Abstract

The article focuses on two U.S. Supreme Court cases Godinez v. Moron and Indiana v. Edwards in which the Court arrived at different conclusions regarding incompetence to represent oneself. It is mentioned that a part of its opinion in Godinez, which regarded the notion of competence to represent oneself (CTRO) has been overturned by the court in the Edwards case. The importance of the increased functional abilities needed to conduct a defense is asserted in the Edwards case.
