This series consists of motions and orders for commissions to be issued for taking of testimony from material witnesses residing out of state. The motion itself consists of a notice to the attorney for the plaintiff (or defendant) stating that application will be made for a commission and giving the name and residence of the witness; and an affidavit stating the grounds for the motion.

These records contain testimony that was taken conditionally (de bene esse) from a material witness who was a transient or a non-resident or who was unable to testify at a trial because of illness. In such instances a party to an action applied for an order allowing a deposition to be taken. The affidavit specifies the nature of the action, the plaintiff's demand, the name and address of the witness, and the reason he cannot appear at the trial.

This series contains records of the pleas, issue, trial, and verdict in civil causes in Circuit Courts. Records documenting civil causes provide name of court; term; names of plaintiff and defendant; names of the judge, attorneys, jurors, and witnesses; and the jury's verdict and its award of damages and costs.

This series consists of fragments from other series originally filed in the Albany, Geneva, and perhaps Utica offices of the Supreme Court of Judicature. Most of the documents are motions, cognovits, writs of execution (usually fi. fa.), briefs, and affidavits of service of declarations. There are also a few returns to writs of certiorari, depositions de bene esse, returns to writs of commission, etc.

This series consists of judgment rolls which have been signed, filed, and docketed by the clerk of the Supreme Court. The judgment roll contains the record of pleadings and proceedings in a cause, prepared by the attorney for the party to whom the judgment has been awarded. Accompanying the judgment roll proper are copies of other documents filed in the cause, in what may be termed the judgment record.

Card index documents judgments of the Supreme Court of Judicature filed in the court clerk's office in New York City between 1781 and June 30, 1847, and of the Supreme Court (New York County) filed in the New York County Clerk's Office from July 1, 1847 to the end of 1910. Judgment rolls filed prior to 1848 are in series JN529. Judgment rolls filed after 1847 are retained in the New York County Clerk's Office. Each card contains data fields for plaintiff, defendant, court, filing date, and file reference code.

This series consists mostly of orders of Circuit Judges granting or denying motions for new trails after hearing arguments on a bill of exceptions in which a defendant alleged error in earlier proceedings. There are also a few orders granting judgment as in the case of non-suit, giving additional time to plead, setting aside a default, etc. The powers of circuit judges were specified in legislation of 1829.

This series contains issue rolls, which contain all the same parts and information as judgment rolls up to and including the award of writ of venire facias juratores. (See finding aids for Series J0134, J0137, and J0140.) The issue roll was prepared only for important cases tried at the bar of the Supreme Court of Judicature. (A nisi prius roll was drawn up for causes tried on the circuit.)

The Court for the Trial of Issues was held by a justice of the Supreme Court for trials of issues which were not heard on circuit. The minutes of a trial include the title of the cause, the plaintiff's motion for the return of jury process with a panel of jurors annexed, a list of the jurors selected, a list of witnesses called for the plaintiff and defendant, and the jury's verdict and award of damages.

Files in this series usually include the writ of error ordering the lower court to return records of the case to the Supreme Court; the lower court's return or answer; and the defendant's bill of exceptions stating the objections to the lower court proceedings. Defendants obtained writs of error to have a cause, previously judged in an inferior court, removed to the Supreme Court for review.

This series consists of minutes of special rules entered during the special terms of the Supreme Court held at Rochester each October between 1841 and 1846. Information includes names of the parties and of the attorney making the motion for the rule, and the ruling of the court on the motion. The minute books also contain rules appointing examiners of candidates for admission as attorneys; general court rules; and miscellaneous rules.

Minute books for 1797-1800 contain grand jury proceedings and minutes of trials and sentencing. The series also contains special rules or orders granted upon special motions, orders issued in real property proceedings, appointments of commissioners to screen candidates for attorney or counsellor in the Supreme Court, and general procedural rules.

This series consists of miscellaneous documents which did not fall into any other series and were filed together by the court clerk. They include draft rules, orders for exoneration of bail and surrender of defendants, recognizances of bail, consents to change attorneys, petitions and orders for appointment of guardians, testimony taken conditionally, oyers of bonds sued upon, a few records of cases remitted, appointments of clerks, replications and rejoinders, and other miscellaneous documents.

This series includes dockets or outlines of actions taken in selected cases heard before Albany courts, and a few heard before Supreme Court in other counties. Information includes court name and location, and the name of the parties involved in the case. Kingsley and Bentley are identified as attorneys for the plaintiff in most cases. Also included are the dates, a short statement describing major pre-trial and post-trial actions and when relevant, legal announcements have been included.

This series consists of transcripts of trial testimony related to mismanagement and malfeasance of Munson G. Lockwood and other officers of Sing Sing State Prison. The testimony contains detailed information on the business and financial affairs of the Prison during Lockwood's controversial term as agent. As a result of his and other state prison agents' mismanagement and malfeasance major revisions in the laws governing the management of state prisons occurred. Included is an index linking witnesses to transcript statements.
