Beginning in the early 1930s, US citizens made a concerted effort to ban lawsuits for breach of promise, seduction, criminal conversation, and alienation of affection. This article analyzes 1930s media representations to show how the movement against heart balm grew from "tort tales" about allegedly outrageous lawsuits. Heart balm narratives drew from stylized representations of "gold diggers" found in popular culture, and they reflected divisions around gender and social class exacerbated by the Great Depression. This paper examines the relationship between law, medical knowledge and romantic suffering in early twentieth-century Australia. Drawing upon a sample of breach of promise of marriage actions from 1824 to 1930, it argues that where the plaintiff’s pain was largely presumed in the nineteenth century, by the twentieth century mastering the language and performance of anguish became crucial to legal success. The less that women suffered socially from romantic disappointment, the more they sought to prove it in court. Women dressed the lesions of their hearts in the disinterested language of medicine and borrowed psychological categories of trauma from victims of war and railway injuries. Heartbreak was thus legitimized as a species of pain by a convergence of law, medicine and women’s audacity to take their feelings seriously. The court’s response to these new bodily articulations of suffering provides a counter-history to the usual tale of law’s preference for the tangible over the intangible. Somatic injury was relegated to special damages, determined by the evidence of doctors and with less lucrative compensation, while emotional injury occupied the dominant, more profitable category of general damages. Moral panics and sexual scandals have long been recognised as key discursive sites in the shaping of modern Britain. This article contributes to that debate with an exploration of how the late eighteenth- and early nineteenth-century press shaped an emotional public opinion through the reporting of breach of promise and seduction suits. It argues that the press directed men into roles as defenders of the nation through their protection of female virtue, using emotion to invest the British public in nation-building. This article discusses the moral objection to the efficient breach theory, specifically the objection that it is not based upon a moral obligation to perform a contract. The efficient breach theory endorses the immoral behaviour of breaching a promise whenever the consequences of breach are considered to be superior (in the sense that they are more efficient or better) to those of performance. It considers that contracts (namely, those promises in which legal rules and institutions are involved) are simply vehicles for achieving economic efficiency. The efficient breach theory has been challenged by a number of critics. It is the idea underlying promissory obligations that a promise excludes or ignores the ordinary grounds - for example, utilitarian grounds - that a promisor may bear in mind and consider in the course of making the decision about whether they should perform the promise. This characteristic of promises can be explained by saying that a promise creates an exclusionary reason for action. This article also addresses two crucial questions. First, why do promises create exclusionary reasons for action in the first place? Without answering this question, it would be difficult to argue that promises should be understood differently from the way the efficient breach theory understands them. Second, how do we decide when breaching a promise is or is not immoral? This question is significant because without such knowledge, it would be difficult to argue that the efficient breach theory endorses the immoral behaviour of promise-breaking once a better opportunity presents itself. The study objective was to determine if Emergency Department (ED) patients experience breaches of privacy and confidentiality during their ED stay and to determine if the type of room in which the patient is placed affects privacy. We surveyed a convenience sample of ED patients at the conclusion of their ED stay regarding their privacy and confidentiality. Overall, 36% of patients overheard conversations with similar frequencies in walled and curtained rooms. The location of conversations overheard varied depending on the type of patient room, as curtained rooms allowed conversations from adjacent rooms to be overheard and walled rooms allowed more conversations from the hallway or nursing station to be overheard. Patients felt more comfortable giving their history and having physical examinations performed in walled vs. curtained rooms. Inappropriate or unprofessional comments by staff were heard by 1.6% of patients. Health care providers in the ED need to be aware of breaches in confidentiality and privacy, as our patients deserve respect of their privacy and confidentiality during their ED visit.
