Dissertação de Mestrado em Direito apresentada à Faculdade de Direito RESUMOEm tempos de constantes e importantes demandas, principalmente das esferas políticas, económicas e sociais levadas ao Judiciário, nos deparamos com, no mínimo, três possíveis situações: a primeira, onde o Judiciário se posiciona estritamente quanto aos aspetos jurídicos da demanda; a segunda, quando o posicionamento extrapola os aspetos jurídicos apresentando uma postura ativista ou judicialista; e o terceiro, quando ao posicionamento do Judiciário frente a essas demandas que se embasam no sentido de não extrapolar seus limites constitucionais, respeitando a independência e soberania dos poderes, porém sem que esta seja uma postura presa a interpretação da lei, uma postura autocontida. A problemática central dessa dissertação reside em verificar as relações entre os poderes, que fazem com que o Judiciário esteja maioritariamente voltado a se posicionar de forma ativista e judicialista, em outras palavras, o estudo da judicialização da política e da politização da justiça. Observamos que essa postura não está intrinsecamente ligada à vontade do Judiciário agir de tal forma, mas também se relaciona tanto na interferência que o Executivo e o Legislativo fazem historicamente no Judiciário, quanto na própria incompetência em cumprir seus papéis constitucionais com plenitude. Based on the study of the evolution of Thai constitutional law and its underlying doctrines from its very origins onwards, this dissertation identifies the core principle of the Thai polity as being royal sovereignty. It was built on material and doctrinal constitutional borrowings, that have, through successive sedimentation, created a specifically Thai doctrine of royal power making the King the supreme constituant power, the interpret of dharma and custom, to which positive law is subordinate. In Europe « medieval constitutionalism » took from the King the power to modify the fundamental laws of the realm, modern constitutionalism tended to take his « Majesty» away, and finally, « new constitutionalism » transferred his role as guardian of the constitution to the judicial power or a constitutional court. In Siam and later in Thailand, the monarchy used Western constitutional ideas and mechanisms to institutionalize and transform while at the same time maintaining the doctrine of royal sovereignty and its effective practice. As a result, constitutional instability has neutralized the development of parliamentarism necessary to make the Thai political regime converge towards its official British constitutional model. This finding opens the question of the transferability of the Bristish constitutional conventions unwritten rules at the heart of British parliamentary system, as they are but a crystallization of legal constraints proper to a specific constitutional history., Cette thèse dégage, à partir de l'étude des mutations du droit constitutionnel thaïlandais et des doctrines qui le sous-tendent depuis ses plus lointaines origines, le point cardinal de l'ordre politique thaïlandais, identifié comme étant la souveraineté du roi. La construction de la souveraineté monarchique s'est appuyée sur des emprunts étrangers formant, par sédimentations successives, une doctrine proprement thaïlandaise du pouvoir royal l'érigeant en constituant suprême, seul interprète du dharma et de la coutume, auxquels le droit positif serait par nature inféodé. Si, en Europe, le « constitutionnalisme médiéval » a soustrait au roi le pouvoir de modification des lois fondamentales du royaume, le constitutionnalisme moderne a eu tendance à le dépouiller de sa « majesté », et enfin, le néoconstitutionnalisme a transféré son rôle de gardien de la constitution au pouvoir judiciaire ou à un organe spécialisé de contrôle de la constitutionnalité des lois, au Siam puis en Thaïlande, la royauté a su utiliser les innovations constitutionnelles occidentales pour s'institutionnaliser et se transformer tout en maintenant l'affirmation doctrinale de sa souveraineté et son exercice effectif. L'instabilité constitutionnelle chronique qui en résulte a pour effet de neutraliser le développement du parlementarisme nécessaire à la convergence du régime politique thaïlandais vers son modèle britannique. Sont ainsi posés les jalons d'une réflexion sur l'impossibilité du transfert des conventions de la constitution, règles non-écrites qui forment le cœur du droit parlementaire britannique, en tant que cristallisation de contraintes juridiques propres à une histoire constitutionnelle spécifique., วิทยานิพนธ์นี้สกัดประเด็นปัญหาอันเป็นหัวใจสำคัญของระบบการเมืองไทยในเรื่องอำนาจอธิปไตยเป็นของกษัตริย์ โดยศึกษาการปรับตัวของกฎหมายรัฐธรรมนูญไทยและลัทธิวิชาการซึ่งช่วยสร้าคำอธิบายที่เกี่ยวข้องนับตั้งแต่เริ่มต้น การก่อร่างสร้างตัวของอำนาจอธิปไตยแบบกษัตริย์อาศัยการหยิบยืมจากต่างประเทศมาอย่างต่อเนื่องจนตกผลึก โดยลัทธิวิชาการในแบบฉบับของไทยโดยเฉพาะเพื่อยืนยันว่ากษัตริย์เป็นผู้ทรงอำนาจสูงสุดในการสถาปนารัฐธรรมนูญ กษัตริย์แต่เพียงผู้เดียวที่เป็นผู้ตีความธรรมะและประเพณี และกฎหมายที่ใช้บังคับในรัฐต้องจำนนต่อธรรมะและประเพณี ในยุโรป “รัฐธรรมนูญนิยมในยุคกลาง” ทำให้กษัตริย์ไม่มีอำนาจในการแก้ไขเปลี่ยนแปลงกฎหมายพื้นฐานของราชอาณาจักร รัฐธรรมนูญนิยมสมัยใหม่พยายามตัดขาดอำนาจสูงสุดเด็ดขาดของกษัตริย์ และในท้ายที่สุด “รัฐธรรมนูญนิยมใหม่” ก็ได้ถ่ายโอนบทบาทในการพิทักษ์รัฐธรรมนูญให้แก่ศาลหรือองค์กรพิเศษที่จัดตั้งขึ้นโดยเฉพาะเพื่อทำหน้าที่ตรวจสอบความชอบด้วยรัฐธรรมนูญของกฎหมาย แต่ในสยาม ซึ่งต่อมากลายเป็นประเทศไทยนั้น กษัตริย์ได้ใช้นวัตกรรมทางรัฐธรรมนูญของตะวันตกเพื่อทำให้ตนเองกลายเป็นสถาบันและทำให้ตนเองเปลี่ยนรูป โดยอาศัยลัทธิวิชาการที่ยืนยันว่าอำนาจอธิปไตยเป็นของกษัตริย์และกษัตริย์ใช้อำนาจอธิปไตยนั้นอย่างแท้จริง ความไร้เสถียรภาพทางรัฐธรรมนูญที่เกิดอย่างต่อเนื่องส่งผลให้การพัฒนาระบบรัฐสภาในระบอบการเมืองไทยเพื่อให้เป็นไปตามรูปแบบอังกฤษนั้นสะดุดลง เช่นกัน เป็นไปไม่ได้ที่จะถ่ายโอนธรรมเนียมปฏิบัติทางรัฐธรรมนูญหรือกฎเกณฑ์ที่ไม่เป็นลายลักษณ์อักษรซึ่งเป็นหัวใจสำคัญของระบบรัฐสภาอังกฤษ มายังประเทศอื่น เพราะสิ่งเหล่านี้บ่มเพาะขึ้นได้จากเหตุปัจจัยบังคับทางกฎหมายซึ่งเป็นไปตามประวัติศาสตร์รัฐธรรมนูญของแต่ละประเทศโดยเฉพาะ

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES) Sem abstract Esta dissertação busca investigar se em que medida o Supremo Tribunal Federal (STF) tem contribuído para o avanço de uma agenda de direitos e de garantias à sociedade civil. Questionamos no debate sobre judicialização da política quais são as políticas públicas efetivamente judicializadas, em sede de controle concentrado de constitucionalidade das leis, comparando a agenda do STF com a agenda de produção legislativa federal, e observamos também como o Supremo decidiu as questões no âmbito dos direitos de cidadania levadas até ele. Nosso recorte temporal está no primeiro governo Lula (2003 a 2006). Analisamos nesse período a agenda do STF e a agenda de produção legislativa dos poderes Executivo e Legislativo federais, de modo a observar o quê da agenda legislativa foi judicializado e por quais atores. E analisamos detidamente, as petições iniciais levadas ao STF, referentes aos direitos de cidadania discutindo os objetivos postos na judicialização dessas políticas: fazer avançar, garantir ou restringir direitos. Para isso, utilizamos os dados de produção legislativa do SILeg, gerando uma base de dados quantitativa dessa produção, organizando-a em variáveis comparáveis com a base de dados de ações do STF, geradas a partir da consulta das petições iniciais de ADIs, ADPFs, ADOs e ADCs ingressadas no período, assim como a consulta do andamento dessas ações (acórdãos). Em geral, a análise apontou que a judicialização das políticas nesse período não teve como objetivo principal o avanço de uma agenda de direitos. Além disso, nossas conclusões apontam que a atuação do STF no período não contribuiu significativamente para o avanço ou expansão de garantias de direitos constitucionais.

This study examines the role of the judiciary in the political process after the Arab Uprising, focusing on a Constitutional Court and its judgements in a case where the popular will was rejected via a judicial ruling. In particular, I will analyse a case of Kuwait where the Constitutional Court declared election void and ordered the dissolution of parliament, after the opposition had won a stable majority. This case conjures images of legal mobilization by the regime; however, considering the political context where the government and parliament were in a serious ongoing conflict, the constitutional rulings by the Constitutional Court can be evaluated as a mediator intended to ease the stalemate and prevent a fall into a more serious crisis concurrent with the political upheaval in other Arab countries.

A literatura política tem ressaltado relevantes aspectos a respeito da judicialização da política no cenário brasileiro. O presente artigo debruçase sobre uma de suas nuances, ao tratar sobre o papel da Ordem dos Advogados do Brasil (OAB) frente à revisão judicial abstrata. Diferentemente dos demais atores do seleto rol presente no artigo 103 da Constituição Federal, a OAB tem a sua atuação pautada em três pilares, legitimados pelo STF no julgamento da ADI 3.026/DF: ausência de pertinência temática e de controle externo e caracterização como serviço público independente. Percebe-se, assim, que o desenho institucional brasileiro conferiu à OAB um rol de prerrogativas atípicas, sinalizando para um forte poder político, capaz de gerar custos e direcionar a agenda de políticas dos Poderes Públicos. Neste sentido, quais os interesses e qual a performance deste ator no campo da revisão judicial abstrata? Esta pesquisa pretende responder a esta pergunta por meio da análise de dados sobre as ações diretas de inconstitucionalidade (ADI) e da busca de evidências empíricas sobre o papel desempenhado pela OAB na arena política da revisão judicial. De forma geral, como conclusão, verificou-se que há uma maior taxa de sucesso das ações que versam sobre interesse corporativo, valendose das questões de interesse público visando o seu próprio fortalecimento. The political literature has highlighted relevant aspects regarding the legalization of politics in the Brazilian scenario. This article focuses on one of its nuances, to treat about the role of the Brazilian Bar Association (OAB) front of abstract judicial review. Unlike the other players in this select group of Article 103 of the Federal Constitution, the OAB has its operations based on three pillars, legitimized by the Supreme Court in the trial of ADI 3.026/DF: the absence of thematic relevance, lack of external control and characterization as independent public service. It is clear, therefore, that the institutional design of the Brazilian Bar Association gave a list of atypical prerogatives, signaling a strong political power, capable of generating significant costs on public authorities. In this sense, what interests and what the performance of this actor in the field of abstract judicial review? This research aims to answer this question by exploring a large dataset of constitutional actions (ADI) and searching for empirical evidence of the role played by Brazilian OAB in political judicial review arena. Overall, in conclusion, it was found that there is a higher success rate of the actions that deal with corporate interests, taking advantage of the public interest aimed at strengthening itself.

This thesis has as empirical object the General Plan of Action of the Public Prosecutor's Office of the State of São Paulo, instrument through which the annual priority goals are set and which prosecutors are required to take into account in the performance of their duties. The background and track record of the General Plan, as well as the classification of the type of goal that it is comprised of, are examined in order to carry out an analysis on the internal organization of the Public Prosecutor's Office and the possible contribution of prosecutors to the phenomenon of judicialization of politics. It also seeks to understand how the relationship is set between the formalization of an institutional policy such as the General Plan of Action and the constitutional principle of the functional independence of the Public Prosecutor's Office. Esta dissertação tem como objeto empírico o Plano Geral de Atuação do Ministério Público do Estado de São Paulo, instrumento por meio do qual são fixadas as metas prioritárias anuais que promotores e procuradores devem levar em conta no desempenho de suas funções. Os antecedentes e o histórico do Plano Geral, assim como a classificação do tipo de meta que o integra, são examinados com o intuito de realizar uma análise acerca da organização interna do Ministério Público e da eventual contribuição de promotores e procuradores para o fenômeno da judicialização da política. Também se busca compreender como se dá a relação entre o estabelecimento de uma política institucional como o Plano Geral de Atuação e o princípio constitucional da independência funcional do Ministério Público.

This work bases itself on the idea of judicialization of politics in order to examine how this process of institutional ascension of the courts stems from the litigation carried out by social movements as a way of promoting their political agenda. In the first chapter, it will be examined the history of the Brazilian LGBT movement, to portray its growing institutionalization and alliance with the State, as well as the use of legal-constitutional discourse as the preferred language for the construction of its claims. In the second chapter, the comparative experience regarding the use of Supreme Courts or Constitutional Courts for the promotion of LGBT rights will be analyzed, focusing on the cases of the United States, Colombia and Argentina. In the third chapter, the possibilities and contingencies of LGBT rights agenda access to the constitutional jurisdiction of the Supreme Court will be examined, regarding abstract and concrete judicial review and through the institutes of amici curiae and public hearings. In the fourth chapter, the positive constraints of the performance of the Judiciary will be analyzed, in order to verify in which way these extra-juridical factors were present in the different cases regarding LGBT rights submitted to the Brazilian Supreme Court. Finally, the last chapter will examine the consequences of litigation, focusing on the influence to public debate and the production of backlash. O presente trabalho tem por objetivo analisar criticamente a judicialização junto ao STF como estratégia para a promoção dos direitos LGBT. Parte-se da ideia de judicialização da política para examinar de que maneira tal processo de ascensão institucional dos tribunais decorre da litigância levado a cabo pelos próprios movimentos sociais como forma de reivindicação de suas demandas políticas. No primeiro capítulo, será examinada a história do movimento LGBT brasileiro, para retratar a crescente institucionalização e aliança com Estado, bem como o recurso à gramática jurídico-constitucional como linguagem preferencial para a construção de suas pautas. No segundo capítulo, será analisada a experiência comparada da judicialização dos direitos LGBT junto às Supremas Cortes ou Tribunais Constitucionais, com foco nos casos dos Estados Unidos, da Colômbia e da Argentina. No terceiro capítulo, serão examinadas as possibilidades e contingências do acesso da pauta dos direitos LGBT à jurisdição constitucional do STF, no tocante ao controle abstrato e concreto e por meio dos institutos dos amici curiae e audiências públicas. No quarto capítulo, serão inicialmente analisadas as condicionantes positivas da atuação do Judiciário, para se verificar de que maneira estes fatores extrajurídicos se fizeram ou fazem presentes nas distintas ações referentes aos direitos LGBT submetidas a apreciação do STF. Finalmente, no último capítulo serão examinadas as consequências do recurso ao Judiciário, com foco na influência do debate público e na produção de backlash.

El protagonismo adquirido por el poder judicial los sistemas jurídicos constitu-cionalizados plantea una serie de desplazamientos y desequilibrios en la arquitectura cons-titucional del Estado democrático contemporáneo. El nuevo paradigma neoconstitucional, como cultura jurídica imperante, es el escenario propicio para que el activismo judicial pueda generarse y desarrollarse .La expansión del poder judicial se produce no solo de manera muy significativa en la jurisdicción constitucional, sino también en la jurisdicción ordinaria con las consecuencias que ello implica., The prominence acquired by the judicial power in the constitutionalized legal systems raises a number of shifts and imbalances in the constitutional architecture of con-temporary democratic state. The new neoconstitutional paradigm, as prevailing legal cul-ture , leads to judicial activism can be generated and developed. The expansion of judicial power occurs not only very significantly in the constitutional jurisdiction, but also in ordi-nary jurisdiction with attendant consequences.

Typical of the expansion of the Judicial Branch, they give rise to investigations in the democratic collision. In this context, assuming a neoconstitutionalist bias with the advent of the Federal Constitution of 1988, the research sought to investigate the tensions caused between democracy and the Brazilian constitutional system itself in the activism and judicialization of politics in the Judicial Branch. Therefore, it was chosen three rulings of the Supreme Court to verify the tensions in multiple themes decided by the highest court of the country: Direct Action of Unconstitutionality nº. 3.999/DF (ruled in 2008), Popular Action nº.3.388/RR (ruled in 2009) and Interlocutory Appeal in Injunction Suspension of the Public Civil Action nº. 47/PE (ruled in 2010).The issues correspond to the loss of term for party infidelity, demarcation of the aboriginal land Raposa Serra do Sol and public health, respectively. To find possible tensions in the trial, it was visualized, at first, the theoretic contributions of substantial democracy, of Ronald Dworkin, and procedural democracy, of John Hart Ely and Jürgen Habermas. Such theories were upheld for taking into consideration the role of the Judicial Branch to rank democracy. It was also approached the theory of the legitimation government body, defended by Robert Dahl, which sustains that the judicial acting acts to legitimize acts of the dominant regime. The decisions were analyzed and, based in the theoretical scenarios presented, it was concluded that there are tension between neoconstitutionalism and democracy, caused by the activism and judicialization of politics in Brazil. However, the tensions found are understood by this study as contributing to democratic development in the country, corroborating to a substantial democracy, although active and judicialized positions must be given rise, within certain self-restraint measures. O ativismo judicial e a judicialização da política são apontados como fenômenos mundiais e são enredos para diversas investigações contemporâneas da Ciência Política. Característicos da expansão pelo Poder Judiciário, ensejam investigações no embate democrático. Neste contexto, admitindo um viés neoconstitucionalista com a advento da Constituição Federal de 1988, a pesquisa buscou investigar as tensões causadas entre a democracia e o próprio sistema constitucional brasileiro na ocorrência de ativismo e judicialização da política pelo Poder Judiciário. Para tanto, foram escolhidos três acórdãos proferidos pelo Supremo Tribunal Federal, visando verificar as tensões decorrentes em múltiplas temáticas decididas pela mais alta Corte do país: Ação Direta de Inconstitucionalidade nº. 3.999/DF (julgada em 2008), Ação Popular nº. 3.388/RR (julgada em 2009) e Agravo Regimental na Suspensão de Liminar de Ação Civil Pública nº. 47/PE (julgada em 2010). As questões abordadas correspondem à perda de mandato por infidelidade partidária, demarcação da terra indígena Raposa Serra do Sol e saúde pública, respectivamente. Para constatar eventuais tensões nos julgados, visualizou-se, em um primeiro momento, as contribuições teoréticas da democracia substancial, de Ronald Dworkin, e da democracia procedimental, de John Hart Ely e Jürgen Habermas. Tais teorias foram acolhidas por levarem em consideração a atuação do Poder Judiciário para classificar democracia. Também se percorreu a teoria do órgão de legitimação, defendida por Robert Dahl, o qual sustenta que a atuação judicial atua para legitimar atos do regime dominante. Analisou-se os julgados e, com base nos enredos teóricos apresentados, concluiu-se pela existência de tensões entre o neoconstitucionalismo e a democracia, causadas pelo ativismo e judicialização da política no Brasil. No entanto, as tensões encontradas são compreendidas por este estudo como contribuintes ao desenvolvimento democrático no país, corroborando para uma substancial democracia, embora devam ensejar posturas ativas e judicializadas dentro de certas medidas de autocontenção.

This study aims to analyze the performance of a specific group among the legitimate to mobilize the judicial review: the class associations. In addition to belong to civil society, the professional associations also show themselves interesting as they involve groups with potentially opposing interests, as entrepreneurs and workers. Then, the intention is to study their performance regarding the use of ADPFs - Pleas of violation of constitutional fundamental statements - that are a mean of judicial review against laws which violate the Constitution in what such associations regard as its most important dictates. O presente trabalho buscou analisar a atuação das associações de classe na proposição de ações de controle de constitucionalidade das leis. Além de se destacarem por provocarem o controle de constitucionalidade via sociedade civil, as associações de classe também se mostram interessantes por envolverem grupos com interesses potencialmente antagônicos, como empresários e trabalhadores. Daí a intenção de estudar seus padrões de atuação no que concerne ao uso das Arguições de Descumprimento de Preceito Fundamental, em que são questionados atos do poder público atentatórios contra a Constituição naquilo que tais associações consideram como seus ditames mais importantes.

Unfortunately, as will be seen in the next sections, the legalization of Health has taken negative proportions focusing critics on the intervention of the Judiciary in Health and Politics. Nonetheless, the excessive and disorderly legalization of Health do not have their reasons only in poor performance of the Judiciary, but find their genesis in the governmental inefficiency, corruption and market influences. Thereby, the aim of this article is to instigate that the issue of legalization of Health in the Brazilian case is complex, not being enough the occasional interventions in the Judiciary, but a set/group of actions to measure the real dilemmas/quandaries and argue/fight/work towards effective actions to solve it through the balanced performance of all actors, governmental and social involved.Keywords: Judicialization of politics; Judicialization of health; constitutional law; bioethical

A partir da noção de judicialização da política, procura-se discutir alguns aspectos das relações entre os Poderes Judiciário e Legislativo no Brasil no contexto de vigência da Constituição de 1988. Tendo como foco específico a problemática do controle de constitucionalidade e judicialização dos procedimentos adotados no âmbito das comissões parlamentares de inquérito, o artigo fundamenta-se em pesquisa sobre a jurisprudência do Supremo Tribunal Federal (STF) acerca do estatuto e das limitações constitucionais do trabalho das comissões parlamentares de inquérito no Congresso Nacional. Aborda-se a questão da separação de Poderes nas democracias contemporâneas, ilustrando o quanto as inter-relações entre os três ramos do Estado afastam-se, na prática, da formulação clássica da teoria; o que permite toda uma complexa teia de controles mútuos que constituem um campo fértil para a ascendência do poder Judiciário sobre o poder Legislativo e a referida judicialização da política. Through the notion of the judicialization of politics, we discuss particular aspects of the relationship between the Judiciary and the Legislature in Brazil within the context of the 1988 Constitution. Taking the issue of control of constitutionality and the judicialization of procedures adopted within the ambit of parliamentary investigation commissions as our specific focus, this article is based on research on the jurisprudence of the Federal Appellate Court regarding the status and constitutional limitations of parliamentary investigation commissions within the National Congress. We look at the issue of the separation of powers in contemporary democracies, demonstrating just how distant the interrelations of the three branches of the State are, in practice, from the classical theoretical formulation; this allows for a complex web of mutual controls that make for fertile terrain for the primacy of Judiciary Power over Legislative Power and the above-mentioned judicialization of politics. A partir de l'idée de judiciarisation de la politique, on cherche à discuter quelques aspects des relations entre les pouvoirs Judiciaire et Législatif au Brésil, dans le contexte de validité de la Constitution de 1988. En soulignant spécifiquement le problème du contrôle de la constitutionnalité et judiciarisation des procédures adoptées dans le domaine des commissions parlementaires d'enquête, l'article s'appuie sur la recherche sur la jurisprudence du Suprême Tribunal Fédéral (STF), autour du statut et des limitations constitutionnelles du travail des commissions parlementaires d'enquête dans le Congrès National. On aborde la question de la séparation des pouvoirs dans les démocraties contemporaines, en illustrant à quel point les interrelations entre les trois secteurs de l'Etat s'éloignent, en pratique, de la formulation classique de la théorie ; ce qui permet tout un réseau complexe de contrôles mutuels, qui constituent un domaine fertile pour l'ascension du Pouvoir Judiciaire sur le Pouvoir Législatif, et la judiciarisation évoquée de la politique.

Este trabalho tem como objetivo principal discutir o processo pelo qual essa instituição adquiriu, a partir da Constituinte de 1987/88, autonomia diante dos Poderes do Estado e como tal autonomia contribui para o processo de judicialização da política. Como a literatura explica o fato de várias instituições terem feito lobby e apenas o Ministério Público teve suas atribuições ampliadas? Para isso, foi realizada uma sistemática revisão teórica acerca da sua autonomização. Os resultados indicam que o debate se divide em duas correntes explicativas. Por um lado, defende-se que a autonomia da instituição pode ser explicada a partir de dispositivos legais internos ao próprio Ministério Público. Por outro, sugere-se a existência de interesses exógenos à institucionalidade do Ministério Público no processo que influenciou positivamente a autonomia dessa instituição. La discusión sobre activismo judicial se ha basado, en buena medida, en autores que trabajan el tema desde una perspectiva anglosajona (particularmente estadounidense) y, en muchas ocasiones, dentro del discurso de ciencias sociales. Estos dos factores llevan a entender el activismo judicial bien como una desviación de la función judicial o como un exceso de dicha función. Un análisis de los criterios utilizados para caracterizar el activismo judicial muestra que estas son dependientes de una concepción de la función judicial limitada a resolver casos concretos y del derecho en clave positivista. Esto, por una parte, contradice no solo la práctica judicial, sino, también, el marco institucional de las modernas democracias constitucionales y, por otra, desconoce otras corrientes del derecho que no están alineadas con el positivismo. El estudio se realiza a partir de jurisprudencia de la Corte Constitucional de Colombia en políticas públicas mineras. The discussion about judicial activism has been based, in a great extent, on studies given under an Anglo-Saxon (especially American) perspective and, in many cases, from the social science discourse. These factors explain judicial activism as a deviation from the judicial function or as an excess of the judiciary. The analysis of the concepts used to characterize the judicial activism shows that they are dependent on a concept of the judicial activity limited to solving cases and the law in a positivistic way. This, on one side, not only contradicts judicial practice but the institutional framework of modern constitutional democracies, and, on the other, neglects the existence of non-positivistic conceptions about law. The study is based on Colombia’s constitutional court decisions on mining public policies.

The article analyzes the judicialization patterns in politics during the two terms of President Fernando Henrique Cardoso (1995-2002) and compare them to the subsequent period of slightly less than a term and a half under President Luiz Inácio Lula da Silva (2003-2008). The purpose of the comparison was to observe whether appeals were issued to the Supreme Court challenging Federal acts on grounds of unconstitutionality. Both differences were observed and some common uses of judicialization when comparing the two Presidential Administrations. On cherche à savoir si l'on trouve des différences dans la façon de faire appel à la Cour Suprême de Justice pour la contestation d'actes du pouvoir fédéral par le moyen de l'Action Directe d'Inconstitutionnalité. On a trouvé, à ce sujet, entre les deux gouvernements, des disparités mais aussi certains usages communs.

In Brazil, the term was first used in the study of Marcus Faro de Castro (1996), O Supremo Tribunal Federal e a judicialização da política. (1999), the expression has become widely used in the research on relations between judicial institutions and politics. However, the definitions, meanings and prognoses contained in these researches are profoundly disagreeable. The judicialization of politics presents itself as a polysemic term. This dissertation seeks to undertake the history of the concept of judicialization of politics in Brazilian political science, with the objective of mapping the different significations and meanings of that term. The temporal cut occurs between 1996 and 2014. The general scope of the research consists, therefore: in a first chapter of review and methodological appropriation; a second chapter of analysis of dissertations and theses about judicialization produced in post-graduate programs in political science in Brazil; and a third chapter of analysis of its main definitions and meanings. Finally, the judicialization of politics is understood as a political concept and five layers of meaning concerning its semantic field in Brazilian Political Science are identified. Há vinte e um anos Tate e Vallinder (1995) cunharam a expressão judicialization of politics. No Brasil, o termo teve o seu primeiro uso no estudo de Marcus Faro de Castro (1996), O Supremo Tribunal Federal e a judicialização da política. A partir da publicação de A judicialização da política e das relações sociais no Brasil, Vianna et al. (1999), a expressão passou a ser amplamente utilizada nas pesquisas referentes às relações entre instituições judiciárias e Política. Todavia, as definições, sentidos e prognósticos contidos nessas pesquisas mostram-se profundamente discrepantes. A judicialização da política apresenta-se como um termo polissêmico. Esta dissertação busca empreender a história do conceito de judicialização da política, na ciência política brasileira, tendo como objetivo o mapeamento das diferentes acepções e sentidos de tal termo. O recorte temporal se dá entre 1996 e 2014. O escopo geral da pesquisa consiste, portanto: em um primeiro capítulo de revisão e apropriação metodológica; um segundo capítulo de análise de dissertações e teses sobre judicialização da política, produzidas em programas de pós-graduação em ciência política no Brasil; e um terceiro capítulo de análise de suas principais definições e sentidos. The goal of my diploma thesis is to describe the influence of ECJ decision making on the common commercial policy ("CCP") of EU. Specifically my thesis examines what factors influence ECJ decision making about direct effect of trade agreements implementing CCP. These factors are applied on several treaties, where the court has not yet decided on their potential direct effect and on a present case at ECJ on direct effect of WTO treaties. With regard to the goal of my thesis an important part of my thesis deals with the development of ECJ decision making. Methods applied in my thesis are analysis and comparison of selected judgements that influence the CCP of EU. After proper analysis I found out that the main motiv behind ECJ decision making is that, if the negotiating position of EU is to be deteriorated, the ECJ is likely to find that the treaty does not have direct effect. Other factors are of secondary character. Examining the influence of decision making of ECJ on direct effect of trade agreements is important, because the role of ECJ influences the legal certainty of subjects about direct applicability of international trade treaties.

O ajustamento estrutural das economias europeias através da austeridade tem na representação da crise como um estado de exceção permanente um seu pilar fundamental. É neste contexto que a judicialização da política passa por uma nova fase, cujo centro é a jurisprudência constitucional sobre o confronto entre o argumentário do Estado de Direito e o argumentário do estado de exceção. Neste artigo analisamos a concretização desta judicialização constitucional da política em Portugal patente nas decisões sobre as leis do orçamento mais recentes. In the structural adjustment of economies through austerity which is the mainstream policy now in place in Europe, the representation of the crisis as a permanent state of exception occupies a crucial place. Within this context, the judicialization of politics enters a new phase whose core is the constitutional case law on the conflict between the argument of the rule of law and the argument of the state of exception. In this article we focus on the contents of this constitutional judicialization of politics in Portugal through the analysis of the decisions of the Constitutional Court on the most recent budgetary laws.

Článek se zabývá diskuzí přítomnosti nové skupiny aktérů na poli vedení válečných konfliktů, a to vnitrostátních soudů. Na případu Nejvyššího soudu Státu Izrael ukazujeme, že proces označovaný jako judicializace se prosadil i v oblasti rozhodování o způsobech vedení ozbrojených konfliktů. Upozorňujeme, že k adekvátnímu uchopení situace se nelze zaměřit pouze na poměrně odvážnou judikaturu soudu, ale je nutné zohlednit také míru akceptace této judikatury důležitými hráči v politickém systému Státu Izrael. The article discusses the occurrence of a new group of actors in the field of pursuing military conflicts, namely the national courts. We present on the case of the Supreme Court of the State Israel that the process described as judicialization gained importance even in the issue of decision-making on pursuing military conflicts. We point out that in order to adequately grasp the position of the Supreme Court and its influence, it is necessary to consider also the acceptance of the Court’s case-law from the side of other important actors in the political system of the State Israel.

It has long been accepted that judges had a different field of proceeding from the other public institutions, but this situation has been changing in the recent years. Indeed, we have witnessed the persistent dismantling of the idea that the judge is "the mouth of the law", a mere applicator of rules, for what this fact has contributed to an internalization of concepts such as judicial activism. This paper tests the hypothesis, in terms of Brazilian subnational politics, that the judicialization of politics is associated with political competition, thus presenting approaches that associate the phenomenon with factors exogenous to judicial courts. The research analyzes empirical data regarding the intervention of the Federal Supreme Court in the state policies of Rio Grande do Sul (RS) and Ceará (CE), federative units that exhibit high and low levels of competition, respectively. Judicialization rates were found to be higher in Rio Grande do Sul. This is because the political forces in the state are in constant conflict, causing competition to move beyond the scope of the Executive and Legislative branches, extending towards the Supreme Court. In Ceará, however, a small hegemonic elite restricts political competition, precluding the participation of opposition groups in politics, whether in traditional representative bodies or in the courts. O trabalho testa, no plano da política subnacional brasileira, a hipótese de que a judicialização da política está associada à competição política, apresentando abordagem que associa a judicialização a fatores exógenos às instâncias judiciais. Analisam-se dados empíricos referentes à intervenção do Supremo Tribunal Federal (STF) nas políticas estaduais do Rio Grande do Sul (RS) e do Ceará (CE), estados que apresentam elevados e reduzidos níveis de competição, respectivamente. Verificou-se que a judicialização, medida pelo número de intervenções do STF na política estadual através de Ações Diretas de Inconstitucionalidade (ADIs), é mais elevada no Rio Grande do Sul. Isso ocorre porque as forças políticas neste estado estão em constante conflito, o que faz com que a competição extrapole o âmbito do Executivo e do Legislativo, estendendo-se em direção ao STF. Já no Ceará, uma pequena elite hegemônica restringe a competição política, inviabilizando a participação de grupos de oposição na política, seja nos tradicionais órgãos representativos, seja na Suprema Corte.

The research aims to investigate the performance of the Brazilian Supreme Court as an actor who interferes in the formulation and implementation of social policies in Brazil, especially performing as veto player or acting as a partner of the Federal Executive in relation to programs and social policies. The research analyses judicial actions between 2003 and 2013, verifying aspects as legitimacy of actors, applications and substantive examination. It is possible to verify that the Brazilian judiciary has been an actor of constant intervention in this type of public policy, working mainly in the stages of implementation. However, it is possible to envision a new role for the judiciary in relation to the formulation of public policies, where criteria as the agenda-setting and the design of the intervention are part of the Judiciaries' new attributions., A pesquisa tem como objetivo investigar a atuação do Supremo Tribunal Federal como um ator que interfere na formulação e implementação das políticas sociais no Brasil, especialmente atuando como ator com poder de veto ou agindo como um parceiro do Executivo Federal em relação aos programas e políticas sociais. A pesquisa analisa ações em julgamento entre os anos 2003 e 2013, verificando aspectos como a legitimidade dos atores, aplicações e mérito. É possível verificar que o Judiciário brasileiro tem sido um ator de intervenção constante neste tipo de política pública, atuando principalmente nas fases de execução. No entanto, é possível prever um novo papel para o tribuna em relação à formulação de políticas públicas, no qual critérios como a definição de agenda e o desenho da intervenção passam a fazer parte das novas atribuições do Poder Judiciário.

Mas tanto sua justificação teórica quanto suas finalidades sociais ainda não se conseguem sustentar em um consenso, restando algumas sérias contrariedades. Isso porque, de um lado, os modelos de racionalidade jurídica até então existentes, que pugnavam por uma certa neutralização do judiciário e de toda a reflexão profunda a respeito dos seus pressupostos normativos (heranças do jusnaturalismo e do positivismo), não lograram satisfazer a promessa de emancipação social e acabaram por afastar os submetidos ao direito do mundo jurídico, ocasionando um sentimento geral de desequilíbrio entre segurança e justiça. De outro, a busca de novas racionalidades – que legitimassem a validade normativa (a fim de que se sopesassem os ideais de justiça e segurança) e que defendessem as práticas jurisdicionais com um papel de maior intrusão em questões de grande envergadura social, muitas vezes, atropelando ou se antecipando à ação dos próprios poderes políticos (legislativo e executivo) – ainda está devidamente mal resolvida, seja em termos teóricos, seja em termos de avaliação de seus efeitos práticos. Nesse tema da judicialização da política, este estudo objetiva, assim, avaliar o perfil da jurisdicionalização da política no Brasil, especificamente, no caso da questão dos julgados do Supremo Tribunal Federal e do Superior Tribunal de Justiça na questão social da reforma agrária no período democrático, até 2011. A ideia foi classificar, por um estudo indutivo dessas decisões, se o perfil dessa judicialização se apresenta como: a) emancipatório, ou seja, acorde com modelos de maior participação democrática na esfera (pública) do judiciário, com a restauração da ligação entre a decisão judicial e o mundo da vida da sociedade e com a afirmação do judiciário como um instrumento, nas mãos da sociedade, para a garantia (e, até, a criação) de direitos alcançados pelas lutas sociais; b) ou se violador das garantias político-democráticas, pelo risco que o empoderamento do judiciário (poder, no Brasil, não sujeito ao controle democrático) possa não só desestabilizar os poderes politicamente atuantes, como também se tornar invadido por disputas ideológicas de grupos dominantes, além de se sofrer o risco de uma mais fácil cooptação desse poder jurisdicional pelas elites hegemônicas. The judicialization of politics has been an actual fact, but both its theoretical justification and its social objectives still are unable to provide a consensus, which leaves some serious setbacks.There is a general feeling of imbalance between security and justice. On the one hand, there is the existing models of legal rationality, which strive to create a certain neutralization of the judiciary. On the other hand, there are the normative assumptions (inheritance of natural law and positivism), which have failed to fulfill the promise of social emancipation departing from the right of the legal world.The search for new rationales to legitimize the normative validity is so that, if posed, the ideals of justice and security can defend the judicial practices with a greater role of inclusion into matters of great social scale. This can often trample or anticipate the actions of its own political powers (legislative and executive), which are still not resolved properly, either in theoretical terms or in terms of evaluating their practical effects. Therefore, in this issue of legalization of politics, this study aims to evaluate the profile of the judicial nature of politics in Brazil, focusing specifically on the justices of the Supreme Court and Superior Court of Justice on the social issue of land reform in the democratic period after the promulgation of the Constitution of 1988 by 2010.An inductive study of these decisions included two elements: a) emancipatory(ie; according to most models of the democratic participation (public) sphere of the judiciary). The restoration of the link between the judicial decision and the world of the life of society as well as the assertion of the judiciary as an instrument in the hands of society, to guarantee (and even create) rights achieved by social struggles; b) violator of political-democratic safeguards, looking at the risk that the empowerment of the judiciary (power in Brazil not subject to democratic control) can not only destabilize politically active powers, but can also become invaded by ideological disputes of dominant groups. This is in addition to the risk of suffering an easier cooptation of this judicial power by hegemonic elites.

De maneira sintética, a judicialização da política é um processo que ocorre em países que adotam o sistema democrático constitucional como forma de organização política, nos quais as instituições do Poder Judiciário ultrapassam suas competências convencionais, interferindo ou reavaliando as decisões políticas dos Poderes Legislativo e Executivo por meio do que se convencionou chamar de revisão judicial (judicial review) e/ou controle de constitucionalidade, ou seja, o Direito intervém na política em alguns casos, um processo considerado por muitos como fortalecedor da democracia. As causas deste processo são discutíveis, sendo uma delas a própria demanda dos outros Poderes por soluções e pela resolução de disputas advindas do Judiciário, como também estabelecer uma postura mais proativa das organizações jurídicas, preenchendo as lacunas deixadas pelos outros poderes, sobretudo no que tange a assegurar direitos fundamentais aos grupos minoritários. Tal discussão, surgida na arena internacional, tem sido amplamente debatida e alvo de pesquisas que buscam consolidar teorias e mensurar os efeitos deste fenômeno para as sociedades democráticas contemporâneas, adentrando no contexto regional. Esta pesquisa tem como objetivo mapear as Ações Diretas de Inconstitucionalidade no estado de Goiás no período entre 1988 e 2013, uma forma de se avaliar o processo de judicialização nesta unidade da Federação Brasileira. O método utilizado para tanto foi o quali-quantitativo, o que pressupões coleta de dados e sua avaliação à luz das teorias e estudos pertinentes ao tema. Tal análise justifica-se pelo fato de este mapeamento ser algo inédito neste estado, o que pode servir de base de dados para pesquisas futuras, além de enriquecer o debate acerca do tema da judicialização da política no Brasil e no mundo. Succinctly, the judicialization of politics is a process that occurs in countries that adopt the constitutional democratic system as a form of political organization in which the institutions of the judiciary beyond its conventional skills, interfering or reevaluating the policy decisions of the Legislative and Executive through what is called judicial review (judicial review) and / or control of constitutionality, the law intervenes in politics in some cases, a process considered by many as strengthening democracy. The causes of this process are debatable, one of which is the demand of the other Powers and solutions for the resolution of disputes arising from the judiciary, but also from a more proactive stance of legal organizations, filling gaps left by other powers, especially regarding ensure the fundamental rights of minority groups. Such discussion emerged in the international arena, has been widely debated and the subject of research seeking to consolidate theories and measure the effects of this phenomenon for contemporary democratic societies, entering in the regional context. This research aims to map the Direct Actions of Unconstitutionality in the state of Goiás in the period between 1988 and 2013, a way to evaluate the process of legalization in this unit of the Brazilian Federation. The method was used for both the qualitative and quantitative, which presupposes data collection and evaluation in the light of theories and studies relevant to the topic. Such an analysis is justified by the fact that this mapping is unheard of in this state, which can serve as a database for future research, besides enriching the debate about the issue of legalization of politics in Brazil and worldwide. Assistimos hoje no Brasil a uma transformação maior que não é nem política nem jurídica, mas cultural: o espaço próprio da democracia se desloca do capitólio ao foro como resultado de uma nova utilização do direito e da justiça por todos. A começar pelos políticos, que têm descoberto o Tribunal como um novo lugar para fazer política. É assim que a Justiça, que até aqui se tinha limitado a resolver conflitos privados, se transforma em um recurso político a disposição de quem quer que seja. E a mudança não se produz sem mal, porque as instituições judiciais não estavam preparadas para dar conta deste novo uso que delas se faz. A tradicional tolerância brasileira com a falta de efetividade do direito parece estar acabando. Especialmente a respeito das diversas figuras penais relacionadas com a corrupção (ativa e passiva) de funcionários públicos, parlamentares e juízes. Destarte, e ao cabo de processos de grande repercussão, se identifica uma nova demanda dirigida à Justiça, não tanto para reparar danos ou para sancionar uma falta penal, mas para satisfazer uma reivindicação política: ver publicamente reprovado um comportamento ou reconhecida uma dignidade escarnecida. We watch today to a major change in Brazil which is neither politic nor legal, but cultural: the space of democracy itself moves from the Capitol to the Forum as a result of a new use of the Law and the Justice by everyone. Starting by the politicians, who have discovered the Court as a new place to make politics. That’s how Justice, until now restricted to solve private controversies, changes itself in a political resource available to anyone, don’t matter who. The change is not performed with no wrongs though, because judicial institutions were not ready to deal with this new use that people make of them. The traditional Brazilian tolerance with the lack of legal enforcement seems to be ending. Especially regarding with several criminal rules, related to corruption (either active or passive) of public officers, lawmakers and judges. Hence, after greatly highlighted lawsuits, it is identified a new demand addressed to the Justice, not as much to repair damages or to impose penalties for criminal faults, but to satisfy a political claim: to see publicly disapproved a behavior, or recognized a scorned dignity.

What explains institutional instability in national judicial institutions? Much extant research focuses on de facto institutional instability, emphasizing political motivations behind irregular changes to high court composition. In contrast, I consider the causes for de jure chan- ges made to the Ecuadorian Supreme Court from 1979 to the present, drawing on qualitative and quantitative analyses. I contend that the judicialization of politics and presidential interest in stacking the courts are central explanatory factors, and that changes to the Supreme Court's institutional framework reflect implicit compromises and political arrangements negotiated by strategic political actors. As such, institutional reforms to national judicial instiuttions may beadopted to ameliorate conflict in the larger political sphere. ¿Qué factores explican la inestabilidad institucional en las cortes supremas de justicia? Recurriendo a una investigación múltiple en la que destaca la elaboración de narrativas históricas y un modelo de regresión logístico, este artículo evidencia que el incremento de las disputas políticas trasladadas a la arena judicial -judicialización de la política- y el interés de los presidentes por obtener jueces afines a su proyecto político, constituyen buenos predictores de los cambios al diseño institucional que gobierna al Poder Judicial. Tomando como caso de estudio la Corte Suprema de Justicia del Ecuador, el artículo constata además que las variaciones institucionales tienen como objetivo redistribuir los espacios de poder al interior de dicho tribunal, reduciendode esa forma los altos niveles de conflictividad observados en la arena política.

A presente pesquisa busca analisar a atuação do poder judiciário, precisamente do Supremo Tribunal Federal e do Tribunal Superior Eleitoral em assuntos de cunho politico. Pode-se considerar que esta participação ativa dos tribunais na esfera politica esta associada ao fenômeno da judicialização da política. Trata-se do estudo especifico do caso da fidelidade partidária, o qual foi regulamentado pelo TSE e ratificado pelo STF através da Res. n. 22.610. Por isso, busca-se trazer as condicionantes da decisão que trouxe outros atributos ao judiciário, assim como regulamentou a relação entre os partidos políticos e seus parlamentares, impondo um clausula de barreira para o troca-troca de partidos. O lapso temporal refere-se aos anos de 1988 (promulgação da Constituição Federal) a 2008 (ano do julgamento do ADI 3999/08, sobre fidelidade partidária pelo STF). A metodologia utilizada no estudo tratam-se de fontes documentais, assim como sites dos Tribunais Regionais Eleitorais e do Supremo Tribunal Federal, referencial bibliográfico sobre o assunto, analise de legislação, consultas, jurisprudências, acordaos. Atraves destas fontes analisa-se o discurso de cada ministro em sua decisão sobre a fidelidade partidária, seus pros e contras. Após a ratificação e entrada em vigor da legislação politicoeleitoral que contempla aspectos sobrea perda do mandato eletivo em favor do partido político, é possível verificar o posicionamento pro-partido, assim com o consenso de fortalecimento das instituições. Por outro lado, tal veio a ferir alguns princípios constitucionais como a liberdade de expressão, assim como a tripartição de poderes, amplamente discutida pela doutrina. Alem disso, na busca de fornecer uma visão aprimorada sobre o assunto e os reflexos da resolução na legislação eleitotal, foram pesquisados cinco estados brasileiros mais populosos dentres cinco regiões do país, através das acoes sobre fidelidade partidária submetidas aos seus respectivos Tribunais Regionais Eleitorais. Assim, a discussão entre os ministros acerca do assunto tem gerado inúmeras polemicas ate hoje, diante da criação de legislação pelo judiciário, vindo com isso a atuar de forma atípica. This research seeks to analyze the role of the judiciary, precisely the Supreme Court and the Superior Electoral Court in matters of political nature. One may consider that this active participation of courts in political sphere is associated with the phenomenon of judicialization of politics. It is the specific case study of party loyalty, which was regulated by the TSE and ratified by the Supreme Court through Res. N. 22.610. Therefore, we seek to bring the constraints of other attributes decision brought to justice, and regulated the relationship between political parties and their parliamentary, clause by imposing a barrier to bartering parties. For this purpose the article analyzes the concept of electoral justice, its traditional investigation approach from Legal Studies and the suggestion of a new stance of study also from Political Science. El presente ensayo se centra en el fenómeno de la judicialización de la política para el caso particular de la justicia electoral costarricense. Financiadora de Estudos e Projetos The purpose of this doctorate thesis is to understand the achievement of the rights to public health in Brazil through the Judiciary Branch. Our hypothesis is that the constituient political actors in 1987-88 have assigned greater political power to the Judiciary Branch, turning it into a veto player, able to suspend the decisions of local executives and change the legislative status quo. Aiming the accomplishment of this research, we will study the competences of the Judiciary Branch in the constitucions of 1934 e 1946 and, afterwards, we will procede to the analysis os the Annals of the Subcomissions of the Judiciary Branch e of the Public Ministry of the Constituient of 1987-88. Eventually we will evaluate the sentences produced by the Justice Court of São Paulo to understand the content of the decisions made by the judges that managed to make effective the rightsto public health. O objetivo desta tese de doutorado é compreender a efetivação de direitos à saúde pública no Brasil por meio do Poder Judiciário. Nossa hipótese é de que os atores políticos constituintes em 1987-88 tenham atribuído maior poder político ao Poder Judiciário, transformando-o em um ator com poder de veto, capaz de suspender as decisões dos executivos locais e mudar o status quo legislativo. Para a realização da pesquisa, estudaremos as competências do Poder Judiciário nos textos constitucionais democráticos de 1934 e 1946 e, posteriormente, faremos a análise dos Anais da Subcomissão do Poder Judiciário e do Ministério Público da Constituinte de 1987-88. Finalmente vamos avaliar os acórdãos produzidos pelo Tribunal de Justiça de São Paulo para compreender o teor das decisões tomadas pelos desembargadores que efetivam os direitos à saúde pública.

The present study proposes to define the concept of judicialization of politics, detailing the main characteristics of each element that composes it. However, the purpose of analysis turns to the repercussions of this phenomenon on the external relations. It seeks to outline brief considerations about the current Brazilian decision process, detailing the due legal process. Finally, it points out some possible consequences that the content of certain judicial pronouncements can lead on an international orbit. El presente estudio se propone a delimitar el concepto de judicialización de la política, detallando las principales características de cada elemento que lo compone. Pero, el objeto de análisis se vuelve hacia las repercusiones de este fenómeno en las relaciones externas. Se busca trazar breves consideraciones sobre el actual proceso decisorio brasileño, detallando el debido proceso legal. Se apunta, por último, algunas posibles consecuencias que el contenido de determinados pronunciamientos judiciales puede acarrear en la órbita internacional. O presente estudo propõe-se a delimitar o conceito de judicialização da política, detalhando as principais características de cada elemento que o compõe. Porém, o objeto de análise volta-se para as repercussões deste fenômeno nas relações externas. Busca-se traçar breves considerações sobre o atual processo decisório brasileiro, detalhando o devido processo legal. Aponta-se, por último, algumas possíveis consequências que o teor de determinados pronunciamentos judiciais podem acarretar na órbita internacional.

O trabalho testa, no plano da política subnacional brasileira, a hipótese de que a judicialização da política está associada à competição política. Na primeira parte, após constatar que muitos autores relacionam a judicialização à vontade dos magistrados ou a mecanismos institucionais, apresentam-se abordagens que associam o fenômeno a fatores exógenos às instâncias judiciais, como por exemplo a competição entre os atores políticos relevantes. Filiando-se a esta última corrente, a pesquisa analisa dados empíricos referentes à intervenção do Supremo Tribunal Federal nas políticas estaduais do Rio Grande do Sul e do Ceará, unidades federativas que apresentam elevado e reduzido níveis de competição, respectivamente. Verificou-se que os índices de judicialização são mais elevados no Rio Grande do Sul. Isso ocorre porque as forças políticas neste estado estão em constante conflito, o que faz com que a competição extrapole ô âmbito do Executivo e do Legislativo, estendendo-se em direção ao Poder Judiciário. Já no Ceará, uma pequena elite hegemônica restringe a competição política, inviabilizando a participação de grupos de oposição no policy-making, seja nos tradicionais órgãos representativos, seja nos tribunais. This paper tests the hypothesis, in terms of Brazilian subnational politics, that the judicialization of politics is associated with political competition. After noting that several authors relate judicialization to the volition of magistrates or institutional mechanisms, the first section presents approaches that associate the phenomenon with factors exogenous to judicial courts, such as competition between the relevant political players. In line with this last concept, the research analyzes empirical data regarding the intervention of the Federal Supreme Court in the state policies of Rio Grande do Sul (RS) and Ceará (CE), federative units that exhibit high and low levels of competition, respectively. Judicialization rates were found to be higher in Rio Grande do Sul. This is because the political forces in the state are in constant conflict, causing competition to move beyond the scope of the Executive and Legislative branches, extending towards the Judiciary. In Ceará, however, a small hegemonic elite restricts political competition, precluding the participation of opposition groups in policy-making, whether in traditional representative bodies or in the courts.

O presente artigo analisa a judicialização da política demonstrando que não se trata apenas de um fenômeno brasileiro, mas de algo comum a diversos países ocidentais. Esse movimento tem sofrido severas críticas, que questionam a sua legitimidade e apontam o esvaziamento da esfera política. Em contraponto, é traçado um paralelo com a doutrina da autorrestrição judicial, a qual defende que as questões políticas devem ser enfrentadas pelos poderes eleitos. Por fim, procura-se demonstrar, por meio da análise de decisões do STF e do STJ, como o Poder Judiciário brasileiro tem se manifestado em questões de políticas públicas, de modo a realizar os direitos fundamentais plasmados na Carta de 1988. This movement has been very criticized concerning its political legitimacy and the exhaustion of political sphere. from the other hand the article analyzes the theory of judicial restraint, which defends that political questions should be decided by elected powers. Finally, it demonstrates through the analysis of Brazilian Supreme Court's (STF) decisions and other Courts decisions such as STJ how Brazilian Judicial Power has faced issues of public policies in order to enforce basic rights present in the Brazilian Constitution of 1988.

O presente artigo insere-se na área de investigação denominada política judicial. A partir da hipótese de que o Supremo Tribunal Federal (STF) age como órgão de governo, testou-se a influência de variáveis política, econômica e jurídica nos julgamentos das Ações Diretas de Inconstitucionalidade por Ação entre os anos 1999 e 2004. Para isso, foi construído um banco de dados com julgamentos de 162 casos envolvendo decisões em questões de Estado e, através da utilização do modelo estatístico de regressão logística, chegou-se a conclusões significativas: o STF é sensível a determinados atores em detrimento de outros, declara a inconstitucionalidade quando a norma traz impacto negativo nas finanças do Estado e julga de acordo com a agenda do presidente. Como conclusão, verificou-se que a Corte possui um comportamento múltiplo, ora se deixando influenciar por variáveis jurídicas, ora decidindo por motivações de ordem política ou econômica, segundo a lógica evidenciada acima. This article is related to an area of investigation called judicial politics. Based on the hypothesis that Brazilian Supreme Court (STF) acts as a government body, it was tested the influence of political , economic, and juridical variables on abstract judicial review decisions from 1999 to 2004. For that purpose, a dataset of 162 cases concerning judicialization of state politics was developed. Using logistic regression, it was concluded that the STF is more sensible to certain groups of actors than others, declares the unconstitutionality of legislation when this legislation brings negative impact on state finances and judge in favor of Presidents' agenda. As a conclusion, we verified that Brazilian Supreme Court decides in such a multiple behavior, sometimes letting itself being influenced by legal variables, sometimes deciding motivated by political or economical variables, according to the logic demonstrated.

Neste contexto, a atuação de juízes e tribunais passa a ser compreendida sob um duplo viés: como judicialização da política ou ativismo judicial. O objetivo deste trabalho é, ao diferenciar estes dois modos de conceber a atividade jurisdicional - considerando o primeiro como um fenômeno contingencial e inexorável, e o segundo como uma postura que decorre de um ato de vontade do julgador , colocar em xeque a afirmação de que é necessário a existência de um Judiciário ativista para concretizar direitos no Brasil, posicionamento que predomina no âmbito da doutrina constitucional do país. Para tanto, o caminho a ser percorrido passa por uma retomada dos contributos apresentados pelas teorias jurídicas e políticas norte-americanas, tendo em vista as influências que passaram a exercer no âmbito do direito brasileiro e o amplo debate realizado sobre o tema nos Estados Unidos, desde o estabelecimento do controle de constitucionalidade (em 1803). Sob esta perspectiva, serão demonstradas as consequências da incorporação equivocada que houve no Brasil do ativismo judicial estadunidense, evidenciando a importância de se observar o distanciamento provocado pelas peculiaridades que há entre estas duas tradições jurídicas. Tudo isso conduzirá, ao fim, à afirmação do perfil ativista do Judiciário como um problema ao constitucionalismo democrático, que somente pode ser enfrentado em face da existência de uma teoria da decisão judicial, tal qual a desenvolvida pela Crítica Hermenêutica do Direito (CHD) de Lenio Streck, que, em uma imbricação de Hans-Georg Gadamer e Ronald Dworkin, culmina na afirmação da necessidade de respostas corretas no Direito, compreendidas como decisões judiciais constitucionalmente adequadas. Following a worldwide tendency, Brazilian constitutionalism is characterized by the important role of the Judicial power in defining social and political controversies. In this context, the role of judges and courts can be understood as twofold: as judicialization of politics or judicial activism. This study intends to question the assertion that is necessary to have an activist judiciary to confer rights in Brazil, which is a predominant position within the constitutional legal scholarship by differentiating these two ways of conceiving judicial review - the first as a contingent and inexorable phenomenon, and the second as a posture that results from an act of will of the judge. To achieve this purpose, the study inquiries the revival of American legal and political theories, that influenced Brazilian law, alongside the extensive/comprehensive debate on the subject in the United States since the establishment of judicial review (in 1803). Within this perspective, the study elaborates on the consequences of this mistakenly incorporation of American concept of judicial activism in Brazil, highlighting the importance of observing the peculiarities caused by the distance that exists between these two legal traditions. Finally, this will lead to the assertion that an activist judiciary represents a problem to democratic constitutionalism, which can only be tackled with a theory of judicial decision, as developed by the Hermeneutical Critics of Law (HCD) developed by Lenio Streck, with an overlapping of Hans-Georg Gadamer and Ronald Dworkin, culminates in the premise of the necessity of right answers in law, understood as constitutionally adequate judgments.
