EL NUEVO PROTAGONISMO DE LOS JUECES: UNA PROPUESTA PARA EL ANÁLISIS DEL ACTIVISMO JUDICIAL

Hay cosas que hacen los jueces que están impactando la esfera política, la esfera de quienes representan a los otros órganos estatales. Durante mucho tiempo se aceptó que los jueces tenían un ámbito de acción distinto al de las otras instituciones públicas; sin embargo en los últimos años esto se ha ido modificando. Se asiste a un progresivo desmantelamiento de aquella idea, hoy la visión del juez "boca de la ley", aplicador mecánico de normas, se aleja de las funciones que está desempeñando. The political sphere from those who represent the other State Bodies has been impacted by the actions of the judges. It has long been accepted that judges had a different field of proceeding from the other public institutions, but this situation has been changing in the recent years. Indeed, we have witnessed the persistent dismantling of the idea that the judge is "the mouth of the law", a mere applicator of rules, for what this fact has contributed to an internalization of concepts such as judicial activism.
