2. Federalism and Settler Imperialism: Racial Regimes, Whiteness, and Conquest in Canadian Constitutionalism.

In political science, federalism is often treated as an "antithesis" to empire. While Canadian Politics has recently become more attentive to the importance of ongoing settler colonialism as conditioning Canadian political life writ large, this has yet to induce a paradigm shift in understanding how the institutional logics of the state were established by, and in order to advance, colonial and imperial ends. This article contributes to this broader understanding by exploring how, in Canada, the federal arrangement congeals a constitutionalized whiteness that facilitates both the internal coherence of a settler class and its subsequent continental expansion. Attentive to the importance of this constitutional development within a world-spanning imperial context, this article also suggests that the simultaneous innovation of Dominion status contoured the early twentieth-century's global colour line, as self-determination was increasingly devolved to other white settler polities. The contradictory realities of these processes are also noted. Résumé: En science politique, le fédéralisme est souvent traité comme une « antithèse » de l'empire. Bien que la politique canadienne ait récemment acquis une conscience plus aiguë quant au rôle continu du colonialisme de peuplement dans le conditionnement la vie politique, cela n'a pas encore mené à un changement de paradigme dans la compréhension de la façon dont les logiques institutionnelles de l'État ont été établies pour faire progresser les objectifs coloniaux et impériaux. Cet article contribue à cette compréhension plus large en explorant comment, au Canada, l'arrangement fédéral consolide une blanchité constitutionnalisée qui facilite à la fois la cohérence interne d'une classe de colons et son expansion continentale subséquente. This article aims to explain the journey of a relevant actor on the political right in the postrevolutionary context of 1974: the Portuguese Federalist Movement-Party of Progress. For this purpose, the party's official weekly newspaper, Tribuna Popular, is taken as a reference, as well as testimonies from former leaders and founders, with other periodical sources of the time and various printed sources as counterparts. The MFP-PP is analyzed by jointly relating the historical-political era with the vicissitudes of the movement, with a particular focus on its relationship with the institutions of revolutionary power, its relationship with other political parties, as well as the structuring of the MFP-PP. In this way, the article is based between the moments following the coup d'état of April 25, 1974 and the political-military movements of September 28, 1974 linked to the intention of the "silent majority", to which a detailed analysis is provided, regarding the involvement of the MFP-PP, due to its inextricable connection with the dismantling of the party. 5. Canada and Comparative Territorial Politics.

This presidential address on Canada and the study of territorial politics makes four main arguments. The first is that territory is a central component of politics, especially of Canadian politics, and that it should remain a focal point of specialists of Canadian and comparative politics. The second is that territory matters in contemporary politics because it serves as grounding for political communities, their claims, and their politics. The third is that not "identifying" parts of Canadian politics as "territorial politics" risks overlooking the importance of territory in the theorizing of federalism, nationalism and regionalism. Premier of Alberta Danielle Smith's comments comparing the Alberta Sovereignty within a United Canada Act to the Indian Act have sparked widespread outrage and condemnation. Premier Smith would later clarify that these remarks were intended to demonstrate that Alberta and First Nations have a "common problem" with Ottawa. In this brief article, we argue that these comments, as well as the act itself, can be analyzed using Jerald Sabin's contested colonialism framework. This research aims to find out the extent of the sovereignty possessed by the countries and regions formed by the Netherlands around 1947-1948, by taking the example of the Pasundan State and the Special Region of West Kalimantan (DIKB). The results of the study is 1) The Pasundan State was founded by Kertalegawa on May 4, 1947, with the support of van Mook. Kertalegawa's efforts ran aground because of the lack of support from Sundanese leaders. The Dutch again tried to establish Pasundan after West Java has controlled thanks to the Renville Agreement. This effort was successful on February 26, 1948, with the Mayor, namely R.A.A Wiranatakusumah, and Prime Minister Adil Puradiredja. The two figures were actually pro-republican, elected based on a session of the Pasundan State Parliament. 2) DIKB was formed on May 12, 1947, which was attended by van Mook, chaired by Sultan Hamid II with the assistance of five members of the Daily Governing Body and a Secretary who was held by Dutch officials. Meanwhile, the West Kalimantan Council (DKB) as parliament is also chaired by Dutch officials. The DKB consists of 40 representatives of ethnic/customary figures and self-government leaders such as the Sultan and Panembahan. 3) The State of Pasundan and DIKB are constituents of the Provisional Federal Government of the Netherlands by adopting a federal system. There was a dualism of government in which the Dutch kept their officials and employees. The State and Regions do not have authority and independence in making policies because they are not implemented 100 percent by the Indonesian people. Penelitian ini untuk mengetahui sejauh mana kedaulatan yang dimiliki oleh negara-negara dan daerah bentukan Belanda sekitar tahun 1947-1948, dengan mengambil contoh pada Negara Pasundan dan Daerah Istimewa Kalimantan Barat (DIKB). Penelitian menggunakan metode sejarah melalui tahapan seperti heuristik, verifikasi, interpretasi, dan historiografi. Berdasarkan hasil telaah didapatkan hasil penelitian sebagai berikut. 1)Negara Pasundan didirikan oleh Kertalegawa pada 4 Mei 1947 yang didukung oleh van Mook. Usaha Kertalegawa kandas karena kurangnya dukungan dari tokoh Sunda. Belanda kembali mencoba mendirikan Pasundan setelah Jawa Barat dikuasai berkat Perjanjian Renville. Usaha ini berhasil pada 26 Februari 1948 dengan Wali Negaranya yakni R.A.A Wiranatakusumah, dan Perdana Menteri Adil Puradiredja. Kedua tokoh sebenarnya pro-republik, terpilih berdasarkan sidang Parlemen Negara Pasundan. 2)DIKB dibentuk pada 12 Mei 1947 yang dihadiri oleh van Mook, diketuai oleh Sultan Hamid II dengan dibantu oleh lima orang anggota Badan Pemerintahan Harian dan seorang Sekretaris yang dipegang oleh pejabat Belanda. Sedangkan Dewan Kalimantan Barat (DKB) sebagai parlemen juga diketuai oleh pejabat Belanda. DKB beranggotakan 40 perwakilan tokoh-tokoh etnis/adat dan pemimpin swapraja seperti Sultan dan Panembahan. 3)Negara Pasundan dan DIKB adalah konstituen dari Pemerintahan Federal Sementara Belanda dengan mengadopsi sistem federal. Terjadi dualisme pemerintahan dimana Belanda tetap mempertahankan para pejabat dan pegawainya. Negara dan Daerah tidak memiliki kewibawaan dan kemerdekaan dalam membuat kebijakan karena tidak dijalankan 100 persen oleh masyarakat Indonesia.

In this article, I present the potential of using a radical feminist approach to empowerment as an analytical framework in federal studies. To do so, I develop an analytical framework that is part of the fourth wave of gender and federalism studies that focuses on the interactions between embedded oppressions and federal arrangements (institutions, practices, discourses). I study the empowerment processes of farmers who protested against the implementation of new agricultural laws in India in late 2020. Through this case, I first illustrate how federalism contributes to the fragmentation of marginalized groups, while raising the need to build federal arrangements from local realities, ecosystems and environments. I then show how a radical feminist conception of empowerment can change analytical perspectives in federal studies and make visible structures that perpetuate interlocking oppressions within a federation. Antifascite, critique littéraire et auteur du roman à succès Rubè (1921), Giuseppe Antonio Borgese émigre aux États-Unis en 1931. Là, peu à peu ses intérêts culturels changent. Après avoir milité dans les rangs interventistes en 1914-1915, après avoir eu un rôle-clé dans les choix de la politique extérieure du Corriere della Sera pendant la période 1916-1918, et après avoir été ébranlé par l’expérience du nazi-fascisme et par l’utilisation de la bombe atomique, Borgese s’oriente avec une abnégation farouche vers la rédaction d’une constitution pour un gouvernement fédéral mondial. Son objectif est la paix des nations. À Chicago, il est le leader de deux groupes fédéralistes-pacifistes auxquels participent surtout des intellectuels américains ou ayant émigré aux États-Unis. Aquest article pretén fer conèixer la figura de Jaume Durany i Bellera, mestre racionalista, periodista i activista polític. Des dels seus inicis com a militant del catalanisme més abrandat de finals del segle XIX, aquest personatge va transitant, a través d’una sòlida presa de consciència social, cap al republicanisme lerrouxista, al qual es vincularà per a exercir el magisteri racionalista que ell considera la forma més efectiva per a la transformació social que desitja. Prèviament, entrarà en contacte amb Francesc Ferrer i Guàrdia i la seva Escola Moderna, amb la qual col·laborarà. Més tard, abandona el lerrouxisme per a militar al federalisme pimargallià i constituirà, ja en temps de la Segona República, una associació, el Claustre de Mestres Laics Històrics, que reivindica el reconeixement oficial de la tasca realitzada per als que, com ell mateix, van exercir el magisteri en les escoles racionalistes durant els anys anteriors al període republicà. From his beginnings as a militant of the Catalanism of the late 19th century, this personage moved, through a solid social awareness, towards Lerrouxist republicanism, to which he linked himself to exercise the rationalist teaching that he considered the most effective form for the social transformation that he desired. He first met Francesc Ferrer i Guàrdia and his Escola Moderna, with which he collaborated. Later, he would abandon Lerrouxism, join the Pimargallian federalism and, during the Second Republic, would set up an association, the Claustre de Mestres Laics Històrics, which would demand official recognition of the work carried out by those who, like himself, taught in the rationalist schools in the years before the Republican period. In any case, a life devoted to secular education, to Republican politics and to journalism, through his tireless contributions to publications of the time., Este artículo pretende dar a conocer la figura de Jaume Durany i Bellera, maestro racionalista, periodista y activista político. Desde sus inicios como militante del catalanismo más radical a finales del siglo xix, este personaje va transitando a través de una sólida toma de conciencia social, hacia el republicanismo lerrouxista, al cual se vinculará para ejercer el magisterio racionalista que él considera la forma más efectiva para la transformación social que desea. Previamente, entrará en contacto con Francesc Ferrer i Guàrdia y su Escuela Moderna, con la cual colaborará. 18. La légalisation du cannabis au Canada : les stratégies de résistance du Québec à une politique unilatérale du fédéral.

On October 17, 2018, Canada became the first Western country to legalize cannabis for recreational use. The policymaking process was characterized by a top-down and often unilateral decision-making approach on the part of the federal government. Nevertheless, the provinces had important prerogatives, which they used to adapt or even resist the framework proposed by the federal government. Using the concept of resistance strategies, this article analyzes how some provinces, especially Quebec, took advantage of the policymaking process to provide a counterweight to the federal government's coercive approach. Quebec used both offensive and defensive strategies to resist federal policy from the formulation to the implementation stage. The article emphasizes the importance of studying cannabis policy implementation in Canada, which has led to a variety of policies rather than to a uniform framework. [ABSTRACT FROM AUTHOR]

This article examines the now largely forgotten, but then important, "Chicken and Egg War" of 1970–71. The chicken and egg war began when the Quebec government established the Fédération des producteurs d'œufs de consommation du Québec (FPOCQ) in 1970, a marketing board that began to restrict the price, grading, and sale of all eggs in Quebec, including egg imports from other provinces. The new board disrupted egg sales in Manitoba and Ontario, and it was not long before a series of legislative retaliations among the provinces took place, including strict import controls on broiler chickens and eggs and the seizure of out-of-province produce. Although predominantly contained to the neighbouring provinces of Manitoba, Ontario, and Quebec, this event was significant because it resulted in appeals to the Supreme Court of Canada, claims made concerning the rights of provinces vis-à-vis the federal government, and the restriction of agricultural goods, in this case, poultry and eggs, across provincial boundaries. This episode also had serious political ramifications, including fractured relationships among farmers, consumers, other industry stakeholders, and politicians and heightened tensions surrounding the legality and authority of provincial agricultural marketing boards. Ultimately, this "war" provided a significant impetus for the federal government to establish a national system of supply management in the egg and poultry sectors, a system that remains today. Pipeline projects in Canada often polarize citizens and governments from coast to coast. While the approval of such projects may seem simple from a constitutional standpoint, recent events show that legal realities and complexities truly add some grit in the works of pipeline projects even if the federal government is constitutionally responsible for the ultimate approval or refusal of projects because of their interprovincial nature. In fact, the passage of a pipeline involves a number of other considerations and fields of law, such as the environment, land use planning, risk management, and human rights, which are within the jurisdiction of federal or provincial legislatures, or both, and also increasingly the business of municipalities. While municipal powers continue, twenty-five years after important statutory reforms were launched, to be considerably limited by the provinces, courts have made it clear that municipal by-laws apply to federal pipelines, unless they have an excessive or serious detrimental effect on the construction or exploitation of such an undertaking, or if they contradict the operation or the purpose of federal legislation. It is in this multi-layered context that this article discusses the legal autonomy of Canadian municipalities in regard to the pipeline debate in Canada, exploring the content, the extent, and the limits of their powers. Le 17 octobre 2018, le Canada est devenu le premier pays occidental à légaliser le cannabis à des fins récréatives. Ce processus s’est caractérisé par une logique décisionnelle de type top-down et souvent empreinte d’unilatéralisme de la part du gouvernement fédéral. Les provinces disposent néanmoins d’importantes prérogatives sur la question, qu’elles ont utilisées pour s’adapter, voire résister à la politique proposée par le fédéral. À l’aide du concept de stratégies de résistance, cet article analyse la manière dont certaines provinces, et particulièrement le Québec, ont tiré avantage du processus de légalisation pour offrir un contrepoids à la démarche du gouvernement fédéral. Le Québec a ainsi fait usage de stratégies tant offensives que défensives afin de résister à cette politique, de sa formulation à son implantation. Ces résultats mettent en évidence l’importance d’étudier l’étape de la mise en oeuvre de la légalisation, qui a conduit au Canada à une multiplication de politiques différenciées plutôt qu’à un encadrement uniforme.

Les projets d’oléoducs au Canada divisent souvent les citoyens et les gouvernements d’un océan à l’autre. Bien que leur approbation puisse sembler simple sur le plan constitutionnel, l’actualité récente montre que des réalités et complexités juridiques ajoutent vraiment des grains de sable dans les rouages des projets d’oléoducs, même si le gouvernement fédéral est constitutionnellement responsable de l’approbation ou du rejet ultime de ces derniers en raison de leur nature interprovinciale. En fait, le passage d’un oléoduc exige de tenir compte d’autres considérations et domaines du droit, comme l’environnement, l’aménagement du territoire, la gestion des risques et les droits de la personne, qui relèvent de la compétence des législatures fédérale ou provinciales – ou des deux – et qui, en outre, concernent de plus en plus les municipalités. Si vingt-cinq ans après le lancement d’importantes réformes législatives les pouvoirs municipaux sont encore considérablement limités par les provinces, les tribunaux ont d’ailleurs clairement établi que les règlements municipaux s’appliquent aux oléoducs fédéraux à moins d’avoir un effet préjudiciable grave ou excessif sur la construction ou l’exploitation de tels projets ou d’aller à l’encontre de l’application ou de l’objet de la législation fédérale. C’est dans ce contexte à plusieurs niveaux que cet article traite de l’autonomie juridique des municipalités canadiennes dans le cadre du débat sur les oléoducs au pays, en examinant le contenu, l’étendue et les limites de leurs pouvoirs.

We examine the roles of sub-national and national governments in Canada and the United States vis-à-vis the protective public health response in the onset phase of the global coronavirus disease 2019 (COVID-19) pandemic. This period was characterized in both countries by incomplete information as well as by uncertainty regarding which level of government should be responsible for which policies. The crisis represents an opportunity to study how national and sub-national governments respond to such policy challenges. In this article, we present a unique dataset that catalogues the policy responses of US states and Canadian provinces as well as those of the respective federal governments: the Protective Policy Index (PPI). We then compare the United States and Canada along several dimensions, including the absolute values of sub-national levels of the index relative to the total protections enjoyed by citizens, the relationship between early threat (as measured by the mortality rate near the start of the public health crisis) and the evolution of the PPI, and finally the institutional and legislative origins of the protective health policies. We find that the sub-national contribution to policy is more important for both the United States and Canada than are their national-level policies, and it is unrelated in scope to our early threat measure. We also show that the institutional origin of the policies as evidenced by the COVID-19 response differs greatly between the two countries and has implications for the evolution of federalism in each. The Koinon of Athena Ilias and the Koinon of the Ionians provide two instances of supra-civic religious associations gathering several Greek cities of western Asia Minor, according to different criteria. In the first case we propose to focus on, ethnical dimension seems totally missing, whereas in the second one, it is clearly claimed. The compared study of these two koina allows to confront both of their differences and common points, regarding their nature, origin and composition. This will lead us to consider how the Greeks from Asia Minor have been able to define and stage their collective identity, in a way that do not necessarily match with the ethnicity concept.

This article analyzes the resistance strategies adopted by French-Canadian traditionalist intellectuals towards the Canadian welfare state project from the late 1940s to the late 1950s. The article traces the political, legal, and media strategies put forward by François-Albert Angers (1909–2003) in his fight against the Canadian federal government. An economist by training, an academic, and an influential leader of Quebec's nationalist networks, Angers notably fought a legal battle with Canada's Department of National Revenue for nearly a decade (1947–57). Through this saga based on the constitutionality of family allowances, the analysis focuses on central themes of traditionalist discourse, not only in relation to issues of federalism and respect for civil rights, but also in relation to the place of Catholicism within Canadian society. This study thus aims to shed light on the ways in which conservative thinkers in Quebec reacted to the advent of a modern, interventionist Canadian state in the aftermath of the Second World War. Federalism and social participation are relevant themes in public policy studies. However, there is little dialogue between these themes, a gap that this article aims to minimize when analyzing the effects of fiscal centralization of social assistance on the functioning and results produced by the councils. Would the federative dynamics of this policy also be reproduced in the councils, differentiating national and subnational institutions? To answer this question, the article adopts qualitative analysis to identify the strengthening or the constraint of fiscal centralism in excerpts of 658 minutes and 2,364 resolutions of five cases: CNAS; the state councils of Minas Gerais and Rio Grande do Sul; and the municipalities of Belo Horizonte and Porto Alegre. The results indicate that the strong regulation of social assistance and the concentration of expenditures at the central level have important effects, promoting the strengthening of CNAS and constraints to the work of subnational councils in the definition and control of this policy in their financing. This article assesses the 2000s reforms of the Russian administrative divisions and the implications of the reforms for the institutional structure and related discourse through institutional and discourse analysis. The authors reach the conclusion that the "special status" of the newly formed territorial entities remains undefi ned, while the representation norm is highly uneven, since the competences of governing bodies in the merged entities lie predominantly in the ethnic and cultural sphere. The reform was not a single and coherent policy measure but rather a number of incoherent initiatives. This can be seen from the presence of diff erent (re)integration models in respective amalgamation cases, diff erent models of a "special status" and a variety of reactions to the reform emanating from the population. Studies of the federal system have generally focussed on the consequences of its application. Most often, the reasons for the adoption of the federal system in its various forms are not examined in depth. A case study like Iraqi federalism may provide an additional building block to the literature on federalism and might also help to explain the rise of federalism elsewhere, especially in countries with deep-rooted diversity (DRD). The debate about whether federalism is a durable, sustainable alternative to the unitary state for purposes of tackling ethnic, cultural, or religious strife has raised fundamental questions. Federal experiments have resulted in failed outcomes as well as successful ones. To better understand the dilemma of federalism’s successes and failures, I have chosen to study the origins of federalism, which might help explain the successes and failures of some federal systems. Hence, Iraqi federalism is just a case that will elaborate on that. In order to accomplish this, the dissertation focuses on the macro-level of Iraqi society; the major ethnocultural groups that are based on territory, and have participated in both the 1991-2002 federal process and, ultimately, the post-2003 federal process. However, in my final chapter of this dissertation, I will look at the key current issues, particularly militias as well as the rise of Al-Qaeda and ISIS in the Sunni region and elsewhere in Iraq, and whether it is connected to the federal system. By addressing the federal subject in the Iraqi context, I will provide a deeper understanding of why federalism emerges and how federalism is a political contract negotiated between minority and majority. I have strived to understand whether such a federal system can help to prevent ethnocultural conflict in a unitary state system distinguished by DRD. À cet égard, les travaux pionniers du philosophe Will Kymlicka ont permis de montrer que les questions de justice devaient dépasser les enjeux de distribution des ressources pour aussi inclure les questions de justice culturelle. Et, si oui, quel impact cet héritage impérial a-t-il eu sur les solutions envisagées et sur la façon dont le problème de la diversité a été posé? Dans l’optique où les espaces impériaux furent parmi les premiers ensembles à devoir gérer la diversité culturelle, on peut se demander dans quelle mesure les théories contemporaines de la gestion de la diversité culturelle rompent avec les théories impériales de la gestion de la diversité culturelle. Plus précisément, on peut se demander s’il existe des continuités théoriques entre une théorie du multiculturalisme libéral telle que celle proposée par Kymlicka et la façon dont les libéraux du XIXe théorisaient le problème de la diversité culturelle à l’époque des empires plurinationaux. Les théories du multiculturalisme libéral auraient-elles reconduit certains biais impérialistes ou coloniaux? Ou, à l’inverse, les critiques faites à leur endroit ne sont-elles pas infondées et ne manquent-elles pas leur cible en s’attaquant aux théories du multiculturalisme? Comment doit-on penser la relation entre empire, colonialisme et multiculturalisme? Dans le cadre de cette thèse, nous avons donc cherché à répondre à ces interrogations en partant de deux questions : existe-t-il un biais impérial dans les théories du multiculturalisme et, si oui, comment peut-on le corriger? Ces deux questions ont pour but de nous aider à comprendre comment le passé impérial des sociétés peut nous aider à mieux saisir les enjeux philosophiques et politiques liés à la question de la diversité culturelle. La présente thèse propose donc de repenser les théories du multiculturalisme libéral à l’aune de leur passé impérial. Pour ce faire, notre réflexion sera construite autour d’une analyse critique des travaux de l’un des principaux penseurs du multiculturalisme libéral : Kymlicka. En partant des travaux de ce dernier, nous tenterons de reconstruire les lignes de continuité théorique qui ont pu exister entre le multiculturalisme libéral et les libéraux impériaux du XIXe siècle. Nous mettrons ainsi en dialogue la théorie libérale de Kymlicka avec les théories de certains de ses prédécesseurs libéraux, notamment John Stuart Mill, Lord Acton et Alfred Zimmern. Cette reconstruction historique nous permettra de mieux comprendre sur quels aspects les propositions de Kymlicka se distinguent de celles de ses prédécesseurs ou, à l’inverse, quels biais elles reconduisent en s’appuyant sur celles-ci. En retour, nous nous pencherons sur les critiques contemporaines qui ont été faites à l’endroit du multiculturalisme libéral, notamment afin de comprendre dans quelle mesure ces critiques se rattachent à la question du passé impérial d’une société comme le Canada. En mettant en place cette double perspective critique, à la fois historique et philosophique, notre ambition est de mieux comprendre les limites des théories du multiculturalisme libéral, et ce, afin de pouvoir en arriver à proposer de nouvelles avenues pour penser la cohabitation des peuples. Pour répondre à ces objectifs, nous soutiendrons dans un premier temps que les théoriciens du multiculturalisme libéral reconduisent un biais impérial en prenant pour acquise la question de la légitimité. Ce faisant, ils laissent de côté la question de l’autorité politique : qui possède le pouvoir sur qui? Dans un deuxième temps, nous argumenterons que les théories du multiculturalisme libéral peuvent mieux réaliser l’idéal d’autonomie des groupes culturels qu’ils défendent en utilisant une conception de l’autonomie fondée sur le concept de non-domination. En partant des travaux d’Iris Marion Young, nous soutiendrons que les concepts d’autonomie relationnelle et d’autodétermination comme non-domination permettent de mieux réaliser le principe d’égalité entre les peuples que ne le font les conceptions classiques de l’autodétermination interne défendues par les libéraux. Cependant, si les propositions théoriques de Young nous permettent d’accroître le potentiel critique des théories du multiculturalisme, nous montrerons qu’elles doivent néanmoins intégrer une conception plus forte des groupes culturels et donc, recourir à une ontologie sociale légèrement différente pour le faire de manière effective., Multiculturalism is considered one of the main contemporary political theories of diversity management, particularly among liberal thinkers. In this regard, the pioneering work of philosopher Will Kymlicka helped to show that questions of justice must go beyond issues of resources distribution to also include issues of cultural justice. By taking up many of the liberal insights of his predecessors, Kymlicka has succeeded in proposing an original model of cultural rights management. However, it is questionable to what extent the theories of his predecessors have influenced liberal multiculturalism. Is it not reasonable to assume that both theories of cultural diversity and liberal multiculturalism have carried over some of the theoretical elements of early liberal thinking on diversity? And, if so, what impact has this imperial legacy had on the solutions envisioned and on how the problem of diversity has been posed? Since imperial spaces were among the first sets to have to manage cultural diversity, one may ask to what extent current theories of cultural management break with imperial theories of cultural diversity management . Specifically, one might ask whether there are theoretical continuities between a theory of liberal multiculturalism as the one proposed by Kymlicka and the way nineteenth-century liberals theorized the problem of cultural diversity in the era of plurinational empires. Do theories of liberal multiculturalism have renewed certain imperialist or colonial biases? Or, conversely, are the criticisms leveled at them not unfounded, and do they not miss their target in attacking theories of multiculturalism? How should we think about the relationship between empire, colonialism, and multiculturalism? In this thesis, we sought to answer these matters based on two questions: is there an imperial bias in theories of multiculturalism and, if so, how can it be corrected? These two questions are intended to help us understand how the imperial past of societies can help us better understand the philosophical and political issues related to the question of cultural diversity. This thesis, therefore, proposes to rethink theories of liberal multiculturalism by considering their imperial past. To do so, our reflection will be built around a critical analysis of the work of one of the main thinkers of liberal multiculturalism: Kymlicka. Starting from his work, we will attempt to reconstruct the lines of theoretical continuity that may have existed between liberal multiculturalism and the imperial liberals of the 19th century. We will thus put Kymlicka's liberal theory in dialogue with the theories of some of his liberal predecessors, notably John Stuart Mill, Lord Acton, and Alfred Zimmern. This historical reconstruction will allow us to better understand in which aspects Kymlicka's proposals differ from his predecessors or, conversely, which biases he reproduces by relying on them. At a second level, we will look at contemporary critiques of liberal multiculturalism, particularly to understand how these critiques relate to the question of the imperial past of a society like Canada. By putting in place this double critical perspective, both historical and philosophical, our ambition is to better understand the limits of theories of liberal multiculturalism and to be able to propose new avenues for thinking about the cohabitation of peoples. To address these objectives, we will first argue that theorists of liberal multiculturalism reproduce an imperial bias by taking for granted the question of legitimacy. In doing so, they leave aside the question of political authority: who has power over whom? Second, we will argue that theories of liberal multiculturalism can better realize the ideal of autonomy for cultural groups that they defend by using a conception of autonomy based on the concept of non-domination. Drawing on Iris Marion Young's work, we will argue that the concepts of relational autonomy and self-determination as non-domination better realize the principle of equality among peoples than do classical conceptions of internal self-determination defended by liberals. However, if Young's theoretical proposals allow us to increase the critical potential of theories of multiculturalism, we will show that they must nonetheless incorporate a stronger conception of cultural groups and thus, a slightly different social ontology if we want this alternative to be effective.

L’année 1820 marque pour l’Espagne, l’empire espagnol et l’Europe un moment de bascule aux échelles européenne, atlantique et américaine. Le succès d’un soulèvement libéral dans la péninsule marque en effet le premier succès du constitutionnalisme après le Congrès de Vienne. En Amérique, ce triennat libéral (1820-1823) intervient après une décennie d’insurrection et de réactions contrastées à l’occupation française et aux innovations politiques des années 1812-1814. Au Mexique, l’indépendance est à la fois le résultat de l’application de la constitution et une réaction contre certains de ses aspects. La lointaine Haute-Californie, au nord du pays, est un observatoire de cette dynamique conservatrice de l’indépendance. Suite à ces indépendances, l’Amérique peut se présenter, par la voix du président Monroe en 1823, comme le continent de la modernité et de la liberté politique, face à une Europe non seulement monarchique mais réactionnaire, malgré les tensions liées à l’expansion de l’esclavage qui se sont exprimées lors du compromis du Missouri en 1820. The year 1820 marked a turning point for Spain, the Spanish Empire and Europe on the European, Atlantic and American scales. The success of a liberal uprising in the peninsula marked the first success of constitutionalism after the Congress of Vienna. In America, this liberal triennium (1820-1823) happened after a decade of insurrection and contrasting reactions to the French occupation and the political innovations of 1812-1814. The independence of Mexico in 1821 was both the result of the implementation of the constitution and a reaction against some of its aspects. Far away Upper California, in the north, is a good case study to observe the conservative dynamics of Mexican independence. Following such achievements of independence, America could present itself, through the voice of President Monroe in 1823, as the continent of modernity and political freedom, in the face of a reactionary, monarchical Europe, in spite of the tensions related to the expansion of slavery which manifested themselves during the Missouri compromise crisis of 1820.

Compte tenu de l’évolution constante de la Belgique vers une plus grande décentralisation des compétences, le statut futur des institutions culturelles fédérales à Bruxelles demeure incertain. Afin d’élargir le champ du débat politique, le présent article présente une comparaison des configurations institutionnelles des institutions culturelles nationales dans différentes capitales fédérales. Les cas de Berlin, Brasília, Canberra, Ottawa et Bruxelles sont examinés, l’accent étant mis sur la répartition constitutionnelle des compétences et sur les mécanismes de coopération entre les niveaux de gouvernement. Cet état des lieux montre que le gouvernement fédéral joue invariablement un rôle dans l’administration des institutions culturelles nationales dans les différentes capitales. En outre, dans la plupart des capitales, des mécanismes de coopération culturelle sont mis en place pour coordonner l’action fédérale et celle des entités fédérées. Sur ce dernier point, il semble que des améliorations soient possibles à Bruxelles. In België worden steeds meer bevoegdheden overgeheveld naar de gewestendeelstaten, en dat maakt het toekomstige statuut van de federale culturele instellingen in Brussel onzeker. Om het politieke debat te verbreden, gaan we in dit artikel na hoe nationale culturele instellingen in verschillende federale hoofdsteden gestructureerd zijn. We nemen Berlijn, Brasilia, Canberra, Ottawa en Brussel onder de loep, met bijzondere aandacht voor de grondwettelijke verdeling van bevoegdheden en voor samenwerkingsmechanismen tussen regeringen. Uit het overzicht blijkt dat de federale overheid steevast een rol speelt in het bestuur van nationale culturele instellingen in deze hoofdsteden. Bovendien zijn er in de meeste hoofdsteden mechanismen voor culturele samenwerking ontstaan om federale en regionale deelstatelijke acties op elkaar af te stemmen. Op dat vlak is er in Brussel nog ruimte voor verbetering.
