In September 2021, Immigration New Zealand (INZ) announced the offer of a one-off residence visa category – the 2021 Resident Visa, to over 165,000 temporary migrant workers and their family members living in the country. The offer was a response to the backlog and growing numbers of applications that INZ was unable to attend to largely because of the lockdown during the COVID-19 pandemic. Drawing on relevant statistical data, news media reports and available academic publications, this research note examines how New Zealand's sanitization policies during the pandemic affected the lives of temporary migrant workers who hold various work visas. This article addresses a gap in the scholarly literature on the legal regulation of temporary labour migration by tracing the legislative history and regulation of work visas for short stay specialists and occupational trainees. By reason of their acute temporariness, both short stay workers and occupational trainees could be regarded as having a migration status that makes them vulnerable in their work relations. In addition, this vulnerability means they may accept terms and conditions that undercut domestic labour standards. Although the detailed legislative tracing of both visas reveals various attempts to re-regulate both visas in favour of greater scrutiny of employer requests for overseas labour, tightening access requirements and increasing enforcement and monitoring capacity, these have been largely incapable of preventing instances of egregious exploitation. These case studies on two little-known visas mirror the growing concerns around the integrity of Australia's temporary labour migration program more generally and point to the myriad tensions, challenges and complexities inherent in the regulation of temporary labour migration programs around the globe. On 2 May 2016, Robert Penner, Canadian national residing in Nepal with a working visa, was arrested and then deported to Canada and his visa being cancelled. Based upon an analysis of the documentation related to his arrest and expulsion, this article analyses the articulation of different operations of control. A chain of public interventions and governmental actions makes the substance of the management of digital expression in Nepal and this has to be analysed with tools from media studies and science and technology studies. We present different operative regimes: Twitter accounts and discussions, police action and arrests, and court petitions. We analyse how operational levels are connected and how their interconnections lead to the criminalisation of one individual, most notably through the reformulations of the accusations by different groups of people via different devices. This in turn shows how specific technical interventions determine the control of the public space. These analyses then add to the debate upon the 'digital public sphere' by offering a critique of its spatial metaphor from a view focused on its performative stakes—public spaces not as sites of discussion, but as theatres of operations. Modern U.S. employment practices necessitate reform of the H-1B sponsorship program. Reducing the number of H-1B visas available to U.S. employers could have a devastating impact on the economy and higher education. Proper expansion of the program would create additional jobs for U.S. citizens, while allowing employers to hire the most qualified candidates, regardless of their national origin. Legitimate interests surrounding national security and domestic economic growth and stability can successfully coincide with program expansion. This Note first reviews the development of the H-1B sponsorship program, its relation to other work visas, and its foundations in immigration law. It next analyzes the Trump administration's proposed changes to the H-1B sponsorship program and relevant legal concerns pertaining to the increased wage requirements and labor market tests for H-1B sponsorship, and the impact this has on U.S. companies. Finally, this Note recommends a practical approach to foreign sponsorship that protects the interests of U.S. citizens, while meeting the growing demand for cross-border work. [ABSTRACT FROM AUTHOR]

Abstract: Whilst scholarly research has highlighted the role of the state in facilitating labour migration, little academic work exists on how skilled and highly skilled migrants actively negotiate changes to immigration policy. Since 2008, UK labour immigration policy has undergone significant reform, including: the introduction of a Points Based System (PBS); the imposition of an annual limit on entry of selected skilled migrants; and the direct linkage of highly skilled visas to offers of employment. Consequently, further investigation is required into how highly skilled individuals negotiate immigration policy and work around the practical challenges they may face in everyday life. This paper seeks to address this gap in knowledge by presenting a qualitative case study investigating the experiences and opinions of students and staff from outside the European Economic Area (EEA), based at universities in London and the Midlands. By focusing on Higher Education (HE), we draw attention to the inter-relationships between highly skilled academic mobility, globalisation and labour immigration policy, highlighting the juxtaposition between perceived ease of movement and the restrictions imposed by border and immigration controls, on this group of individuals. The article discusses the American H-2A visa program and a reported need for systemic changes to the legal protections afforded to marginalized workers in the U.S. as of March 2012. The legal aid provided by the Migrant Farm Worker Division of Colorado Legal Services program is addressed in relation to foreign sheepherders working in the U.S. The U.S. Department of Labor's regulatory scheme for H-2A workers is examined, along with the legal representation of sheepherders.

• Employers do not necessarily devalue the foreign educational credentials of high-skilled immigrants, as previously thought. • Wage offers are positively associated with foreign credentials from more prestigious universities. • Wage offers are negatively associated with foreign credentials from more culturally distant countries. • Employers may interpret educational prestige as a signal of an immigrant's individual ability. • Employers may interpret cultural distance of the place of education as a signal that an immigrant lacks relevant cultural competence. We examine the reasons behind a wage penalty that is applied to foreign-educated immigrants—a phenomenon identified across countries and levels of educational attainment. The lower wages employers offer to high-skilled immigrants are usually attributed to the foreignness of their educational credentials. We argue instead that their disadvantaged economic outcomes are related to the educational prestige of their universities and the cultural distance of their places of education. Employers may interpret signals of ability from the educational prestige associated with credentials and may view immigrants as lacking relevant cultural competence if they perceive the place of education as culturally distant. Using data from the U.S. H-1B visa program, we show that employers do not discount wage offers to immigrants with foreign degrees per se. Instead, we find that they offer lower wages to immigrants with educational credentials from less prestigious universities and more culturally distant places of education. [ABSTRACT FROM AUTHOR]
