This article examines the role of policy entrepreneurs in countering regulatory capture, a phenomenon whereby regulatory bodies influenced by industry lobbying often prioritize private over public interests. The study employs an abductive process‐tracing approach to investigate the 2013 drug pricing reform in Morocco, illustrating how substantial policy shifts can occur even in authoritarian contexts susceptible to regulatory capture. The findings underscore the pivotal role of Houcine El Ouardi, the former Minister of Health, whose strategic leadership exemplified policy entrepreneurship. His capacity to navigate and surmount industry resistance was instrumental to the reform's success, culminating in a significant reduction in drug prices. This case challenges conventional wisdom regarding regulatory capture, demonstrating that individual agency can reshape regulatory outcomes despite opposition. By elucidating how policy entrepreneurs can drive transformative change in resistant regulatory environments under authoritarian regimes, the study contributes to the literature on policy entrepreneurship and regulation. This article assesses the impact of the Municipal Basic Sanitation Plan (PMSB) and the Municipal Basic Sanitation Policy (PolMSB) on the efficiency of basic sanitation service providers in the municipalities of Santa Catarina. In the first stage, the Data Envelopment Analysis (DEA) method is used to obtain sanitation companies’ efficiency scores for the period from 2012 to 2020. In the second stage, the Tobit model is combined with the Differences in Differences (DiD) method to verify the effect of environmental variables, including PMSB and PolMSB, on the efficiency of signed contracts. The results show that regulation did not promote efficiency concerning maximizing the sector’s production – within the observed period – which showed a decline over the years. Another finding is that sanitation companies operated by municipal public authorities, with the exception of local authorities, demonstrate greater efficiency than private operators. This paper presents a comparative law study that documents and analyzes various regulatory approaches to cryptocurrencies adopted internationally. It particularly focuses on the criminal aspects addressed by these regulations, aiming to assess how legal and punitive actions in this area are profoundly influenced by socio-economic interests, which may vary even within the same state. This variability, along with other factors, contributes to one of the most challenging aspects of virtual assets: their fragmented and heterogeneous regulation. Based on the research findings, a range of punitive intervention levels is proposed, which has significant implications for the criminal policy adopted in the context of cryptocurrencies. El artículo describe la modernización del sector eléctrico argentino en los años 1990s, impulsada por cambios tecnológicos, privatización y regulación a través de agencias especializadas, dentro de un contexto macroeconómico de estabilización. Tras la crisis de 2001, las tarifas fueron congeladas, lo que generó distorsiones con fuertes subsidios y menos influencia de las herramientas de mercado. El trabajo plantea la exploración de nuevas organizaciones institucionales que incentiven la modernización como en los 1990s, pero que también aborden problemas regulatorios relacionados con la inversión en generación, equidad distributiva y desarrollos tecnológicos recientes como la generación distribuida, energías renovables y medidores inteligentes. Se cuestiona el impacto de las reformas de los 1990s, se analizan experiencias positivas y negativas, y se discuten posibles diseños institucionales que promuevan eficiencia, equidad y una transición ordenada hacia la nueva tecnología.

El objetivo de este artículo es presentar un enfoque sociológico-jurídico, sobre todo basado en la teoría de los sistemas sociales, sobre el problema de la desinformación masiva a través de redes y plataformas digitales. Para tanto, el trabajo analiza las fake news como un fenómeno emergente a partir de una transformación estructural en los medios de diseminación de la comunicación, y en seguida enfoca el caso de la regulación brasileña sobre el tema. La hipótesis directiva de la investigación es de que es posible identificar un paquete de estrategias de aprendizaje regulatoria por el sistema jurídico. El texto aborda sobretodo el caso de fake news sobre el tema de la salud. Desde el punto de vista jurídico, una cuestión importante es saber si la difusión de fake news es susceptible de control, especialmente a través de formas de prevención y no sólo a través de la represión de los daños.

This study examines the limits of professional practice in the field of comprehensive esthetics and related areas in Ecuador. A mixed methodological approach was used, including document analysis, practitioner surveys and expert interviews. The central objective was to identify and examine discrepancies between existing regulation and actual practice, along with their implications for patient health and safety. The findings revealed confusion in terminology, diversity in professional training, and lack of regulatory awareness. In addition, it was observed that non-medical professionals perform invasive procedures, despite being prohibited by Ecuadorian law. In conclusion, it is necessary to review and strengthen regulation, as well as improve professional training, to ensure safe and ethical practice in the field of comprehensive esthetics in Ecuador. We are witnessing a new space race. In the past few years, the number of successful launches to low Earth orbit has been higher than at any time since Sputnik. Commercial space companies, led by SpaceX and Blue Origin, have developed reusable rockets that are fundamentally changing the economics of spaceflight and opening new markets for recreation and tourism. Large numbers of small satellites are being deployed to monitor Earth resources and deliver high speed Internet to developing countries. Meanwhile, a growing number of countries have built space programs, and a superpower rivalry between China and America has replaced the traditional competition between Russia and America. All this activity raises legal and ethical issues. Space debris is accumulating at a rapid rate, creating a hazard for humans and hardware in low Earth orbit. Currently, there is no real incentive for companies or governments to mitigate this threat. The ownership of space resources is not covered by international law and in most countries, spaceflight is subject to very little regulation. Another concern is the potential militarization of space by the major powers. As we explore space, exploitation may be taking precedence over conservation. The emergence of increasingly capable artificial intelligence (AI) systems has raised concerns about the potential extreme risks associated with them. The issue has drawn substantial attention in academic literature and compelled legislators of regulatory frameworks like the European Union AI Act (AIA) to readapt them to the new paradigm. This paper examines whether the European Parliament's draft of the AIA constitutes an appropriate approach to address the risks derived from frontier models. In particular, we discuss whether the AIA reflects the policy needs diagnosed by recent literature and determine if the requirements falling on providers of foundation models are appropriate, sufficient, and durable. We find that the provisions are generally adequate, but insufficiently defined in some areas and lacking in others. Finally, the AIA is characterized as an evolving framework whose durability will depend on the institutions' ability to adapt to future progress. [ABSTRACT FROM AUTHOR]

La revolución de la tecnología y las telecomunicaciones ha permitido la innovación en modelos de negocios mediante el uso de plataformas, en particular las de domicilios, que han generado un ecosistema de gestión por algoritmos que en muchos casos somete a los trabajadores a condiciones de control y precarización de sus actividades. El caso de Rappi es un ejemplo de uso de la innovación para la precarización de los trabajadores incluso con la negación misma de su carácter de trabajador, mas aun en contextos como el colombiano con una estructura laboral precaria y una clase empresarial rentista. Este trabajo analiza el caso Rappi en Colombia por medio del uso de entrevistas y encuestas realizadas entre el 2021 y el 2024.

El presente artículo examina la regulación y aplicación de la aprobación administrativa de cláusulas generales de contratación en el contexto peruano, con énfasis en los sectores de servicios financieros y telecomunicaciones. Se destaca y cuestiona la importancia de esta aprobación para la protección de los consumidores. Además, se discuten las discrepancias jurisprudenciales sobre la impugnación de estas cláusulas. En suma, el artículo ofrece una visión detallada y crítica de la regulación de las cláusulas generales de contratación en el Perú, destacando los desafíos y consideraciones clave en este ámbito legal.

La plataformatización del trabajo puede representarse con un término: precariedad. El proceso de precariedad iniciado por las plataformas digitales es muy similar al panorama general del mundo del trabajo en la periferia capitalista, por lo que entender esta puede aclarar mucho sobre el asunto. La precariedad del trabajo en plataformas está vinculada al modelo de negocio adoptado por las empresas tecnológicas, razón que invita a abrir espacios para discusiones sobre la posibilidad real de cambios efectivos a través de la regulación jurídica de las relaciones de producción capitalistas y la forma mercantilizada de trabajo. Surge entonces la pregunta: ¿es posible regular el trabajo en plataformas? El presente trabajo de carácter exploratorio presenta diferentes perspectivas sobre el proceso de plataformatización del trabajo y la actividad regulatoria, adoptando como método de procedimiento la investigación bibliográfica, y como método de abordaje el análisis deductivo con la guía general del método materialista histórico-dialéctico. Con esto esperamos contribuir a las reflexiones sobre la regulación del trabajo en plataformas digitales.

El objetivo de esta investigación fue analizar la dinámica de producción y exportación de hortalizas, las relaciones y prácticas contractuales entre productores y agro empresas exportadoras y los fundamentos legales aplicables que favorecen la agricultura por contrato para producción y exportación de hortalizas, en el estado de Guanajuato, como producto de la globalización. Se realizó un análisis basado en la producción y exportación de hortalizas y el papel preponderante que tiene el estado de Guanajuato como proveedor de hortalizas a las empresas exportadoras. Adicionalmente se realizó la revisión de documentos oficiales disponibles (tratados, convenios y acuerdos internacionales; leyes y reglamentos federales y estatales), con la finalidad de entender cómo se dan los arreglos entre productores y empresas, la falta de información y posibles vacíos legales para la agricultura por contrato en hortalizas de exportación. Los resultados muestran que el estado de Guanajuato ocupa los primeros lugares a nivel nacional como exportador y proveedor de brócoli, lechuga, zanahoria, coliflor, apio y ajo, principalmente. Las prácticas contractuales presentan una relación de dominio por parte de las agroempresas y la necesidad de una regulación jurídica que garantice prácticas contractuales más justas para los productores.

In the literature, evidence has been provided that establishes that compliance with environmental regulations promotes the adoption and implementation of eco-innovation activities in manufacturing firms, since through this type of activities not only are the costs associated with the discharges of pollutants, but also increases the level of sustainable performance of companies. However, little is known about the relationship between environmental regulations, eco-innovation, and sustainable performance, since there are few studies published in the literature that have focused on their analysis, so this study aims to fill this existing gap, and generate new knowledge of the relationship between these three constructs through an extensive review of the literature. Likewise, a questionnaire was distributed to a sample of 460 manufacturing firms in Mexico, analyzing the data through confirmatory factor analysis and structural equation models based on covariance. The results obtained suggest that environmental regulations have positive effects on eco-innovation, and eco-innovation has positive effects on sustainable performance of manufacturing firms in the automotive industry. In this context, the results obtained allowed us to conclude that compliance with environmental regulations established by the public administration, by manufacturing firms in the automotive industry, improve both eco-innovation activities and sustainable performance of organizations. The military now views cyberspace as a new warfare domain, with constant cyber operations potentially causing significant consequences. Internationally, countries are heavily involved in cyberspace, but international law lags behind this evolution, raising questions about its application and retaliation measures. This article investigates international law in cyberspace and cyber operations in warfare and terrorism, exploring recent calls for increased legislation. The impact of cyberspace nonregulation on international security is examined from both positive and negative perspectives. It argues that solving anonymity and attribution issues requires state collaboration, with an initial step of cooperation against cyber‐terrorism. El puma (Puma concolor) es el segundo mamífero terrestre más grande de América, y el cuarto a nivel mundial, es un depredador adaptativo cuyos hábitos de caza y territorio han permitido que sea una de las especie más grande de felino de América, es conocido por su gran fuerza, agilidad y es una parte importante del entorno natural en muchos países de América del Norte y del Sur, los beneficios que Puma concolor proporciona a los ecosistemas en los que habitan son significativo, estos grandes felinos ayudan a mantener el equilibrio de la naturaleza al contribuir con la regulación de la población de presas como ciervos, conejos y jabalíes, el control de estas poblaciones ayuda a prevenir la propagación de enfermedades entre presas y herbívoros a su vez favorece la salud de los bosques y los prados de la región.

Este trabajo se propone definir el alcance de la inteligencia artificial, a pesar de las dificultades y la falta de consenso que rodean este concepto. El objetivo principal es analizar los efectos de la regulación de la inteligencia artificial y sus consecuencias en los derechos fundamentales desde una perspectiva general. Se examina en detalle el estado actual de la regulación de la inteligencia artificial, con especial atención al Reglamento de la Unión Europea y al Acuerdo del 8 de diciembre de 2023. Se ponen en relación la inteligencia artificial y los derechos fundamentales, mediante el análisis de aquellos derechos que podrían verse más claramente amenazados por los sistemas de inteligencia artificial con el objetivo final de lograr una visión global del impacto de la inteligencia artificial en el régimen de derechos. Este análisis busca, en definitiva, contribuir a la comprensión y discusión informada sobre los aspectos éticos y legales que la inteligencia artificial plantea en la actualidad. La discusión sobre la regulación de plataformas se ha centrado, tanto en la academia, como en organismos internacionales y agencias de la competencia, en las herramientas del modelo neoclásico de regulación: cuotas de mercado y análisis de bienestar, entre otras. Más recientemente el big data y los algoritmos han pasado a ser centrales en estos debates. El objetivo de este artículo es analizar, desde una perspectiva crítica, la evolución de esta discusión, su impacto en las diferentes propuestas legislativas, y el largo período que llevó a la Unión Europea a adoptar, en 2022, la regulación de estas corporaciones. Adicionalmente, se sugieren nuevos instrumentos de políticas públicas que puedan superar estas nuevas normativas.

En el agronegocio del vino, las representaciones colectivas, como los sistemas de indicaciones geográficas, se crean para proteger la calidad y diferenciar cada región productora en el mercado nacional e internacional. En la actualidad, la diversidad del escenario vitivinícola global, las nuevas demandas de los consumidores y los cambios socioambientales están invitando a repensar este tipo de sistemas de protección de la calidad y a enriquecer el debate en relación con las posibles alternativas a estos. En ese contexto, el presente trabajo explora las opiniones acerca de dicho debate desde regiones y países vitivinícolas emergentes, como es el caso de Sonora, en México. Estos espacios se encuentran en una fase de crecimiento, experimentación y desarrollo que permite analizar cómo se percibe la posibilidad de adoptar y regular modelos de protección geográfica y los desafíos asociados a este tipo de estrategias de clasificación y valorización. Asimismo, a nivel más amplio, este análisis busca reflexionar respecto a la creación de formas alternativas de diferenciar y representar colectivamente la calidad y el valor asociado al lugar de origen de la producción vitivinícola. Lo anterior, finalmente, con el objetivo de comprender en profundidad los cambios a los que se enfrenta la diversificación y transformación de la industria vitivinícola actual en América Latina y a nivel global.

La agenda de construcción de paz internacional está experimentando una serie de transformaciones que han llevado a la literatura a cuestionarse si seguimos dentro de lo que se venía llamando Paz Liberal – un conjunto de políticas, formas de entender y abordar los conflictos cuyo mayor objetivo era la consecución de la paz mediante la reforma de los estados en conflicto, promoviendo la democracia liberal, el desarrollo y los derechos humanos. Si bien este modelo ha estado prácticamente siempre en transformación y se ha tenido que ajustar a cada contexto, desde aproximadamente 2010 se ha consolidado una pérdida de fe en la consecución de la paz y en la reforma política de los estados, y una tendencia a buscar victorias militares y a incrementar la dotación de recursos para la guerra a los Estados en conflicto. Estos dos aspectos llevan aparejados otras consecuencias como la pérdida del contexto multilateral que había hecho posible la seguridad colectiva en el seno de Naciones Unidas, un giro hacia la protección del Estado y una condena de la población civil, a la que ahora se ve como una amenaza. En base a la sociología del militarismo, este artículo analiza las transformaciones de la Paz Liberal desde el punto de vista de los cambios acaecidos en las prácticas de legitimación y consecución de la guerra, argumentando que estamos transitando de un paradigma de Paz Liberal a uno de Paz Militar. Esto no necesariamente implica que vivamos en un mundo más militarizado o menos pacífico, sino que en contra del objetivo de monopolizar y regular la guerra que se encontraba en el seno de la Paz Liberal, el uso de la fuerza se ha desmonopolizado, haciendo de la guerra, y no la promoción de la democracia o el control de la fuerza, el instrumento por defecto en la promoción del orden internacional. Metodológicamente, el artículo se basa en un análisis temático de los principales documentos sobre la agenda de construcción de paz de la ONU desde 1992 hasta 2023 e incluye algunos ejemplos sacados de varias observaciones y entrevistas realizadas con oficiales de la ONU en República Democrática del Congo (RDC) y la República Centroafricana (RCA).

La Alerta de Violencia de Género contra las Mujeres comprende una serie de procesos que vista superficialmente pueden ocasionar que se identifique como una política pública, sin embargo, la manera en la que ha sido diseñada e implementada también en ocasiones la hace ser considerada como un instrumento de política. El objetivo de este artículo es identificar las características que tiene la Alerta de Violencia de Género contra las Mujeres para que en un futuro puedan ser analizadas y estudiada desde la óptica de los instrumentos de política pública.

El artículo analiza la regulación jurídica de la calidad del agua en la provincia de Buenos Aires. La calidad del agua reviste un papel crítico por la incidencia que tiene en la salud de la población y las condiciones de vida digna. Su prestación mediante el servicio público es la forma más segura de acceso y reduce la explotación de los acuíferos por parte de particulares de forma directa. La selección de la provincia como caso de estudio se vincula con dos motivos: por un lado, la presencia de distintas empresas que prestan el servicio y un entramado que atraviesa regulaciones de la nación y la provincia; y, por otro, la jurisprudencia que ha tenido lugar a partir de demandas por la calidad. El trabajo hace un análisis de la normativa vigente a nivel nacional y provincial de forma comparada, y de los fallos jurisprudenciales relativos a la calidad del agua. El análisis permite observar las tensiones que se presentan por la adecuación de valores de elementos contaminantes a las recomendaciones de la Organización Mundial de la Salud y la relevancia que ha tenido el Poder Judicial en materia de reconocimiento del derecho humano al agua.

Nowadays, there is no consensus on the effects of regulation on economic growth. In this document, we analyze the relationship between regulation and economic growth for Colombia, using data on the accumulation of regulation and real GDP during the 1991-2019 period for nine large productive sectors of the Colombian economy. Different models are estimated using time series and panel data techniques to present evidence at the economic sector level. The results show that, for some sectors, such as agriculture, forestry, fishing, mining, manufacturing, electricity, gas and water, commerce, restaurants and hotels, financial and business services and community, social and personal services, there exists an inverted U relationship between regulatory accumulation and GDP. These results offer important lessons for those responsible for the design and formulation of public policies on matters of regulatory improvement. [ABSTRACT FROM AUTHOR]

Informal settlements in Latin America generally present high levels of vulnerability as they are located in multi-hazard zones. Faced with this problem, we propose to analyze how disaster risk has been constructed in the peri-urban area of the city of Quito. By means of a mixed methodological design, the case of the parish of El Condado and the neighborhood of Colinas del Norte are analyzed. The work refers to the design of a specific procedure, so that it constitutes a methodology, in the process of evaluation and analysis of non-constructive and assembly investments with the insertion of technological components in the province of Villa Clara, and in this way fill a gap within the regulatory activity of the Office of Regulation and Environmental Safety (ORSA) of said province. In the same way, broaden the spectrum of its specialists and promote multidisciplinary work based on decision-making when granting the technological opinion, as a governing document in the authorization process. On the other hand, it forces the specialist to carry out a constant study and self-preparation for the correct Integral Technological Assessment and thus provide a quality service, not only due to the vertiginous advance of technology in the world but in the current modifications suffered by the current environmental legislation. For all of the above, this work aims to guarantee the necessary methods to carry out the environmental regulatory activity effectively, and guide the work of the respective officials. Objective. To analyze the different elements of the arguments received during the public consultation of the Modification Project to the Official Mexican Standard-051 (NOM-051), emphasizing the protection of children and adolescents. Materials and methods. The information provided in 1 095 arguments was analyzed. Key actors were identified, and a content analysis was carried out to identify if the position was in favor or against the numerals related to the protection of children and adolescents. The analysis was done using NVivo software. Results. 781 key players were identified. During the public consultation, four private sector tactics were identified to interfere in the NOM-051 process: a) front groups that sent comments against NOM-051; b) questions about the scientific evidence on the relationship between consumption of sweeteners and obesity in schoolchildren; c) questions about the effectiveness of the use of warning labeling for sweeteners; d) comments about individual responsibility individuals responsible for their disease. This research explores the regulation dynamics that corporate organizations exercise in certain spheres of educational policy through the projects they coordinate in their areas of influence through Corporate Social Responsibility. The premises of the Critical Stakeholder Analysis are recovered to raise the implications of the delivery of public services being located in the sphere of influence of corporations. This process is illustrated using a comparative approach based on a non-experimental design and a literal replication methodology. The findings indicate a shift in decision-making towards corporations in the framework of the transition to the State of competition and the New Corporate Citizenship. [ABSTRACT FROM AUTHOR]

The objective of this study is to analyze the response of university students in relation to the perception, assimilation, understanding and regulation of their emotions in the face of diverse situations that arise, using a quantitative approach and an exploratory design of a sample of two groups of two, generations with a total of 62 participants, the survey technique was applied and a questionnaire was used to measure emotional intelligence using the scale (ESCQ) Emotional skills and competencies that explored four categories in particular from the Mayer and Salovey model (1997): perception, assimilation, understanding and regulation of emotions. It consists of 45 items, on a Likert-type scale with a rating from 1 to 5. To process the information, the data were analyzed by comparing means in the Anova test. The results indicate that the generation factor does not influence the behavior of the EI dimensions, so a significant difference is not reported. The conclusions indicate that there are more latent needs in the perception and regulation of emotions, which could have certain effects on personal and professional life.
