This article examines the proper use and definition of the term, fair use. According to the Association of American Publishers Inc., the law is silent on the question of fair use. A large body of case law exists, but any instance of challenge regarding use must be settled in court. Many publishers, lawyers, legislators, and users of copyrighted materials believe that fair use cannot be given exact definition or workable legislation. The Association, however, states that almost all concerned now agree that fair use should have statutory recognition even though definition appears to be impossible. In terms of quantity or kind of work copied no formula can be found. The proposed copyright provision bill includes factors to consider in determining fair use. The factors include the purpose and character of the use; the nature of the copyrighted work; the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and the effect of the sue upon the potential market for or value of the copyrighted work. Thus, as the Association observes, copying a one-page poem could be taken as unfair use, while copying pages from a longer work might not be. Making multiple copies and distributing them would probably be unfair, whether copies are sold or given away.
