In the context of the current penitentiary crisis in Ecuador, characterized by repeated violations of the human rights of individuals deprived of liberty, a particular infringement of personal integrity has been observed within the National System of Social Rehabilitation. This infringement manifests through acts involving physical, psychological, and sexual aggressions. The present graduation thesis aims to shed light on this issue through the analysis of the jurisprudential case 484-20-JH, issued by the Ecuadorian Constitutional Court. The primary objective of this research is to evaluate the structural remedies established in the judgment, which seek to address the systematic violation of the right to personal integrity. To carry out this analysis, a mixed methodology is adopted, combining descriptive and comparative approaches. The use of documentary, jurisprudential, and bibliographic analysis strategies is employed to explore various perspectives and similarities present in doctrine and jurisprudence, aiming to assimilate the case and its context more easily. Additionally, this investigation incorporates jurisprudential dogmatics into its theoretical framework, providing a solid conceptual basis that underpins the analysis of the legal case. Finally, it is expected that this analysis will significantly contribute to the understanding of the right to personal integrity of individuals deprived of liberty, emphasizing the urgent need to implement effective measures to remedy existing deficiencies in the penitentiary system.

The research focuses on the analysis of the application of Habeas Corpus to people deprived of liberty with catastrophic illnesses, focusing on the cases of the Constitutional Court of Ecuador. The methodology used includes an inductive analytical, synthetic and jurisprudential approach supported by documentary and bibliographic review. The general objective of the research is to analyze a paradigmatic case of constitutional jurisprudence in Ecuador that addresses the limitations and origin of the Habeas Corpus action to protect people deprived of liberty with catastrophic illnesses. Two judicial cases resolved in the constitutional justice system of Ecuador are analyzed. The conclusions reveal the importance of Habeas Corpus in protecting the right to health of people deprived of liberty with catastrophic illnesses. Although its effectiveness is evident, limitations are identified, such as the prevalence of the patrimonial approach in judicial practice and challenges related to overcrowding in detention centers. The research highlights the need to address these challenges for a coherent and fair application of Habeas Corpus, reinforcing the importance of access to health as a fundamental right in the prison context.

This research addresses modern slavery and violations of human rights among the workers of Furukawa Plantaciones C.A in Ecuador, focusing on the case 23571-2019-01605, which was substantiated in the province of Santo Domingo de los Tsáchilas. The Japanese company specializes in abacá fiber production, and agricultural workers have faced conditions comparable to modern slavery, with violations of fundamental rights. The case hypothesizes the existence of certain structural conditions that have resulted in systematic violations of human rights. Objectives include identifying specific forms of modern slavery, examining national and international regulations, analyzing the sentences of the case, and evaluating the effectiveness of implemented measures in Ecuador through justice operators. The methodology is deductive, utilizing document analysis, jurisprudential review, and a detailed study of the case. The social, academic and professional relevance implies awareness and fight against labor exploitation. Knowledge about modern slavery from a legal perspective, and, finally, provides information for the design of effective labor policies. The research structure includes chapters on the historical evolution of slavery, Ecuadorian legal framework, and the legal analysis of the case under investigation.

This paper aims to study how persons with psychosocial disabilities, holders of the right to education and priority attention, access this right in Higher Education Institutions, and how they are protected in the Ecuadorian constitutional justice through the analysis of a relevant case carried in the city of Cuenca with the number 728-19-JP and which was selected by the Constitutional Court of Ecuador. The method used is inductive/descriptive, seeking to observe through a particular case of judicialization of the right to education for persons with psychosocial disabilities, the minimum standards of protection and care provided for in the Constitution of Ecuador and in international human rights treaties and instruments.

In the present titling work, through a doctrinal and practical legal analysis, the problem of visual contamination in the city of Déleg was evidenced, which is a consequence of several polluting factors that urgently need to be regulated in order to mitigate them and in itself prevent its advance, since the non-existent legislation is demonstrated by the Decentralized Municipal Autonomous Government of Déleg. Thus, the design of this investigation allows us to understand as a first point, the problem of pollution in general, then, the consistency of the type of "visual" contamination is determined, the violated rights and principles belonging to the branch of Public Law that is Urban Environmental Law, and finally, the realization of a normative proposal for an ordinance for the regulation of visual pollution in the Déleg canton of the province of Cañar. All this through an analytical, qualitative, legal and comparative methodological combination, through the application of techniques, highlighting: direct observation, photographic record, surveys of inhabitants and frequent visitors, interviews with community leaders, authorities and environmental experts. Revealing that the result achieved by this project is very significant not only for the inhabitants of the Déleg canton, but for all the decentralized autonomous governments of the province of Cañar.

Social protest plays a fundamental role in the construction of a democratic state. Faced with the lack of direct dialogue channels between the State and social movements, protest becomes a tool to bring into the public debate the needs neglected by the government. Although the right to protest has been constitutionally recognized, the Ecuadorian State has not succeeded in ensuring its full exercise, and in many cases, it has resorted to state and judicial force to restrict or suppress demonstrations, thereby endangering democratic stability. In this context, the inter-American framework of human rights plays a key role by acknowledging protest as a right that contributes to the development of a more just society. Through discourse analysis and the use of data triangulation, which includes a literature review, action document analysis, and semi-structured interviews, this study aims to generate findings and conclusions that promote greater effectiveness of the right to protest and strengthen the Ecuadorian democratic system.

The paper takes a theoretical journey through the different conceptions put forth regarding legal pluralism, with special emphasis on the perspectives provided by Latin American authors. Furthermore, based on critical legal theories, it recognizes the legal nature of ancestral justice systems of indigenous peoples and their emancipatory and transformative potential in challenging power structures that, founded on processes of colonization, marginalize non-dominant cultures and ways of life. It also provides a description of the national and international regulatory framework that governs the right of indigenous peoples and nationalities to exercise jurisdictional powers through their authorities, while also outlining the constitutional limitations to which such jurisdictional power is subject. Finally, through the use of qualitative methods such as participant observation and semi-structured interviews, combined with case analysis, it presents the functioning of the indigenous justice system in the community of San Pedro in the Province of Cañar.

The city, as a spatial framework for the daily activities of millions of people around the world, contains several underlying social contradictions in its current configuration. The access to public space constitutes the central theme of this research, which examines the exercise of the "Right to the City" and its lack of consensus regarding its meaning. In the present normative context, which promotes a welfare state model and the protection of social and economic rights through the Constitution, there is a noticeable deterioration in social public policies that directly affects the access to rights, particularly for those engaged in the informal sector of the economy who rely on the use of public space for their direct subsistence.

Initially, the study of habeas data will be carried out, its generalities, object and scope of protection, as well as the procedure regulated in Ecuadorian legislation for its filing; by virtue of the fact that habeas data constitutes the ideal mechanism to guarantee the right to digital oblivion, which is the one that enables the elimination of personal data that rests on digital networks and platforms. Computer platforms store a large amount of personal information, easily accessible, which can be known and used maliciously by third parties to cause serious damage to the owner. Given this situation, the right to be forgotten is born with the aim of establishing limits to computer power and avoiding the violation of the constitutional rights of individuals.
