Im Jahr 2015 verabschiedete der Deutsche Bundestag ein Gesetz, das die Beihilfe zum Suizid verbietet, wenn sie geschaftsmasig (d. h. mit Wiederholungsabsicht) erfolgt. Auch wenn damit Sterbehilfeorganisationen in Deutschland gestoppt werden sollten, sorgte der Wortlaut des Gesetzes fur Verwirrung und Missverstandnisse. Behandelnde befurchteten u. a. sogar strafrechtliche Konsequenzen, wenn sie mit ihren Patient*innen uber dieses Thema sprechen. Die Berufsordnung der Bundesarztekammer verbietet die Beihilfe zum Suizid und erklart, die Beteiligung am Suizid sei keine arztliche Aufgabe. Im Jahr 2020 erklarte das Bundesverfassungsgericht das Gesetz fur verfassungswidrig. Das Recht auf einen selbstbestimmten Tod sei nicht auf Situationen beschrankt, die durch ausere Ursachen wie schwere oder unheilbare Krankheiten definiert sind. Es muss sichergestellt sein, dass Wunsche nach assistiertem Suizid auf einer freiverantwortlichen, wohluberlegten Entscheidung beruhen. Dies erfordert eine obligatorische Beratung im Vorfeld und ggf. eine Wartezeit. Palliativmedizinische Unterstutzung sollte angeboten werden, um physisches, psychisches und existenzielles Leiden zu lindern. Wird dies jedoch nicht als hilfreich empfunden, ist der Sterbewunsch zu respektieren, wobei aus dem Recht auf selbstbestimmtes Sterben kein Anspruch gegen Dritte auf Beihilfe zum Suizid abgeleitet werden kann.

Background: The advance directive holds patients’ health care choices and fosters the patients’ autonomy. Nevertheless, understanding the patients’ wishes based on the information provided in advance directives, remains a challenge for health care providers. Based on the ethical premises of positive obligation to autonomy, an advanced directive that is disease-centred and features problems and complications of the disease the patient has, should help the health care providers to understand the patients’ wishes correctly. To test this hypothesis, a pilot-study was conducted to compare if physicians could make the correct end-of-life decision for their patients when patients used a disease-centred advance directive versus a common advance directive.Material and Methods: A randomised, controlled, prospective pilot study was designed, that included patients with NSCLC stage VI from the Department of Haematology and Medical Oncology, University Medical Centre, Goettingen. Patients were randomised into intervention and control groups. The control group received a common advance directive and the intervention group a disease-centred advance directive. Both groups filled out their advance directives and returned it. Subsequent, patients were asked to complete nine medical scenarios with different treatment decisions. For each scenario the patients had to decide whether they wanted to receive treatment on a 5-point-Likert scale. Four physicians were given the same scenarios and asked to decide on the treatment, according to the patients’ wishes as stated in the advance directive. The answers by patients and physicians were compared whether the physicians had made the correct assumptions.Results: Recruitment was stopped prematurely. 15 patients completed the study, 9 patients were randomised into the control group and 6 patients in the intervention group. A total of 135 decisions were evaluated. Concordance of physicians’ and patient’s answers, was 0.83 (95%-CI 0.71-0.91) in the intervention group, compared to 0.60 (95%-CI 0.48-0.70) in the control group and the difference between the two groups was statistically significant (p=0.005).Conclusions: This pilot study showed that disease-centred advance directives help physicians to understand their patients’ wishes more precisely and make treatment choices according to their wishes. Zusammenfassung Hintergrund und Ziel der Arbeit Für die Elektrokonvulsionstherapie (EKT) liegen Leitlinienempfehlungen zur Behandlung schwerer affektiver und psychotischer Erkrankungen vor, wie sie auch bei Patienten im Maßregelvollzug (MRV) vorkommen. Über die Anwendung der EKT in der forensischen Psychiatrie existieren jedoch keinerlei systematisch erhobene Daten. Ziel der vorliegenden Arbeit ist eine Erhebung des Ist-Zustands sowie des geschätzten Bedarfs an EKT im MRV. Material und Methoden Es wurde ein Fragebogen zur Erhebung der aktuellen Anwendung sowie der Einschätzung des Bedarfs an EKT in dieser Population entwickelt. Dieser wurde elektronisch und bei Bedarf postalisch an die forensischen Kliniken in Deutschland versendet. Ergebnisse Wir erhielten Antwort von 52 Kliniken (66 %). 29 der Kliniken gaben an, Patienten mit EKT behandeln zu können. Eine Behandlungsindikation wurde klinikübergreifend für 3,4 % der untergebrachten Patienten gesehen. In einem Jahr (2018) wurden insgesamt 32 EKT-Behandlungen an 12 Kliniken des Maßregelvollzugs mit durchschnittlich guter Wirksamkeit (Ø CGI‑I 2,32) durchgeführt. Häufigste Begründung für die fehlende Anwendung der EKT waren mangelnde strukturelle Voraussetzungen. Jeweils etwa ein Drittel der Kliniken sehen einen mittleren bzw. hohen Bedarf an EKT im MRV. Diskussion Die EKT kommt im MRV in Deutschland aktuell nur sehr begrenzt zum Einsatz. Auffällig ist, dass die Anzahl der durchgeführten Behandlungen etwa um den Faktor 8 hinter der Indikationshäufigkeit zurücksteht. Ungeachtet dessen sehen zwei Drittel der Kliniken einen mittleren bis hohen Bedarf, womit eine Unterversorgung mit EKT im MRV zu bestehen scheint.

The right of patients to self-determination has become increasingly important in recent decades. In clinical practice, it finds concrete expression in the concept of informed consent, according to which medical interventions outside of emergency situations are only permissible with the consent of the informed patient. In the event that the patient later becomes incapable of giving consent, it is possible to document the patient's own treatment wishes in a living will or to appoint a trusted person as a proxy. The right to self-determination reaches its limits where the patient demands medical measures for which there is no medical indication, which are prohibited by law or which contradict the physician's conscience. The latter applies to physician-assisted suicide, which is legally permissible but which physicians cannot be obliged to perform.Das Selbstbestimmungsrecht von Patient*innen hat in den letzten Jahrzehnten stark an Bedeutung gewonnen. In der klinischen Praxis findet es seinen konkreten Ausdruck im Konzept der informierten Einwilligung, wonach medizinische Eingriffe außerhalb von Notfallsituationen nur mit Einwilligung der aufgeklärten Patient*in zulässig sind. Für den Fall späterer Einwilligungsunfähigkeit besteht die Möglichkeit, eigene Behandlungswünsche in einer Patientenverfügung zu dokumentieren oder eine Vertrauensperson als rechtliche Stellvertreter*in zu benennen. An seine Grenzen kommt das Selbstbestimmungsrecht dort, wo die Patient*in ärztliche Maßnahmen einfordert, für die keine medizinische Indikation besteht, die rechtlich verboten sind oder die dem Gewissen der Ärzt*in widersprechen. Letzteres trifft auf den ärztlich assistierten Suizid zu, der zwar rechtlich zulässig ist, zu dessen Durchführung Ärzt*innen aber nicht verpflichtet werden können.

Objectives Severe psychiatric disorders may be accompanied by life-threatening conditions, lack of insight, and treatment refusal. Involuntary treatment may be indicated in patients who lack capacity to consent and refuse treatment. In this context, there is a lack of systematic data regarding the use of electroconvulsive therapy (ECT) in Germany. Methods A questionnaire with 25 items comprising quantitative and qualitative data was sent to all psychiatric hospitals in Germany that perform ECT. Cases of ECT treatment in incapable patients refusing therapy were identified retrospectively in a 12-month period. Results Fifty-three hospitals completed the questionnaire, and 15 cases of ECT in incapable and refusing patients were reported. A marked clinical response was observed in 14 patients. Capacity to consent was restored in 11 patients. In contrast to this particularly good effectiveness, psychiatrists' attitudes revealed a widespread lack of experience as well as reservations and uncertainties regarding the use of ECT against the patient's wishes. Conclusions In line with other recent publications, our data suggest a very good benefit-to-risk ratio for ECT in incapable patients refusing the treatment, while at the same time the provision of ECT in such patients is rare in Germany. In light of the scarcity of treatment alternatives and the possible consequences of a refusal to perform ECT in life-threatening conditions, a general rejection of involuntary ECT does not seem ethically appropriate.

Angewandte Ethik verfolgt nach Auffassung von Ralf Stoecker das Ziel, die Bedingungen der Moglichkeiten fur verantwortliches Handeln zu schaffen. Der Beitrag zeigt auf, dass das mit diesem Ziel verbundene Bild der Angewandten Ethiker*in als „Ethik-Scout“ ein geeignetes Rollenbild fur Ethikberater*innen abgibt. Ferner illustriert er am Beispiel der verschiedenen Aufgaben von Klinischer und Ambulanter Ethikberatung, wie das von Ralf Stoecker beschriebene Ziel der Angewandten Ethik praktisch umgesetzt werden kann.

Background The concept of clinical ethics consultation (CECs) was implemented to provide support in ethical controversies in clinical settings and are offered in at least every second hospital in Germany. Neurological disorders often require complex decision-making. The aims of this study were to determine which situations lead to CEC in neurology and to investigate the influence of the individual patient’s wishes on the recommendation. Methods Standardised CEC protocols in the years 2011 to 2017 at the University Hospitals of Goettingen and Jena were retrospectively surveyed. The contents were categorised along existing protocol templates of CEC scenarios and subsequently paraphrased and reduced to significant meanings. Results 27 CEC scenarios which were facilitated by various professional disciplines were reviewed. Stroke was the most frequent underlying condition. Nearly all patients were not able to consent. Mostly, the relatives acted as representatives or health advocates. In 67 % of cases, a sense of conflict triggered a CEC; in 33 % a sense of uncertainty was the reason for the CEC request. In 21 CEC scenarios, a recommendation was reached in consensus with all parties involved. In 59 % of cases, a decision was made to continue medical therapy. In seven cases, the patient’s wishes led to a limitation of therapy, while in just two cases this decision was made primarily relying on the patient’s best interest. In only 13 % of cases, a valid advance directive led to respective therapeutic consequences. Conclusions CEC is feasible for consensus-finding not only in conflicts, but also in situations of therapeutic uncertainty in neurology. There is a special importance of the patient’s wishes in decision-making in neurology. However, only in a few cases were advance directives precise and specific enough to have sufficient and decisive weight in therapeutic decision-making.

Electroconvulsive therapy (ECT) is recommended in guidelines for the treatment of severe affective and psychotic disorders that also can be found in patients in forensic psychiatric commitment; however, there are no systematically collected data concerning the use of ECT in forensic psychiatry. The aim of this study was to investigate the current state and estimated need for ECT in forensic psychiatry in Germany.A questionnaire was designed consisting of questions about the current practice and estimated need for ECT in this population. This questionnaire was sent electronically (and by post if needed) to the forensic psychiatric hospitals in Germany.We received replies from 52 hospitals (66%) and 29 of these hospitals stated that they were capable of treating patients with ECT. An indication for ECT treatment was seen in 3.4% of all detained patients across all forensic hospitals. In 1 year (2018) 32 ECT treatment courses were carried out with on average good effectiveness and a mean clinical global impressions (CGI) scale of 2.32. The most frequent reason for not using ECT was lack of structural requirements. Approximately one third of the forensic psychiatric hospitals stated that there was a medium or even high need for ECT in forensic psychiatry.The use of ECT in German forensic psychiatry is currently very limited. It is striking that the number of applied ECT treatments is eight times lower in comparison to the frequency of indications. The paper takes up the perspective of clinical practice and discusses the importance of respect for patients’ autonomy from this angle. Until a few decades ago, physicians and nurses involved in ethical decision-making primarily considered the principles of beneficence and non-maleficence. Respect for the patient’s autonomy clearly played a subordinate role. In traditional ethical codes such as the Hippocratic Oath or the Declaration of Geneva of the World Medical Association of 1948, no reference is made to the patient’s wishes. This has changed radically: In line with the shift in values towards greater individuality and personal responsibility observed in the Western world in the second half of the twentieth century, patient self-determination became more and more important. Legal decisions and modern medical ethics emphasize that patient autonomy overrides what physicians and nurses consider best for the well-being of the patient. Informed consent is now a widely acknowledged normative standard in medical ethics, and patient autonomy finds its concrete expression in clinical practice in this concept of informed consent. The paper introduces the concept and discusses central issues concerning patient autonomy in clinical practice: What can health care professionals do to encourage patient autonomy? What are possible limits to patient autonomy? How can a patient’s capacity to consent be assessed? How should health care professionals deal with patients who have temporarily or completely lost their capacity to consent? What is the importance of advance directives? What are possible problems concerning advance directives in clinical practice, and how can they be solved?

Advance directives enable patients to ensure that treatment decisions will be based on their autonomous will, even if they are incompetent at the time at which the treatment decision is taken. Although psychiatric advance directives are legally binding in Germany and their benefits are widely acknowledged, they are still infrequently used in German psychiatric practice.The aim of this study is to assess psychiatrists' attitudes toward the use of advance statements in mental health care.A postal survey of psychiatrists in Germany was carried out to examine their views on advance statements in psychiatry. The survey addressed psychiatrists' experiences of and attitudes toward different types of advance statements, including psychiatric advance statements written by patients without any specific assistance, and joint crisis plans ( 'Behandlungsvereinbarungen'), where involvement of the clinical team is required. A total of 396 responded.Results suggest that generally speaking, respondents held favorable views on joint crisis plans for mental health care. In all, 80.7% of participants agreed that more frequent use of joint crisis plans in clinical practice would be desirable. However, clinicians' attitudes differ largely depending on the type of advance statement. Implications for the use of advance statements in psychiatry are discussed.The findings suggest that increasing the support structures available to train physicians and inform patients could lead to increased adoption of advance statements.

Patientenverfügungen und andere Formen der gesundheitlichen Vorausverfügung haben in den letzten Jahren stark an Bedeutung gewonnen. Der Beitrag diskutiert die Möglichkeiten und Grenzen psychiatrischer Vorausverfügungen vor dem Hintergrund der aktuellen ethischen und rechtlichen Debatte um Zwangsbehandlung in der Psychiatrie. Ferner werden mögliche Konflikte bei der Umsetzung psychiatrischer Vorausverfügungen in der klinischen Praxis aufgezeigt und erörtert.

Schwerwiegende affektive und psychotische Storungen konnen bei entsprechender Auspragung mit Einwilligungsunfahigkeit einhergehen. Lehnt in diesem Fall ein Patient mit seinem naturlichen Willen die Behandlung ab und besteht parallel die Gefahr einer erheblichen gesundheitlichen Schadigung, kann unter definierten, engen Voraussetzungen eine Behandlung auch gegen den Patientenwillen erfolgen. Die Elektrokonvulsionstherapie (EKT) stellt hier aufgrund ihrer guten und zum Teil uberlegenen Wirksamkeit bei schweren oder auch pharmakotherapieresistenten affektiven und psychotischen Storungen eine wichtige Behandlungsoption dar. Darstellung der Grundlagen und allgemeinen Voraussetzungen therapeutischer Masnahmen gegen den naturlichen Patientenwillen. Ausgehend von einem Fallbericht erfolgt in einem interdisziplinaren Ansatz eine Diskussion und Bewertung des Einsatzes der EKT als arztliche Zwangsmasnahme aus klinischer, juristischer und ethischer Perspektive. Die (empirische) Evidenz zur allgemeinen Wirksamkeit der EKT wie auch zu ihrem Einsatz gegen den naturlichen Patientenwillen zeigt ein klar positives Nutzen-Risiko-Verhaltnis. Obwohl die EKT als arztliche Zwangsmasnahme, wie jede Behandlung gegen den naturlichen Patientenwillen, einen schweren Eingriff in das Grundrecht auf korperliche Unversehrtheit und das Selbstbestimmungsrecht darstellt, kann ihr Einsatz im Einzelfall medizinisch indiziert, rechtlich zulassig und ethisch geboten sein, um einen drohenden schwerwiegenden Gesundheitsschaden abzuwenden. Ethische wie auch rechtliche Voraussetzungen der Behandlung gegen den Patientenwillen sollten im multiprofessionellen Team gepruft und der gesetzliche Vertreter fruhzeitig einbezogen werden.

Menschen, die infolge einer schwerwiegenden psychischen Storung straffallig geworden sind und infolge dieser Storung weiterhin gefahrlich sind, konnen zur Besserung und Sicherung in den Masregelvollzug nach §§ 63 und 64 des Strafgesetzbuches (StGB) untergebracht werden. In Deutschland werden gegenwartig etwa 9000 Patienten in Kliniken fur forensische Psychiatrie und Psychotherapie auf Grundlage des § 63 StGB und in Entziehungsanstalten auf Grundlage des § 64 StGB stationar behandelt. Die Behandlung der Patienten im Masregelvollzug ist landerrechtlich geregelt, sodass sich die Rahmenbedingungen der Behandlung in den einzelnen Bundeslandern unterscheiden. Wahrend fur die Erstellung von Gutachten zur Schuldfahigkeit und zur Legalprognose bereits Mindestanforderungen publiziert worden sind, liegen konsentierte Standards fur die Behandlung im psychiatrischen Masregelvollzug bislang nicht vor. Vor diesem Hintergrund beauftragte die DGPPN 2014 eine interdisziplinare Arbeitsgruppe damit, fachliche Standards fur die Behandlung in der forensischen Psychiatrie zu erarbeiten. Dabei sollten die rechtlichen, ethischen, strukturellen, therapeutischen und prognostischen Standards nach dem aktuellen Stand der Wissenschaft beschrieben werden. Nach dreijahriger Bearbeitungsphase wurden die Ergebnisse der interdisziplinaren Arbeitsgruppe im Fruhjahr 2017 vorgelegt und vom Vorstand der DGPPN konsentiert. Die Standards fur die Behandlung im psychiatrischen Masregelvollzug wollen eine Diskussion anstosen mit dem Ziel, die Behandlungsbedingungen zu vereinheitlichen und fachlich begrundete Empfehlungen zu verankern.

Purpose The purpose of this paper is to discuss improvement of the business of health care delivery through the application of systematic problem solving. This was strengthened by recurrence prevention through standardization at every level transforming into culture. Design/methodology/approach The methodology utilized is set derived from the true fiber and fabric of Toyota, the Toyota Business Practice (TBP) or eight-step problem solving and its translation into health care thinking by aligning to the process of clinical diagnosis of patients. The methodology that gives energy and direction to TBP is Hoshin Kanri, a Japanese approach to strategic planning. When you combine focus and purpose through strategic direction alongside a culture of systematic problem solving you get results. Findings The application of the Toyota mindset resulted in a cultural shift which built on the strength of the current organizational culture. This approach had a broad impact on the program impacting leadership and management roles, improved employee engagement, complete visibility of organizational priorities, improved system performance, visibility and awareness of the vision and defined measures that drive the health care system. This has also resulted in cost diversions of approximately five million dollars CDN. Originality/value A grass roots application of real-time problem solving through strategic alignment.

Die palliative Versorgung schwer kranker und sterbender Menschen wirft eine Reihe schwieriger Fragen medizinischer, pflegerischer, versorgungstechnischer, aber auch ethischer und rechtlicher Art auf. Der folgende Beitrag beschaftigt sich mit den ethisch-rechtlichen Aspekten medizinischer Entscheidungen am Lebensende. Ausgehend von einem konkreten Fall werden zentrale medizinethische Prinzipien, verschiedene Formen der Sterbebegleitung und Sterbehilfe sowie die ethisch-rechtlichen Kriterien der Entscheidungsfindung vorgestellt. Daruber hinaus gibt der Beitrag praktische Hinweise zum Umgang mit Patientenverfugung und Stellvertreterentscheidungen, zu Entscheidungen in Notfallsituationen sowie zum Prozess der Entscheidungsfindung.

Der Begriff Advance Care Planning bezeichnet ein Konzept umfassender gesundheitlicher Vorausplanung, das u. a. darauf zielt, Menschen bei der Erstellung gesundheitlicher Vorausverfugungen, in denen Ziele und Wunsche fur zukunftige Behandlungen festgelegt werden, durch aufsuchende, qualifizierte Beratungsangebote zu unterstutzen. Weiterhin zielt dieses Konzept darauf, die Verbreitung und Umsetzung solcher Vorausverfugungen durch strukturelle, meist regionale Masnahmen zu fordern. Dieser Beitrag diskutiert Advance Care Planning in der Psychiatrie. Er stellt verschiedene Formen psychiatrischer Vorausverfugungen sowie exemplarisch rechtliche Regelungen aus den USA, aus Grosbritannien und aus Deutschland vor. Ferner beleuchtet er die internationale Studienlage zur Umsetzung von Advance Care Planning in der Psychiatrie. Diese belegt deutlich den Bedarf an qualifizierten Beratungs- und Unterstutzungsangeboten, da ohne solche Angebote psychiatrische Vorausverfugungen in der Praxis nur wenig Verbreitung und auch wenig Beachtung finden. Vor dem Hintergrund dieser Erfahrungen pladieren die Autoren dafur, (regionale) Advance-Care-Planning-Programme als Pilotprojekte zu etablieren mit dem Ziel, die Qualitat und die Akzeptanz gesundheitlicher Vorausverfugungen in der Psychiatrie zu erhohen. Diese Projekte sollten wissenschaftlich begleitet, evaluiert und ggf. angepasst werden.

Background Organ allocation guidelines in many countries give children relative priority, but the normative justification of child priority is seldom articulated. Methodology We conducted a scoping review of the recent international literature (2013–2019) to identify moral positions and normative frameworks to justify or criticize pediatric priority in all kind of organ allocation. We identified 11 relevant papers. Results Our analysis revealed a complex juxtaposition of pro and contra argumentations along three main normative lines: a) equal treatment of each individual, b) individual benefit, and c) social benefit and the public good. The general type of argument can be found independent of the organ allocated. For each of these three lines we identified and categorized two types of argumentations: those in favor and those critical of the priority rule. Additionally, we discuss a problematic issue that has not yet been mentioned in the literature, namely the effects of age thresholds related to child-priority rules in organ allocation. We illustrate this problem with an analysis of selected German data with allocated postmortal kidneys and livers. These data show non-normal distributions of organ transplantations and waiting times for patients between the ages of 16 and 19. Discussion Our overview serves as a matrix to reconsider existing guideline policy. The review can assist policy makers or experts on organ allocation committees in increasing the transparency of child priority rules, in explaining their justifications, and in reforming existing guidelines.

Seit den 1990er Jahren werden zunehmend Klinische Ethikkomitees in Krankenhausern unterschiedlicher Tragerschaft eingerichtet. Ihr Ziel ist, die Klarung moralischer Fragen bei Entscheidungsprozessen zu unterstutzen. Inzwischen haben sich ahnliche Modelle vom Krankenhaus in den Pflegeund ambulanten Bereich ausgeweitet. Nach einer letzten Untersuchung wurden bei einer Rucklaufquote von 29,6 % in 74,9 % aller deutschen Krankenhauser Strukturen Klinischer Ethikberatung implementiert, so dass mindestens 21 % aller deutschen Krankenhauser eine Klinische Ethikberatung etabliert haben; der tatsachliche Anteil durfte aber wahrscheinlich daruber liegen. 28 % der Krankenhauser haben einen Eintrag ihres Ethikkomitees auf ihrer Klinik-Homepage angegeben [unveroffentlichte Recherche Dorries A & Scheel E, August–Dezember 2014]. Es ist davon auszugehen, dass grosere Kliniken haufiger ein Ethikkomitee eingerichtet haben als kleinere [19]. Fur den ambulanten Bereich liegen bisher keine Zahlen vor. Zur Fortbildung in Klinischer Ethikberatung werden seit mehreren Jahren interdisziplinare Qualifizierungsprogramme, Inhouse-Schulungen und zahlreiche andere Veranstaltungen durchgefuhrt [4].1 Der Vorstand der Akademie fur Ethik in der Medizin (AEM) hat Standards fur Ethikberatung festgelegt [24] und eine Arbeitsgruppe in der AEM Empfehlungen fur ein Curriculum, die Dokumentation ethischer Fallbesprechungen und die Evaluation von Ethikberatung erarbeitet (s. FN 1).
