The article discusses the three memoranda on the obligations of prosecutors to provide exculpatory evidence issued by the U.S. Department of Justice (DOJ) in January 2010. There are at least three sources in which the obligations to provide exculpatory evidence in federal criminal prosecutions are based. These include the due process clause of the Fifth Amendment of the Constitution, the Federal Rules of Criminal Procedure (FRCrP) and ethical obligations of prosecutors. A prosecutorial misconduct case involving Alaska Senator Ted Stevens is also tackled.
