Abstract

This research addresses modern slavery and violations of human rights among the workers of Furukawa Plantaciones C.A in Ecuador, focusing on the case 23571-2019-01605, which was substantiated in the province of Santo Domingo de los Tsáchilas. The Japanese company specializes in abacá fiber production, and agricultural workers have faced conditions comparable to modern slavery, with violations of fundamental rights. The case hypothesizes the existence of certain structural conditions that have resulted in systematic violations of human rights. Objectives include identifying specific forms of modern slavery, examining national and international regulations, analyzing the sentences of the case, and evaluating the effectiveness of implemented measures in Ecuador through justice operators. The methodology is deductive, utilizing document analysis, jurisprudential review, and a detailed study of the case. The social, academic and professional relevance implies awareness and fight against labor exploitation. Knowledge about modern slavery from a legal perspective, and, finally, provides information for the design of effective labor policies. The research structure includes chapters on the historical evolution of slavery, Ecuadorian legal framework, and the legal analysis of the case under investigation.
