The article presents comments on the emergency-powers of U.S. President George W. Bush. An eavesdropping program of the president illustrates the principle of such powers. Following the September 11, 2001 terrorist attacks, the Foreign Intelligence Surveillance Act was outdated by new communications technologies and by the enhanced terrorist threat. Legislative powers and the power to initiate wars were assigned to the Congress by the Constitution.
