Diplomatic immunity, on its different modalities, procures the efficient development of the activities and objectives of a diplomatic corps. It integrates, thus, a wide variety of prerogatives and exemptions due to sovereignty and equality among States. Nonetheless, it has limits that have not been developed or applied uniformly nationally and internationally given that there is no consensus about whether must be applied in conformity to its iure imperii or iure gestionis dimension. In this context, this reflection article aims towards shedding light on this controversy that harms the comprehension, study, and application of this figure. The former takes greater complexity when attending the ius cogens norms and international law of human rights, i.e. when these norms are infringed under the protection of diplomatic immunity, even though the international courts and the doctrine are not pleased in an interpretation regarding the limits and scope of said immunity. Summarizing, we present the Colombian case and emphasize in the ambiguities of the high courts' jurisprudence with a divergent thesis. This article seeks to describe the strategic use of a rights discourse by domestic and international actors involved in the negotiation and ratification processes of free trade agreements between Colombia, the United States, and the European Union. We suggest that some of the differences between both FTAs and the processes leading up to their approval and ratification can be attributed to the ability of relevant actors to build and disseminate rights-based arguments in order to develop like-minded political coalitions, and other institutional and contextual characteristics. After the tragic events of September 11, 2001, there has been a strong interest amongst States in matters relating to national security. While every State has a right to ensure security and control borders, it is also necessary to ensure that the legitimate security interests of States are consistent with their international human rights obligations and that immigration controls do not indiscriminately affect those refugees in need of international protection, so as not to undermine the international regime for protection of refugees. This article explores the links between the security of States and the international protection of refugees, focusing on the compatibility of both themes. Security is both a right of refugees and a legitimate interest of States. It is therefore important to understand that the security of States and the protection of refugees are complementary and mutually reinforcing. In this sense, legislation regarding refugees and fair and effective operational procedures for the determination of refugee status can be utilized by States as useful tools to solidify and strengthen their security. The aim of this paper is to advance in the analysis about the nature, the meaning and the reach of the Guantánamo base. In order to do so, we describe the route of the phenomenon, integrating it in the broader dynamics of the current militarized globalization whose vector and dominating shape go through the imperial strategy of the USA post-September 11. Deep articulated with the enlarging logic and consequences of global capitalism, this strategy implies, among other distinctive traces, the legitimation of growing spaces of exceptions, the preventive war without imminent attack threat and the ascension of the "absolute enemy" embodied in the deterritorialized image of the new theological political terrorist. The terrorist attacks of September 11, 2001, in New York and Washington, besides shaking the idea of security that used to prevail in the United States, have inspired the adoption of a series of internal and external measures that go against human rights. On choosing such a course of action, the American Government, which had already been taking unilateral stances, with no concern for international law, may be destroying the movement for human rights on a world scale.
