the loss of land or land uses adjacent to Whitewater Creek due to anticipated future high water events. Wetland impacts are not anticipated. Stream mitigation will not be required due to the nature of the project. 4. Avoidance and Minimization: The only avoidance measures considered by the applicant are "No Action" and "Proceed as originally planned". The applicant's project description and purpose is meant to reduce erosion and if allowed to proceed as planned should decrease sediment deposits while simultaneously increasing water quality of Catfish Creek. The Applicant's project plans also minimize impacts to Waters of the United States by applying riprap and longitudinal peak stone to strategic locations within the creek and not the entire length

The project includes the mechanical maintenance dredging ofaccumulated sediment on the river side of the jetty at the City of Fo1t Madison Marina, and jetty extension. b. The purpose of the project is to restore the marina jetty to its previous condition and reduce future siltation. This project is needed to keep the marina in useable condition and to minimize ongoing maintenance costs by reducing future siltation. Dredging operations shall span approximately 95 linear feet beginning at the entrance to the marina and proceeding no1th up to the end ofthe marina jetty on the river side. Dredging operations will remove silt to a depth oftwo to three feet below normal pool level. Approximately 630 cubic yards ofsediment shall be removed from the river side. Spoil material will be transpo1ted off-site to the closed City ofFort Madison landfill.
