Fixed-term employment relationships as demarcated by Czech and French legal regulation Abstract The present paper analyzes fixed-term employment relationships as demarcated by Czech and French legal regulation. The purpose of the study is to discuss similarities and differences within the examined legislations, provide a basic historical background and reflect on whether the French legislation could be used as a source of inspiration for Czech law. In author's opinion, due to the frequent issues arising in connection with the application of the legal regulation of fixed-term employment relationships, this thesis could also serve as a source of interesting facts for both employees and employers. The paper is divided into four chapters. The introductory chapter looks briefly at labour law as a distinct legal branch, highlighting some of the issues which the doctrine of labour law must contend with in the context of the re-codification of private law and defining "an employment relationship" as the basic legal term of the thesis as a whole. The work deals with the issue of evaluation of employees in public administration. First, it describes the principles of remuneration and reward theory in general, and subsequently, the specifics applicable to public administration are formulated here. The description of the currently valid legislation governing the issue of the staff is being described in the essay, again, first in general, then the attention is focused on the specifics regulated by rewarding employees who work in public administration, it also mainly analyzes the current treatment of the Labour Code, as well as treatment of related specific and complementary legal standards. On a practical level, the work deals with the remuneration of the tax office in Ostrava III and the municipal office of Ostrava South, specifically devoted to the analysis and evaluation of the remuneration of workers in these institutions. On the basis of the analysis the possible recommendations and suggestions for changes and improvements to existing practice in those institutions were set out.

The main aim of this bachelor thesis is to clarify the issue of informing employees about their rights and obligations which come out as a result of the employment contracts. At the beginning of this work, there are described the general concepts which are related to the main topic. At the following part there is characterized this informational obligation of the employer regarding to the situation when the employee should be informed about his rights and obligations. In this bachelor thesis, the Directive 91/533/EEC is analyzed and also compared with the Czech legislation. The aim of this bacheler thesis is to analyze and compare Czech and Italian regulation of employment relationship and to determine on the basis of this comparison whether the legislation is similar or different. My thesis is divided into four main chapters, which are divided into smaller subsections. The first chapter deals with the historical development and sources of labor law in the Czech Republic and then in Italy. At the end of the chapter is based on established facts engage in comparative analysis with emphasis on the differences or similarities. The thesis is written in the field of labor law. Content is the dismantling of the individual provisions of the existing legislation relating to the scheduling of working hours laid down in the Act no. 262/2006 Coll., The Labour Code, as amended, and other related regulations of the Czech legal order. The work is divided into ten chapters, which focus on individual provisions relating to the regulation of working hours and provisions linked. Work includes historical development of legal regulation of working time, the definition of working time, analyzing provisions relating to individual species scheduling of working hours, breaks and rest periods, overtime, night work and availability. Further, a working time under specific working conditions for employees caring for a child or another individual, especially the attitude of employers towards complying workers' requests for shorter working hours. The aim of this bachelor thesis is to compare the Czech and Italian regulation of employment relationship and on the basis of this comparison determine to what extent they are similar or different. The thesis is divided into five major chapters, which are consequently divided into a number of smaller subchapters. In the first chapter I deal with the history of labor law and with its legal basis in both countries. The second chapter focuses in detail on individual types of labor relations in the Czech Republic and then in Italy. The third chapter explains the rules related to employment contracts, establishment and termination of employment relationship in these two states. In the fourth chapter, which is the main part of this work, I make a comparison on the basis of the findings with an emphasis on the differences and similarities between both regulations. In the final, fifth, chapter I make an analysis of terminology and then create an Italian-Czech glossary. The thesis is concluded with a summary in Italian language.

The theme of my Bachelor's Thesis is the issue of occupational safety and health protection at work. The Thesis is divided into a theoretical part and a practical part. In the first part, I will specify the legislation beared on the selected industry. In the second part, I compare the theory with practice and provide a brief commentary on the individual parts. In the practical part is also a survey on employee satisfaction with occupational safety and health protection. The aim of this work is to provide a comprehensive comparison of occupational safety and health protection from a theoretical and practical perspective.

People were aware of the connection between the quality of the job done and the person performing the job as early as in the ancient times and in the times of ancient Egypt. In the course of centuries prevention was favoured over the treatment of an injury or illness. Nowadays the healthcare for employees is regulated by numerous international as well as national rules of law, the most important international one for the observed field being the International Labour Organization Convention No. 161 ? Occupation health services Convention. Upon this international convention ratified in Czechoslovakia in February 1989, many rules of law dealing with the health protection of employees at their workplaces are specified in our legal order, the significant being the Act 262/2006 Coll., Labour Code and newly also the Specific Healthcare Act 373/2011 Coll. The thesis aims to recapitulate the basic rule of law regarding the above-mentioned matter as well as finding out how these rules of law are adhered to and what the employees' awareness concerning their rights and obligations in the area of occupational healthcare is. The practical research of this thesis used qualitative dialogues with the representatives of 10 companies with different business planes. At the same time, a quantitative survey took place among the employees of the same companies. The results indicate that employers meet their obligations to their employees in the area of arranging occupational health services including regular medical checkups. Furthermore, employers try to respect the doctor's capability to work, despite the fact that this area is often quite problematic for them. The employees themselves are aware of their rights and obligations in the area of occupational health services.

The topic of my master thesis is the comparison of Czech and Slovak labour law. The goal of the paperwork is to compare structure and of content Czech and Slovak labour code, describe the most significant differences in chosen parts and analyse rights and obligations of employees and employers in both countries. At first the basic concept of labour law, his functions and position in legal system are defined. It continues with description of the history of labour law with focus on development of legislation after separation of the Czechoslovak Republic. Thesis analyses main three instituts of Czech and Slovak labour code: commencement of an employment relationship, his termination including financial and others entitlement of employees and agreements of work performed outside an employment relationship. The conclusion containts the partial summaries with emphasis on the biggest differences and evaluation of the hypotesis given at the beginning of the work.

The Labour Code states that it regulates relations arising in connection with the performance of dependent work between employees (workers) and employers. Legal relations arising in with the performance of non-dependent work are regulated. A key issue in terms of recognition, when must be the work carried out under the rules contained in the Labour Code, is the fulfillment of the essential characteristics of dependent work. Among these basic signs for the identification of the dependent work the performance of work within the relations of the employer’s superiority and his employees’ subordination and in the employers’ name stand as the most important.

This dissertation describes and analyzes the topic - agency employment in the Czech Republic. It explains scope of relations among subjects of agency employment. It describes the inclusion agency employment in the Czech law system and the most important changes related to recent amendments to the Employment Act and the Labour Code. Custom research is primarily focused on analysis of practical activities of selected employment agencies, agency employees and the users of staffing services.

The aim of this work is not only to be familiar with the history and current legislation relating to health and safety at work, but mainly with the application of legal standards in the specific conditions of the selected company with a focus on selected workplace. Occupational health and safety of workers in the performance of work tasks is one of the fundamental duty of every employer. This obligation arises mainly from the Labour Code, which imposes a number of duties and rights not only on the employers but also on the employees and trade unions. The main pillar of occupational health and safety at work is the searching and evaluation of risks at work - prevetion of risks at work. An integral part of this problem is the categorization of work, safety of technical equipments, personal protective equipment, work hygiene, occupational medicine. Equally important is the area of fire protection and ecology.

Working hours and terms related to it are permanently a topical subject, because in lifetime it affects everyone. Arrangement of working hours determines specific time periods for the employer and employee where is a performance of the work carried out on the basis of the employment relationship which they have arranged. Both sides of the contractual relationship are interested in satisfying their specific needs. The aim of this thesis is to interpret a legal regulation of working hours and institutes related to it and also make its application in practice.

The bachelor's thesis is focused on working time and rest period under Czech legislation conditions that is influenced by Community law of European Union, which is the Czech Republic a part of. The main subject of my Bachelor's Thesis called "Analysis of employee Benefits in Specific Organization" is to analyze system of employee benefits used in company RWE Transgas, a. s. in 2010. Theoretical part will specify basic terms in general, which are important to cope with this issue. There will be especially importance, division, risks and trends in benefits. In practical part the analysis of employee benefits in specific joint-stock company is made. Part of this analysis is survey done by questionnaire to verify preferences of employee benefits between selected employees. Results of research will be compared with current trend in provision benefits and nationwide research done by company Robert Half International. By results provided some new employee benefits will be suggested to organization to motivate employees and to give tax advantages to organization.

The aim of this bachelor's thesis is to provide readers with a more complex view of current legislation for the termination of employment stated in the labour code with regard to provisions, which came into force in January 2012. I have tried to describe its advantages and disadvantages and suggest possible recommendations for its improvement based on the opinion of an employer. The first chapter deals with employment, the principles of labour relations and its participants. The second chapter is devoted to the topic of termination of employment, both by employers and employees. In the third chapter I describe the employer's duties, which have to be fulfilled during the process of termination of employment. The last chapter focuses on the practical part of this thesis. By method of interview with an employer, I am interested in opinions and recommendations for current legislation of termination of employment. The bachelor thesis deals with the issue of so-called "švarcsystém", also known as concealed employment relationship. The term describes a situation when people working for an employer are not his employees, but individual entrepreneurs. The first chapter defines basic concepts related to the topic. The following part describes the historical development of legal regulation of "švarcsystém" in the Czech Republic and evaluates its strong and weak points. The main section includes an analysis of current legal regulation of concealed employment and its main advantages and disadvantages. The next chapter concerns the economic aspects of "švarcsystém" and examines its impact on the state budget. A practical example illustrates the differences between the tax obligations of employees and self-employed. The following section is devoted to two key court rulings that significantly influenced the understanding of "švarcsystém" over the years. The last chapter examines the various forms of concealed employment in other member states of the EU. The conclusion summarizes the findings and includes proposals de lege ferenda.

The thesis deals with the dismissals of employees for organizational changes. This area of laubor law become very important in connection with the economic crisis beginning in the year of 2008. The main goal of this thesis therefore is, using various methods of law interpretation and relevant judicature, to find the content of very brief law regulation of artical 52 letter a) to c) Labour code. The thesis summarizes legal regulation of working hours and their scheduling in the Czech legal order. The aim of this thesis was to describe and evaluate various types of working patterns, which are addressed in the Labour Code, as well as to highlight some problems that can cause their application in practice. In addition to the current regulation, this paper deals with modifications proposed by the amendment to the Labour Code, which would come into effect January 1, 2012, and its influence on the organization of working time (the main change is the proposed unification of regulation of even and uneven schedule of working time and reducing the administrative burden and complexity of account of working time). The thesis can be divided into five main parts. The first part is devoted to the very definition of working time in European and Czech legislation and records of working hours. The second part focuses on the main topic of the thesis - the organization of working hours. The bachelor thesis deals with a payroll accounting and its main goal is to get the most important elements of the payroll accounting in a chronological sequence of the work of accountants and to notice the legislative changes in the year 2012. The most important changes relate to the labour code which is described in the first chapter. A mechanism of a wage and payments for an insurance and income tax follows in the second chapter. At the end of the thesis is a practical example of the fictitious company which shows how a type of a contract of an employment can influence a calculating of a net wage.

As a theme for my Master's Thesis I chose the theme of problems which are connected with application of Occupational Safety and Health Protection principles in practice. The aim of the Master's Thesis is to outline possible problems which we could come across while implementing the Occupational Safety and Health Protection policy and to map a major part of important legal enactments covering sphere of Occupational Safety and Health Protection. In the theoretical part I at first briefly outline historical development of legal regulation in the Czech Republic then I proceed to a summary and characteristics of the most important contemporary legal enactments whereas I don' t omit an European legal regulation and legal regulation within the framework of International Labour Organisation. The object of this bachelor's thesis is summarization of legal provisions concerning working hours and rest period in the Czech republic and evaluation the application of these legal regulations in practise. This bachelor's thesis should especially judge whether legal regulations are formulated in accordance with needs of labour law parties or these legal provisions should be modified, left out or completed.

This diploma thesis deals with problems of misusing of company computers by employees. Specifically describes the factors affecting computers misuse, various forms of its misuse and protections against its misuse, the impact on employers and related regulations. The thesis also outlines possible ways how to control employees and penalties for computer misuse. The title of my diploma paper is summing up of state employment policy in the Czech Republic, on the current applicable legislation. And it take into account the active employment policy and passive employment policy. The purpose of the paper is to create a compact image of labour market in the Czech Republic. This paper chart unemployment in southern Bohemia, in the Písek region gives to understand that authoress will occupy with the unemployment problems of the Písek region. My survey is based on the data from Labour Market Situation Report from several Bureaus of Labour, data from Czech Statistic Office and Ministry of Labour and Social Issues. The practical part of the theses covers the situation on the labor market in Písek region. The second part of this thesis includes a possible solution for solving unemployment, active employment policy and passive employment policy. This is a sample illustration creation of project design which concentrates on employment support by means of a new requalification program for long-term unemployed people, in the concrete this employment policy of the Písek employment bureau. The main topic of my thesis is the wage problems from the accounting and tax point of view. First I summarize labour law relations and the arrangements performed outside of the employment contract. A large part of this thesis is devoted to payroll matters, namely providing and paying wages. The next chapter deals with the problems of health insurance and social insurance. The following chapter is devoted to personal income tax and fringe benefits valid until 1.1.2011. The individual chapters provide examples for better understanding. My intention is to bring the main principles of wage problems closer to the extensive area of laws and to provide easier orientation in payroll accounting and the conditions of legal regulations in the Czech Republic

The bachelor thesis examines the situation of the statutory obligation to inform about terms and conditions of employment contract regarding both its development and its current legislative state with practical compliance. It analyzes in detail the emergence of this obligation and follows its evolution in the legislative norms. It also includes a summary of points about which the employee should be informed in connection with the creation of employment and a dividing of these according to the statutory announcement time. In the practical part are described the results of work inspections conducted in 2010 focused on the aforesaid obligation. The issue of breaches of the obligation to inform about terms and conditions of employment contract is examined in a questionnaire survey too. Finally also an outline of options solving the non-compliance and circumvention of this obligation is included in the conclusion.

There goes a number of tasks in company with need to acquire a new employee, his admission, possibly dissolution of labour relation with him, which are usually divided between personnel officer and wages accountant in the company. Personnel agenda management is personnel officer´s duty, wages sphere, which is not less important, is wages accountant´s duty. These acitvities are influenced by many rules and government regulations. Main laws with serious impact on labour relations are tax laws and labour code. All of these were subject to many changes in recent years. Main aim of this baccalaureate thesis is to evaluate influence these changes have on labour relations and it is a part of thesis theoretic side. My final diploma thesis main subject is Wage accounting in accordance with a Labour code. My goal is to create a summary of the most important changes, which where brought by a new Labour code, talk about the changes in travel benefits and suggest how to solve some problems with bringing new Labour code into practise. The aim of my bachelor{\crq}s thesis was to find out changes in the Czech labour law and labour relations between employees, employers and trade unions caused by the accession of the Czech Republic to the European Union. I focused on the EC directives that had to be implemented into the Czech judicial code because of the compatibility with the EC law. I focused on the mediation of employment abroad by Czech employment bureau for Czech workers in practical part of my thesis.
