The legal regulation of the liability of civil servants for damage caused by them to the civil service contained in Act No. 234/2014 Sb., on the Civil Service, as amended, directly refers to Act No. 262/2006 Sb., the Labour Code, as amended. However, there has been a disagreement among the professional community as to the extent to which certain legislation should be applied. 4. Dispoziční pravomoc zaměstnavatele
- Abstract
Diplomová práce se zabývá dispoziční pravomocí zaměstnavatele jakožto základním projevem organizační funkce pracovního práva. Práce se zabývá vnitřními předpisy a dalšími pokyny u předchozího zaměstnavatele autora. Součástí práce je komparace právní úpravy dispoziční pravomoci zaměstnavatele v České republice s právní úpravou ve Spolkové republice Německo. Dále jsou v souvislosti s pracovním poměrem uvedeny vybrané aspekty pandemie Covid-19 v souvislosti s dispoziční pravomocí., The diploma thesis deals with the organization power of the employer as a basic manifestation of the organizational function of labor law. The thesis also focus on internal regulations and other instructions of the author's former employer. Part of the work is a comparison of the legislation on the disposition powers of the employer in the Czech Republic with the legislation in the Federal Republic of Germany. Dne 2. 1. 2020 předložila Vláda ČR Poslanecké sněmovně návrh zákona, kterým se mění zákoník práce. Návrh zákona byl rozeslán poslancům jako tisk 689/0 dne 2. 1. 2020.2 Navrhovaná změna zákoníku práce byla sestavena Ministerstvem práce a sociálních věcí ČR, kromě ostatních cílů i s cílem dosáhnout souladu národní právní úpravy s předpisy a judikaturou EU. Výslovně má navrhovaná změna zákoníku práce nově upravit podmínky pro převod činnosti zaměstnavatele a dále zpřesnit podmínky pro dání výpovědi zaměstnancem podle § 51a zákoníku práce při přechodu práv a povinností z pracovněprávních vztahů. Právě v otázce podmínek pro převod činnosti zaměstnavatele byla stávající právní úprava opakovaně kritizována, a to z důvodu nedostatečného využití unijní legislativy pro národní právní úpravu přechodu práv a povinností z pracovněprávních vztahů. On 2 January 2020, the Government of the Czech Republic submitted a bill to the Chamber of Deputies amending the Labor Code. The bill was sent to deputies as press 689/0 on 2 January 2020. The proposed amendment to the Labor Code was compiled by the Ministry of Labor and Social Aff airs of the Czech Republic, among other objectives, with the aim of achieving compliance with national legislation with EU regulations and case law. The proposed amendment to the Labor Code should explicitly regulate the conditions for the transfer of the employer's activities, and further specify the conditions for giving notice by an employee pursuant to Section 51a of the Labor Code when transferring rights and obligations from employment relationships. It is precisely in the issue of conditions for the transfer of the employer's activities that the current legal regulation has been repeatedly criticized due to insuffi cient use of EU legislation for the national legal regulation of the transfer of rights and obligations from labor relations.

Work From Home Abstract The thesis deals with the current institute of labor law, which is working from home. The aim of this thesis is to explain the basic concepts, to summarize the past and current legislation, to analyze the main shortcomings of the current legislation and problematic points of homeworking, and to propose further direction of the legislation through de lege ferenda considerations. In particular, the main idea of the thesis is to present considerations to remedy the deficiencies of the current legislation. The overall structure of this thesis is composed of four parts. The first section discusses basic concepts such as working from home, working away from the employer's workplace, home office, homeworking and teleworking. Furthermore, this section is focused on the development of the legal regulation of homeworking, not only in the Labor Code, and the international and EU context. The second part examines the current legal regulation of working from home, more precisely working away from the employer's workplace, i.e. the provisions of Section 317 of the Labor Code. The author in his article deals with the current proposal the Labour Code amendment by the Ministry of Labour and Social Affairs and comes to the conclusion that the proposed amendments change strengthening the protection of workers, but does not contribute to deepening the flexibility of industrial relations. The author expresses the view that the amendments to the Labour Code should be very exceptional and should be preceded by careful analysis. Termination of the employment relationship by the employer Abstract The dissertation focuses on termination of employment relationship under Act No. 262/2006 Coll., Labour Code of the Czech Republic, namely termination by the employer. It therefore focuses on the notice of termination of the employment relationship, the immediate termination of the employment relationship, the cancellation of employment relationship during the probationary period and the closely related issue of invalidity of the above legal acts. The dissertation is divided into a general part and a special part. The general part (1-3) first gives an overview of the basic features of the applicable legislation on termination of employment relationship by the employer and considers its function (purpose), then offers a brief insight into the legislation regarding termination of the employment relationship by the employer in the Republic of Austria, the Federal Republic of Germany and the Slovak Republic and finally briefly summarizes the starting points of alternative approaches to termination of the employment relationship. 10. Okamžité zrušení pracovního poměru zákonným zástupcem nezletilého zaměstnance

Článek se zabývá aktuální problematikou možnosti okamžitého zrušení pracovního poměru zákonným zástupcem nezletilého zaměstnance. Od roku 2014 může být pracovní poměr nezletilého zaměstnance (mladšího 16 let) okamžitě zrušen na základě rozhodnutí jeho zákonného zástupce (zpravidla rodiče); podle zákoníku práce je přitom nezbytný souhlas soudu. Hlavním cílem článku je analyzovat základní potíže nové právní úpravy ve svou hlavních aspektech: hmotněprávním a procesněprávním. Analýza problému je založena na právní exegezi současné právní úpravy účinné od 1. 1. 2014 ve všech relevantních předpisech: občanském zákoníku, zákoníku práce, občanském soudním řádu a zákonu o zvláštních řízeních soudních. V článku jsou zmíněny také souvislosti se zásadou smluvní volnosti., The paper deals with the actual issue of the possibility of the immediate termination of employment by the legal representative of the minor employee. Since 2014, The employment of minor employee (who is younger than 16) can be immediately terminated by the decision of his legal representative (typically parent). Consent of the court is necessary to this termination according to Labour Code. The main aim of this paper is to analyse the main struggles of the new legal regulation from two main aspects: material law aspect and process law aspect. The main problems are found, described and criticized in the article. The analysis of the issue is based on the legal exegesis of the current legal rules active since 1st January 2014 in all related laws – Civil Code, Labour Code, Civil Procedure Code and Act on Special Procedures. Consequences of the principles of the autonomy of will are also mentioned in the article.

Fixed-term employment Abstract The topic of this master thesis is, as its name indicates, legislation of fixed-term employment in the Czech Labour Code. This thesis further develops and in some parts modifies my student work named "Reflection on fixed-term employment not only in perspective of conflict of opinions between the Constitutional Court and the Supreme Court". This topic became relevant again with the ongoing judicial dispute between the Constitutional Court and the Supreme Court, as neither of the courts decided to withdraw of its way of interpretation of section 39 subsection 5 of the Czech Labour Code. The aim of this thesis is to briefly introduce the current legislation and its historical sources, analyse it critically and propose a regulation de lege ferenda. The thesis is divided into five chapters, while subchapters 2., 3. and 4. are further divided into thematically different subchapters. 1 Abstract This diploma thesis deals with the issue of a status of professional athlete from a perspective of Labour law. The main goal of this thesis is try to find an answer to a question whether the activity of professional team sports athlete should be considered as dependent work of an employee. The first part is theoretical and focuses mainly on definitions of sport, sports law, sport legislation and professional athlete. The second part deals with the current position of professional athletes in our legal system. In practice, professional athletes can act as self- employed, as employees or as professional soldiers. At the same time, the author tried to outline the advantages and disadvantages of these individual statutes. The main of part of the thesis is dedicated on the definition of dependent work in terms of the Labour Code and the questions of basic institutes of labour law, which are essential for proper comparing with the status of a professional athletes. The theme of this thesis is the issue of the termination of the employment relationship in the legal regulation of the Czech Republic. Within the issue of the termination of the employment relationship, there is a principle of the protection of employees as weaker parties to the employment contract clearly manifested. THE SHARING ECONOMY AND DIGITALIZATION: CHALLENGE FOR COMPLEX MODIFICATION OF LABOR LAW? ABSTRACT This diploma thesis discusses the phenomenon of last decade called sharing economy, which has many different forms and names. In its purest meaning, the sharing economy concerns behavior of economically active entities that, in order to reduce their own costs or to use their spare capacity, share free resources. As the best examples of sharing economy, we can name capital platform Airbnb, where people share their unused immovable in order to generate profit or work platform BlaBlaCar trough which people reduce their car costs while travelling one-off long-distance trips. However, as mentioned above, sharing economy has many different forms. One of them, which cannot be recognized as its pure form, is provided by Uber. Uber, as well as BlaBlaCar, created mobile platform trough which providers of transport services can get in touch with users of these services. Despite this similarity, there are several significant differences from which one can conclude that Uber is not a classic provider of information technology services, such as BlaBlaCar. Předkládaný článek se zabývá obecnými východisky ochrany soukromí zaměstnance a relevantní úpravou obsaženou zejména v § 316 zákoníku práce. Pozornost je věnována třem konkrétním oblastem, a to monitorování zaměstnanců prostřednictvím kamerových systémů, monitorování elektronické pošty a telefonních hovorů. The Labour Code is also focused on employee privacy protection in the labour-law relationships. The submitted paper deals with the general basis of employee privacy protection and the relevant legal regulation contained in sec. 316 of the Labour Code. Working hours, its lenght and distribution, with the focus on part-time Abstract The thesis deals with the issue of working hours and its distribution with a special focus on part-time. The thesis also introduces the legislation of part-time in the foreign law system, particularly in the Netherlands. The aim of this thesis is to analyze the current legal regulation of working hours, its length and distribution, focusing on part-time. The thesis is divided into six chapters, which represent labor law in the system of law, historical development of working hours, sources of labor law, legal regulation of working hours and rest periods and distribution of working hours. The fifth chapter deals with labor law institutes in which part-time deviate from the set weekly working hours. Firstly, the work briefly describes the historical development of labour law and defines basic concepts of labour law, its functions and legal sources. Secondly, the work has focused on definition of employment relation with emphasis on individual labour relations and legal entities. In her PhD thesis, the author deals with the legal regulation of transfer of undertaking (and the passage of the employees' rights and obligations it involves) and the frequent collective redundancy related to such transfers. Both sets of provisions dealing with these topics are embodied in the Czech Labour Code and are harmonised with the EU directives pertaining to these fields, specifically Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses (originally, Council Directive 77/187/EEC of 14 February 1977 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of businesses) and Council Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies. The second part of the diploma thesis is based on the survey published through questionnaire. The thesis deals with the topic of employee benefits in the Czech Republic. At first, the thesis sets employee benefits to specific area of the company, which is an in-house social policy of the company. Following part deals with the legislative framework, which regulates the providing of these benefits in 2015. The thesis includes a chapter describing the employee benefits, their structure and their various distribution systems. Analysis of the trends in the provision of employee benefits creates another part of the thesis. Three types of employee benefits are analyzed in detail: meal allowances, educational allowances and contributions to employees' pension savings. The objective of this thesis is to examine the impact of the latest amendment of the Labour Code of the Slovak Republic (effective 1st January, 2013) on labour cost, employer obligations and compensations and responsibilities of the employees covered under an agreement on work performed outside the employment, in comparison to previous version of the Labour Code. The theoretical part of my thesis covers the basic terminology and legal standards related to the employment, description of the main changes implemented by the amendment of the Labour Code and related enactments. The practical part of this thesis covers actual examples of how the Labour Code amendment affected recording in accounting. It also describes the amendment impact on actual enterprise, with possible suggestions on how to cover the need for temporary employment.

Czech Law concerning work safety in high school laboratory in the Czech Republic is constantly changing, while these changes in the law might go unnoticed by high school teachers. These teachers are often not informed which law is currently in effect and if it has any impact on their teaching in chemical laboratories. Therefore, this work presents compiled laws that influence teaching in chemical laboratories, translates their meaning into comprehensible sentences and then puts them together to a summary of these laws. To keep this information up to date, a basic web design is included in this work that will be put on web www.studiumchemie.cz, where it will be actualized by author of this thesis. On this web high school teachers will have the opportunity to easily access both original formulations and translated meaning of the law. Processed thesis deals with termination of employment. The thesis deals with various forms of termination of employment according to the then applicable legislation throughout history, IE before the creation of the first legal regulation of Labour Law, which was Act No. 65/1965 Coll., The Labour Code (chapter 3), pursuant to Act No. 262/2006 Coll., the Labour Code, which replaced the above act (Chapter 4). Attention is given to the amendment of the Labour Code effective from January 1, 2012 which relates to arranging of a probationary period, termination of employment during the probationary period, the exceptions to the prohibition of dismissal lengthening of the period of moderation of the court; sets a new reason for dismissal in § 52. h) of the Labour Code (Chapter 5). This thesis also deals with the issue of termination of employment in EU countries (Finland, Belgium, Austria), namely agreement on termination of employment, dismissal and termination of employment during the probationary period (Chapter 6). The topic of contract of employment is still contemporary issue of czech labour law. Nowadays contract of employment is under the influence of a technical and societal progress which demands frequent and important legal changes. There is also the substantial influence of contemporary European tendency to make labour law more flexible with maintaining the high level of social security standards of employees. This tendency is widely known as "flexicurity". The thesis is divided into three chapters. The chapter deals with common principles of labour law which are crucially important for understanding the issue of contract of employment. For this reason, the charter contains explaining the term "labour law" and its object, principals of labour law, the relations between the Labour Code and Civil Code, the defining the term of dependent work. This term is strongly connected with the issue of disimulation of legal act.
