In order to cope with the COVID-19 crisis, the French Parliament has adopted an Act creating a new emergency powers regime, dubbed state of health emergency, which is currently in force. The present paper aims at analysing and providing a critical appraisal of this regime. In particular, it will be demonstrated that this regime is rather imbalanced in that it confers important powers to the executive with limited checks and balances. It will also be contended that the creation of a new regime was not necessary, and that it would have been wiser to amend the existing state of emergency.

This article seeks to expose the state, as of February 28th, 2018, of the negotiations between the European Union and the United Kingdom on the exit of the latter (the process being called “ Brexit”, in reference to the British exit). After briefly tracing its legal and political background, the general principles determined by the European Union (and accepted by the United Kingdom) for the negotiation of Brexit will be presented. Then, the article presents the main elements of the tentative agreement concluded by the United Kingdom and the European Union in December 2017, on the fundamental aspects related to an “ orderly withdrawal” of the United Kingdom. This includes the rights of citizens, on the one hand, and the calculation method for the “ invoice” of what is owed by the United Kingdom and Ireland, on the other hand. Inasmuch as it is possible to trace it at this stage in the negotiations, the position of the European Union as concerns its “ future relations” with the United Kingdom will be also be presented., Le présent article entend faire le point, à jour le 28 février 2018, des négociations entre l’Union européenne et le Royaume-Uni concernant la sortie de ce dernier (le processus appelé «Brexit » , pour «British exit » ). Après avoir retracé brièvement l’arrière-plan juridique et politique, seront présentés les principes généraux posés par l’Union européenne (et acceptés par le Royaume-Uni) pour la négociation du Brexit. There are several ways to define the institutional balance in the European Union. First, the institutional balance can be understood as a ‘fact’; namely, the actual balance of powers between institutions that one can observe when looking at the way EU institutions operate with one another, along with its evolution through time and the identification of possible trends for the future. Second, the institutional balance can be seen as a normative principle – that is, what the balance between institutions should be. Third, the institutional balance can be seen as a legal principle, used and enforceable by the Court of Justice. This is the meaning that I will use in this chapter. The Court of Justice defined the institutional balance in the Chernobyl case. In this ruling, the Court found that ‘the Treaties set up a system for distributing powers among the different Community institutions, assigning to each institution its own role in the institutional structure of the Community and the accomplishment of the tasks entrusted to the Community’. In this context, ‘observance of the institutional balance means that each of the institutions must exercise its powers with due regard for the powers of the other institutions’. It serves therefore as a principle of mutual respect between institutions as regards their respective remits and attributions. The main question about the institutional balance is whether the institutional balance is a ‘general principle of EU law’. I will argue here that the institutional balance is indeed a general principle of EU Law. This conclusion does not derive unambiguously from the case-law of the Court. Quite the contrary, there has been important fluctuations in the case-law of the Court, to the extent that we can talk about three ‘ages’ of the institutional balance. The view that the institutional balance is a general principle is not unanimously shared. I will try to address several objections to this classification before concluding.

National audience; Que reste-t-il aujourd'hui de l'héritage juridique de Vichy 70 ans après l'ordonnance du 9 août 1944 relative au rétablissement de la légalité républicaine ? Les différentes contributions à cet ouvrage tentent l'analyse, à travers l'étude de différentes branches du droit, des modalités comme du contexte institutionnel, ayant permis à l'intense production normative du régime de Vichy de se greffer au corpus législatif républicain. Puis comment, à la Libération, se sont perpétuées nombre de mesures vichystes, souvent intégralement conservées dans le nouvel ordre légal sans guère d'adaptations. Reprise accidentelle ou intentionnelle ? Oubli inhérent à l'urgence ou au contraire marque, sur certains points, d'une indéniable concordance idéologique ? Peut-on encore évoquer aujourd'hui, de fait, une rupture radicale plutôt qu'une continuité partielle entre la IIIe République agonisante et Vichy, puis entre Vichy et les IVe et Ve Républiques ?Telles sont les questions auxquelles s'efforce de répondre ce volume d'actes du colloque pluridisciplinaire tenu à l'Université Savoie Mont Blanc les 23 - 24 octobre 2014, à l'invitation du Centre de Droit Public et Privé des Obligations et de la Consommation (CDPPOC) de la Faculté de droit de Chambéry, en partenariat avec le Centre d'Etudes et de Recherches Comparatives sur les Constitutions, les Libertés et l'Etat (CERCCLE), et le Centre de Recherche et de Documentation Européenne et internationales (CRDEI) de l'Université de Bordeaux.

La loi no 69-3 du 3 janvier 1969 institue un regime derogatoire du droit commun a l’egard des Gens du voyage. Sollicitee en ce sens, la Clinique juridique des droits fondamentaux souleve les restrictions apportees aux droits et libertes des interesses (droit a la libre circulation, droit de vote, etc.) et en interroge la constitutionnalite et la conventionnalite. Ce travail a pour finalite de soutenir les avocats et les associations specialisees dans leurs recours devant differentes instances juridictionnelles.

This research argues that the European Court of Justice, with its interpretative action, plays a major role in defining fundamental rights for irregular migrants in the EU. The limited competences of the EU in migration matters, shared with the Member States (Article 4(2)(j) TFEU), have not prevented the Court of Justice from affirming general principles of law that have marked the development of European legislative activity, to the point of thwarting the law enforcement action highlighted by the Member States and sometimes by the EU itself. Nevertheless, the interpretation made by the CJEU of primary and secondary law in the light of the EU Charter of Fundamental Rights encounters major limitations when it comes to criminal and administrative litigation on illegal immigration. The first part of the study is dedicated to the limits of the interpretative action of the CJEU. As the territorial dimension is the central thread of the research, the analysis of case law shows the obstacles to effective action by Luxembourg judges in the face of repression "before entry" and "on exit" of migrants. Indeed, both the agreements taken by the EU or by its Member States with third countries to prevent departures, and the readmission agreements aimed at the return of migrants in an irregular condition to their country of origin or to transit countries are often outside the competence of the CJEU. The second part focuses on the practices of repression of irregular migration on the territory of the EU. The importance of the preliminary ruling mechanism (Article 267 TFEU) will be highlighted from the criminal litigation on the criminalisation of migration and the administrative litigation on the repression of the same phenomenon. While the effectiveness of the action of the CJEU is obvious in the internal dimension of the repression of migration, the analysis of its case law on the external dimension of repression shows the need for harmonisation that EU migration policy needs today.; L’étude défend la thèse selon laquelle la Cour de justice de l’Union européenne, avec son action interprétative, joue un rôle majeur dans la définition du niveau de protection des droits fondamentaux des migrants en condition irrégulière dans l’UE. Les compétences limitées de l’UE en matière migratoire, partagées avec les États membres (article 4, § 2, lettre j TFUE), n’ont pas empêché la Cour de justice de contrecarrer l’action répressive mise en exergue par les États membres et parfois par l’UE elle-même. Néanmoins, l’interprétation faite par la CJUE du droit primaire et dérivé à la lumière de la Charte des droits fondamentaux de l’UE rencontre des limites majeures lorsqu’elle vise le contentieux pénal et administratif portant sur l’immigration irrégulière. La première partie de l’étude est consacrée aux limites de l’action interprétative de la CJUE. La dimension territoriale étant le fil conducteur de la recherche, l’analyse de la jurisprudence montre les obstacles qui s’opposent à une action efficace des juges de Luxembourg face à la répression « avant l’entrée » et « à la sortie » des migrants. En effet, tant les accords pris par l’UE ou par ses États membres avec des pays tiers pour empêcher les départs, que les accords de réadmission visant les retours des migrants en condition irrégulière vers leur pays d’origine ou vers des pays de transit se placent souvent à l’extérieur des compétences de la CJUE. La deuxième partie se concentre sur les pratiques de répression des migrations irrégulières sur le territoire de l’UE. L’importance du mécanisme du renvoi préjudiciel (article 267 TFUE) sera mise en exergue à partir du contentieux pénal sur la criminalisation des migrations et le contentieux administratif sur la répression du même phénomène. Si l’efficacité de l’action de la CJUE manifeste son ampleur dans la dimension interne de la répression des migrations, l’analyse de sa jurisprudence touchant la dimension externe de la répression permet de montrer le besoin d’harmonisation dont la politique migratoire de l’UE a besoin aujourd’hui.

At present cases Burkinabè, Beninese and Senegalese, we propose to analyze the constitutional and electoral rules that determine the mode of accession and the exercise of state power. It raises the question of the role of these rules and these institutions in the avenue of the democratic alternation and that of the social environment and the policy of the audit and the authority of the constitutional judges in its advent or his questioning on the other hand. The United States has, in fact, opposed standards and institutions. They have been authenticated by democratic electoral institutions. This is a new time of a new constitution, is this is a self-review, as to it, as work of the building of the edition of 1990, as-it-it-it be carriers of institutions able to promote the occurrence of democratic alternation. As we can see, the constitutional order is today constantly paraded. The constitutional impulse that has propelled states towards the path of constitutional democracy has halted or slowed down in many states in favor of a pregnant presidentialism, but it is also observed that 'democratic alternation has been experienced, democratic conquests have not have not been followed by the satisfaction of the social demands that have yet been inspired. Elle pose la question du rôle de ces règles et des institutions dans la survenue de l‟alternance démocratique d‟une part et de celui de l‟environnement social et politique de même que de l‟audace et de l‟autorité des juges constitutionnels dans son avènement ou dans sa remise en cause d‟autre part. Les Etats africains se sont, en effet, dotés de mécanismes normatifs et institutionnels permettant la tenue régulière d‟élections démocratiques sous la conduite d‟institutions électorales indépendantes chargées de garantir des changements véritablement démocratiques de gouvernement.Cependant, au regard de l‟actualité politique ambiante marquée par un reflux du nouveau constitutionnalisme lequel est caractérisé par une remise en cause de l‟édifice institutionnel issu de la vague de démocratisation des années 1990, on peut se demander si les principes consacrés dans les nouvelles constitutions peuvent être des facteurs de réalisation de l‟alternance démocratique. Comme on le voit, l‟ordre constitutionnel est aujourd‟hui constamment rompu soit par des révisions constitutionnelles, soit par des coups d‟Etat, soit encore par des accords politiques qui ont la particularité de participer à un processus de « déconstitutionnalisation ».Non seulement l‟élan constitutionnel qui devait propulser les Etats sur la voie de la démocratie constitutionnelle a été stoppé ou ralenti au profit d‟un présidentialisme prégnant, mais également l‟on observe que même là où l‟expérience de l‟alternance démocratique a été vécue, les conquêtes démocratiques n‟ont pas été suivies de la satisfaction de la demande sociale qui, pourtant, a généralement inspiré les réformes. La Thèse, tout en mettant le doigt sur les failles des dispositifs normatifs et politico-institutionnels mis en place, comme étant des facteurs favorisant les manipulations dévoyées des normes, insiste aussi sur la figure du juge constitutionnel marquée par sa faible contribution à la consolidation de la démocratisation.

This study focuses on the evolution of two processes, the internationalization of South American constitutions and the constitutionalizing of international law within South American states. We analyze the existence or absence of a trend in the status of international law within the Constitutions in the region. To do this, there is a four-step reasoning. The first step devoted to the analysis of the causes of the inclusion of international law within the Constitutions, the second step dedicated to the study of the constitutional recognition of international law not under agreement, in a third step we will measure the influence of international law and the distribution of powers of the branches of public power on the conclusion of treaties. Finally, in a fourth step, it is the constitutional value of the treaties within the South American Constitutions which will allow us to identify the atypical position of human rights treaties and their privileged place in the legal order internal.; Cette étude porte sur l’évolution de deux processus, à savoir l’internationalisation des Constitutions sud-américaines et la constitutionnalisation du droit international au sein des Etats sud-américains. Nous analysons l’existence ou l’absence d’une tendance dans le statut du droit international au sein des Constitutions dans la région. Pour ce faire, il y a un raisonnement en quatre étapes. La première étape consacrée à l’analyse des causes de l’inclusion du droit international au sein des Constitutions, la deuxième étape dédiée à l’étude de la reconnaissance constitutionnelle du droit international non conventionné, dans une troisième étape nous mesurerons l’influence du droit international et de la répartition des compétences des branches du pouvoir public sur la conclusion des traités. Finalement, dans une quatrième étape, c’est la valeur constitutionnelle des traités au sein des Constitutions Sud-Américaines qui va nous permettre d’identifier la position atypique des traités des droits de l’homme et de leur place privilégiée dans l’ordre juridique interne.

The phenomenon of destatization of the use of the notion of general interest raises questions with regard to the role that this concept plays in the system of the European Convention on Human Rights. In the context of the European Convention, the general interest does not manifest itself as a concept consubstantially linked to the State. Indeed, the indeterminate, flexible and functional nature of the general interest allows the use of this concept by various actors of the system of the European Convention and facilitates its integration into this system. Faced with the diversity of users of the concept of general interest, the use by the European Court of Human Rights stands out in particular because of its power of authentic interpretation. This makes it possible to question the existence of a conception of the general interest specific to the system of the Convention and to research the functions of general interest in this context.; Le phénomène de désétatisation de l’utilisation de la notion d’intérêt général conduit à s’intéresser au rôle que cette notion joue dans le cadre du système de la Convention. Dans le contexte de la Convention européenne des droits de l’Homme, l’intérêt général ne se manifeste pas seulement comme un concept consubstantiellement lié à l’État. En effet, la nature indéterminée, flexible et fonctionnelle de l’intérêt général permet l’utilisation de cette notion par les divers acteurs du système conventionnel et facilite, par conséquent, son intégration dans ce même système. Face à une diversité des utilisateurs de la notion d’intérêt général, l’utilisation effectuée par la Cour européenne des droits de l’Homme se démarque en particulier en raison de son pouvoir d’interprète authentique. Cela permet de s’interroger sur l’existence d’une conception de l’intérêt général propre au système de la Convention ainsi que sur les fonctions que l’intérêt général occupe dans le cadre de ce système.

Legal literature has shown that the administrative decisions adopted by national administrations within the scope of EU law may have extraterritorial effects. By challenging the principle of territoriality of public law, this phenomenon opens a new field of study whose object is the transnational dimension of administrative activity. Through the study of administrative cooperation between Member States, this work explores the establishment of a system of recognition of administrative decisions in the European administrative space.; La littérature juridique a montré que les décisions administratives adoptées par les administrations nationales dans le champ d’application du droit de l’Union européenne peuvent avoir des effets extraterritoriaux. En remettant en cause le principe de territorialité du droit public, ce phénomène ouvre un nouveau champ d’étude qui a pour objet la dimension transnationale de l’activité administrative. A travers l’étude de la coopération administrative entre Etats membres, ce travail explore la mise en place d’un système de reconnaissance des décisions administratives dans l’espace administratif européen.

The European Charter for Regional or Minority Languages adopted in 1992 is the only international treaty dealing exclusively with linguistic diversity. It lays down obligations which are interpreted by the State parties and by the Committee of Experts, a monitoring body established by the Charter. Adding up the Charter’s obligations amounts to the existence of a language policy aiming for the protection and the promotion of regional or minority languages. Therefore, when interpreting these obligations, both the States and the Committee define the framework of the language policy. In so doing, the interpretation of legal norms and the existence of a public policy become connected. This connection is not neutral as the language policy uses the Charter’s obligations in order to achieve its objective : the protection and the promotion of regional or minority languages. This « instrumental » conception of the obligations layed down by the treaty does have an impact on their interpretation. It influences the States’ interpretation by transforming the content of the acts they adopt when implementing the treaty. As for the Committee of Experts, the requirements resulting from its interpretation are also influenced by the language policy’s objective. Thus, the common construction of the language policy by the interpretation provided by the States and by the monitoring body of the Charter involves a more general reflection on the changing nature of law when it aims to deal with and transform complex social realities.; La Charte européenne des langues régionales ou minoritaires de 1992 est la seule convention internationale ayant pour objet exclusif la diversité linguistique présente dans les Etats. La manière dont le traité se saisit de cet objet consiste à prévoir plusieurs obligations qui sont interprétées tant par les Etats parties que par le Comité d’experts, organe chargé du contrôle du respect de la Charte. Or, l’addition de ces obligations prévues par la Charte équivaut à l’existence d’une politique publique linguistique ayant pour objectif la protection et la promotion des langues régionales ou minoritaires. Ainsi, à travers leur interprétation des obligations, les Etats et le Comité d’experts construisent d’une manière concertée cette politique publique linguistique. Dans cette configuration, nous assistons au contact entre l’opération d’interprétation des normes juridiques, question centrale de la science du droit, et l’existence d’une politique publique, modalité d’intervention de l’Etat intéressant la science politique. Ce contact entre les deux éléments n’est pas neutre. En effet, la politique publique linguistique utilise les obligations de la Charte comme des instruments afin de parvenir à l’objectif qu’elle s’est fixée : la protection et la promotion des langues régionales ou minoritaires. Cette instrumentalisation a un impact sur l’interprétation de ces obligations que celle-ci soit fournie par les Etats ou par le Comité d’experts. En ce qui concerne l’interprétation des Etats, l’influence se manifeste par une certaine transformation de la substance des actes étatiques relevant de la mise en œuvre des obligations de la Charte. Pour ce qui est du Comité d’experts, les exigences des obligations, telles qu’elles résultent de son interprétation, sont également surdéterminées par l’objectif de la politique publique linguistique. Par conséquent, la construction concertée de la politique publique linguistique par l’interprétation des États et par l’interprétation du Comité d’experts nous invite à réfléchir, d’une manière plus générale, sur les transformations subies par le droit lorsqu’il entend s’emparer et transformer des réalités sociales complexes.

International audience; L’objectif de cette contribution est d’orienter l’analyse dans deux directions. La première nous conduit sur le terrain du droit pénal spécial. L’objectif paraît, de prime abord, relativement simple : il s’agit de rechercher d’éventuels textes d’incriminations créés sous Vichy et qui n’auraient pas été abrogés à la Libération. Il sera également question de vérifier si le durcissement du régime de certaines peines a été entériné. La seconde direction oriente le débat sur le terrain des idées, des doctrines pénales et de la politique criminelle. En effet, la thématique du colloque invite à dépasser la simple énumération de textes qui pourraient avoir subsisté. Elle incite à s’interroger, de manière peut-être quasi intuitive, sur des questions de cet ordre : de l’après guerre à aujourd’hui, la politique pénale sous Vichy a-t-elle influencé, peu ou prou, le législateur contemporain ? Ou encore pour affiner le propos : l’attrait du régime de Vichy pour les juridictions spécialisées et plus généralement pour l’exception ne trouve-t-il pas un écho dans certaines orientations plus actuelles du droit pénal de fond et de forme ? Certaines techniques juridiques de catégorisation de la population pénale, caractéristiques du régime de Vichy, ne se retrouvent-elles pas plus ou moins explicitement dans des textes récents ?

In the political, economic, and cultural status quo, constitutional justice has been developed in both Egypt and France. From the legal perspective, it has been realized that various difference between both countries within the mechanism of the constitutional review of laws. Recently, the development of this legal issue in both countries leads to some of similarities between the mechanism in both Egypt and France, especially on the procedural level. Egypt adopted the same French scheme in 2005 with respect to some of the election laws. Further, France adopted the same constitutional review as Egypt via subordinate claim in 2008. But that does not mean that the constitutional review in both countries include only the procedural levels but also the main principle of the legal constitutional reviews in Egypt and France; Dans un contexte politique, économique et culturel différent, la justice constitutionnelle se développe en Égypte et en France. D’un point de vue purement juridique, le contrôle de constitutionnalité des lois s’exerce dans les deux pays selon une procédure différente. Le développement du contrôle de constitutionnalité des lois dans les deux pays avait, toutefois, pour effet de reproduire progressivement des rapprochements quant au contrôle de constitutionnalité des lois. L’Égypte établit en 2005 un mécanisme a priori sur la constitutionnalité des certaines catégories des lois électorales. De son côté, la France finit en 2008 par inaugurer un mécanisme du contrôle a posteriori (la QPC). Cette thèse propose de montrer que la justice constitutionnelle dans les deux pays s’appuie sur les mêmes fondements, tant sur un plan matériel que formel. Le contrôle exercé par la Cour constitutionnelle dans chacun des deux pays peut être considéré comme une application du modèle européen de justice constitutionnelle adaptée aux différentes données politiques, juridiques, économiques et culturelles de chacun de deux pays.
