2. Can mandatory work in activation programmes be meaningful work?

Abstract

Quantitative well-being studies have shown that welfare recipients performing work activities in activation programmes report relatively high levels of well-being. This article asks how these findings can be explained, given welfare recipients' constrained autonomy. To answer this question a qualitative study was conducted in the Netherlands to explore the interaction between welfare recipients' constrained autonomy and how they experience work in Mandatory Work Programmes. This article uses concepts from critical theoretical approaches to meaningful work and autonomy to analyze the data. The findings show how the restrained autonomy of programme impacted the participants' work experiences in various, sometimes contradictory ways. It is concluded, among other things, that quantitative well-being research does not seem to fully capture people's experiences as having the status of a welfare recipient and, related to that, what it means for them when their autonomy is constrained in one or more dimensions. It is also recommended that future quantitative well-being studies clearly distinguish between types of activation programmes, particularly regarding their mandatory nature, their goals and their target groups. Abstract

This article analyses the consistency between the implementation of the EU Youth Guarantee and the fundamental right to work. Focusing on the use of traineeships as an implementation instrument, it explores various types of national Active Labour Market Policies (ALMP) for young unemployed people in Italy, Spain, the Netherlands and Poland. The case studies show that it remains to be seen whether the traineeships considered in this research comply with the right to work. The authors argue for the need to strengthen the Youth Guarantee to accord with the right to work, so that in addition to the right to a first job, it ensures that work-related instruments include the provision of effective training, as well as the right to equal pay for work of equal value, and decent working conditions. This is particularly important in view of the Coronavirus disease 2019 (COVID-19) pandemic, that has had an unprecedented economic impact in the EU and is likely to result in another dramatic upsurge in the number of young unemployed.

34. Verplichte ontzorging - en gelijkebehandeling van statushouders met recht op bijstand

Abstract

Sinds 1 januari 2022 is de gemeente verplicht om gedurende zes maanden de belangrijkste vaste lasten van statushouders te betalen en te verrekenen met hun bijstandsuitkering. Is dat geen betutteling? Leidt het tot meer zelfredzaamheid dan vrijwillige begeleiding doet? In dit artikel analyseert Anja Eleveld de verplichte ontzorging uit de Wet Inburgering 2021 in het licht van de gelijke behandeling-bepalingen uit het Europese en internationale recht. Vooral het ontbreken van beleids- of beoordelingsruimte is een heikel punt. Ontzorging is verplicht, ongeacht de wenselijkheid ervan in een concrete zaak.

Abstract

Drawing on the neo-republican theory of non-domination and a qualitative case study conducted in three Dutch municipalities, this article explores the extent to which external rules are able to prevent arbitrary power in relationships between welfare officers and work supervisors, on the one hand, and welfare recipients participating in mandatory work programmes, on the other hand. It concludes that external rules were insufficiently implemented in the three municipalities in question. In addition, it found that rules cease to be capable of constraining arbitrary power where institutional contexts themselves are unpredictable and insecure. Under these conditions, welfare recipients may seek to avoid risks and act in accordance with the preferences (or their expectation of the preferences) of the welfare officer or work supervisor by playing the role of the 'good recipient' instead of relying on available rules of a protective nature or rules that enable them to have a say in their participation in mandatory work programmes. 49. Protecting working welfare recipients through human rights experimentalism

Abstract

In this paper, we adopt an experimentalist approach to determining the content of international human rights for assessing national mandatory work programmes for recipients of social assistance (MWPs). This approach implies going back and forth between law and experience in order to determine the better way to secure human rights in an ever-changing environment. After having identified six criteria for evaluating MWPs in the soft case-law of international bodies, we confront this emerging international human rights framework with an empirical study on MWP practices in the Netherlands. This confrontation reveals that specific aspects of the capability for voice of working welfare recipients are absent in the human rights framework and that the framework is not gender-neutral. Abstract

In nationaal politieke kringen is de basisbaan het nieuwe buzzwoord. De basisbaan en daaraan verwante voorstellen zijn met name door de gezaghebbende rapporten van de Commissie Borstlap en de WRR stevig op de politieke agenda gezet. Bovendien lanceerde de regering ten tijde van de afronding van dit artikel het (onuitgewerkte) plan van coronabanen, een soort tijdelijke basisbaan voor tekortsectoren zoals onderwijs en gezondheidszorg. Er zijn diverse redenen voor de toenemende populariteit van de basisbaan. Zo wordt tegemoetgekomen aan de (eveneens breed gedeelde) wens om uitkeringsgerechtigden te activeren. Basisbaanwerknemers ontvangen immers niet, zoals bij het basisinkomen, zomaar gratis geld, maar leveren een op loon gewaardeerde prestatie. De basisbaan geeft bovendien een antwoord op falend re-integratiebeleid dat door partijen van verschillende politieke kleur op een voor hen herkenbare wijze kan worden ingevuld. Dit alles neemt niet weg dat een serieus voorstel voor de basisbaan, ongeacht het ideologische gedachtegoed dat eraan ten grondslag ligt, uiteindelijk zal moeten voldoen aan de verplichtingen die voortvloeien uit fundamentele (sociale) grondrechten waaraan Nederland zich heeft gecommitteerd. Aan dit aspect wordt echter geen aandacht besteed in de diverse voorstellen. Deze bijdrage voorziet in deze omissie door na te gaan in hoeverre de uiteenlopende voorstellen in overeenstemming zijn met met een tweetal fundamentele grondrechten: het recht op arbeid en het gelijkeloonbeginsel. Vervolgens wordt op basis van die analyse een eigen voorstel geformuleerd dat is verankerd in beide grondrechten en dat daarnaast betaalbaar, rechtvaardig en toekomstbestendig kan worden geacht. Dit betoog start met een overzicht van de basisbaanvoorstellen die tot nu het licht hebben gezien.
