Can Thomas Aquinas, thinker of the thirteenth century, tell us something to our current Latin American political reality? A text between two contexts is the pretext to generate a reflection on the right to rebellion, from the perspective of nonviolence and the right to civil disobedience. A path from justice and good government in Aquinas, followed by the political common good and the political virtues in Angelicus to end up in the right to rebellion, is the route that is traced for this exposition. A reading from the hermeneutic exegetical proposal of Dr. René Padilla, that is, an intuitive understanding, a grammatical-historical understanding and a contextualizing understanding are the how and manner of the present work. The great advances in genetic engineering, especially what is known as "Directed evolution" and "Gene drive" offer humankind the possibility of minimizing or eradicating diseases, improving ecosystems, and producing improved organisms in a simple, affordable, and effective way. However, the use of these technologies, as in any intervention in the teleological order of reality, represents physical-chemical and biological risks, but, above all, ethical implications that are important to consider. This work is aimed at offering some philosophical foundations of perennial value, which can help in an assessment of the use of the technologies used for a directed evolution, resorting to the philosophical synthesis of Saint Thomas Aquinas. Inspirado en una extensa tradición historiográfica que se ha ocupado de los sentidos, la sensibilidad y las emociones, este trabajo explora una causa del fuero penal en la que un hombre, que en los albores del siglo XX asesinó a su esposa en una casa del centro de la ciudad de Buenos Aires, fue condenado a la pena de muerte. El objetivo es develar la sensibilidad subjetiva y los umbrales de tolerancia social a la violencia conyugal, expresados por un elenco heterogéneo de actores que incluyen al homicida, sus parientes y sus conocidos, pero también a la policía, al defensor oficial, al fiscal, al juez de primera instancia y a los magistrados de la Cámara de Apelaciones. Se trata de un delito usual que recibió una condena excepcional, pero que aún en su singularidad permite avizorar los sentidos (entendidos como sensación, significado y sentimiento) de la violencia.

Este artículo se propone analizar los planteamientos de Nietzsche sobre la función cultural de la justicia y del derecho en el desarrollo de la civilización occidental, vinculados en su obra al análisis genealógico de la moral. Se explican la centralidad de la obediencia a la ley en el paso de los seres humanos de su estado natural a su condición de seres de cultura y la función de esa imposición de la ley en la posibilidad de la vida en sociedad; y se exponen las razones de la defensa nietzscheana de la justicia y el derecho como fuerzas socialmente configuradoras y estructurantes. Se analizan seguidamente las razones de su rechazo a las propuestas anarquistas y antisemitas que sitúan el origen de la justicia en la venganza y el resentimiento, y se expone la relación interna entre derecho y voluntad de poder. Se concluye, por último, con la crítica de Nietzsche a la concepción y práctica del derecho en su concepción moderna

¿En qué consiste la aplicación más justa de la ley, en aplicarla al pie de la letra en todos los casos o permitir al juez cierto margen para interpretarla? A lo largo de este texto presentaremos cómo no han sido pocos los partidarios de un “literalismo” a la hora de aplicar la ley, y para ello explicaremos lo sucedido durante la Revolución Francesa. Basados en la opinión de Rousseau, los ilustrados franceses creían que el legislador, en tanto que creador de la ley, era el que mejor conocía el espíritu de la misma, luego la interpretación de la ley por parte del jurista era arbitraria. Dicho de otra manera: la labor del juez se entendía nada más como la inferencia de una conclusión a partir de ciertas premisas (la ley y el caso). Aristóteles, sin embargo, ya había previsto este problema. Entonces, el propósito de este escrito es (1) explicar qué ha llevado a querer aplicar la ley al pie de la letra, (2) cuáles son sus riesgos y (3) la solución que Aristóteles propone a este asunto, en donde hablaremos sobre la prudencia y el juez como «ley dotada de vida».

Aunque existe una coordinación social, formal y coercitiva que exige la observancia de la ley, en el sistema de impartición de justicia frecuentemente puede apreciarse la exégesis androcéntrica de los juzgadores. Este sistema normativo creado, aplicado e interpretado desde la masculinidad tradicional, categoriza por medio del derecho a las buenas mujeres dentro de la ley, y malas mujeres fuera de la ley. El objetivo de la presente reflexión consiste en prefigurar pautas para reivindicar la dignidad de las mujeres en el acceso a la justicia como sujetos marginados por la heteroaplicatividad de la norma patriarcal. El aspecto metodológico de la presente investigación es de corte cualitativo estrictamente documental. Entre los hallazgos principales de la presente, se encuentra que el feminismo es una configuración efectiva de teoría de la justicia que responde a las necesidades de las mujeres acorde a sus contextos sociales, y que, además, esta praxis no puede ajustarse a una única teoría universalista de justicia ya que no existe una unívoca categoría de mujer. Esto a su vez implica que, las mujeres tengan la prerrogativa a presentar el derecho a ser malas mujeres.

The article discusses Aristotle’s thought as regards the role of popular juries and the principles that assigned judicial power to citizens. It is precisely within the framework of this reflection that Aristotle recognises the founding principle behind making judgements. This is the need for the sentence to correspond to the thos of the constitution and therefore to that notion of «global justice», the same feeling found in a political community.

Pocos temas han generado más debates en el campo de la filosofía política a lo largo de las últimas décadas que el de la justicia. Sin embargo, la mayoría de estos debates han girado en torno a qué tipo de equilibrio entre libertad e igualdad puede considerarse como justo, o qué tipo de instituciones legales y judiciales serían necesarias para ofrecer mayores niveles de justicia a los ciudadanos. Este trabajo pretende abordar el problema de la justicia desde un punto de vista radicalmente distinto. A saber, la forma en la que el sujeto –el ‘hombre de carne hueso’, en palabras de Unamuno– experimenta la justicia. Dejando a un lado los ya mencionados aspectos institucionales, el objetivo de este artículo es explorar la forma en que el término justicia opera como un significante vacío en relación con la ley; y cómo esto, a su vez, permite la formación de infinidad de nociones subjetivas de justicia.

¿Qué razones profundas llevan a Platón y a Marx, dos pensadores situados aparentemente en orillas opuestas del espectro ideológico, a defender posturas muy parecidas respecto de la relación entre la filosofía y la religión, de una parte, y respecto de la relación entre la religión y la política, de la otra? Al intentar dar respuesta a esta pregunta, el texto indaga por los límites que Platón le asigna a la educación moral, así como por los límites de la ilustración en el proyecto de la modernidad. A nivel conceptual, y siguiendo a Marx, intenta establecer una clara distinción entre la emancipación humana y la emancipación política.

Incluso tras considerar las destacadas contribuciones de Georges Sorel, Simone Weil y Hannah Arendt, el ensayo de Walter Benjamin, «Crítica de la violencia», es sin duda alguna el texto teórico más significativo e influyente sobre la violencia escrito en el siglo XX. Aquí, Benjamin propone la relación entre ley, justicia y violencia para establecer una crítica, en un sentido etimológico, de varias polaridades: una violencia que funda el derecho en contraste a una que lo mantiene, así como una de origen divino opuesta a una de origen mítico. Como la violencia es una parte intrínseca de la emoción trágica, es posible leer Raquel, de Vicente García de la Huerta (1734-1787), a través del ensayo de Benjamin (y viceversa). El diálogo entre ambos textos revela paralelismos fascinantes y supera las aparentes distancias históricas y pragmáticas que los separa. Al mismo tiempo, también expone hasta qué punto la tragedia de García de la Huerta conceptualiza el derecho, la justicia y la violencia como una tríada de conceptos interrelacionados.

Este artículo investiga los modos en que la literatura argentina del siglo XIX articula las relaciones de los habitantes con el Estado y con la ley. Interroga las maneras en que la literatura argentina representó e intervino en lo que Lawrence Friedman llama la “cultura legal”: el conjunto de opiniones, expectativas, valoraciones, y actitudes de la sociedad hacia la ley. A partir del estudio de las escenas judiciales en el Martín Fierro, de José Hernández (1872, 1879), y la disputa que entabla con las nociones estatales de criminalidad y de justicia, mi argumento es que el texto fija una posición de la literatura respecto de la ley y de la justicia estatal que disloca el lugar simbólico de la criminalidad en la sociedad, y así fundan un lugar de enunciación específico de la literatura argentina que continúa vigente hasta hoy.

This article shows Francisco Suárez’s conception of the eternal law, the natural law and of the human law. It also analyzes their different characteristics, and its relation with Suárez understanding of the common good. For me, the relation between law and natural law constitutes the basis to give solution to the nominalistic conflicts of the period. Those conflicts went so far as to deny the existence of true justice in the civil law, and to understand that morality, being a fiction of human nature, is the necessary condition in order that the civil law and the legal right achieve the common good in society.

El presente artículo abordará el problema de la construcción identitaria y su relación con la justicia en el Guzmán de Alfarache (segunda parte, libro segundo, capítulos 3 a 5). En dicho pasaje, ésta se materializa bajo distintos modos simbólicos, productores del ser social entre el acontecimiento –el hecho delictivo, la puesta a disposición del propio cuerpo ante la ley– y la deriva infinita de padecimientos a que lo somete. Explorar la lógica que subyace al sistema judicial permitirá arrojar luz sobre los modos en que una sociedad concibe el orden y a quienes relega al margen.

Este artículo analiza el uso del sistema jurídico judicial por parte de los esclavos de la ciudad de Ibagué como estrategia para cambiar de amo en el período comprendido de 1750-1810. Igualmente, presenta las posibilidades que la legislación les brindaba a los esclavos para defenderse y hace una breve descripción de los oficios en los que se les utilizaba. En este sentido se entiende que los esclavos usaban de manera oportuna argumentos, pruebas y testigos, lo que les permitió fortalecer su demanda. Este trabajo se realiza tomando como referencia las peticiones judiciales interpuestas por esclavos en el Cabildo local y en la Real Audiencia.

This article proposes a reflection on the irrational aspects of justice and legality that remain veiled in the debate on the difficulties of judicial reform processes in our region and which are expressed harshly in gender violence. Psychoanalytic contributions on culture state that the existence of the unconscious (the instinctual life of the subject) is that which enables the establishment of the law. From this perspective, conflict is inherent in human beings and the anxieties it arouses cannot be bypassed or denied. Therefore, the establishment of limits and a healthy expression of aggression depend on the internal construction of legality in the subject. On the intersubjective level, the mismatch between the expectations of the population and justice operators is associated with the confusion between social reality and the real (Lacan), generating a basic misunderstanding to be solved. As a method, fundamental psychoanalytic concepts are employed and situations of violence against women from Peruvian rural communities are discussed. The paper concludes that it is essential to any process of change or reform to work around the elaboration of anxieties that block the task in institutions and groups. This work facilitates access to justice, while generating new knowledge in this field.

La concesión de amnistías para facilitar la paz y la aplicación individual de sanciones para favorecer la justicia plantean una tensión que caracteriza a la justicia transicional. Estos dos extremos ofrecen un escenario oportuno para explorar la relación entre ley, sujeto y justicia desde una perspectiva psicoanalítica. Al situar la indagación alrededor del deseo y el goce que habitan al sujeto, se concluye que la justicia transicional debe centrarse más en la pregunta sobre cómo juzgar que sobre cómo castigar. En consecuencia, para el Trabajo Social se abre una vertiente de reflexión sobre la relación entre ley y cambio social.

Análisis de la representación iconográfica de la virtud de la Justicia en el Libro de la Sabiduría de las Biblias de Bolonia (siglos XIII y XIV) localizadas en España. La interpretación iconográfica se completa con el contexto histórico y la influencia de la disciplina del Derecho en Europa y, en especial, en Bolonia.

En la discusión actual sobre la tolerancia, la teoría política liberal predominante sigue muy ligada a los argumentos que ya se esgrimieron en el pasado en la discusión sobre la tolerancia religiosa. Como el desarrollo de la misma fue una de las raíces del liberalismo, muchos autores liberales asumen que la separación Iglesia/Estado proporciona el paradigma para abordar hoy otro tipo de diferencias. De hecho, eso es lo que ocurre en Liberalismo Político de J. Rawls en el que encontramos semejanzas interesantes con el pensamiento de F. A. Hayek, lo que apoyaría la tesis de que Rawls acabó justificando la tolerancia sobre premisas típicas del liberalismo clásico, probablemente porque el liberalismo no está equipado intelectualmente para defender otro tipo de tolerancia.

Death penalty has been accepted through the years by the United States as a useful way to deal with criminals. Th is practice was in accordance to a system which required swift justice. The appearance and development of the rule of law in which individual rights were recognized increased the opposition to this measure. Capital punishment has been abolished in almost all Western countries, but in the case of the United States many local legislatures include death penalty statutes. Th is paper has the purpose of approaching the ever-changing debate surrounding this practice in the United States, in order to review diff erent sceneries that have modified both how the executions take place, replacing public executions in favor of private ones, and the public perception regarding them. Las tramas de Billy Budd y La hoguera de las vanidades están organizadas íntegramente alrededor de un juicio. En Los papeles póstumos del Club Pickwick, el proceso es una parte importante de la obra, pero también existen aventuras relacionadas en las que participan los diversos personajes. En los tres juicios se juzga a un inocente. En Los papeles póstumos del Club Pickwick, el autor busca presentar el funcionamiento real del sistema legal, en el cual el modus operandi de abogados inescrupulosos, quienes emplean únicamente métodos tramposos y fraudulentos, determina el origen y el resultado del proceso. En Billy Budd, un inocente es condenado a muerte para preservar un supuesto interés mayor: el bien común. En La hoguera de las vanidades, factores políticos, intereses personales, resentimientos y otros elementos de carácter mundano determinan el resultado del proceso. En los tres casos, el mecanismo de relojería que parece ser el proceso es totalmente sobrepasado por factores externos al mismo.

This work studies the different characterizations of the divine law in the Ancient Greek from Homer to Heraclitus. It analyzes the metonymic substitution of the divinity as the source for the law by the citizen’s nómos, and shows the symbolic violence and the active oblivion associated to this process of political foundation from the 5th century. Finally it rebuilds the oral frame’s axiology of the old theonomies and emphasizes the role of writing in the refiguration of the Greek juridical field during the classic period.

La justicia, ha sido siempre un tema presente en la filosofía y con más notoriedad en la filosofía clásica, por ello resulta saludable, atractivo y de valor el análisis de los textos griegos al respecto. En este punto, Platón es quizás el más estudiado, siempre sus diálogos resultan útiles para quien recorre sus páginas, ya convertidas en verdaderos monumentos de la filosofía, con pasajes y afirmaciones hasta hoy irrefutables, además haciendo de su maestro Sócrates un personaje invalorable para la sabiduría universal. La innata ansia por una vida mejor, empuja al hombre casi siempre a la búsqueda de un mundo sin defectos. Esta es la razón de sus ilusiones utópicas de alcanzar justica, entendida ella como la perfecta armonía en la convivencia social. De la producción platónica, extensa, variada y valiosa, por todo lo que trata y por su sobrevivencia al paso de los años, la obra La República ocupa un lugar de preferencia, por eso estudiar sus paginas y repasar, tanto como re-pensar sus conceptos, es buen estimulo para quienes desean conocer temas de trascendencia en Filosofía, Derecho o afines. Volver a los clásicos es siempre un deber, ellos siempre son fascinantes y sus enseñanzas perduran con gran lozanía, a prueba de todo elemento corrosivo, por tanto no hay pretexto que valga, como para no estudiar, lo que sobre la justicia con genialidad nos comentaron hace ya tantos años.

This reflection article analyzes the remuneration of punishment in Law 975 of 2005 in order to establish if the system satisfies the parameters defined by the international criminal law for prosecution of the most serious crimes of concern to the international community as a whole. During the dark night of the Middle Ages -so named by certain historians- shone a light so bright that it is yet to fade away. It is the light of Saint Thomas Aquinas. He is the greatest and most important of Aristotle's commentators. In his philosophical endeavors, Aristotle made use of his great intellect, the natural light of Reason. However, Saint Thomas had something extra that Aristotle lacked: his faith, the great faith of Aquinas the theologian. If we try to place his thought within the context of the Philosophy of Law, we quickly realize that Aquinas was adept at using political and juridical concepts, such as: law and natural right, law in general, the common good, and justice, among others. He handled the aforementioned concepts with such precision and clarity that his contributions to the philosophy of Law are invaluable and undeniable. [ABSTRACT FROM AUTHOR]

The aim of this work is to analyze the conceptual structure used by Philo of Alexandria in the definition of the term ΔƖκαƖοσννη ("justice") in Special Laws 4. 136-143. We will examine what is the justice according to Philo and what are the concepts that are constitutive part in the rational process which its definition implies. In addition, we will inquire what are the Greek and biblical influences that delimit the philonic idea of the justice in the legal ambit. In this manner, we will be able to demonstrate that Philo understands the justice not only as the fundament of the regulations codified in the written rules in the legislation of Moses, but also as the virtue of the knowledge of the of the divine realities contained in the laws of the Pentateuch that have their origin in God.
