It is analyzed and concretized from the participatory action on those rulings of the Constitutional Court, focused on highlighting the transversal introduction of due process in labor relations in the private sector, filling the gaps left by the labor law. To that extent, the labor disciplinary process must be structured from the characteristics, principles and purposes of the material and formal labor law, to ensure respect for the human dignity of workers. From the question, does due process have a cross-cutting effect on labor relations in the private sector? Understanding the reflexive analysis of due process as a phenomenon and circumstance of transversalization in labor contracts and private labor relations, from its transdisciplinarity between the disciplinary process and labor law. From the qualitative, transdisciplinary and transversalization approach, deductive, phenomenological and hermeneutic complex method, being explanatory and exploratory. It is corroborated that currently the due process is a dogmatic category within the national legal system that fulfills the ontological function of transversality, the pro homine principle of human dignity in private labor relations. It is a contribution in the labor relations of the private sector, which shows the need to constitutionalize the substantive labor code in relation to the disciplinary due process. Sanctioning Law, conceived in general terms, comprises legal categories within which the State imposes a sanction on individuals for conduct that violates the legal system. Disciplinary Law is one of its aspects which, together with Criminal Law, shares dogmatic categories given their relationship of species to species. However, Disciplinary Law has been recognized jurisprudentially as an autonomous and independent right with differential characteristics. Thus, despite being one more expression of ius puniendi, disciplinary law cannot be understood as dependent on the dogmatic systems of other expressions of the right to sanction. This article discusses the normative structure of Article 57 of Law 1862 of 2017, which structures the Military Forces' disciplinary non-legality, establishing discipline, probity, and service and state purposes as legal goods seemingly incompatibly with the foundations of criminal law. To this end, it reviews the differences between the normative structures and purposes of the disciplinary regime and criminal law. Criminal law seeks to protect legal goods through objective assessment standards, while disciplinary law seeks to establish a model of conduct in public servants through subjective standards of determination. Although the disciplinary law of the Roman Curia and of the Vatican City State has not been thoroughly studied, it ought to be further explored due to its particular nature and field of application. In fact, and with a certain amount of frequency, confusion arises among experts concerning the procedures to be followed in imposing disciplinary sanctions. Disciplinary law relating to work sub umbra Petri is addressed in this study, with particular reference to the two Regulations of the Disciplinary Commissions of the Roman Curia and of the Vatican City State. A comparison is made between the two Regulations in order to bring out the points of parallel and discrepancy, shared features and established limits, in the hope that the latter may be overcome in the future by the canonical and Vatican legislator. 13. The beginnings of disciplinary responsibility of Polish state officials

Objectives Disciplinary liability, implemented in the form of a peer court judging the inappropriate behavior of members of a given corporation, was born on our continent along with the formation of the rule of law. Regulations relating to state officials in Poland were later created due to the weakness of the native clerical corps in the pre-partition period. The first Polish regulations governing the liability of state officials were created in the years 1918 – 1922. The purpose of the work is to show the birth process of disciplinary provisions regulating the disciplinary liability of title officials. Material and methods The work uses a number of unpublished source materials, which have been subjected to detailed analysis. Results As a result of the conducted research, a number of interesting findings were obtained, which became the basis for the development of the presented text. Conclusions Disciplinary law in Poland was born later than other branches of law. Due to the thinness of the clerical corps in the pre-partition period, the disciplinary provisions in relation to this professional group were not sufficiently separated from the entire legal system. However, there were regulations in relation to several other categories of employees treated in a special way. The process of birth of disciplinary law against the title officials began in 1918.

In accordance with the normative guidelines that establish the objectives of the civil service with regard to discipline, its difficulties in their application and efficacity concerning the internal control of the Comptroller General of the Republic appear worrying, suggesting that the objectives of the State are not being fulfilled as required by the 1991 Constitution. Specifically, Article 2 in the Colombian Political Charter addresses the State objectives, and Article 267 ibidem indicates what constitutes the functions and importance of the Comptroller General of the Republic, while Law 734 of 2002 repealed by Law 1952 of 2019 and modified by Law 2094 of 2021 all deal with the regime and internal disciplinary control of state entities. In this light, it is important to study how the Comptroller General of the Republic conducts internal discipline to determine whether it abides by the guidelines established in the Constitution and the aforementioned laws, as well as determine the purpose of the investigations, starting with the investigative phase through to the final decision. This research paper aims to investigate the objectives of the civil service in this disciplinary area, analyze the application and efficacy of the internal control of state entities, and determine the context of application and efficacy regarding the internal control of the Office of the Comptroller General of the Republic. Celem niniejszego artykułu naukowego jest przedstawienie instytucji prawnej, którą jest obowiązująca od 1 października 2018 r., a wprowadzona do systemu prawa na podstawie przepisów ustawy z 20 lipca 2018 r. – Prawo o szkolnictwie wyższym i nauce, mediacja prowadzona w postępowaniu dyscyplinarnym wobec nauczycieli akademickich (mediacja akademicka). W tekście zostaną zaprezentowane: pojęcie mediacji akademickiej, inicjowanie mediacji, zasady postępowania mediacyjnego, przebieg tego postępowania oraz postulaty mające na celu sprawne procedowanie na ten temat. Autor, odwołując się do wyników prowadzonych przez siebie badań naukowych, stawia tezę, że jeśli nie zmienią się przepisy dotyczące mediacji akademickiej oraz praktyka ich stosowania na uczelni, to mediacja nigdy nie będzie skutecznym instrumentem służącym rozwiązywaniu konfliktów na uczelni wyższej. Paweł Czarnecki’s aim in this article is to present the legal measure of mediation conducted in disciplinary proceedings against academic teachers (academic mediation), introduced on October 1st 2018, after the entry into force of the Act of July 20th 2018, Law on Higher Education and Science. Czarnecki discusses the following aspects of this measure: the definition of academic mediation, the procedure of referring a case to mediation, general principles of mediation proceedings, stages of this procedure, and postulates aimed at increasing the efficiency of proceedings in such cases. Based on his analysis of statistical data obtained from Polish universities, Czarnecki puts forward a thesis that, unless the provisions on academic mediation are changed, mediation will not be an effective instrument to help resolve conflicts at a university between the accused academic teacher and the victim.

Cet article porte sur la mutation en cours des prérogatives du droit disciplinaire universitaire, désormais tenu de considérer les infractions sexuelles. Par une étude de cas qui croise entretiens et archives, cet article analyse la cécité de ce droit aux violences faites aux femmes. En raison de sa matrice inégalitaire et de sa dépendance au droit pénal, il continue de prémunir les auteurs de harcèlement de tout stigmate délinquant. Ces procédures résistent ainsi, malgré un contexte propice à la reconnaissance des manquements déontologiques, à une transformation (pro-féministe) des institutions universitaires. This article focuses on the ongoing change in the prerogatives of university disciplinary law, now required to consider sexual offences. Through a case study combining interviews and archives, this paper analyzes its blindness to violence against women. Because of its unequal matrix and its dependence to criminal law, it continues to protect harassers from any delinquent stigma. Despite a context that is favorable to the recognition of breaches of ethical principles, these procedures continue to resist (pro-feminist) challenges from within.

The main objective of this review article is to analyze the private lives of public and civil servants, and their behavior in the public sphere, with a focus on events that resulted in further investigation by the Colombian State with subsequent economic and legal sanctions due to actions underwent in their private lives. An inquiry was made through the means of hypothetical/deductive reasoning, documentary analysis and case studies of disciplinary regimes of the public force, their Disciplinary Code, among others, and their modifications through the jurisprudence of the Constitutional Court and the Council of State, in order demonstrate events in which public service participation was limited. One key finding was the identification of several faults in the disciplinary regimes of the National Police, the National Army, and the Sole Disciplinary Statute of Colombia. These faults allegedly do not constitute a substantial violation of the functional duties of public servants, since the behaviors typified therein do not contradict principles that govern public function. Thusly it would be possible to demonstrate that its inclusion in the law constitutes an affectation to the private life of the public servant. [ABSTRACT FROM AUTHOR]

El derecho disciplinario aplicado por las Instituciones de Educación Superior propende por garantizar la actividad académica e institucional a través de la prevención e imposición de sanciones disciplinarias a los miembros de la comunidad educativa, instituciones en las que debe predominar el fin pedagógico, asegurando siempre el cumplimiento de los planes y programadas desarrollados bajo el cumplimiento de la visión y misión institucional. Con la imposición de sanciones disciplinarias es posible el surgimiento de la tensión entre el principio de autonomía universitaria como garantía y el derecho fundamental a la educación, tensión que se evitaría si la Institución Educativa en cabeza de la autoridad disciplinaria aplica las subreglas condensadas en la presente investigación, las cuales buscan evitar la vulneración de uno de ellos al proteger de manera extrema el otro, ya que ambos derechos deben ser respetado. El derecho fundamental al debido proceso debe ser respetado y garantizado por las Entidades de Educación Superior en aras de no vulnerar el derecho a la educación, permitiendo que las entidades no incurran en arbitrariedades al momento de imponer sanciones disciplinarias a los estudiantes, concretando en este trabajo los aspectos que dichas entidades deben tener presentes. Se analizaron dos sanciones disciplinarias impuestas a estudiantes por parte de las Unidades Tecnológicas de Santander, con la finalidad de determinar la proporcionalidad y la legalidad de las mismas. The disciplinary law applied by the Higher Education Institutions seeks to guarantee the academic and institutional activity through the prevention and imposition of disciplinary sanctions to the members of the educational community, institutions in which the pedagogical purpose must predominate, always ensuring the compliance of the plans and programs developed under the fulfillment of the institutional vision and mission. With the imposition of disciplinary sanctions, it is possible that tension may arise between the principle of University autonomy as a guarantee and the fundamental Right to education, a tension that would be avoided if the educational institution at the head of the disciplinary authority applies the sub-rules gathered in this investigation, which seek to avoid the violation of one of them by protecting the other to the extreme, since both rights must be respected. The fundamental right to due process must be respected and guaranteed by the higher education entities in order to avoid the violation of the right to education, allowing entities not to incur in arbitrariness when imposing disciplinary sanctions to students, specifying in this work the aspects that these entities must take into account. Two disciplinary sanctions imposed on students by the Unidades Tecnologicas of Santander were analyzed in order to determine their proportionality and legality. La presente investigación brinda en su primera parte un amplio panorama en relación con el marco normativo, jurisprudencial y doctrinal nacional e internacional en relación con el tema del derecho a la defensa de las personas privadas de la libertad y el concepto de las relaciones especiales de sujeción. En segundo plano, se podrá apreciar el análisis efectuado a un gran número de procesos disciplinarios que han sido adelantados en contra de personas privadas de la libertad en tres establecimientos carcelarios de orden nacional, donde se aprecia de manera palpable las evidencias encontradas en relación con aspectos sustanciales y procesales. Therefore, the evidence found in relation to substantive and procedural aspects is observed. Teniendo en cuenta que la Ley 1474 de 2011, en su artículo 132, modificó el término de prescripción de los procesos disciplinarios al indicar que, la prescripción de cinco (5) años, para ejercer la acción disciplinaria, comenzaba a contarse a partir del auto de apertura de la investigación disciplinaria. Ahora bien, ¿Qué ocurre si posterior a haberse iniciado un proceso bajo el amparo de esta normatividad, se promulga una ley, que establece que la prescripción de cinco (5) años, se debe computar, desde la ocurrencia del acto o desde el último hecho para las faltas de ejecución continuada, eliminando el término de caducidad de cinco (5) años existente en la anterior regulación? Pues en ese evento, será más favorable la aplicación de la norma posterior al sujeto investigado, por contener una garantía procesal más benéfica. Es precisamente la situación jurídica precedente la que se presenta actualmente, como resultado de que el (Congreso de la República, Ley 1952 de 2019, artículo 33) o Código General Disciplinario [CGD], haya establecido que la prescripción comenzaría a contabilizarse mucho antes de la expedición del auto de apertura; esto es, a partir desde el momento mismo de la realización de la conducta. Por ello, aunque el artículo 22 del CGD, aún no se encuentra vigente, ciertamente, dará lugar a que se promuevan numerosas solicitudes ante las Oficinas de Control Interno Disciplinario de las entidades públicas, o ante las Personerías o Procuradurías que ejercen el poder preferente, para que se aplique la normatividad más favorable, cuando los procesos se encuentren tramitándose bajo la Ley 734 de 2002 y la modificación que en ese entendido realizó la Ley 1474 de 2011, a efectos de solicitar la prescripción de los procesos disciplinarios donde no se haya proferido fallo. Resumen. Este artículo discute la construcción normativa del artículo 57 de la Ley 1862 de 2017, pues parece edificar la antijuridicidad disciplinaria de las Fuerzas Militares con el establecimiento de la disciplina, la probidad, el servicio y los fines estatales como bienes jurídicos, lo cual es incompatible con los fundamentos del derecho disciplinario. Para ello, se revisa la distinción del régimen disciplinario respecto al derecho penal en su constitución normativa y en sus fines: el derecho penal busca proteger bienes jurídicos a través de normas objetivas de valoración, mientras el derecho disciplinario busca establecer un modelo de conducta en servidores públicos a través de normas subjetivas de determinación. Al final se propugna por interpretar los intereses de dicha ley como deberes personales y no como bienes jurídicos, en concordancia con el régimen disciplinario. Abstract. This article discusses the normative structure of Article 57 of Law 1862 of 2017, which structures the Military Forces’ disciplinary non-legality, establishing discipline, probity, and service and state purposes as legal goods seemingly incompatibly with the foundations of criminal law. To this end, it reviews the differences between the normative structures and purposes of the disciplinary regime and criminal law. Criminal law seeks to protea legal goods through objective assessment standards, while disciplinary law seeks to establish a model of conduct in public servants through subjective standards of determination. In the end, it advocates interpreting this laws interests as personal duties and not legal goods, following the disciplinary regime.

At the time of the emancipation of American colonies from the Spanish Crown, at the beginning of the nineteenth century, it was necessary to replace the colonial legal regime with a constitutional regime in accordance with the needs of the new Republic of Colombia and the interests of the triumphant creole aristocracy. Disciplinary law was no exception. Therefore, it is noted that some fundamentals of the disciplinary regime of public officials and state organizations responsible for advancing the investigations appear in each Constitution issued throughout the nineteenth century. This paper presents an analysis on the involvement of the victim in the disciplinary process against State Armed Forces for serious human rights violations and humanitarian Law in Colombia, through review of disciplinary cases. For this, it is necessary to look of the criteria needed which should include the disciplinary process according to the Colombian Law and of the Inter-American Human Rights System, and the assessment made by the Court and Inter- American Commission on Human Rights of the disciplinary inquiries in the decisions that determine the responsibility of Colombia in order to show new elements that promote the discussion on the disciplinary law and allow effective involvement of the victim. Resumen El derecho disciplinario forma parte de la estructura pública inherente a toda organización estatal, independientemente de cual sea su naturaleza, con el fin de vigilar y controlar la conducta de los servidores públicos conforme a los principios rectores contenidos en su respectiva normatividad legal vigente, para permitir el cumplimiento de los fines e intereses del Estado. En ese sentido, dada la naturaleza autónoma e independiente de este derecho, vale la pena destacar los pilares que lo fundamentan, como son el ius puniendi del Estado, el principio de ilicitud sustancial y la relación de sujeción especial que existe entre ciertos agentes con el Estado. Así mismo, al considerar que los fallos disciplinarios proferidos por órganos de control, como la Procuraduría General de la Nación, se adoptan en el marco del quebrantamiento o la perturbación de un deber funcional en el ejercicio de la actividad estatal por parte de servidores públicos o particulares que cumplen funciones públicas, es menester analizar el control pleno e integral de legalidad que efectúa la jurisdicción de lo contencioso administrativo a los mismos, dada la esencia que configura a estas decisiones como actos administrativos, para determinar si es necesario brindarles un tratamiento especial en el ordenamiento jurídico colombiano. Abstract Disciplinary law constitutes a part of the public structure inherent to every state organization, regardless of its nature, in order to monitor and control the conduct of public servants in accordance to the guiding principles contained in the respective current legislation, to allow the fulfillment of the purposes and interests of the State. In that sense, given the autonomous and independent nature of this right, it is worth pointing out the pillars that support it, such as the State's ius puniendi, the principle of substantial illicitly and the special subjection relationship that exists between certain agents with the State. Likewise, considering that the disciplinary rulings issued by the control bodies, such as the Procuraduría General de la Nación (Attorney General's Office), are adopted within the framework of the breach or perturbation of a functional duty in the exercise of the state activity by public servants or particulars who perform public functions, it is due to examine the complete and integral control of legality that the jurisdiction for administrative proceedings applies to them, given the essence that configures these decisions as administrative acts, to determine if it is necessary to provide them with a special treatment in the Colombian legal system.

En Colombia nos encontramos en un espacio coyuntural realizando una transición entre el Código Disciplinario Único, ley 734 de 2002 y el llamado Código General Disciplinario, Ley 1952 de 2019. Estos cambios, derogatoria y modificaciones se realizan por la dificultades procesales de las partes en audiencias y tramites; las confusiones presentadas están originadas básicamente en el poder sancionatorio y coercitivo del Derecho Disciplinario tratando de relacionarlo al Derecho penal. Estas mismas son las que abordaremos y buscaremos clarificar respecto a su mejoría. La función pública de estos servidores se materializa, ejecuta y se exterioriza frente a la colectividad a través de la dinámica que le imprime el servicio público, por tal razón estos sujetos deben tener control por parte del Estado y asegure una doble vía, de un lado se ejecuten las conductas exigidas por el poder supremo y por otra parte la colectividad reciba como contraprestación un adecuado servicio de acuerdo a sus peticiones; en este contexto es que aparece la necesidad de un derecho regulador de esta actividad funcional del servidor público. In Colombia we are in a conjunctural space making a transition between the Single Disciplinary Code, Law 734 of 2002 and the so-called General Disciplinary Code, Law 1952 of 2019. La corrupción hoy en día es una de las principales preocupaciones de la sociedad. Son varios los casos y razones que hacen que las personas se pregunten qué tan eficiente es el Estado a la hora de combatirla. En años recientes el enfoque ha estado en la sanción de los responsables de faltas contra la administración pública y el erario, sin embargo, tal orientación no es del todo efectiva. Es por eso, que este artículo busca reflexionar en torno a los mecanismos jurídicos que existen en Colombia para enfrentar esta problemática, en especial se realizara un examen del nuevo Código General Disciplinario y su papel en la prevención y sanción de la corrupción. Disciplinary law consists of a set of substantive and procedural juridical norms intended to set certain reproachable actions foreseeing the penalties that can be imposed to a number of people through a special procedure. As punitive law, it consists of types which set facts and relevant penalty; however, they hold a flexible structure in disciplinary issues. This article states and concludes that incomplete norms may affect the due process. RESUMEN Con el presente trabajo se abarca de forma específica aspectos importantes introducidos en la reforma del Régimen Disciplinario establecida en la Ley 1952 de 2019, así mismo se indica el alcance de la Procuraduría frente a la competencia para investigar y sancionar a los servidores en un proceso sin desconocer y garantizar el derecho fundamental de acceso a la administración de justicia y al debido proceso de los mismos, es de indicar que la norma nueva contuvo modificaciones de aspecto procesal en materias como la doble instancia y ampliación de garantías constitucionales en etapas investigativas y en otros tipos de procesos y así mismo en la parte sustancial se introduce taxativamente figuras jurídicas como el dolo y la culpa al derecho disciplinario para afincar la parte procesal del derecho disciplinario. finalmente se percibe que la reforma al Régimen Disciplinario estuvo dirigida principalmente por un eje garantista que buscó en principio la no vulneración de los derechos humanos y políticos de implicados en casos disciplinarios en curso. ABSTRACT This paper specifically covers important aspects introduced in the reform of the Disciplinary Regime established in Law 1952 of 2019, It also indicates the scope of the Office of the Attorney-General as opposed to the competence to investigate and punish servers in a process without disregarding and guaranteeing the fundamental right of access to the administration of justice and to due process thereof, It should be noted that the new norm contained procedural modifications in matters such as double instance and extension of constitutional guarantees in investigative stages and in other types of processes and likewise in the substantial part, legal figures such as fraud and guilt are exhaustively introduced. to disciplinary law to establish the procedural part of disciplinary law. Finally, it is perceived that the reform of the Disciplinary Regime was directed mainly by a guarantee axis that sought, in principle, the non-violation of the human and political rights of those involved in ongoing disciplinary cases..
