Abstract

This paper explores how accounting for variations in factor utilization rates alters the empirical characteristics of productivity residuals in the United States and Canada. Using data on 19 manufacturing industries, we study the behavior of productivity using three proxies for capital services. We find that adjusting for cyclical movements in capital utilization alters many of the empirical characteristics of productivity, both within and across countries.

Abstract

A mathematical model was developed of the three-dimensional dynamics of a high-altitude scientific research balloon system perturbed from its equilibrium configuration by an arbitrary gust loading. The platform is modelled as a system of four coupled pendula, and the equations of motion were developed in the Lagrangian formalism assuming a small-angle approximation. Three-dimensional pendulation, torsion, and precessional motion due to Coriolis forces are considered. Aerodynamic and viscous damping effects on the pendulatory and torsional motions are included. A general model of the gust field incident upon the balloon system was developed. The digital computer simulation program is described, and a guide to its use is given.

Abstract

The design of a helical flux compression generator, driven by 200 g of high explosives, for basic studies is presented and experimental results are discussed. Generator current and dI/dt are measured with Rogowski coils placed on the load. Both crowbar closure and contact velocity have been successfully simulated with CTH, a three-dimensional finite element hydrodynamic code. Abstract

The article discusses active portfolio management and examines a discussion of viewing portfolio construction as an optimization problem proposed by M. Barton Waring and Laurence B. Siegel. The author looks at assumptions made about the covariance structure of active return that are used in optimal portfolio structure. Using sensitivity analysis, the author finds that the degree of diversification in active returns and the sources of active return leads to variation in optimal portfolios. The author concludes that active portfolio management is made up of the level of active return, the volatility of active return, and the covariance structure of active return.

Abstract

In City of Newport v. Fact Concerts, Inc., the Supreme Court held that cities are not liable for punitive damages under the Civil Rights Act of 1871. Considerations of efficiency support the Court's conclusion. Punitive damages promote efficiency under a limited set of circumstances, but imposing them vicariously on an employer for the acts of employees is not necessary to achieve efficient outcomes. Since, under current law, a punitive damage assessment is likely to be larger if imposed on the employer than if assessed against an employee, vicarious liability produces inefficient results. This is especially true if the employer is a governmental entity, because of problems of control inherent in political, non-profit-maximizing organizations.

Abstract

In an article entitled ‘An Economic Theory of Intentional Torts’ that appeared in an earlier issue of this Review,’ Landes and Posner argued ‘that the concept of intentional tort can be given a coherent economic meaning and . . . that the common law treatment of intentional torts can be explained on the hypothesis that the common law attempts to promote efficiency.‘2 In this comment, I argue that the authors’ explication of their model is confused and that their explanation of punitive damages is both incomplete and inconsistent with their own model. By introducing normative considerations into the model, however, punitive damages become a rational response to deliberate harms. Finally, I suggest reasons for scepticism about the explanatory power of the model as applied to modern decisions of English and American courts.
