It is indicated that at the current stage of the development of world legal opinion, the United Nations Educational, Scientific and Cultural Organization officially defines that «the basic theoretical basis of copyright is the need to provide humanity with the results of knowledge, and, therefore, there is a clear need to encourage the desire to knowledge by rewarding those who introduce it to other people». The article examines the criticism of the copyright institution from the perspective of Anglo-American philosophical and legal thought, as well as alternative models of legal regulation of intellectual property proposed in American academic circles, including the concept of free culture and the open access movement. The article analyzes the main views and theories of the past and present that criticize copyright. The doctrine of Proudhon, the most famous opponent of literary property in the 19th century, is considered, and the views of leading American copyright critics are analyzed, who argue that this institution is incompatible with modern society, which is dominated by technology. They argue that the rigid framework of copyright inhibits innovation and creates obstacles to the free exchange of information in the age of artificial intelligence. Among such critics, the work of L. Lessig, one of the most influential contemporary thinkers in the field of intellectual property law, stands out. Lessig's scientific work focuses on copyright issues in the digital era. He proposes to reform the existing system, emphasizing the need to balance the interests of creators and society. Lessig actively promotes the ideas of free culture and open access, arguing that they will contribute to a more equitable and efficient distribution of information. The article examines in detail Lessig's arguments for copyright reform, as well as their possible consequences for society and culture. The analysis of Anglo-American philosophical and legal thought demonstrates that copyright reform is a necessary step to achieve a balance between protecting the rights of creators and ensuring free access to knowledge and information for society. The digital era has seen the rise of innovations such as online training platforms and digital toolkits for teaching and learning whilst at the same time open access initiatives are losing the attention of educators. The problem under consideration in this paper is the replacement of open educational resources (OER) with digital innovations in higher education (HE). The purpose of this study is to identify the relevance of OER to post-Soviet HE in the digital age. The research employed methods of descriptive analytics to process data on users’ activities extracted from OER repositories with web-analytic apps. The survey was conducted among 441 lecturers to elucidate their request for access to and patterns of usage of digital OER. The findings confirmed the relevance of OER in contemporary education through the similarity of lecturers’ experience worldwide. During the urgent transition to remote learning owing to the COVID-19 pandemic, OER helped lecturers access informed digital practices through appropriate methods and content. OER has thus retained its relevance against the backdrop of the emergence of digital innovations in HE. Open licences serve as a crucial mechanism for safeguarding the rights of creators by granting authors increased authority over their work, encompassing aspects such as reproduction, distribution, performance, display, and adaptation. Creative Commons, among other open licences, not only affords legal safeguards to creators to prevent misuse or infringement but also the dissemination of academic knowledge and facilitates collaborative efforts. The adoption of open licences is on the rise within the realm of academic publishing, aiming to promote knowledge sharing and cooperation. Academic institutions are benefitting from novel open publishing models that enable researchers to share their findings with a wider audience while safeguarding their intellectual property through Creative Commons licensing. These models confer a competitive advantage to academic entities by empowering them to independently publish their research outcomes, which are often relegated to the realm of grey literature. The present article discusses a study that explores various open licensing models and their applications, elucidating their advantages for the academic community. This study examines the disparities in open educational resource sharing among various academic disciplines in French universities. Conducted shortly after the COVID-19 pandemic, it involved an online survey with 947 participants. The findings reveal significant differences in knowledge sharing practices across academic fields. For example, computer science instructors demonstrated greater familiarity with Creative Commons (CC) licences. However, awareness of these licences did not always translate into a willingness to use them. In contrast, law professors, despite being aware of CC licences, were less inclined to share their course materials. The study found that faculty in the hard sciences, as classified by the Becher-Biglan framework, were more inclined to share their resources. These observations highlight the need to consider the academic discipline of instructors when exploring their attitudes towards open education and in formulating policies to enhance the availability of resources on the internet. Aspects of copyright literacy and attributing open licenses as scholarly practice inform this commentary. Because citation practices have a much longer history than attribution, an overview of the study of citation and its relationship to the developing practice of attributing open licenses provides a model and trajectory to follow. Copyright literacy as part of attribution knowledge and skills bifurcates from citation scholarship, yet it is part of reconsidering and affirming knowledge connections. Decolonizing perspectives of epistemology and what counts as knowledge, ownership, and sharing are part of this bifurcation that involves attribution, Indigenous ways of knowing, and Traditional Knowledge Labels. There are also tensions involved with properly attributing Creative Commons licenses and the title, author, source, and license process offers an imperfect and sometimes complicated pathway forward. Through this process, accurate and effective license acknowledgement occurs for newly created, reused, revised, remixed, or reshared artifacts. It is suggested to use the online attribution builder and best practices for attribution placement are provided for written documents, presentations, blog posts, videos, and other formats. As part of open education practices, attribution signals contributions to the knowledge commons and are part of copyright literacy and professional digital competence.

Generative AI has taken the world by storm over the last few years, and the world of scholarly communications has not been immune to this. Most discussions in this area address how we can integrate these tools into our workflows, concerns about how researchers and students might misuse the technology or the unauthorised use of copyrighted work. This article argues for a novel viewpoint that librarians and publishers should be encouraging the use of their scholarly content in the training of AI algorithms. Inclusion of scholarly works would advance the reliability and accuracy of the information in training datasets and ensure that this content is included in new knowledge discovery platforms. The article also argues that inclusion can be achieved by improving linkage to content, and, by making sure that licences explicitly allow inclusion in AI training datasets, it advocates for a more collaborative approach to shaping the future of the information landscape in academia.

L’articolo si propone di fornire una visione organica del diritto d’autore in open access e delle sue implicazioni nel campo della ricerca. Il movimento open access è nato in seno alla comunità scientifica circa vent’anni fa e una serie di provvedimenti legislativi hanno trasformato open science e open access da movimenti a fenomeni concreti. Si tratta di una materia che evolve rapidamente – anche in relazione alla cosiddetta ‘rivoluzione digitale’ – e che richiede quindi un costante aggiornamento. I paragrafi introduttivi, dedicati alle basi del diritto d’autore, ai contratti di edizione e al pubblico dominio, mirano a fornire un inquadramento legislativo. Si analizzano quindi le licenze Creative Commons, strumenti semplici, intuitivi e facilmente personalizzabili, che consentono ai titolari dei diritti sulle opere di disciplinare giuridicamente le modalità di accesso alle opere stesse, consentendo di fatto una maggiore diffusione dell’open access. Si considera poi il legame tra rivoluzione digitale, diritto d’autore e ricerca scientifica, attraverso il recepimento della nuova direttiva europea EU 2019/790 sul diritto d’autore e sui diritti connessi nel mercato unico digitale: si evidenziano così le contraddizioni che caratterizzano le politiche di promozione di apertura della scienza. Infine, per dar conto della scarsa diffusione delle pratiche open access nell’editoria italiana di ambito giuridico, si riporta un’indagine condotta a partire dai prodotti della ricerca presenti in Iris Sapienza, limitatamente all’area disciplinare 12 delle Scienze giuridiche. A fronte di una sorta di idiosincrasia dimostrata dagli autori nei confronti degli aspetti giuridici dell’OA e dei temi legati al copyright, all’accesso aperto e alle metriche di misurazione, i bibliotecari possono ribadire il loro ruolo di professionisti della conoscenza a supporto della ricerca, padroneggiando le norme connesse al diritto d’autore e supportando gli autori durante le attività, sempre più diffuse, di disseminazione in open access.

A web-based survey of academic publishers was undertaken in 2021 by a team at Oxford International Centre for Publishing into the state of monograph publication in the arts, humanities, and social sciences. 25 publishing organisations responded, including many of the larger presses, representing approximately 75% of monograph output. Responses to the survey showed that the Covid 19 pandemic has accelerated the existing trend from print to digital dissemination and that Open Access (OA) titles receive substantially greater levels of usage than those published traditionally. Responses also showed that for most publishers OA publication stands at under 25% of output and that fewer than 10% of authors enquire about OA publication options. Continuing problem areas highlighted by respondents were the clearing of rights for OA publication and the standardisation of title and usage metadata. All responding organisations confirmed that they expect to be publishing monographs in ten years' time, but that they anticipate the format and/or the model will be different, with open access expected to play a key part in the future, perhaps in the context of a mixed economy of OA and 'toll access' publication. The library of the Federal Institute for Drugs and Medical Devices (BfArM) in Bonn assists BfArM employees not only in obtaining the desired literature for scientific work, but also in publishing. To make scientific research more transparent and accessible to all interested parties, the library supports the open science movement.The poster “Creative Commons-Lizenzen” provides an overview of the various licensing models and helps with decision-making.

The present study aims to investigate the trend and growth of Open Access (OA) journals in the Directory of Open Access Journals (DOAJ) portal. The authors found that there are 17,379 indexed journals in 80 languages from 130 countries covering all fields of science, technology, medicine, social sciences, arts, and humanities. The study presents findings on the contribution to DOAJ by subjects, country, DOAJ seal, article processing charges (APC), and author publishing rights. The study found that medicine journals were highest in this portal and the majority of contributions came from Indonesia. It was also found that the majority of the journals allow the author to hold publishing rights and only 8% of OA journals received the DOAJ seal. The maximum numbers of OA journals have Creative Commons Attribution licences and the highest APC is Rs. 3,97,985. DOAJ is the main source of information in facilitating organized access to OA literature. It is recommended to raise a DOAJ special seal for practicing extra high-level commitment to OA publications. This paper offers overarching insights into the benefits and drawbacks of Open Educational Resources (OER) for learning communities. A semi-systematic literature review (SSLR) is used as a research approach. Data is gathered from research articles, books, and other published work, and analyzed using thematic analysis. OER and Open Educational Practices (OEP) have the potential to support sustainable educational practices, but these have not yet reached their capacities to benefit wider learning communities. It is not yet known if the global academia is prepared towards embracing OEP due to limited pieces of evidence. OE policies have been successfully adopted by a few countries, but others have failed to accept open policies due to a lack of a supportive environment. MOOCs have benefitted the academic community in many ways, but openness, equality, lifelong learning, and liberation remain major challenges. A vast number of open repositories offer free resources, but learners and teachers have been unsuccessful to develop quality learning resources due to a lack of capacity to adapt and re-use OER. Documentary evidence confirms the use of digital licenses by global learning communities, but lack of awareness, incompatibility of Creative Commons (CC) with the traditional copyright laws, and lack of uniform global policy framework have deterred OEP. The design and implementation of Learning Objects can contribute to the virtualization of teaching, enabling develop our materials or adapt them for a particular teaching situation. This fact becomes of special relevance in circumstances in which we must adapt face-to-face teaching to virtual teaching or under pedagogical approaches based on the flipped classroom. In this paper, we will describe an initiative in which, we have designed with eXeLearning a Learning Object for the study of the urban landscape. eXeLearning allows the creation of diverse, accessible, and friendly resources, allowing instructors to save time in preparing learning materials and facilitating their adaptation to different educational and social needs. We apply this initiative, developed thanks to a Project for Educational Innovation, within the degree of Geography and Spatial Planning of the UPV/EHU, but it could be adapted to other levels of education.

Galloping speed of technological development and intense research activities in ICT over last couple of decades has facilitated opportunities of rapid expansion in creation, distribution and consumption of educational resources across the world. While fulcrum motivational factor for such technological advancement is indeed profit driven, a substantial gain has also been drawn by academic communities using the same set of technologies for greater social good. The LODEStone model is an emerging design model for consulting on organizational, department or team level challenges for specialized learners. LODEStone evolved from the iterative design of OCTBR, a course development tool created at an academic health science center (AHSC). OCTBR's purpose is to help create better blended and online learning experiences for graduate-level students in medicine, allied health and related health sciences. Reflecting on how OCTBR was developed, we describe a pilot model of Learning, Opinions, Discerning, Equipping and Shaping (LODEStone) that can be used to design other projects for specialized learners. Uber, Airbnb, CouchSurfing, Netflix, electric scooters: all of these have become part of our daily lives, just as Allegro.pl, Amazon.com and other network economy businesses already have. Even so, according to their promoters they are a harbinger of a new order. For the market economy, with its anonymous market, sharing economy practices are to be what institutions of direct citizen influence on political decisions are to representative democracy. The economy will at last begin to fulfil actual human needs instead of producing superfluous things on a mass scale. The Earth's devastation and the wasteful exploitation of its resources will cease. Old pre-capitalist economy institutions, spread all over the globe by means of the Internet, will empower the people marginalized by the market and reconstruct the communities weakened by it. Trust will be the greatest capital at people's disposal, both in the local and global exchange of things and services. I do not estimate how realistic this promise is; all I do is present, from the perspectives of both sharing economy advocates and its critics, the specific institutions (in the sociological sense) meant to deliver on it. In the summing-up I highlight the ambivalence towards the market economy that the very idea of sharing itself is burdened with, and consequently, the ambiguity of its self-professed mission: is to be a mere correction to the present-day form of capitalism or an alternative to it? Estas innovaciones han traído consigo también cambios en la forma de acceder a ese conocimiento, pasando desde pagar para su acceso a tenerlo sin ningún costo.

The UC San Diego Library is in the process of digitizing approximately 300 audio recordings from the Paul Blackburn Collection, which consists of readings from over 200 poets. This session will take a look at the risk assessment, rights and permissions process, and the reason the Library decided to take a risk-averse approach to this project in order to make parts of this collection available online through its Digital Collections website. The second part of the session will review the work the Library’s Copyright Policies Task Force has undertaken to incorporate Creative Commons licenses to its collections.

This article maps patterns of interest in key terms associated with copyright and online culture in the US context. Using exploratory factor analysis of data from Google Trends, authors examined patterns in keyword searches between 2004 and 2019. The data show three distinct periods of interest. The first period consists of utopian, cause-driven search terms; the second marks a rise and eventual decline in creatively motivated, maker-fueled searches; and the third is characterized by rising utilitarian and institutional interest in accessible copyrighted material. These data show empirically that the public curiosity about alternatives to strict copyright have changed during the study period. This article reflects the design community’s interest in Global Tools, a 1970’s radical movement in architecture and design, born in Italy and corresponding to a shift from design considered as a practice to a cultural movement that is able to propose new paradigms. Activists involved in making, such as Victor Papanek (1973), in a post-nuclear culture in The Whole Earth Catalog (1971), and by several actors in Aspen, Colorado in 1971, precipitated this movement to the design community. The movement questions the impact of a mass production and consumption model generating an economic, social, and environmental crisis. Global Tools initiated as a school by Ettore Sottsass and Andrea Branzi, questioning the role of the industry as part of a paradigm in which the issue was not how designers could contribute to industry, but how industry could contribute to society. In this article conceived as an interview, the research activity of institut supérieur des arts de Toulouse (isdaT) reveals a manifesto towards making in a social economic and milieutechnology new paradigm, with polemic and conceptual relationships to both Global Tools and Design 3.0.

A presente resenha busca destacar e estabelecer conexões entre as principais questões apresentadas na obra “A cultura é livre: uma história da resistência antipropriedade”, pelo pesquisador da Comunicação e editor do BaixaCultura Leonardo Foletto. O resgate empreendido na obra das ideias, acontecimentos e ferramentas que constituem a história das tensões entre a apropriação e liberação da cultura nos ajuda a colocar em perspectiva a situação da cultura no presente. Para sustentar sua jornada, o autor oferece uma panorama histórico da cultura que vai da Antiguidade aos dias atuais, precisamente no momento em que seu compartilhamento se tornou mais propício, e também quando se veem mais esforços por seu aprisionamento. E traz consigo a lembrança de que um mundo de livre circulação de ideias é possível.

The Plan S Rights Retention Strategy (RRS) requires authors who are submitting to subscription journals to inform publishers that the author accepted manuscript (AAM) will be made available under a Creative Commons Attribution (CC BY) licence. The laudable stated aim of the RRS is to achieve immediate open access to research outputs, while preserving journal choice for authors. However, proponents of the RRS overlook the significant administrative and legal burdens that the RRS places on authors and readers. Even though compliance with existing green open access (self-archiving) policies is poor at best, the RRS is likely to rely on authors to successfully execute the CC licensing of their work in the face of publisher resistance. The complexity of copyright law and CC licensing gives many reasons to doubt the legal validity of an RRS licence grant, which creates legal risk for authors and their institutions. The complexity of RRS CC BY licensing also creates legal risk for readers, who may not be able to fully rely on the reuse rights of a CC BY licence on the AAM. However, cOAlition S has released no legal advice that explains why the RRS is valid and legally binding. Publishers of legacy subscription journals have already begun implementing strategies that ensure they can protect their revenue streams. These actions may leave authors having to choose between paying publication fees and complying with their funding agreements. The result is that the RRS increases the complexity of the copyright and licensing landscape in academic publishing, creates legal risk and may not avoid author fees. Unless increased complexity and conflict between authors and publishers drives open access, the RRS is not fit for its stated purpose as an open access strategy.

This review provides a brief summary of the online digital curation platform Curationist. The principal project of the MHz Foundation, Curationist publishes visual and cultural materials found in the Creative Commons and public domain with the intent to expand and diversify the histories of art and culture found online. Curationist is an attractive and easy-to-use platform that offers viewers the ability to explore individual works as well as collections and feature articles compiled by a global team of editors. As a whole, the platform appears to be in its nascent stage and does not yet offer the ability for users to zoom in on images, notate works, or arrange favorited images into collections of their own choosing. As the number of openly-licensed works continues to grow, so, too, does the need to understand the permissions afforded by the Creative Commons licenses. In this report on a recent program delivered at the North Carolina Serials Conference, the presenters will provide an introduction to Creative Commons, the four conditions upon which the Creative Commons licenses are built, and a description of the six Creative Commons Commons licenses accompanied by a real-life use scenario. This article describes current production practices taking place in the sound industry, concentrating on the process of implementation and popularization of Creative Commons. Existing studies have considered the role of classical copyright in the creative industries, pointing at its functions in regulating the creative process, but so far have not extensively examined its relationship to alternative intellectual property frameworks. This paper uses the empirical example of the largest sound repository to describe the change occurring in cultural production. The article posits that mass popularization of Creative Commons provokes transformation within three key and intersecting areas of production, including the subjects of property (creators), objects of property (creations) and articulation of usage (source information). Digitalisierung impliziert für die Wissenschaft insbesondere die digitale Verfüg- und Austauschbarkeit des „Rohstoffs“ Forschungsdaten. Dies setzt die Schaffung und Vernetzung von rechtssicheren Datenräumen voraus. Die Ausgestaltung der Bedingungen, unter denen dort Forschungsdaten geteilt und nachgenutzt werden dürfen, liegt dabei in der Entscheidungshoheit der Forschenden. Vehikel zur Ausübung dieser Selbstbestimmung ist die Vergabe von Lizenzen. Um dazu eine Hilfestellung zu bieten, analysiert der Beitrag vorhandene Lizenzempfehlungen und prüft die Eignung verschiedener Lizenzmodelle, bevor abschließend eine eigene, differenzierte Empfehlung ausgesprochen wird.

This article reviews the book "Creative Commons for Educators and Librarians," a guide to the application of the Creative Commons system for open access licenses. In addition to providing an assessment of the book as an instructional text in critical skills of copyright and licensing applications among librarians and educators, it discusses pedagogical features of the text and gives a brief overview of its content.

Con il primo fascicolo del 2021 la rivista festeggia i suoi primi dieci anni, rinnovandosi sia dal punto di vista grafico, sia da quello editoriale: si presenta oggi ai suoi lettori con un sito web aggiornato, con una licenza di pubblicazione più aperta e con il riconoscimento del DOAJ Seal.
