Foreign workers holding H‐1B visas gained recourse to federal employment rights under the Immigration & Nationality Act (INA) for the very first time when Congress passed the Immigration Act of 1990 (IMMACT90). This paper examines H‐1B employment rights enforcement under the INA as it has intersected with broader features of the American legal system: what political scientists call judicial retrenchment and the quasi‐judicial state. I first show how H‐1B rights, already limited by the domestic politics that shaped the IMMACT, became subject to judicial retrenchment when the federal courts confined H‐1B disputes under the INA to the quasi‐judicial state at the Department of Labor (DOL). I then use published data on DOL investigation outcomes, published and unpublished administrative case records, and judicial cases reviewing agency action to examine the extent to which and how H‐1B workers can use the quasi‐judicial state to solve workplace problems. My empirical findings contribute to a new understanding of the relationship between rights retrenchment, the judiciary, and the rise of alternatives to court in immigration and employment law and point to possible fine‐grained changes for future immigration reform. The American Competitiveness in the Twenty-First Century Act of 2000 (AC21) eliminated the H-1B cap for foreign employees of academic, nonprofit and government research organizations. This act potentially affects the job preferences of newly graduated foreign Ph.D. students. Choosing a career in an uncapped H-1B-qualified entity means circumventing the risk of facing the fiercely competitive H-1B application process and possibly avoiding potential losses due to a visa rejection. We use data from the census of Ph.D. graduates to examine the causal effect of this policy change on academic and industry labor markets in the USA. We find that as a result of this policy, Ph.D. graduates with temporary visas are 5 percentage points more likely to pursue a job in academia, and 3–4 percentage points less likely to choose a job in industry. The increased criminalization of immigration law has resulted in a number of problems that directly affect Latinos. For example, Latinos currently account for the vast majority of individuals detained in immigration detention and removed from the country. Furthermore, Latinos are the largest racial group sentenced to federal prison, and immigration offenses are the most commonly prosecuted federal crime. Aside from this over-representation, Latinos have also witnessed the use of racial rhetoric by policymakers and law enforcement in support of new immigration policies (e.g., California Prop 187 and Arizona S.B. 1070) that criminalize undocumented persons. This note will utilize a synthesis of compliance theory and the concept of racial microaggressions to argue that the above problems negatively impact Latino perceptions of immigration law. Specifically, this note will explain how racial "macroaggressions" that occur during policy formation and as a result of policy implementation have impeded Latinos' sense of belonging, an important antecedent to compliance with immigration law. The result is a feedback loop: Latinos are then perceived as having a higher propensity to violate immigration law, which in turn drives even more aggressive immigration enforcement policies and more extreme and perverse racial macroaggressions. Finally, this note will explain a potential reform policy intended to address these concerns: a new temporary work visa program that will likely begin to foster a greater sense of belonging among Latinos and encourage greater compliance with immigration law. The main focus of this work is to explore the effect that United States immigration laws have on the international and domestic artistic community, particularly since the attacks of September 11, 2001. The economic impact of stricter immigration laws is observed in many industries, including music, film, and fashion. While there has been a candid effort by many legislators to rewrite the laws, little progress has been made, and the application of the laws continues to be highly subjective and capricious. In fact, practitioners in the field often express their discontent towards a largely discretionary system that has offered little guidance to the community as far as the legal standards and burdens that must be met when filing certain petitions. Nevertheless, the goal of both lobbying practitioners and supportive lawmakers is to make the immigration system more accessible and accommodating to the needs of foreign artists while not jeopardizing national security and safety. Comparative scholarship tacitly assumes immigration politics to be relatively rigid. A state's immigration policy legacy is said to institutionalise policy preferences, thereby making it difficult to implement lasting reforms that are inconsistent with that legacy. This presents difficulties for states with restrictionist legacies wanting to implement liberal reforms in response to the emergence of labour shortages or demographic problems. The supposed rigidity of immigration politics is scrutinised in this article through a systematic process analysis of developments in the United Kingdom over the past decade, where the Blair government confounded the UK's characterisation as a ‘reluctant immigration state’ to implement various liberal work visa reforms. The uncoordinated nature of policymaking and implementation, and the limited involvement of state and societal institutions in the reform process, reflect the UK's historical experience with restrictionist policies, and help to explain the subsequent reintroduction of strict visa controls. The case demonstrates that policy legacies indeed play a significant role in defining the character of the policymaking institutions that shape a state's immigration politics.
