A pergunta que se pretende responder é: os deputados federais brasileiros são omissos ao debate da política externa? Para isso, levantam-se elementos que possibilitem a compreensão sobre o interesse congressual na política externa, especificamente na tramitação dos atos internacionais. A análise compreende o período de 1988 a 2014 com foco na Câmara dos Deputados. Testam-se duas hipóteses: 1) o tipo de ato internacional influencia positivamente na atuação parlamentar; 2) a atuação dos deputados exerce um efeito positivo sobre a probabilidade de atuação do Executivo. Por fim, percebe-se que os parlamentares atuam, de um lado, a partir da lógica da critical issue perspective e, do outro, constrangidos pela dinâmica Executivo-Legislativo. This paper intends to answer the following question: do the Brazilian federal deputies overlook the debates on foreign policy? To do so, we raise elements that allow the comprehension of the congressional interest on foreign policy, specifically on the processing of international acts. The analysis covers the period between 1988 and 2014, focusing on the Chamber of Deputies. We test two hypotheses: 1) the type of international act positively influences the parliamentary performance; 2) the deputies’ performance has a positive effect on the likelihood of executive actions. Finally, it is clear that deputies act, on the one hand, according to the logic of the critical issue perspective and, on the other hand, constrained by the executive-legislative dynamics. La question à laquelle l’on prétend répondre est la suivante: les députés fédéraux brésiliens sont-ils omis par rapport au débat sur la politique étrangère ? Pour cela, des éléments sont soulevés qui permettent de comprendre l’intérêt du Congrès pour la politique étrangère, en particulier en ce qui concerne les procédures par rapport aux actes internationaux. L’analyse comprend la période 1988-2014 en mettant l’accent sur la Chambre des députés. Deux hypothèses sont testées : 1) Le type d’acte international influence positivement l’action parlementaire ; 2) l’action des députés a un effet positif sur la probabilité d’action de l’exécutif. En conclusion, nous constatons que les parlementaires travaillent, d’une part, à partir de la logique de la critical issue perspective et, d’autre part, intimidés par la dynamique des pouvoirs exécutif et législatif

O artigo analisa a ação dos senadores brasileiros na deliberação dos atos internacionais negociados pelo poder Executivo. Um ponto central defendido é que os parlamentares são atores interessados em discutir e analisar questões de política externa. Os preceitos constitucionais impõem limites significativos à ação congressual ao impedir a apresentação de emendas aos atos internacionais ou impossibilitar o controle ex ante, razão pela qual se faz necessária uma busca por outros mecanismos de aferição da atuação parlamentar. Há ocorrências de outras formas de participação dos parlamentares no processo deliberativo, assim como situações de acirrada divergência quanto ao conteúdo substantivo de certos atos internacionais. Parlamentares desinteressados não desperdiçariam tempo e energia debatendo questões que não lhes interessam. This article analyses the action of Brazilian Senators in the deliberation of international acts negotiated by the executive branch. A central point here argued is that lawmakers are interested actors in discussing and analyzing matters of Foreign Policy. Constitutional precepts put significant limits on congressional action, when prevent the submission of amendments to international acts or the impossibility to exercise control ex ante, which is the reason that makes it necessary to look for other mechanisms in order to measure the parliamentary action. The work demonstrates not only occurrences of different forms of participation of parliamentarians in the deliberative process, but also exemplify heated disagreement situations among them, when it comes to the substantive content of certain international acts. Uninterested lawmakers do not waste time and energy debating questions that do not interest them. L'article analyse l'action des sénateurs brésiliens dans la délibération des actes internationaux négociés par le pouvoir Exécutif. Il défend surtout que les parlementaires sont des acteurs intéressés dans la discussion et l'analyse de questions de politique externe. Les préceptes constitutionnels imposent des limites significatives à l'action parlementaire en empêchant la proposition d'amendements aux actes internationaux ou en empêchant le contrôle ex ante, raison par laquelle il est nécessaire de chercher d'autres mécanismes d'évaluation de l'action parlementaire. Il existe d'autres moyens de participation des parlementaires dans le processus délibératif ainsi que des situations de profonde divergence quant au contenu substantif de certains actes internationaux. Des parlementaires désintéressés ne gaspillent pas leur temps et leur énergie à débattre des questions qui ne les intéressent pas.

O artigo analisa a atuação dos deputados federais no exercício de suas funções tanto de "controle legislativo" quanto de "controle político" na deliberação dos atos internacionais. A literatura tende a indicar que no Brasil há déficit em matéria de controle legislativo e, no campo das Relações Internacionais, o diagnóstico não é muito diferente. A reconstituição do trâmite legislativo dos projetos de decreto legislativo (PDL) permitiu-nos identificar o padrão de interação entre os poderes, com a constatação de que o Executivo domina a deliberação dos acordos internacionais. Para além do fato do Legislativo ter somente a prerrogativa de apresentar ressalvas aos decretos legislativos, o Executivo tem como controlar o tempo para deliberação dos atos internacionais nas comissões permanentes e a indicação dos relatores na maioria dos casos. Em resumo, mais até do que na política doméstica, os preceitos da Constituição Federal e os mecanismos de controle da agenda à disposição do poder Executivo restringem significativamente o campo de atuação do poder Legislativo na deliberação dos acordos internacionais, principalmente no que diz respeito ao "controle legislativo". A eficácia de mecanismos de controle do tipo "político", como os pedidos de informação, ficam circunscritos a possíveis constrangimentos de ordem eleitoral. This article analyzes how federal representatives have exercised their functions in both "legislative" and "political" control in deliberation around international acts. The literature in the field seems to indicate that in Brazil, legal control is faulty, and that within the field of International Relations, much the same could be said. A reconstitution of legislative procedures regarding legislative bills (PDL) has enabled us to identify patterns of interaction of powers, showing that the Executive prevails in deliberations on international agreements. Beyond the fact that the Legislature has only the prerogative of presenting objections to these bills, the Executive must control the time that deliberation on international acts is able to take within permanent commissions and, in most cases, the nomination of relaters. In short, even more than within domestic politics, the precepts of the Federal Constitution and the control mechanisms for the agenda that is available to Executive power place significant restrictions on operating fields in deliberations on international agreements, primarily with regard to "legislative control". The efficacy of control mechanisms of the "political" type, such as requests for information, remain circumscribed by the potential constraints of the electoral order. L'article analyse l'actuation des députés fédéraux dans l'exercice de leurs fonctions de "contrôle législatif " et aussi de "contrôle politique", dans la délibération des actes internationaux. La littérature tend à indiquer qu'au Brésil, il y a un déficit en matière de contrôle législatif et, dans le domaine des Relations Internationales, le diagnostique n'est pas très différent. La reconstitution des procédures législatives des projets de décret législatif (PDL), nous a permis d'identifier le standard d'interaction entre les pouvoirs, avec la constatation que l'Exécutif domine la délibération des accords internationaux. En plus du fait que le Législatif a seulement la prérogative de présenter des exceptions aux décrets législatifs, l'Exécutif a une façon de contrôler le temps pour la délibération des actes internationaux dans les commissions permanentes et l'indication des rapporteurs dans la majorité des cas. En résumé, plus encore que dans la politique intérieure, les préceptes de la Constitution Fédérale et les mécanismes de contrôle de l'agenda à disposition du pouvoir Exécutif, limitent de manière significative le domaine de performance du pouvoir Législatif dans la délibération des accords internationaux, principalement par rapport au "contrôle législatif". L'efficace de mécanismes de contrôle du type "politique", comme les demandes d'information, restent circonscrits aux possibles contraintes d'ordre électorale.
