Measurements of impulsive and premeditated aggression, developed recently, have been applied to prison and outpatient populations without severe mental disorders. Comparable measures of impulsive and premeditated aggression have not been developed for populations with a severe mental disorder. A practical difficulty is that seriously disturbed, thought-disordered patients are incapable of providing reliable historical information. The investigators adapted the Barratt-Stanford instrument for differentiating impulsive from premeditated aggression so that instead of serving as an interview schedule, it could be used to assess aggression from previously documented written descriptions. The study found that the majority of ratable patients showed predominantly impulsive aggression, and after omitting four weak items, the inter-rater reliability for the determination of impulsive aggression was good ( k = 0.53). Far fewer of the patients were determined to have shown predominantly premeditated aggression (from 14.2% to 15.5%) and the inter-rater reliability for premeditated aggression was deemed fair ( k = 0.33). Although data and research on the topic are lacking, the phenomenon of feigned homicidality in short-term hospitalization appears to have increased in recent years. Inpatient psychiatrists not only assess the seriousness of homicidal threats, but also whether such threats are authentic. However, specific literature and diagnostic manuals provide virtually no clinical guidance for this. The authors present two case examples of homicidality feigned for self-serving purposes that had little to do with hostility against the would-be victim. They recommend an approach to assessment that first takes any threat of homicide seriously, and involves an attempt to assess the seriousness of the threat and risk of harm. Secondly, if feigned homicidality is suspected, clinicians can methodically assess for this using criterion that have been applied to the assessment of malingering. [ABSTRACT FROM AUTHOR]

Assessment of a violent act committed by an offender with schizophrenia typically focuses on whether the act was due to distortions in thought or perception, i.e., delusions or hallucination. An important but less appreciated feature is the impulsivity of the act, which can have forensic and therapeutic implications. Here a modification of Barratt's classification of aggressive behavior is presented that includes premeditated (instrumental), medical (secondary), impulsive (expressive), and compulsive (instrumental and expressive) aggression. Violence due to a mental condition such as schizophrenia is considered medical, but even aggression motivated by delusions or hallucinations can also be characterized as impulsive, premeditated, or compulsive. Although research on aggression and schizophrenia is limited with regard to the impulsivity–premeditation dimension and difficult to compare, current evidence suggests this to be an important consideration in the assessment of aggression in individuals with schizophrenia, important both forensically and therapeutically. Future research on the impulsive–premeditated quality of aggressive acts by offenders with schizophrenia—research wherein aggressive behavior is defined, situational context is clarified, and diagnostic criteria are explicitly followed—should further refine our understanding of the nature of aggressive acts associated with schizophrenia. One of the major difficulties in presenting an international perspective on delusional disorders and their impact on offending or violent behaviour is that no two legal systems are quite the same, and there are substantial differences between some of them; in addition, there is international variation in relevant service provision or use. We therefore invited several experts practising in forensic mental health services or the law to consider the following case and to use relevant literature, statute and case law to draw out similarities and differences in process and management of the following case. The relationship among parasomnias, sleep-related violence (SRV), and psychosis has neither been reported nor studied. The authors introduce the phenomenon of psychotic dream-related aggression (PDRA) and, through a review of the research on manifest dreams, the continuity of thinking across the sleep–wake cycle, and SRV, argue for its inclusion alongside the parasomnias of DSM-IV. Five cases are presented that illustrate this phenomenon, usually a male diagnosed with paranoid schizophrenia whose violent act toward another was closely associated with the manifest content of his nocturnal dreams and his inability to test reality. Differential diagnostic criteria are proposed to separate PDRA from other parasomnias that may be related to violence. Treatment and forensic implications are discussed. [Copyright &y& Elsevier]

Science can provide more information about the nature of aggressive acts, and therefore the mens rea of criminal offenses, than is commonly assumed. For example, progress has been made in classifying aggression as impulsive or premeditated within the context of the role of conscious experience in controlling behavior. This review of the status of the scientific ability to distinguish conscious from unconscious acts and more specifically impulsive from premeditated aggressive acts is organized around four themes: (i) How is aggression defined and measured in general? (ii) How does the distinction between impulsive and premeditated aggression relate to the legal concept of mens rea ? (iii) How do various scientific disciplines contribute to the mind/body discourse? (iv) What risk factors are associated with impulsive and premeditated aggression respectively? The authors conclude that the most promising approach to researching the nature of behavioral intention and motivation is to apply a discipline neutral model that integrates the data from multiple disciplines, collectively designated the cognitive neurosciences. Prior to the Tarasoff decisions, jurisprudence pertaining to the duty to warn, or inform, to prevent violence to third persons, was separate from that pertaining to the duty to control to prevent such violence. The Tarasoff Principle consolidated preventive obligations in the face of foreseeable violence under a single "duty to protect." Even as courts adopted divergent rules for establishing foreseeability, many held to a single duty to protect with warnings as one possibility for fulfilling this option. Particularly over the past decade, courts have again disengaged the duty to warn and the duty to control, each requiring different legal predicates to occur. In recent years, courts have upheld or rejected a duty to warn, upheld or rejected a duty to control; and several courts have, within a single opinion, articulated fundamental distinctions between these two separate protective duties. The evolution of civil commitment procedures is seen as reflecting changing social and ethical values regarding individual liberty versus protection of self and others. The dilemma of dealing with the modern suicidal patient places the psychiatrist at the interface of conflicting a societal expectations. The legal aspects of civil commitment are seen as not necessarily compatible with the best clinical course for the suicidal patient. This pilot study investigates factors associated with assaultive behavior in hospitalized female patients. Eight patients who assaulted were compared with 11 patients who did not. Associated with the assaultive sample were prior assault, a time span from first to last assault of over one year and destruction of property. Behavioral items significantly associated with assault included a history of frequent physical assaults between 10 and 18 years of age. The existing literature on the relationship between childhood cruelty to animals and later violence against people appears to be inconsistent. The authors review the controlled studies that did not support this relationship and those that did and identify several methodological factors that may have contributed to the contradictory findings. Studies using direct interviews to examine subjects with multiple acts of violence point to an association between a pattern of childhood animal cruelty and later serious, recurrent aggression against people. The article examines the relationship between childhood cruelty toward animals and aggressive behavior among criminals and noncriminals in adulthood. A dominant factor in the rising concern for animal cruelty is the presumption that abusive treatment of animals would tend to brutalize the human perpetrator and increase the likelihood of similar conduct toward human beings. It reviews the results of a study of 152 aggressive and nonaggressive criminals and non-criminals in Kansas and Connecticut and explores the phenomenon of animal cruelty among three groups of males, that is, aggressive criminals, nonaggressive criminals and noncriminals. Motives for cruelty toward animals include control of an animal, retaliation against an animal, to satisfy a prejudice against a species or breed or to enhance one's own aggressiveness. Domestic violence in the families of aggressive criminals who were cruel to animals assumed many forms, although extreme paternal violence and alcoholism were especially common. The evolution of a more gentle and benign relationship in human society might be enhanced by promoting a more positive and nurturing ethic between children and animals.

The author discusses the possible worsening of mental health services for mentally ill prisoners (MIPs) as a result of an untimely 2014 joint sheriffs' report. He cites its findings of the rising number of MIPs, the forced providing of care for them due to reduction of hospitals and mental health services, and its advocacy for a molecular minimalist approach to ensure forced treatment. The author observes that the report is biased against addressing the root causes of mental illness in MIPs.

The authors focus their interest on the socially deviant mafia world, especially on the question of a psychopathic dimension of individuals in mafia. From the scientific point of view this continues to be an unknow world. In all these cases, individuals in mafia, their "feats", their profiles seem to correspond to popular conceptions of the psychopath. Even less known is the women's role in criminal organizations. Their historical role in recent decades has gradually shifted and become more important than it was in the past. The investigators' interest was focused on identifying the prevalence of the psychopathic dimension in mafia women. So the authors examined a sample of 20 convicted mafia women coming from Campania and Calabria, the regions of Camorra and 'Ndrangheta respectively, historical Italian criminal organizations. These women inherited their roles from previous bosses and successfully carried on the criminal business. The authors compared this sample of mafia women with a sample of female offenders with full criminal responsibility who were in common female prisons. Like men of mafia, the women of mafia have a low prevalence of the psychopathic dimension. Further research is necessary to identify the psychopathic dimension in larger samples of women, and then compare them with similar male samples. [ABSTRACT FROM AUTHOR]

Forensic mental health services are a necessity for individuals involved in the criminal justice system. Such services involve two generally independent functions: assessment and treatment. A jurisdiction's legal system is a determinant of how such services are provided and to whom. In our study, we identified the Lebanese laws that address the rights and protections given to a mentally disordered defendant in the criminal justice system. We then analyzed how the Lebanese judicial system interprets and applies the written law in cases where the mental health of the defendant was brought up as an issue. We found that Lebanon's insanity test has a cognitive and a volitional component. However, there does not seem to be a uniform process regulating the use of the insanity defense: statutes do not address the procedural details and the cases we reviewed used various processes to reach their decisions. Understudied is psychopathy in females, particularly socially dangerous NGRI females, where the construct could be of forensic, clinical and criminologic significance. Italy's recent transformation of its mental health system created the context for studying such a population on a national level. Throughout the twentieth century until their closure in 2015, offenders found to be not guilty by reason of insanity (NGRI) and socially dangerous were placed in one of the the six high security hospitals in Italy (OPGs). Only one hospital, the Castiglione delle Stiviere maximum security hospital (OPG) in North Italy, treated female offenders, who came from all parts of Italy. The authors studied 66 of all 86 women in Castiglione delle Stiviere OPG. The aims of this study were to identify the prevalence of psychopathy in NGRI female offenders and eventually to identify any phenotypic gender-specific features of psychopathy. The SCID I and II interviews and other tests (MMPI-2, MCMI-III, R-Bans) were administered to all the women. Clinical historical information was obtained. Finally for all women who consented to participate in the study, the researchers administered the PCL-R version validated for the Italian population.
