We propose to include dimensions of justice more explicitly into institutional and policy analysis of environmental governance. We investigate how alternative frameworks for the analysis of environmental institutions - the IAD framework by Elinor Ostrom, the Environmental Governance framework by Arild Vatn, and the Diagnostic Approach by Oran Young - address concerns of justice.More specifically, we ask: (1) What dimensions and elements of justice are relevant for institutional analysis and design? (2) Do these dimensions appear in existing frameworks for institutional analysis?And (3) if not, can these frameworks be adapted to include core elements of justice? Based on the political philosophy literature on justice the authors develop a check-list of different dimensions and aspects of justice, which they use when analyzing the different frameworks for institutional analysis. We find that the investigated frameworks, although not explicitly excluding questions of justice, do not fully exploit their potential to consider different dimensions and categories of justice. Drawing on the conceptual analysis as well as on the limited examples of empirical studies which examined justice as part of an institutional analysis, we suggest ways to improve the analysis of justice in institutional analysis frameworks.

This habilitation thesis consists of seven published journal articles and one published book chapter. Part I, consisting of chapter 1, introduces the overarching theme of environmental policy instruments and discusses the current use of and prospects for economic instruments in conservation policies. A number of research gaps are identified which are addressed in the subsequent chapters. Part II, consisting of chapters 2–5, encompasses four papers focused on a single type of policy instrument: intergovernmental fiscal transfers. Although well documented in public finance literature, intergovernmental fiscal transfers remain a somewhat neglected instrument in environmental policy. Despite being well suited to address the spillover benefits that often accrue with conservation policies, there is scant research literature on ecological fiscal transfers compared to other economic instruments such as environmental taxes or tradable permits. In fact, very few countries make practical use of them to achieve conservation objectives. Thus intergovernmental fiscal transfers are an innovative instrument in conservation policies in particular, so that advances in both theory and applied research may prove especially beneficial here. Part III, consisting of chapters 6–9, combines a number of articles in integrative biodiversity research and applied biodiversity governance, themes that are often neglected in the economic analysis of environmental policy instruments. However, when implementing policy instruments in societal settings, interdisciplinary research bridging the natural and social sciences is as much a prerequisite as policy-relevant research that responds to the needs of decision makers and other stakeholders. Both policy design and policy evaluation yield the best outcomes when they involve ecologists, economists, legal and other social scientists, as this ensures that consideration is given to ecological effectiveness, economic efficiency, administrative feasibility, social acceptance, and perception by stakeholders. Policy-relevant research also responds to current societal developments and prospective changes in legislation which may provide windows of opportunity to propose new instruments. Meanwhile, sound empirical research and case study design are indispensable in making concrete policy recommendations, taking into account existing formal and informal institutions.

This thesis is written within the contemporary classical institutional economics tradition. The intention has been to provide insight into how different institutions can enable us to avoid harmful effects and generate beneficial effects on the environment and food security from genetically modified organisms (GMOs). This is done by analysing how institutions influence perspectives on GMOs, the GMOs that are developed and commercialized, as well as our ability to handle possible uncertain and unknown effects of GMOs. The thesis consists of 4 papers. Paper 1 analyses scientists’ perspectives on the release of GMOs into the environment, and the relationship between their perspectives and the institutional context that they work within, e.g. their place of employment (university or industry), funding of their research (public or industry) and their disciplinary background (ecology, molecular biology or conventional plant breeding). Q-methodology is employed to examine these issues. Two distinct perspectives are identified by interviewing 62 scientists. Perspective 1 is characterised by a moderately negative attitude to GMOs and the uncertainty and ignorance involved are emphasised. Perspective 2 is characterised by a positive attitude to GMOs and it is emphasised that GMOs are useful and do not represent any unique risks compared to conventional crops. The results show a strong association between scientists’ perspective on GMOs and the explanatory variables training, funding and place of employment. Paper 2 analyses how different institutional structures shape the research and development (R&D) of GMOs. Whether this R&D is conducted within companies, cooperatives or public research organisations is expected to influence the type of crops and traits that are developed and therefore the effects on society and ecosystems that potentially could follow from the use of GMOs. This issue is analysed empirically by statistical analysis of 1323 notifications for field trials with GMOs in the EU. The results show that the type of R&D organisation influences strongly the traits and crops that are developed. Paper 3 analyses how the type of regulation for marketing of GMOs influences which GMOs that are commercialised. The EU and Norway have assessed the release of GMOs as commercial products quite differently. Of twenty four notifications approved by the EU, Norway has approved four, rejected ten, and has ten pending. The paper examines whether these differences could be explained by different judgments concerning the effects to be prevented and encouraged, response to uncertainty and and the burden of proof defined. Norwegian rejections are found to be explicable by the combination of no real benefit to society, lack of scientific knowledge, and involved risks. The main explanation for the EU approvals is that they see no reason to believe that there will be any adverse effects on health and the environment. Paper 4 analyses how capable three different governance regimes are for adequate handling of uncertain and unknown effects of GMOs. GMOs are characterized by strong uncertainty. This implies that procedures for identification, reduction and monitoring of uncertainty, as well as how to treat irreducible uncertainty will be highly incomplete. Governance mechanisms that facilitate cooperative adaptation and communicative rationality (communicate with the intention of reaching agreement exclusively via the force of better arguments) are therefore needed. The three governance regimes compared are: GMOs are produced by private firms and these firms are made liable for harm (GR1), GMOs are produced by private firms and the government decides whether the crops should be marketed (GR2), GMOs are produced by public research organisations and the government decides whether the crops should be marketed (GR3). GR3 will be stronger in cooperative adaptation and communicative rationality than GR2. Public research organisations have fewer conflicts of interest with the government than private firms, and academic norms are important as opposed to firms where commercial norms are important. Difficulties in proving harm and identifying the responsible firm will make GR1 weak in cooperative adaptation and communicative rationality. Based on the results of this thesis it is advised that consideration of the environment and food security justify institutional reforms concerning how we decide which GMOs that should be released into the environment and how we organise the R&D of GMOs. My analysis suggests that it is important to involve scientists from several disciplines in public marketing decisions on new technologies and that information about the contextual background of the scientists is relevant in these decisions. There are strong arguments for changing current practise where those that apply for marketing approval of GMOs also produce the risk assessment prior to marketing and the post marketing monitoring. It is further important to increase public GMO research to secure scientific advices and development of products that are independent from the priorities of the industry and to a greater extent could serve public needs. Denne avhandlinga er skrevet innenfor en moderne, klassisk institusjonell økonomisk tradisjon. Hensikten har vært å frambringe kunnskap om hvordan ulike institusjoner kan gjøre oss i stand til å unngå skadelige og å frambringe gunstige effekter av genetiske modifiserte organismer (GMOer) på miljø og matvaresikkerhet. Dette er gjort ved å analysere hvordan institusjoner påvirker perspektiver på GMOer, hvilke GMOer som utvikles og kommersialiseres, samt vår evne til å håndtere usikre og ukjente effekter av GMOer. Avhandlinga består av 4 artikler. Artikkel 1 analyserer 62 forskeres syn på effekter av GMOer, og sammenhengen mellom synet deres og den institusjonelle konteksten de arbeider i, i form av type arbeidsplass (universitet eller industri), finansiering av forskning (offentlig eller privat) og fagdisiplin (økologi, molekylær biologi, eller tradisjonell planteforedling). Ved bruk av Q-metode ble to ulike syn identifisert. Syn 1 innebar en moderat negativ holdning til GMOer og vektla usikkerhet og uvitenhet. Syn 2 innebar en positiv holding til GMOer og vektla at GMOer er nyttige og ikke vesentlig forskjellige fra konvensjonelle landbruksvekster. Resultatene viser en sterk sammenheng mellom forskeres syn på GMOer og forklaringsvariablene utdanning, finansiering og type arbeidsplass. Artikkel 2 analyserer hvordan ulike institusjonelle strukturer former forskning og utvikling (F&U) av GMOer. Vi forventa at om denne F&U blir gjort enten i private bedrifter, landbrukssamvirker, eller offentlige forskningsorganisasjoner påvirker hvilke arter og egenskaper som blir utvikla og dermed hvilke samfunns- og miljøeffekter som kan følge fra GMOer. Vi studerte dette ved hjelp av statistisk analyse av 1323 søknader om feltforsøk med GMOer i EU. Resultatene viser en sterk sammenheng mellom type forskningsorganisasjon og hvilke arter og egenskaper som blir utvikla. Artikkel 3 analyserer hvordan type regulering for omsetning av GMOer påvirker hvilke GMOer som blir godkjent for kommersiell bruk. Den europeiske unionen (EU) og Norge har vurdert søknader om omsetning av GMOer forskjellig. Av 24 søknader som er godkjent av EU, har Norge godkjent fire, avvist ti og ikke tatt stilling til ti. Artikkelen analyserer om disse forskjellene kan forklares med ulike vurderinger av hvilke effekter som er ønska og uønska, hvordan man reagerer på usikkerhet og uvitenhent og hva som er en rimelig bevisbyrde. De norske avslaga kan forklares med at de ikke kunne se at GMO-søknadene hadde samfunnsmessig nytteverdi eller var bærekraftige, samt at de vektla uheldige miljøeffekter og mangel på vitenskapelig kunnskap. Hovedforklaringen på godkjennelsene i EU er at de ikke fant noen grunner til at skadelige effekter ville inntreffe. Artikkel 4 analyserer hvor egna tre ulike regimer er for å håndtere usikre og ukjente effekter av GMOer. Stor usikkerhet knytta til GMOer medfører at prosedyrer for å identifisere, redusere og overvåke usikkerhet, samt hvordan man skal håndtere ikkereduserbar usikkerhet blir ufullstendige. Styringsmekanismer som legger til rette for samarbeidsvilje og kommunikativ rasjonalitet (kommunikasjon som har til hensikt å oppnå enighet ved bruk av argumenter) blir derfor viktig. Følgende tre regimer er sammenligna: GMOer produseres i private bedrifter og disse bedriftene er ansvarlige for eventuelle skader (R1), GMOer produseres i private bedrifter og myndighetene bestemmer hvilke GMOer som kan omsettes i markedet (R2), GMOer produseres i offentlige forskningsorganisasjoner og myndighetene bestemmer hvilke GMOer som kan omsettes i markedet (R3). Det er sannsynlig at R3 vill føre til bedre samarbeidsvilje og mer kommunikativ rasjonalitet enn R2. Offentlige forskningsorganisasjoner har færre interessekonflikter med myndighetene enn de private, og de er i større grad karakterisert av akademiske normer. Kommersielle normer har derimot en større plass i private bedrifter. Vanskeligheter med å bevise skade og skadegjører kan føre til at R1 gir svak samarbeidsvilje og lite kommunikativ rasjonalitet. Funnene i avhandlingen innebærer at dersom hensyn til miljø og matvaresikkerhet er viktige, bør man gjennomføre institusjonelle endringer av hvordan man beslutter hvilke GMOer som kan omsettes i markedet og hvordan samfunnet organiserer F&U av GMOer. Min analyse antyder at det er viktig å involvere forskere fra ulike disipliner i offisielle beslutninger om hvilke GMOer som kan omsettes og at informasjon om den kontekstuelle bakgrunnen til disse forskerne er relevant. Det er sterke argumenter for å endre dagens praksis hvor de som søker om å få omsette GMOer i markedet også gjennomfører risikovurderingen og overvåkningen. Det synes videre viktig å øke andelen offentlig GMO-forskning for å sikre vitenskapelige råd som er uavhengige av industrienes prioriteringer og som i større kan tjene samfunnets interesser.

Jordbruket produserer mer enn bare varer som kan omsettes i markeder. I tillegg produseres en lang rekke goder, onder og tjenester som ikke kan omsettes i markeder. Jordbruket kan på grunn av dette gi bidra til ulike samfunnsmessige mål samtidig. Dette er essensen i det multifunksjonelle landbruket. Mengdene av de ”produktene” som ikke kan omsettes i markedet vil ikke være samfunnsmessig optimale siden produsentene, dvs. bøndene, ikke får de rette signalene gjennom markende. En måte å korrigere for disse eksternalitetene på, som er hovedtema i avhandlingen, er å betale/skattlegge bøndene direkte basert på hvor mye de produserer av de ulike godene, ondene og tjenestene. Imidlertid, dette er ikke den eneste muligheten, og i en del tilfeller er dette ikke den optimale løsningen. Mange av ”produktene” fra jordbruket er koblet i den forstand at dersom en endrer mengden av ett endres også mengden av ett eller flere andre. Dette, som kalles koblet produksjon eller jointness på engelsk, skyldes enten tekniske og biologiske prosesser eller økonomiske faktorer som faste allokerbare innsatsfaktorer. Dersom vi kjenner disse sammenhengen, vil ulike kombinasjoner av skatlegging/subsidiering av innsatsfaktorer, ”produkter” og praksiser føre til de ønskede mengdene sett fra samfunnets side. I en slik situasjon vil den optimale politikken være den som fører til de laveste administrasjonskostnadene. To av artiklene i denne avhandlingen omhandler virkemidler for å redusere nitrogenforurensingen fra jordbruket. Siden forurensingen fra hver gård eller hvert skifte ikke kan måles eller er veldig kostbar å måle, vil ikke direkte skattlegging av forurensingen være mulig/fornuftig. Den første artikkelen analyserer effekten av private transaksjonskostnader i et marked for omsettelige gjødselkvoter. Det blir vist at transaksjonskostnadene i liten grad påvirker handelen i kvotemarkedet, og at omsettelige kvoter har den forventede miljøeffekten. Den andre artikkelen analyserer en mulighet for å fjerne noe av usikkerheten knyttet til hva som er optimal gjødsling det enkelte år. Det foreslåtte virkemidlet er et system med delte kvoter. Den første delen av kvoten blir tildelt om våren og er lik hvert år, mens den andre delen blir tildelt senere basert på hva som anses som optimal gjødsling hvert enkelt år. Resultatene indikerer at virkemidlet gir reduksjoner i forurensingen til en lavere kostnad (både for samfunnet og for bonden) enn en avgift på gjødsel. De to andre artiklene er knyttet til transaksjonskostnader og optimal politikk når produksjonen er koblet. Transaksjonskostnadene er mye lavere når virkemidlene er knyttet til varer enn når de er knyttet til andre objekter. Dersom koblingen er slikt at bonden ikke kan påvirke den, er virkemidler knyttet til varer helt klart det optimale for å korrigere for eksternaliteter. Dersom koblingen er mer fleksibel, er det ikke mulig å trekke generelle konklusjoner. Forskjellene i transaksjonskostnader mellom ulike mulige virkemidler vil imidlertid fortsatt være avgjørende. Analysene viser også at transaksjonskostnadene kan reduseres betydelig gjennom å redusere antallet virkemidler. Dette er ikke overraskende, men det er overraskende hvor fort transaksjonskostnadene øker når en øker antallet virkemidler (og holder den totale overføringen konstant). For et land som ikke er konkurransedyktig på verdensmarkedene, som Norge, indikerer analysene at den optimale politikken er å bruke prisstøtte (direkte og indirekte) for å sikre produksjon på et vist nivå, og å supplere dette med andre virkemidler som for eksempel direkte støtte for å produsere miljøgoder. Det første vil føre til et vist nivå av de kollektive godene, mens det siste kan brukes for å finjustere produksjonen av dem. Agriculture produces more than just commodities that can be and are traded in markets. In addition, agriculture provides a large range of non-market outputs in the form of goods, bads and services. These multiple outputs may contribute to different societal objectives at once, which is the essence of the concept of multifunctional agriculture. The quantities of the non-market goods, bads and services may not be socially optimal since the producers do not receive the right signals through the markets. One option for correcting for these externalities is to use direct payments/taxes based on level of the non-market outputs. However, this is not the only options, and in some cases this is definitely not the optimal option. Many of the outputs in agriculture are linked in such a way that a change in the level of one will affect the levels of the others. This, termed jointness, is due to technical and biological processes and economic factors like fixed allocable inputs. If these relationships are known, different combinations of taxes/subsidies on inputs, outputs and practices may be used to induce the socially desirable levels of the agricultural outputs. In this setting the optimal policy mix is the mix that results in lowest administrative costs. Two of the papers in this thesis discuss policy measures to reduce nitrogen pollution from agriculture. Since pollution at farm or field level is not observable or very costly to monitor, taxing emissions directly is not a viable option. The first paper analyzes the effect of private transaction costs in a market for fertilizer quotas. It is shown that transaction costs do not influence trade much, and that tradable fertilizer quotas have the expected environmental effects. The second paper analyzes one option for resolving some of the uncertainty about the growing conditions a given year. The proposed instrument is a two-round quota system: a year independent amount is awarded in the spring while the quota in the second (later) round is awarded based on the expected optimal fertilization level the given year. Results indicate that abatement costs (both private and social) are lower for the proposed instrument than for a nitrogen tax. More research is needed in order to investigate the possibility and costs of estimating the yearly optimal fertilization levels ex ante. The two other papers concern transaction costs and optimal policies under jointness. Transaction costs are much lower for polices targeting commodities than for polices targeting other objects. If jointness is such that it is not possible for the farmer to influence the proportions of the different outputs it is clearly optimal to target the commodity. For more flexible forms of jointness it is not possible to draw a general conclusion. Still, the differences in transaction costs between policy options are of great importance. The analysis also shows that transaction costs can be reduced substantially by reducing the number of schemes. It is not surprising that merging schemes would result in lower administrative costs, but it is surprising how fast the total transaction costs increase as the number of schemes increases (given a total transfer to farmers). For a country that is not competitive on the world market, like Norway, the analysis suggests that the optimal policy is to use commodity based support to induce production up to a certain level and to supplement this with other measures like direct payment for the production of public goods. The first will insure a certain level of public goods production wile the latter may be used for fine-tuning public goods production.

The issue of the usefulness of different prosopis species versus their status as weeds is a matter of hot debate around the world. The tree Prosopis juliflora had until 2000 been proclaimed weedy in its native range in South America and elsewhere in the dry tropics. P. juliflora or mesquite has a 90-year history in Sudan. During the early 1990s a popular opinion in central Sudan and the Sudanese Government had begun to consider prosopis a noxious weed and a problematic tree species due to its aggressive ability to invade farmlands and pastures, especially in and around irrigated agricultural lands. As a consequence prosopis was officially declared an invasive alien species also in Sudan, and in 1995 a presidential decree for its eradication was issued. Using a total economic valuation (TEV) approach, this study analysed the impacts of prosopis on the local livelihoods in two contrasting irrigated agricultural schemes. Primarily a problem-based approach was used in which the derivation of non-market values was captured using ecological economic tools. In the New Halfa Irrigation Scheme in Kassala State, four separate household surveys were conducted due to diversity between the respective population groups. The main aim was here to study the magnitude of environmental economic benefits and costs derived from the invasion of prosopis in a large agricultural irrigation scheme on clay soil. Another study site, the Gandato Irrigation Scheme in River Nile State represented impacts from prosopis that an irrigation scheme was confronted with on sandy soil in the arid and semi-arid ecozones along the main River Nile. The two cases showed distinctly different effects of prosopis but both indicated the benefits to exceed the costs. The valuation on clay soil in New Halfa identified a benefit/cost ratio of 2.1, while this indicator equalled 46 on the sandy soils of Gandato. The valuation results were site-specific and based on local market prices. The most important beneficial impacts of prosopis on local livelihoods were derived from free-grazing forage for livestock, environmental conservation of the native vegetation, wood and non-wood forest products, as well as shelterbelt effects. The main social costs from prosopis were derived from weeding and clearing it from farm lands and from canalsides, from thorn injuries to humans and livestock, as well as from repair expenses vehicle tyre punctures. Of the population groups, the tenants faced most of the detrimental impacts, while the landless population groups (originating from western and eastern Sudan) as well as the nomads were highly dependent on this tree resource. For the Gandato site the monetized benefit-cost ratio of 46 still excluded several additional beneficial impacts of prosopis in the area that were difficult to quantify and monetize credibly. In River Nile State the beneficial impact could thus be seen as completely outweighing the costs of prosopis. The results can contributed to the formulation of national and local forest and agricultural policies related to prosopis in Sudan and also be used in other countries faced with similar impacts caused by this tree. Prosopis juliflora -laji oli vuoteen 2000 mennessä määritelty rikkakasviksi sen alkuperäisillä kotiseuduilla Etelä-Amerikassa sekä muualla kuivassa tropiikissa. Myös mesquite-puuna tunnettu P. juliflora tuotiin 90 vuotta sitten Sudaniin.Yleinen mielipide Keski-Sudanissa sekä maan hallitus alkoivat jo 1990-luvun alussa pitää prosopista haitallisena rikkakasvina, koska sillä on kyky vallata viljely- ja laidunmaita etenkin keinokastelluilla alueilla. Tämän seurauksena prosopis määriteltiin haitalliseksi vieraslajiksi myös Sudanissa, ja vuonna 1995 hyväksyttiin laki sen hävittämiseksi koko maasta. Tutkimus analysoi kokonaisvaltaisen ekonomisen analyysin (TEV) avulla mitä haittoja ja hyötyjä prosopis on tuottanut kahden sudanilaisen keinokastelualueen kotitalouksien toimentulossa. Tavoitteena oli tuottaa prosopiksen vaikutuksia ja lajin torjunnan tarvetta tai mahdollisuuksia selvittävää tietoa Sudanin metsä- ja maatalouspolitiikan päätöksentekijöille. Tutkimuksessa käytettiin ongelmakeskeistä lähestymistapaa, jossa markkinahinnoittamattomien tuotteiden, palveluiden ja haittojen taloudelliset arvot määritettiin ekologis-taloudellisin menetelmin. Työ toteutettiin kahdella olosuhteiltaan toisistaan poikkeavalla alueella. Keski-Sudanin savitasangolla Kassalan osavaltiossa sijaitsevassa New Halfan keinokasteluprojektissa tehtiin neljä erillistä haastattelututkimusta toisistaan selväsi erottuvien etnisten ryhmien keskuudessa. Päätavoite oli selvittää eri väestöryhmien toimentulon muodot ja sisäiset tulonjaot sekä niihin liittyvät prosopiksen tuottamat ekologis-taloudelliset hyödyt ja haitat. Toinen kohde, Gandaton keinokastehanke Niilin osavaltiossa Pohjois-Sudanissa edusti prosopiksen vallitsemaa hyvin kuivaa hiekkamaan aluetta Niilin pääuoman varrella. Täällä haastattelututkimus käsitti 70 kotitaloutta yhtenä ryhmänä. Prosopiksen hyödyt ja haitat olivat eri kohdealueilla selvästi erilaiset mutta hyöty oli kummassakin tapauksessa haittaa suurempi. Savimaalla New Halfassa prosopiksen hyöty-kustannus-suhteeksi tuli 2,1 kun taas tämä suhde oli Gandaton hiekka-alueella peräti 46. Viimeksi mainittu suhdeluku jätti vielä huomioimatta sellaisia prosopiksen hyötyvaikutuksia, joita ei kyetty mittaamaan eikä siten myöskään arvottamaan tämän tutkimuksen puitteessa. Suurimmat prosopiksen hyötyvaikutukset olivat sen käyttö polttopuuna ja karjan rehuna sekä paikallisen alkuperäisen kasvillisuuden käyttöä vähentävänä vaihtoehtoisena luonnonvarana. Sillä oli myös merkitystä tuulensuojana ja hiekka-aavikon leviämisen estäjänä. Suurimmat prosopiksen haitat koituivat sen torjunnan kustannuksista pelloilla ja kastelukanavien varsilla sekä sen piikkisyyden aiheuttamista tapaturmista sekä vahingoista kotieläimille ja kulkuneuvoille. Eri väestöryhmistä vuokraviljelijät kärsivät eniten prosopiksen haittavaikutuksista, kun taas maattomat, Länsi- ja Itä-Sudanista saapuneet perheet olivat erittäin riippuvaisia tästä luonnovarasta. Tuloksia voidaan osittain myös hyödyntää muissa maissa joissa tarvitaan tietoja prosopiksen haitoista ja hyödyistä taikka tämä puulajin torjunnan tarpeesta ja mahdollisuuksista.
