Abstract

With the arrival of name, image, and likeness (NIL), the college sports labor market has distinctly taken on similar characteristics to the gig economy, with athletes able to earn extra compensation through external NIL-based independent contractor "gigs." But with this comparison comes comparable issues, and scholarship and litigation examining and challenging gig economy structures have identified several legal and ethical concerns both individual to each worker and more broadly affecting labor markets. Building off this literature, we conceptualize the NIL phenomenon within the gig economy space, exploring the legal and ethical concerns that have plagued companies like Uber and applying those same concerns to the brave new world of NIL-fueled college sports. We not only find similar issues in college sports but also find even deeper concerns based on new and existing challenges unique to the novel space of college sports, particularly given the increased proliferation of NIL collectives. Abstract

In October 2016, Fédération Internationale de Football Association (FIFA) announced a landmark reform package that ushered in a new era of global football governance known as FIFA 2.0. Despite decades of profitability for its most visible event - the Men's World Cup (MWC) - FIFA's leadership had come under intense scrutiny following a corruption and bribery scandal over the MWC selection process and hosting approaches. In this article, we use a critical investigative framework to examine the conjunctural politics of FIFA 2.0 through a critical analysis of official FIFA documents, published media reports, and official bid documents for the 2026 MWC - the first in the FIFA 2.0 era. By selecting the United 2026 bid, FIFA seemingly moved beyond market expansionism and urban redevelopment strategies, seeking instead to functionally and symbolically (re-)imagine the event's purpose as a principal agent for promoting global peace, unity, and international diplomacy. We offer a rich genealogy of FIFA's growing presence in global geopolitics – an approach we theorize as global peacemaking – and argue that FIFA's approach is a rationally and purposefully constructed organizational strategy aimed at exploiting the material and symbolic value(s) of global unity, peace, and international diplomacy as a means of capital accumulation, neoliberal marketization, and an intensification and consolidation of FIFA's global football empire. We discuss how FIFA's global peacemaking has accelerated the commercialization MWC and led to an increasingly interdependent and mutually constitutive relationship between the MWC and FIFA. 4. The Spirit of Aggieland: Neoliberalism, Militarization, and Football Culture at Texas A&M University

Abstract

Significant scholarship exists indicating an increase in militarization within the neoliberal university (see Armitage 2005; Giroux 2008; Giroux 2013), which has transformed the academic institution into "a factory that is engaged in the militarization of knowledge, namely, in the militarization of the facts, information and abilities obtained through the experience of education" (Armitage 2005, 221). The lack of research on intercollegiate athletics' role within this transformation is particularly problematic, given the highly visible role intercollegiate athletics play in publicly reproducing the logics of the neoliberal university (see Sperber 2001; Toma 2003; Bass, Newman, and Giardina 2012). Whereas Butterworth and Moskal (2009) have discussed this in regards to college football's postseason bowl competition, a significant gap in the literature still exists regarding the promotion of military and neoliberal doctrine through the spectacle of sports on college campuses. This study expands on their work by focusing on Texas A&M University and its militarized (and militarizing) traditions, examining how the commodification of military spectacle implicates members of the university community.

7. Putting the First Amendment in Play: Name, Image, and Likeness Policies and Athlete Freedom of Speech

Abstract

Following a unanimous defeat at the Supreme Court in National Collegiate Athletic Association (NCAA) v. Alston and facing an impending start date for various state laws that would force action on athletes’ ability to profit off their name, image, and likeness (NIL), the NCAA recently made the decision to simply allow states and member colleges and universities to promulgate NIL restrictions on their own. But while such a delegation helps the NCAA stave off relevant antitrust action against them, placing regulatory authority over college athlete endorsement and sponsorship deals in the hands of government actors like state legislators, governors, and public educational institutions brings constitutional analysis into play in a way that has not previously been seen in sports due to the wholly private natures of sports leagues and the NCAA. Along these lines, this Article applies First Amendment jurisprudence to three recurring NIL restrictions imposed by states and schools: (1) restrictions on athlete deals that conflict with institutional endorsement deals; (2) restrictions on athlete deals with vice industries like gambling and alcohol; and (3) broad restrictions on deals that conflict with undefined “institutional values.” To do so, we apply several First Amendment doctrinal frameworks—those concerning commercial speech, student speech, public employee speech, and the overbreadth doctrine—to provide a range of different means by which courts may interpret how the rights of college athletes are affected by NIL policies. In the end, we find that the nature of these restrictions as overbroad prior restraints of free speech creates significant doubt as to the constitutionality of many of these restrictions under the First Amendment. We conclude that such restrictions in no uncertain form “present a ‘realistic danger’ [that these actors] could significantly compromise recognized First Amendment protections,” including the advanced protections for political speech.

Abstract

Understanding fans' perceived associations with their favorite teams is crucial for the successful management of sport teams. In the current study, team brand associations are measured as a reflective-formative construct to examine the role of the fan identification on the relationship between team brand associations and behavioral intentions. Data from professional soccer spectators (n = 101) were analyzed using PLS-SEM. The results indicated that the reflective-formative construct of team brand associations and fan identification influence behavioral intention, whilst fan identification was found to mediate the relationship between team brand associations and behavioral intentions. Managerial implications include strategic marketing how sport team managers can alter their team brand associations to foster the relationship between fans and teams. [ABSTRACT FROM AUTHOR]
