Antinaturalistic Strategies in Beyond Good and Evil. Naturalistic interpretations of Nietzsche's thought ultimately appeal to two arguments. On the one hand, when tracing various human phenomena back to processes sufficiently explicable by the natural sciences, it would appear that Nietzsche was pursuing a de facto naturalization program. On the other hand, in BGE 230, the need for the naturalization of human beings as a whole is often interpreted as an argument de jure. After outlining some basic features of contemporary naturalism and showing its incompatibility with Nietzsche's philosophy, I argue in this paper that neither the de jure nor the de facto argument can be understood in a naturalistic sense. The task of "translating man back into nature" in BGE 230 is indeed turned against a point of view held by "old metaphysical bird-catchers." An analysis of the manuscript and a comparison of it with the preface to HH I, in which this figure is used in the opposite sense, suggests rather that Nietzsche conceives of the renaturalization of the human in a deceptive way, that is, as one of those numerous "snares and nets for unwary birds" scattered throughout his works. Widening this view, a similar dynamic arises with respect to the de facto argument. In the concluding section, I highlight how, in On the Prejudices of Philosophers, certain naturalization operations are countered by as many arguments to the contrary. Such sudden shifts in perspective seem to indicate, at least in Beyond Good and Evil, a desire to subvert naturalism from within. [ABSTRACT FROM AUTHOR]

The English title of Alain Corbin's classic study The Foul and the Fragrant hits the nail on the head: Smells are commonly characterized as evoking strong emotions and are highly dichotomized. They are perceived either as pleasant for the person smelling them, or as stinking, penetrating, and disgusting. This article explores the background of the dichotomy of olfactory emotions, focusing on the field of commerce and the significance of odors in early modern Warenkunden—books consisting of lists of commodities detailing their characteristics and quality. Analyzing how smells were described in this context can, on the one hand, further reveal the historical process of the naturalization of the dichotomy triggering a ref lection on its impact on the use of the emotional capacities of smell for social discrimination. On the other hand, it shows that the olfactory worlds of pre-modern commodity practices and commodity knowledge were considerably more complex. Historical sources can thus help to elaborate alternatives to the emotional and analytical dichotomization of olfaction. [ABSTRACT FROM AUTHOR]

7. Problems of Onomastics in 26 English Translations of The Glorious Qur’an: God Names in Focus

Onomastics, dealing with culture-specific terms, poses great challenges for literary translators, especially for translators of sacred texts. Translating God’s Names requires profound cultural knowledge. The paper is aimed at investigating procedures of translating God’s Names in English translations of the Glorious Qur’an by adopting Liang’s (2016) model. After identifying the equivalents of proper names in 26 English translations, the procedures used for rendering them were identified. Finally, the general tendencies of procedures were specified. The findings revealed that two procedures used by the Qur’an translators (‘couplet’ and ‘transposition’) do not appear in Liang’s (2016) model. It was also found that the procedure of ‘convention’ was by far (60.50%) the most frequently used procedure. Additionally, the data analysis revealed that no translator used procedures of ‘naturalization’ and ‘rendition’. Moreover, it was found that 1.60% of procedures were source-oriented and 98.40% of them were target-oriented. In other words, all English translators of the Holy Qur’an showed greater tendencies to adopt target-oriented procedures in rendering God’s Names. Prospective researchers can work on other language pairs and translations of God’s proper names in other sacred texts.

Although in recent years there has been an increased awareness of the life situation of students with experiences of violence, trauma, behavioral problems or mental illness, approaches of rehistoricizing diagnostics that address precisely these groups are rather an exception in the school context. The concept of ›rehistoricization‹, coined by Wolfgang Jantzen, was initially developed in nonschool fields of work in special education and deinstitutionalization, but it also opens up important perspectives for school pedagogy for an understanding diagnosis of the educational processes of children and adolescents with disabilities, especially in the case of cognitive impairments, behavioral problems or mental illnesses. The article outlines a framework of understanding diagnostics and emphasizes the importance of rehistoricization for school fields of work and their transformation in terms of inclusive school and teaching development. In celebration of the 30th anniversary of the existence of the Journal of Psychology, we address the essential and persisting factors of the critique of psychology that has been smouldering since the criticism of science of the student movement. The central questions are why this critique has had little influence on the mainstream of psychological research and teaching and what the lasting success of mainstream psychology, which has been only slightly touched by this critique, grounds on. Within the context of the measures for quality assurance of science that currently shape the practice of academic research, »success« proves to be an ambivalent term. This holds true for strategies of dissemination, research documentation and public presentation of research outcomes. 11. The United States Immigration Laws: History of a nation set up by migrants

The purpose of my paper is to consider a set of policies concerning flows adjustment and naturalization of immigrants. The starting point of my analysis is the Naturalization Act of 1790, the first immigration law of the US government, which inspired the subsequent ones. I have conducted a more detailed investigation into federal measures since 1882, the year of Chinese Exclusion Act, passing through the legislation of the period between 1920 and 1930, influenced by a marked protectionism, to arrive to the acts of 1965, which dismantled the system of national quotas. The goal of my work is to highlight the relationship between the laws and the debate that has been created around them, which involves congress, public opinion, trade unions and associations.

Due to its favourable geographical position, during the High and the Late Middle Ages the city of Vercelli was settled by some important migration flows: a phenomenon that confronted the local authorities with some unavoidable exigences of legal regulation. In order to comprehend their ratio, this essay aims to examine the prescriptions about the outlanders’ legal status, the immigrants’ naturalization and the crime of arbitrary emigration dictated by some norms contained in the city statutes of Vercelli promulgated in 1241 and in 1341. Moreover, the practical implementation of the above-mentioned prescriptions will also be explored, by analysing further documentary sources, such as the Ordinati of the Consilium de Credencia of the Commune of Vercelli and a record of criminal judgements delivered in 1359 by Giovannolo de Pirovano, podestà of Vercelli.

Zionism is rooted in the programme for overcoming the Diaspora. The descriptions of this programme go hand in hand with an in-depth »diagnosis« of the sufferings of the Diaspora as a symptom of the ongoing animosity towards Jews and their persecution even, and particularly, in the age of emancipation. This cultural, social and political diagnosis was described in Zionism - and it is no coincidence that this happened mostly through physicians - as the medical and psychiatric pathologization of the »Jewish people's body«. In this process of naturalization and scientification paradigms and methods of the contemporary humanities and social sciences were applied, including concepts as controversial as that of the »Jewish race«. The present analysis examines this medical account from two complementary perspectives: the medical verbalization of the political discourse of Zionism on the one hand (Leon Pinsker, Max Nordau, etc.), and the politicization of medicine on the other (Arthur Kahn, Felix Theilhaber, etc.). Translation Studies are increasingly occupied with questions about the translation of children's literature, since from its special position and characteristics we can learn a lot about translation in general, and about the personality of the translator and factors affecting the translation. This paper provides insight into the translation problems and solutions for a few novels of the well-known Dutch children's literature author, Annie M.G Schmidt. I demonstrate through the translation of proper nouns, geographical names, culture-bound terms and puns in the novels, what kind of translation methods and strategies were chosen by the translator and why; and how the voice and discursive presence of the translator can be traced. In the effect of the examined expressions the relevant role is not played by the fact that they originate from a foreign culture. The most important elements of the impression are the recognizable, yet unique and fairytale-like (linguistic) environment and humor, as well as a certain playfulness. Accordingly, the applied translation strategy is naturalization, while in the meantime the action, and 'beyond language' elements of the story clearly reflect the possibly foreign features of the source language in the target language. The translation of children's literature in general is characterized by naturalization, because the translator aims to enable the young target language reader to elaborate and understand the translation based on their own knowledge.

The Project of a Radical Naturalization of Mind. Remarks on Some Conceptual Assumptions - In this paper we address the program of the radical naturalization of the mind and, in particular, the materialist monism perspective which is the product of that program. Our aim is to identify the fundamental assumptions on which the program is based. The first assumption we recognize and critically discuss concerns the correspondentist conception of truth. A second assumption is related to the view that the study of the mind consists solely in the identification of causal relations and laws that govern mechanical processes, while the only investigations that can be considered scientific are those which are based on the principle of the closure of the physical world. In conclusion, we show that the most significant assumption of this program is the negation of subjectivity and consciousness, which are reduced to unconscious, non-intelligent processes. The problem we identify with respect to this reduction is that the fundamental distinction between empirical conditions and the conditions of intelligibility is disregarded.

Feminist issue and Marxist issue mainly meet under the question of reproduction of working class in capitalism. Among other things, the existence of capitalist system is conditioned by possibility of, how Marx put it, „worker to show up at factory’s gates every day“. Traditional Marxist analysis of this question entails taking wage as a main point. According to this position, reproduction of a worker is thought only through a wage as money paid to him for buying his/her labor force. It is at this point where feminist perspective help us see narrowness of traditional Marxist analysis by insisting on category of reproductive labor. Reproductive labor is unpaid housework that is mostly done by women. Nonetheless, introduction of this category is not just an addition to Marxist analysis since this labor is necessary for reproduction of capitalist system itself. It is a system that allocates labor in such a way that besides paid waged labor there also exists unpaid reproductive labor that is also crucial for existence of the system. This leads us to two complex problems: question of women’s emancipation in capitalism and question of productivity of labor in capitalism.

The Science of Love and its Limits - To investigate love as a natural phenomenon entails subjecting this aspect of human life – up till now considered evanescent, impalpable and deeply subjective – to the scrutiny and understanding of contemporary science. The natural sciences continue to modify our intuitive concepts of love suggesting that even in love man is much less free than we like to think. Nevertheless, once we discover the extent to which we are constrained by our biology even where love is concerned, something remains that contemporary science cannot explain. At this point in its natural history, the claims made for love appear weakened but love is still alive and – precisely for this reason – perhaps even more heartfelt.

Phenomenology, Psychology, and Embodiment. Reflections on Edmund Husserl’s Philosophy as a Rigorous Science – The empirical subject psychologists investigate is closely related to the pure subject phenomenologists work on. Because of this, one could think that phenomenological analysis embraces naturalistic presuppositions, even though Husserl decidedly rejected this idea and argued, on the contrary, in favor of epoché, of eidetic research and of the primacy of intentional consciousness. In the current research on consciousness we witness a conflict between the authors supporting an embodied view who think that neurosciences are or will be able to sufficiently explain psychical phenomena and phenomenologists who rely on Husserl’s concept of hyle and conceive a subjectivity sensitive, or a consciousness bound to sensory experience. On first case the search for scientific status leads through the sciences of complexity up to a mathematized psyche, on second case phenomenologists find support in the advancements of the neuroscience.

The paper explores how the 19th century scientific discourses naturalized sex. Those highest ranking forms of public knowledge are situated within a broader context of knowledge production on what it is to be human and how the gradation of humanity has been made possible. The paper concentrates on the sexed ‘humans’ in order to show how sex worked as the political and epistemic tool which foreclosed the domains of citizenship for women. I argue that epistemic incomprehensibility is fundamentally related to the politically liminal or impossible lives. Thus, by using examples from the Victorian sciences, the paper shows how the scientific naturalization of sex actively limited the space of citizenship for women. Switzerland was an important country of immigration for Austrians in the 20th century. Based on the biographical narratives and accounts of five Austrian men and women who moved to Switzerland between 1959 and 1972, this article focuses on three factors: the circumstances leading to this permanent move, integration into the host society, and transculturality. In the cases discussed here, individual circumstances were sufficiently heterogeneous to argue that the decision to move was not exclusively driven by economic considerations. Integration in the host society is analyzed in terms of narratives about the naturalization process, the right of foreigners to vote, and various experiences of discrimination. Factors that helped in the integration process included language, family, and career. Finally, actors in transcultural spaces can feel they belong to several cultures at once. In addition to cultivating social contacts, the continued connectedness of these eyewitnesses to Austrian culture is expressed in their ongoing interest in political and social issues, as well as in Austrian cuisine. Staatenlosigkeit – ein Mangel von Rechten, Rechte zu haben Das Recht auf eine Staatszugehörigkeit wird in der allgemeinen Menschenrechtskonvention als ein grundlegendes Menschenrecht festgehalten. Dennoch hat dieses Recht keine unmittelbare Wirkung in Österreich. Ziel dieser Forschungsarbeit ist es, die Bedeutung von Staatenlosigkeit in Österreich zu analysieren, um sowohl auf die sozialen als auch auf die rechtlichen Herausforderungen aufmerksam zu machen. Mit Hilfe der aktuellen Gesetzestexte und der wissenschaftlichen Forschung im Feld der Staatenlosigkeit in Österreich werden Möglichkeiten einer Einbürgerung sowie Lücken und Problematiken im Bundesgesetzblatt thematisiert. Abschließend werden die Folgen von Staatenlosigkeit als ein grundlegender Verstoß gegen die Menschenrechte problematisiert, und es liegt in der Aufgabe der Sozialarbeit als Menschenrechtsprofession, dagegen sozialpolitisch zu handeln. Statelessness – a lack of rights to have rights The right to a nationality is stated in the General Convention on Human Rights as a fundamental human right. Nevertheless, this right does not have direct effect in Austria. The aim of this research is to analyze the meaning of statelessness in Austria in order to draw attention to both social and legal challenges. With the help of current legal texts and scientific research in the field of statelessness in Austria, possibilities of naturalization as well as gaps and problems in the Federal Law Gazette will be addressed. Finally, the consequences of statelessness as a fundamental violation of human rights are problematized, and it lies in the task of social work as a human rights profession to act socio-politically against it.

escriptivists’ method of naturalizing moral language is neither the only nor the most promising one in metaethics. The paper deals with attempts to combine the expressivistic account of moral concepts with an evolutionary research programme. As Allan Gibbard puts it: Normative discussion is part of nature but it does not describe nature (Wise Choices, Apt Feelings, Harvard University Press, Cambridge, Mass., 1990, p. 7). First, Gibbard’s expressivism is outlined against the background of the theory of evolution. Then the Author proceeds to his own metaethical theory according to which, to take but one example, the judgment that a is morally wrong consists of a belief that it is possible to avoid a, a belief that there is a universal property P which a exemplifies, a desire not to actualize a, a disposition(1) to desire not to actualize anything that instantiates the property P, and a disposition(2) to desire to subject everyone who does a to coercive measures (including punishment). Language thus interpreted is shown to be an apposite tool for negotiating a stable normative consensus; it addresses specific problems of cooperation viewed from the evolutionary perspective. Finally, it is argued that the Author’s proposal exhibits some important advantages over Gibbard’s theory.

Como figure destacada en el complejo escenario político de la transición entre la dinastía Tudor y la dinastía Estuardo de Inglaterra, Francis Bacon (1561-1626) adoptó la teoría de los dos cuerpos del rey en sus textos políticos y jurídicos. Su uso de esta teoría tiene una estrecha conexión con conceptos centrales de su filosofía natural que testimonia la profunda conexión que Bacon encuentra entre la política y la naturaleza. En este trabajo, analizaré su utilización de la teoría medieval de los dos cuerpos del rey y la vinculación que esta tiene con el resto de la filosofía baconiana. Tomaré como eje para el análisis su discurso sobre la naturalización de los escoceses nacidos después de la subida al trono de James I, donde Bacon trata el concepto de los dos cuerpos del rey con más profundidad.As a prominent intellectual figure in the complex political arena of England, during the transition from Tudor to Stuart dinasties, Francis Bacon (1561-1626) assumes the medieval King's two bodies theory in his political and juridical writings. His use of this theory is extremely linked to central concepts of his natural philosphy, which testifies to the deep connection that Bacon finds between politics and nature. This paper addresses Bacon's use of the King's two bodies theory and its link to the rest of the Baconian philosophy. The focus of this study will be his discourse on the naturalization of Scots born after James I assumption of power, where Bacon deals more deeply with the King's two bodies theory.

In diesem Beitrag werden regionalisierte Indikatoren über ausländische Bevölkerung in Deutschland vorgestellt und analysiert, die für jede*n Interessierte*n in einem Internetportal zugänglich und auswertbar zur Verfügung stehen. Mittels INKAR online lassen sich Verteilungen von Indikatoren in Form von Karten oder Tabellen darstellen. Für alle Indikatoren sind Definitionen und Berechnungsmodi hinterlegt. Da es sich bei den Indikatoren nicht um Absolutzahlen, sondern in der Regel um Anteile handelt, ist für das Verständnis unverzichtbar, als Bezugsgrundlage die Referenzgrößen aus den entsprechenden Veröffentlichungen des Statistischen Bundesamtes hinzuzuziehen. Neben der regionalen Verteilung von Ausländern nach siedlungsstrukturellem Kreistyp – mit Fokus auf kreisfreie Großstädte – geht die Analyse insbesondere auf Wanderungsmobilität sowie Bildung, Beschäftigung und Einbürgerung als Integrationsanzeiger ein.

27. From participants to citizens? Democratic voting rights and naturalization behavior

We study the causal effect of the possibility to vote on foreigners propensity to naturalize, a key indicator of successful integration. Based on Swedish administrative data and an institutional setting producing a quasi-random assignment of the eligibility to vote, we find that the overall effect depends on the composition of the migrant population. For immigrants from places with poor living conditions, we observe that the experience of non-citizen voting rights substantially increases their propensity to naturalize. In contrast, for those coming from places with a high standard of living, the same experience reduces it. Both reactions clearly reveal that individuals assign a positive value to formal democratic participation rights. While the behavior of the former group is likely dominated by the motivational force inherent in the possibility to participate, the behavior of the latter group reflects the devaluation of formal citizienship if it is decoupled from democratic rights.

Neben der in Osttirol autochthonen, jedoch sehr seltenen und auf ein enges Verbreitungsgebiet begrenzten Taxus baccata sind im Osttiroler Siedlungsraum seit einigen Jahren zunehmend auch Eiben-Jungpflanzen außerhalb dieses Taxus-baccata-Teilareals zu beobachten, die unzweifelhaft Verwilderungen aus nahen gärtnerischen Kulturen darstellen. All diese Eibenverjüngungen liegen in anthropogen mehr oder weniger stark überprägten Gehölz- und Waldlebensräumen in enger Nachbarschaft zu kultivierten Eiben. Aufgrund der Merkmalskombination aus gekielten, eiförmig-verlängerten, tw. zugespitzten Knospenschuppen sowie intermediärer Blattspitzenausbildung bzw. auch abrupt zugespitzten Nadeln ist der Großteil dieser Eibenverjüngungen zumindest morphologisch Taxus × media zuzuordnen, welche häufig im Handel angeboten und in Osttirol verbreitet kultiviert wird. Es liegt der Verdacht nahe, dass auch in anderen Ländern Europas ein Großteil der zuletzt registrierten Eibenverwilderungen dieser Kulturhybride zugehörig ist. Inwie-weit sich kultivierte und verwilderte Eiben auf die autochthone Taxus baccata auswirken, ist derzeit noch unerforscht. Angesichts der zunehmenden Siedlungsentwicklung in Mitteleuropa und der damit einhergehenden, flächigen Kultur züchterisch veränderter Pflanzen heimischer Arten wie etwa den Kultur-Eiben darf jedoch von einem wie auch immer gearteten Einfluss auf den Genpool autochthoner Bestände ausgegangen werden., In addition to the autochthonous Taxus baccata, which is very rare and limited to a narrow range in East Tyrol, in the settlement area of East Tyrol an increasingly amount of yew plants can be observed. The latter represent undoubtedly wilds from nearby horticultural cultures. All of these synanthropic yew plants are located in anthropogenically more or less heavily overgrown wood-land and forest habitats in close proximity to cultivated plants. Due to the combination of fea-tures of keeled, ovate-elongated, tapered bud scales as well as intermediate blade tip formation or also abruptly pointed needles, the majority of these yew plants can be determined at least mor-phologically to Taxus × media, which is often offered commercially and widely cultivated in East Tyrol. It is suspected that in other European countries, a large part of the last registered naturali-zations of yews could be this hybrid. The extent to which cultivated and naturalized yews affect the autochthonous Taxus baccata is still unexplored. The Science of Love and its Limits - To investigate love as a natural phenomenon entails subjecting this aspect of human life – up till now considered evanescent, impalpable and deeply subjective – to the scrutiny and understanding of contemporary science. The natural sciences continue to modify our intuitive concepts of love suggesting that even in love man is much less free than we like to think. Nevertheless, once we discover the extent to which we are constrained by our biology even where love is concerned, something remains that contemporary science cannot explain. At this point in its natural history, the claims made for love appear weakened but love is still alive and – precisely for this reason – perhaps even more heartfelt.

In his book Epochen der italienischen Lyrik (Epochs of Italian Poetry, 1964), Hugo Friedrich presents Mannerism as a clear decline from the previously effective classical principles, thus largely following a paradigm of decline that his Structure of Modern Poetry (1956) seems to oppose. At the same time, journalist Gustav René Hocke published two volumes on Mannerism in art (I) and literature (II) in the series “rowohlts deutsche enzyklopädie”, in which he advocated radically opposite views and presented a cyclical model of art and intellectual history. He promoted nothing less than the salvation of homo europeus by taking up an “irregular”, namely mannerist tradition. In doing so, Hocke—like Friedrich—referred to Ernst Robert Curtius and his distinction between Classicism and Mannerism. The article examines how Hocke’s cyclic conception differs from Friedrich’s understanding of epochs, the links both have to Curtius’s topology and whether the three approaches can be understood as naturalizations of literary history.

In Pierre Bourdieu’s 1967 Postscript to his translation of Erwin Panofsky’s Gothic Architecture and scholasticism, in which he quotes mostly theoreticians of art, culture and society from Germany and Austria, the expression “lieu géométrique” (in English texts locus geometricus) points to methodological and theoretical questions about the relation between the individual and the collective. From his first book publication in Germany (Zur Soziologie der symbolischen Formen, 1970) to the Outline of a Theory of Practice (1972, Engl. 1977), this expression articulated questions related to habitus, categories of perception and thinking, figuration, statistics and field theory. To analyze the link with Bourdieu’s critique of naturalization, situated in a tension between German philosophy and French sociology, this article enlarges the perspective by including the impact of the war and of his fieldwork in Algeria on Bourdieu’s thinking and his direct or indirect relation to the United States.

The audiobook, located at the disciplinary interface of literature, media, theatre, language, speech and book studies, is still largely unexplored in France. Based on (neuro-)psychological aesthetics and narratological controversies over the concept of voice, using theoretical considerations and audio-versions of Kafka’s The Trial and Cervantes’s Don Quijote by Buhlert, Paetsch, Cassel, Hochmair et al., the article examines how naturalization processes are involved in making the perception of audiobook versions of literary narrative texts a sensual-gestural experience of narrativity. Naturalization processes promote an anthropomorphic unison perception of the narrative voice, despite the fact that narrative voice is always polyphonic in the audio book. In the case of disruptions of automated perception through the dissonant clash of naturalized genre expectations and listening patterns, however, they also trigger the search for subjectively experienced coherence in listening, thus allowing alternative constructions of narrativity to become active in listening. This change of perception provides an aesthetic experience.

Die Deutschen öffnen sich dem Thema Zuwanderung: Immer weniger Deutsche ohne Migrationshintergrund, so zeigen die repräsentativen Daten dieses Berichts, fühlen sich durch Zuwanderung bedroht. Auch beim Thema Einbürgerung hat ein Wandel stattgefunden. Auf die Frage "Was ist für die Vergabe der deutschen Staatsbürgerschaft entscheidend?" antworten die Deutschen inzwischen anders als noch in den 90er Jahren. Ein großer Teil der Bevölkerung ohne Migrationshintergrund hält die ethnisch deutsche Abstammung für wenig wichtig. Immer mehr Deutsche glauben hingegen, dass vor allem das Verhalten der Menschen für die Einbürgerung ausschlaggebend sein sollte. Ein Rückgang der Fremdenfeindlichkeit ist damit jedoch nicht zwangsläufig verbunden: Wer das Verhalten und die kulturelle Anpassung als die wichtigeren Faktoren erachtet, weist genauso häufig stark fremdenfeindliche Einstellungen auf wie jemand, der ethnische Zugehörigkeit für bedeutsamer hält. Insgesamt sank aber die Anzahl der Deutschen mit stark ausgeprägten fremdenfeindlichen Einstellungen.

"Der Beitrag zeichnet die Entwicklung des föderalistischen Schweizer Bürgerrechts zwischen der Bundesstaatsgründung im Jahr 1848 und der Verankerung einer restriktiven Einbürgerungs- und Niederlassungspolitik in der Zwischenkriegszeit nach. Ausgehend von der schwierigen staatsbürgerlichen Integration der ausländischen Wohnbevölkerung in Geschichte und Gegenwart der Schweiz fragt die Autorin nach den Ursachen für die Gewährung und Verweigerung des Schweizer Bürgerrechts. Dabei wird deutlich, dass sich die Entwicklung und Ausprägung des Zugangs zum Schweizer Bürgerrecht nicht allein auf Vorstellungen von der schweizerischen Nation oder auf staatliche Interessen reduzieren lassen. Vielmehr waren sie Ergebnis eines permanenten politischen Aushandlungs- und Koordinationsprozesses zwischen Bund, Kantonen und Gemeinden: Das Gemeindebürgerrecht bildete aufgrund seiner armenrechtlichen Bedeutung bis weit ins 20. Jahrhundert hinein das Nadelöhr für Einbürgerungen. Im Gegensatz dazu versuchten der Bund und einzelne Kantone wie Zürich, Basel und Genf die seit den 1880er Jahren stark angestiegene Zahl der ausländischen Wohnbevölkerung durch die Liberalisierung der Einbürgerung zu verringern. Der Ausbruch des Ersten Weltkriegs setzte diesen Bestrebungen ein Ende. Im Zuge des Aufstiegs einer 'neuen Rechten' seit 1900, der Gründung der Eidgenössischen Fremdenpolizei im Jahr 1917 und der Institutionalisierung der behördlichen 'Überfremdungsbekämpfung' wurde das schweizerische Staatsangehörigkeitsrecht nachträglich ethnisiert. Die kulturelle 'Assimilation' an die 'schweizerische Eigenart' galt nun als Voraussetzung dafür, um Schweizer Bürger zu werden. (Autorenreferat) "The article traces the development of the federal structure of Swiss citizenship between the founding of the federal state in 1948 and the entrenchment of a restrictive naturalisation and establishment policy in the interwar period. Considering the difficult integration of the foreign residents through naturalisation in the past and present in Switzerland, the author examines the causes for the granting and refusal of Swiss citizenship. She shows that the development of and arrangements for access to Swiss citizenship cannot be reduced only to notions about the Swiss nation or national interests. They are the result of a permanent process of political negotiation and coordination between the federation, cantons, and local authorities: owing to its importance in social assistance matters, local citizenship constituted an impediment to naturalisation until well into the 20th century. In contrast, the federation and certain cantons like Zurich, Basle, and Geneva had sought since the 1880s to reduce the strongly increasing number of foreign residents by liberalising naturalisation. The outbreak of the Second World War put an end to these endeavours. With the rise of a 'new right' since 1900, the setting up of the Central Office of the Police for Foreigners in 1917, and the institutionalisation of the authorities' 'fight against foreign infiltration,' Swiss nationality law became ethnicized. Cultural 'assimilation' into the 'particularity of Swiss society' was now regarded as a precondition for becoming a Swiss citizen. Die Studie ist der Frage gewidmet, welche Einstellungen die deutschstämmige Mehrheitsbevölkerung, aber auch Ausländer bzw. Migranten selbst gegenüber dem Erwerb der deutschen Staatsangehörigkeit haben. Wer soll Deutscher werden dürfen, bzw. an welche Kriterien soll die Vergabe des deutschen Passes geknüpft werden? Empirische Grundlage der Studie sind Ergebnisse der Allgemeinen Bevölkerungsumfrage der Sozialwissenschaften (ALLBUS), in deren Rahmen 1996 und 2006 diesbezügliche Einstellungen erhoben worden sind. In den Analysen zeigen sich, mit Ausnahme des Themas 'Doppelpass', relativ geringe Differenzen zwischen Deutschen und Migranten in den Einstellungen zum Erwerb der deutschen Staatsangehörigkeit, sowohl was die Wertigkeit einzelner Kriterien als auch die Entwicklung zwischen 1996 und 2006 angeht. Offenbar haben sich - trotz Unterschieden im absoluten Niveau der Zustimmung - in diesem Zeitraum ähnliche Einstellungsveränderungen in verschiedenen Bevölkerungsgruppen vollzogen. Erkennbar ist eine Entwicklung weg von angeborenen oder 'ethnischen' Kriterien (Abstammung, Geburt) hin zu verhaltensorientierten bzw. 'leistungsbezogenen' Kriterien (Straffreiheit, Sprachbeherrschung, Lebensstilanpassung, Bekenntnis zur freiheitlich-demokratischen Grundordnung). "Die Arrangements, die um das Kind herum installiert werden, rekurrieren stets auf eine diskursiv produzierte Natur des Kindes. Die Naturalisierung der Kindheit stand und steht dabei ganz im Zeichen von Normierung, Disziplinierung und Individualisierung (nicht nur der Kinder) mittels Separation und Besonderung in speziell dafür vorgesehenen Räumen, genauer: Krisenheterotopien. Die Natur entsteht, indem die ihr zugehörigen Dinge mittels der Kategorien Zahl, Form, Proportion und Situation gerastert werden; damit geht eine Neutralisierung der Dinge und Verortung innerhalb eines Tableaus einher. Es entsteht eine Verengung des Sichtfeldes: Ein Blick, der den Raum ordnet. Das empirische Augenmerk liegt auf dem Kinderzimmer als einem Ort, an dem sich Sedimente europäischer Machtgeschichte abtragen lassen - Sedimente, die mit besonderem Blick auf die Semantik der Naturalisierung in den pädagogischen Bildern der tabula rasa, der terra incognita und des Masturbators verankert sind. Ihnen allen ist gemein, dass sie die Natur des Kindes zugleich mit einer Unschuld und anormales Verhalten mit den schlechten Sozialisationsbedingungen verbinden. Ziel der an diese Diskurse anschließenden Praktiken ist also 'die natürliche Erziehung' des Kindes, organisiert in der direkten Eltern-Kind-Beziehung der Kleinfamilie und angeleitet von den Experten der Natur: Ärzten und Pädagogen. Solche Beschreibungsfeldzüge um die Bedürfnisse und Erfordernisse naturalisierter Kindheiten legen den Grundstein für eine pädagogische Bearbeitung im Rahmen einer generationalen Ordnung. Im Zentrum steht eine reorganisierte Familie, die als Sozialisationsagentur zwischen Diskurs und Praxis Disziplinierung durch (Selbst-)Kontrolle und Individualisierung durch Liebe vornimmt. Durch die physische Verräumlichung der Familie entwickelt sich eine Architektur, die das Kind unter der Fahne der pädagogischen Errungenschaft in den speziellen Bearbeitungsraum Kinderzimmer überstellt. An die Vorstellung eines reziproken Bedingungsverhältnisses von Naturalisierung, Bearbeitung und Verortung von Kindheit knüpfen die Verfasser ihr analytisches Anliegen für diesen Vortrag an: 1. die ideengeschichtliche Herausarbeitung einzelner Konstruktionsmomente der Natur des Kindes; 2. das Aufzeigen der Verknüpfung der Konstruktionsmomente mit den Bearbeitungsstrategien des Einzelnen; 3. die Bestimmung des erfundenen und lokalisierbaren Orts, an dem sich die Bearbeitungsstrategien vollziehen." Bis zum Ersten Weltkrieg betrieben in der Schweiz Kantone und Gemeinden Bevölkerungspolitik. Erst mit dem Ersten Weltkrieg begannen auch bundesstaatliche Stellen sich vermehrt für bevölkerungspolitische und -wissenschaftliche Fragen zu interessieren. Die während des Ersten Weltkriegs geschaffene Fremdenpolizei versuchte, mit einer möglichst zurückhaltenden Niederlassung- und Einbürgerungspolitik und -praxis die Zusammensetzung der in der Schweiz lebenden Bevölkerung zu steuern und so genannte 'unerwünschte' Ausländerinnen und Ausländern fern zu halten. Diese Haltung, die sich stark gegen jüdische Immigranten richtete, war geprägt vom damals vorherrschenden Überfremdungsdiskurs. Die Behördenvertreter orientierten sich an einer engen Abstammungslehre und nahmen dabei insbesondere die Diskriminierung der Frauen in Kauf. Gleichzeitig traten private Organisationen und einige Kantone für sozialpolitische Maßnahmen ein, die das Ziel hatten, die Geburtenrate zu steigern. So entwickelte sich in der Zwischenkriegszeit ein schweizerischer bevölkerungswissenschaftlicher Diskurs, der sich durch eine nach außen gerichtete Abwehr und einer zunehmenden Diskriminierung der Frauen auszeichnete., The paper analyses the beginning of a Swiss population policy at the intersection of federal, cantonal and non-governmental interests in the twenties and thirties. During World War One, the Federal Council founded the Swiss Foreign Police, a special police unit which formed part of the immigration office. This new police unit was the first federal institution which followed a population policy. In the case of immigration and naturalisation the authorities brought to life a strict population-control. Their point of view was influenced by the discourse about the threat of foreigners ('Überfremdung'), the catchphrase during the decade after World War One. While they were trying to exclude the 'unwanted people' they also encouraged the discrimination of women. At the same time several private associations and some cantons demanded a social policy for families with the aim to raise the birth rate. This dissertation focuses on the reform of German nationality law which entered into force on January 1st, 2000, paying special attention to legal issues regarding multiple nationality.The Citizenship Reform Act is compatible with all priniciples of constitutional and international law and as such to be supported without restriction whatsoever. The introduction of the ius soli principle as well as the increased acceptance of dual nationality resulting from the citizenship law reform are admissible under the German Basic Law. The same applies to the introduction of the optional model relating to German dual nationals (section 29 of the German Nationality Act) as well as to the rules on loss of nationality as a consequence thereof. In addition, the Citizenship Reform Act is compatible with Public International Law as well as with European Community Law.The optional model represents a compromise which was enforceable politically upon passing the nationality law reform. Difficulties thereof will presumably arise from the application of this regulation rather than its legal scope. At present reliable forecasts on this issue, as well as on the results of the so-called generation cut under section 4 para. 4 of the German Nationality Act, to be implemented not until 2018 to 2020, are not feasible.Recent experiences with the reformed regulations regarding naturalization have shown that certain difficulties arise from their practical application: The administrative practice in the German Federal States may be regarded as unsatisfactory since it considerably differs in many areas. This applies, in particular, to the procedure of evaluation if an applicant for naturalization has sufficient knowledge of the German language. The debate on the necessity of the so-called Regelanfrage (default enquiry) to the Authorities for the Protection of the Constitution, however, became superfluous after the entering into force of the Immigration Act of 2004. The need for new regulations, however, still exists for some questions concerning the pre-conditions of naturalization as well as the naturalization procedure, e.g. the definition of the applicant s habitual residence , the exceptions from the ability to earn his/her living, and the missing obligation of the naturalization authority to adhere to their assurance of naturalization if the factual or legal situations change. With regard to the newly introduced acquisition of German nationality by children of foreign parents born on German territory, problems like the acquisition of nationality by children of very young parents, or the temporary discontinuation of the legality of residence, were satisfactorily solved by the new Immigration Act of 2004. Recent experiences concerning this new mode of acquisiton by ius soli, especially in the light of the new tasks legislation put on the registrars, are favourable. The transitional regulation of section 40b of the Nationality Act, which provided for a limited claim to naturalization of young aliens not yet ten years of age, was accepted only reluctantly for various reasons. The transition of ethnic Germans within the meaning of section 116 of the German Basic Law into German nationality as of August 1st, 1999, as well as the legal acquisition of German nationality resulting from the issue of a special certificate by the Federal Administrative Office, replacing the former naturalization in each individual case, constituted an enormous relief to the workload of the naturalization authorities.Although this new citizenship law still does not accept double nationality as a default, the number of persons with a dual and multiple nationality living in Germany has increased considerably since the new nationality law came into force. In most countries dual citizenship becomes more and more accepted, especially since many countries in Western Europe have come to accept multiple nationality when naturalizing migrant workers. Although in certain areas multiple nationality may cause complications, these conflicts may be overcome by the conclusion of international agreements, ideally by multilateral treatments, at least, however, with bilateral treaties with the main states of origin. These agreements should generally aim at applying the law of the state where a dual national has his/her habitual residence, or which nationality is the effective one. This applies, in particular, to the legal subjects of military obligations and alternative service, diplomatic protection between both states of nationality, double taxation and aspects of private international law. Further issues comprise the exercise of political rights by dual nationals including voting and holding of political offices, loss and withdrawal of the secondary citizenship as well as protection of national minorities.

Die öffentliche Diskussion über Ausländer in Deutschland war in den letzten Jahren stark von gewaltsamen Übergriffen gegen Ausländer und Kriminalität durch Ausländer geprägt. Dadurch sind die umfassenden Veränderungen beim Anteil, der Zusammensetzung und der sozialen Integration von Ausländern bisher in der öffentlichen Diskussion kaum zur Kenntnis genommen worden. Veränderungen in diesem Bereich finden mehr oder weniger stark in allen europäischen Ländern statt. Für Deutschland stellt sich die Frage, wie die Integration weiter gestaltet wird. Dies betrifft insbesondere die zweite bzw. dritte Generation von Ausländern. Die anstehenden Entscheidungen betreffen das Staatsbürgerrecht, insbesondere die Einbürgerungsvoraussetzungen, aber auch Fragen der Chancengleichheit im Bildungswesen und auf dem Arbeitsmarkt sowie die politische Partizipation und das Wahlrecht. Zeitschrift für Entwicklungspädagogik 16 (1993) 4, S. 8-14, In Veranstaltungen der Erwachsenenbildung zur Asyldiskussion, zur Einwanderungsproblematik oder zur doppelten Staatsbürgerschaft ist regelmäßig eine sich harmlos gebende, selbstverständliche Bereitschaft feststellbar, Menschen nach ihrer Herkunft und ihrer vermeintlichen Abstammung zu unterscheiden. Das (häufig unbewußte) Festhalten an der Ideologie einer vermeintlich klar definierbaren "Blutszugehörigkeit" erweist sich dabei - auch bei aufgeschlossenen und gegenüber Fremden wohlmeinenden TeilnehmerInnen - als eine sehr stabile Denkschablone, die etwa die rechtliche Ungleichstellung von EinwanderInnen als Normalfall erscheinen läßt, die eigentlich nicht hinterfragt werden müsse. In Folge dieser Erfahrungen entstand dieser Vortrag. Er stellt den Versuch dar, deutlich zu machen, daß das deutsche Staatsbürgerrecht auch ein Ausfluß rassistisch-völkischer Denkweise ist. This article deals with the concept and the mode of existence of the Community (Gemeinde) in Switzerland. Following a brief discussion of the origin of the different communities and their present legal groundwork, the significance of individual communities is illustrated by an example – Altstätten in the Rhine Valley (the canton of St. Gall). In addition to the Politische Gemeinde, there exist the Ortsgemeinde which consists of nineteen subdivisions called Rhoden, ten denominational Schulgemeinden and two Roman Catholic and one Protestant Kirchgemeinde. The Politische Gemeinde (political Community) performs all the public tasks of the Community such as the police, the fire brigade, public Utilities, land registry, etc. The Ortsgemeinde (Organisation of the Citizens of Altstätten) has Charge of its own extensive lande property, and reserves the right to decide upon the matters concerned with naturalization and citizenship. The Schulgemeinde (school Community) is responsible for organizing the eight- to nine-year education for children with no Charge. The Kirchgemeinden (parishes) takes care of churchaffairs. Every resident of Altstätten is a member of the Politische Gemeinde and a Schulgemeinde, and, if h belongs to one of the two confessions, also of Kirchgemeinde. Only if he is the Citizen of Altstätten ten, he has a membership in the Ortsgemeinde as
