This review seeks to establish takings as a respected field of sociolegal inquiry. In the legal academy, the term takings has become synonymous with constitutional takings. When defined more broadly, however, a taking is when a person, entity, or state confiscates, destroys, or diminishes rights to property without the informed consent of rights holders. Adopting a more expansive conception of takings lays the groundwork for a robust interdisciplinary conversation about the diverse manifestations and impacts of involuntary property loss, where some of the most valuable contributions are made by people who do not consider themselves property scholars. This review starts the conversation by bringing together the empirical literature on takings published between 2000 and 2015 and scattered in the fields of law, economics, political science, sociology, psychology, geography, and anthropology. Most importantly, a robust understanding of property's multiple values is required to fully comprehend the magnitude of the loss associated with takings, and this creates a space in which scholars can rescue property's political, cultural, emotional, and social value from the sizeable shadow cast by the overly dominant focus on its economic value. Every day, up and down the country there are a large number of party wall cases that require resolving. There are, however, a few cases among them that, due to historical disagreements between neighbours, mean that the adjoining owners may not want party wall works to proceed. Boundary dispute claims often prevent such developments from taking place in the first place. If, prima facie, such instances are treated with some credence, with injunctive actions tofollow, the county courts are inundated with such cases and may not be able to deal with them swiftly. In boundary disputes, building owners may be faced with long delays, However, in the event of adjoining owners wishing to sell their properties in future, obligation for disclosure of boundary disputes would. It is essential that when boundary disputes are made, the disputes are considered alongside the party wall process and ideally outside the ambit of the courts, perhaps through expert mediation to evaluate the validity of the allegations made and rectify the misunderstandings. This paper analyses a boundary dispute in which no amount of diplomacy could deter a disgruntled adjoining owner from stopping the building process by declaring that administration of the party wall process was null and void until the disputed boundary matter has first been resolved. The number of vacant properties nationwide jumped by 4.5 million between 2000 and 2010, an increase of 44%, due to a variety of factors, such as the financial crisis and natural disasters. Vacant properties create a vicious cycle of negative externalities: abandoned property breeds blight and crime, thereby fu rth er depressing the economy, which leads to more abandoned property. Solving the problem of abandonment is a top priority for municipal leaders, b ut effective means of putting abandoned property in the hands of a private owner are ha rd to come by. Cities have experimented with a variety of solutions ranging from eminent domain to land banks to enticing owners to re tu rn to th e ir abandoned property through grant money. This Article proposes an alternative solution for abandoned property: adverse possession with a reformed possession requirement. This Article argues that the traditional application of the possessory requirement for adverse possession should be modified when the true owner has vacated his property. In this instance, actual possession should be unnecessary; instead, a notice of in ten t to possess should be sufficient to acquire abandoned property through adverse possession. By altering the doctrine in this manner, adverse possession can be an efficient solution for private pa rtie s to acquire ownership of abandoned properties while still offering a temporal safety net to protect true owners. Furthermore, expanding possession in this manner allows the doctrine to serve as a tool for market discovery that encourages adverse possessors and true owners to tran sfe r ownership through voluntary bilateral transactions. This Article shows that, in adverse possession disputes, a uniform approach to the claim of right inquiry can produce undesirable results. To reach the desired result in one type of adverse possession case, a court might be forced to adopt a particular approach for determining whether the possessor had the required state of mind ("claim of right"). In a different type of adverse possession case, however, using this same approach might produce a result that the court finds objectionable. Thus, to reach the desired outcome for each type of adverse possession case a court must resolve, a court might be compelled to adopt a different test for measuring the possessor's state of mind. This Article suggests that much of the confusion regarding the claim of right inquiry can be attributed to a failure to recognize the analytical point made herein--namely, that a uniform approach to the claim of right inquiry will often be problematic. Recognizing that adverse possession arises in factually distinct contexts-- and accepting that different rules could apply in each of these contexts--should resolve much of the confusion associated with the claim of right inquiry. This paper discusses the importance of private property rights not to trade a resource, with reference to the economic emphasis on transactional efficiency due to Hayek's friend, Ronald H. Coase (1910–2013). These were stressed by James M. Buchanan (1919–2013), a supporter of Austrian economics, for the planning and development of a market economy that respects human dignity based on freedom. It has been explained that the ideas of Coase and Buchanan are not contradictory, but complementary. The former focused on voluntary contracting and the latter on institutional stability that safeguards the freedom of contract. Three contentious topics in property planning and development, namely trends in the exercise of eminent domain and land resumption in favour of doubtful public use or purpose; a legislative tendency to reduce the period of occupation for adverse possession; and government eviction of squatters from public land, are illuminated by such rights not to trade. This article reviews the Land Registration Act 2002, taking advantage of the deeper perspective afforded by the intervening decade, and absorbing subsequent developments - and, in the case of the Act's electronic conveyancing project, non-developments - that have also come to contribute to the picture. It suggests especially that while the Act's central idea of conclusive, indeed 'constitutive', registration can be beneficial, its deployment here has been problematic. In particular, the lapse of electronic conveyancing, and the possibility (resisted by the courts) that conclusive registration can be procured by fraudsters, have diminished the control that parties have over dispositions of their own title, to the detriment of their autonomy; and over-preoccupation with the central idea has resulted in a failure to think carefully enough about problems to which it was never going to be the answer. In C v Holland, Whata J recognised that the tort of intrusion upon seclusion formed part of New Zealand's common law. The tort protects against intentional intrusions into a person's private space. This decision potentially exposes the news media to tortious liability when it engages in intrusive newsgathering practices. However, Whata J's decision provides little guidance as to how the tort should be applied in later cases. In order to ascertain the meaning of the tort's formulation, this article draws upon the methods used, both in New Zealand and internationally, to prevent the news media from breaching individual privacy rights. It then suggests that the courts should replace the formulation with a one-step reasonable expectation of privacy test. It also argues that the legitimate public concern defence should be better tailored to the intrusion context. Finally, it briefly assesses how the intrusion tort should interact with the privacy tort in Hosking v Runting. Ultimately, it concludes that, in future, the courts should reflect more carefully on the precise wording of the intrusion tort's formulation so that it best vindicates the interests that it was designed to protect.
