Objective/Context: With a modernizing discourse and business partners, former Peruvian president Alan García led the sale of indigenous Amazonian lands to oil companies. The Awajun and Wampis peoples responded, alongside national and international allies, by demanding the application of ILO Convention 169 through various mobilizations known as "el Baguazo" (2007-2009). This study analyzes, from a deliberative perspective, how the visibility of the arguments and cultural representations of indigenous peoples influenced their self-representation in the public sphere. Methodology: Based on the review of journalistic sources, government reports, statements from national and international organizations, and literature on social conflict and indigenous peoples, the chronology and discourses of the conflict were reconstructed. Conclusions: The mobilized indigenous communities self-represented, expressing their demands and cultural identities (cosmogonies, notions of territory, and development), opposing the sale of their lands. In this way, public spaces emerged, breaking into the national imagination, where sectors of the Peruvian citizenship recognized them for the first time. A network of allies reproduced and supported the indigenous arguments, lending them credibility to those who were unfamiliar with them. However, it was a partial advance as it remained limited to the cultural sphere without translating into the political realm, which is evident in the obtained Law of Prior Consultation (2011), which disregarded their sovereignty. Originality: While the literature on socioenvironmental conflicts focuses on actors and strategies, this article emphasizes the arguments of indigenous peoples, their deliberation, dissemination, and power of persuasion in the face of the rest of the Peruvian citizenry. The present article examines the right of prior, free and informed consultation of indigenous peoples in the light of International Human Rights Law, in order to verify the possibility of Brazil's international liability for violating this right. To this end, it uses as an object of study the case of the construction of the Belo Monte Hydroelectric Power Plant. It was observed, specifically, the understandings adopted by the Brazilian Courts and the Inter-American System of Human Rights in relation to the case of the construction of the Belo Monte Hydroelectric Power Plant. As a main methodology, the investigation is legal-comprehensive with a qualitative approach, based on bibliographical and documentary research. The results showed that Brazil ignores the international debate about this subject, to the extent that it has not ensured mechanisms guaranteeing the right to consultation of indigenous peoples, which enables its liability to the Inter-American System of Human Rights. This article addresses the mobilization of indigenous peoples and traditional communities for the recognition of their right to free, prior and informed consent (FPIC) provided for in ILO Convention 169, as a strategy of resistance and strengthening of their social organization in defense of their traditionally occupied territories. It takes as reference observations in the field, during visits and consultations carried out in five traditional communities, and testimonies of leaders of these territories, in the state of Pará. Sixty-one community autonomous protocols approved in Brazil, between 2014 and 2022, were also consulted, available at the Observatory of Autonomous Protocols. It is concluded that the appropriation of the FPIC has strengthened organization and resistance in indigenous territories and have become potential instruments for the exercise of local grassroots democracy. The article presents a documentary ethnographic analysis of the multiple conflicts involving the Munduruku people and the federal government, from the attempt to implement the São Luiz do Tapajós Hydroelectric Power Plant, emphasizing the clash regarding the situational application of the right to prior, free and informed consultation. Based on the indigenous history that opposes the jabuti and the tapir, I seek to demonstrate the conflicting discursivities, resistances and interests in dispute in the implementation of this project, as well as to explain how the agents involved mobilize different meanings for the legal device that is the right to prior consultation. This article has as its main objective determining how the Special Indigenous Jurisdiction (JEI in Spanish) and Special Jurisdiction for Peace (JEP in Spanish) are coordinated, as well as the role performed by indigenous communities in the applied justice of the post-agreement. To achieve this, the study employs the empirical-analytical and the exploratory-descriptive approach from the Embera Chami case in Riosucio (Caldas), supported by dialogues with the community about their knowledge of the Special Justice for Peace (JEP) and the possible conflicts that might arise from its application in the sanctioning and criminal justice dimensions. As a result, the study finds that the jurisdictions interact with each other in the framework of the unity, territory, culture and autonomy principles and founded in institutional harmony, legal diversity and understanding between cultures; which allows that the coordination between both finds multiple expressions. As a conclusion, the study finds that far from assuming a passive role and despite the conflict between competences, the Special Indigenous Jurisdiction revindicates different roles in the post-agreement justice in matters such as assistance, attention, integral repair of the victims, construction of truth and memory, re-incorporation of former-combatants indigenous people, among others. This article reflects around the ethnically differentiated approach contained within the peace agreement between the Colombian State and the former guerrilla group FARC. We aim to identify the judicial effects of this notion and in which way its introduction in the peace agreement has brought greater protection for the indigenous people and other ethnic minorities. Given that the agreement recognizes that the judicial tool for the development of peace in the lands and territories of the ethnic minorities is the prior consultation, we also perform a preliminary analysis of the effects of this law proposal. La Colombie, qui a érigé le droit à la consultation en droit fondamental, est perçue comme un modèle en ce qui concerne la mise en oeuvre de la Convention 169 de l’OIT. La consultation y est fortement institutionnalisée, grâce notamment aux mobilisations autochtones et aux décisions de la Cour constitutionnelle colombienne. Si le « modèle colombien » de consultation crée un véritable espace de participation pour les peuples autochtones, il n’en demeure pas moins fortement contesté. Les consultations servent en effet surtout à légitimer les décisions gouvernementales, dans la plupart des cas, plutôt qu’à protéger les droits des peuples autochtones. Cette forte institutionnalisation a aussi comme effet paradoxal de restreindre et d’encadrer la portée du droit au consentement, de plus en plus mis de l’avant par les peuples autochtones face aux limites des procédures consultatives. En ce sens, la résistance au passage d’un modèle consultatif à un modèle reposant sur le droit au consentement reste importante en Colombie., Colombia, which has enshrined the right to consultation as a fundamental right in its constitution, is perceived as a model for the implementation of ILO Convention 169. Thanks to Indigenous activism and key judicial victories, consultation is a well-established institution in Columbia. While it creates a unique participatory space for Indigenous peoples, the “Columbian model” of consultation remains highly contested. For many, it serves less the interest of Indigenous peoples in protecting their rights than as a procedural tool for legitimizing government decisions that will impact those rights. The strong institutionalization of this model also paradoxically serves to curtail Indigenous claims for a greater recognition of the principle of free, prior and informed consent. Resistance to the passage from a consultation to a consent regime therefore remains strong in Columbia., Colombia, que ha establecido el derecho a la consulta como un derecho fundamental, es considerado como un país modelo en la aplicación del Convenio 169 de la OIT. No obstante, la consulta ha sido muy institucionalizada, como resultado de las movilizaciones indígenas y las decisiones de la Corte Constitucional colombiana. Si bien el “modelo colombiano” de consulta crea un verdadero espacio de participación para los pueblos indígenas, éste sigue siendo muy controvertido. De hecho, las consultas sirven principalmente para legitimar, en la mayoría de los casos, las decisiones gubernamentales más que para proteger los derechos de los pueblos indígenas. Esta fuerte institucionalización tiene también el paradójico efecto de restringir y enmarcar el alcance del derecho al consentimiento, cada vez más reivindicado por los pueblos indígenas ante las limitaciones de los procedimientos consultivos. En este sentido, la resistencia a la transición de un modelo consultivo a un modelo basado en el derecho al consentimiento sigue siendo significativa en Colombia.

Indigenous peoples have developed in a context of exclusion with assimilation approaches, especially in Latin America. In this sense, there have been several struggles of these peoples to prevent the imposition of the hegemonic culture on their identity, customs and traditions, in order to make their rights effective. One of these fundamental rights is prior consultation, which is established in international regulations such as ILO Convention 169 and the United Nations Declaration on the Rights of Indigenous Peoples. However, despite the promulgation of regulations whose purpose is the respect and protection of indigenous peoples, these regulations generally do not fulfill the purpose for which they were created. The study presented in the following lines was carried out using a qualitative methodology, with an analytical-descriptive perspective; Specifically, the analysis of Judgment T-444/19 of the Colombian Constitutional Court was carried out, evaluating a case in which it was evidenced how the relationship between indigenous peoples and companies is truly materialized, what is the reality of the prior consultation , as well as, what is the role of the State as guarantor of human rights within this scenario in Colombia. Los pueblos indígenas se han desarrollado en un contexto de exclusión con enfoques asimilacioncitas, especialmente en Latinoamérica. En este sentido, varias han sido las luchas de estos pueblos para impedir la imposición de la cultura hegemónica en su identidad, costumbres y tradiciones, con la finalidad de hacer efectivos sus derechos. Uno de estos derechos fundamentales, es la consulta previa, misma que se encuentra establecida en normativa internacional como es, el Convenio 169 de la OIT y la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas. Sin embargo, pese a la promulgación de normas cuyo fin es el respeto y protección a los pueblos indígenas, esta normativa por lo general, no cumplen con la finalidad para la que fueron creadas. El estudio que se presenta en las siguientes líneas se llevó a cabo mediante una metodología cualitativa, con una perspectiva analítico-descriptiva; específicamente, se realizó el análisis de la Sentencia T-444/19 de la Corte Constitucional colombiana, evaluando un caso en el que se evidenció como verdaderamente se materializa la relación de los pueblos indígenas y las empresas, cuál es la realidad de la consulta previa, así como, cuál es el papel del Estado como garante de los derechos humanos dentro de ese escenario en Colombia. Os povos indígenas se desenvolveram em um contexto de exclusão com abordagens de assimilação, especialmente na América Latina. Nesse sentido, tem havido diversas lutas desses povos para impedir a imposição da cultura hegemônica sobre sua identidade, costumes e tradições, a fim de efetivar seus direitos. Um desses direitos fundamentais é a consulta prévia, que é estabelecida em regulamentos internacionais como a Convenção 169 da OIT e a Declaração das Nações Unidas sobre os Direitos dos Povos Indígenas. No entanto, apesar da promulgação de regulamentos cujo objetivo é o respeito e a proteção dos povos indígenas, esses regulamentos geralmente não cumprem o propósito para o qual foram criados. O estudo apresentado nas falas a seguir foi realizado com metodologia qualitativa, com perspectiva analítico-descritiva; Especificamente, foi realizada a análise da Sentença T-444/19 do Tribunal Constitucional da Colômbia, avaliando um caso em que foi evidenciado como a relação entre povos indígenas e empresas realmente se materializa, qual é a realidade da consulta prévia, como bem como, qual é o papel do Estado como garantidor dos direitos humanos neste cenário na Colômbia.

21. Indigenizing the Prior Consultation: Re-thinking the Protection of Indigenous Peoples

For many years it has been discussed the necessity of protecting effectively indigenous peoples and their territories from the interventions of companies and States. Nevertheless, the legal framework established for this purpose, particularly the prior consultation as one of the most iconic mechanisms, is ineffective in practice, which justifies the necessity of re-think its purpose, elements and its application. This is due mainly to the existence of structural and ideological flaws since the inception of this instrument, especially to the capitalist ideas, through which biopower has been exercised, as an expression of “legitime” imperialism. Durante años se ha discutido sobre la necesidad de proteger efectivamente a los pueblos indígenas y sus territorios de las intervenciones de empresas y los mismos Estados. Sin embargo, el marco normativo establecido actualmente para dicho propósito, particularmente, la consulta previa como uno de los mecanismos más icónicos, resulta ser poco efectivo en la práctica, lo que justifica la necesidad de re-pensar su propósito, elementos y aplicación. Esto obedece principalmente a fallas estructurales e ideológicas existentes desde la concepción misma de dicho instrumento de participación, especialmente las ideas capitalistas a través de las cuales se sigue ejerciendo el biopoder como una forma de imperialismo “legitimo”. Durante anos, foi discutida a necessidade de proteger efetivamente os povos indígenas e seus territórios das intervenções das empresas e dos Estados. Entretanto, o marco normativo atualmente estabelecido para esse fim, particularmente a consulta prévia como um dos mecanismos mais icônicos, está se mostrando pouco efetivo na prática, o que justifica a necessidade de repensar seu propósito, elementos e aplicação. Isto se deve, principalmente, a falhas estruturais e ideológicas na própria concepção desse instrumento de participação, especialmente as ideias capitalistas através das quais o biopoder continua a ser exercido como uma forma de imperialismo "legítimo".

El propósito de este artículo es sintetizar un examen crítico sobre la relación del discurso jurídico del modelo de desarrollo, las políticas nacionales sobre inversión extranjera directa y la gobernabilidad minera con las reivindicaciones de las comunidades étnicas colombianas, en especial las comunidades indígenas. Para ello, mencionaremos la literatura latinoamericana que ha impulsado una aproximación crítica al modelo de desarrollo promovido por los Estados del Norte global y las agencias multilaterales que estos presiden. Posteriormente, haremos un breve recuento histórico de la correlación entre la extracción minera extranjera y el esquema jurídico occidental que hemos heredado y acogido, que se asienta como antecedente y telón de fondo de un contexto jurídico que refleja la ineficacia de la consulta previa para alcanzar un verdadero diálogo intercultural. En este sentido, demostraremos que la jurisprudencia de la Corte Constitucional en torno a este mecanismo ha defendido un régimen de verdad oficial, acorde con la metáfora de éxito del desarrollo económico y, de esta manera, ha desconocido el saber-poder situado y periférico de las comunidades indígenas, afrodescendientes y campesinas en Colombia. Proceder que ha significado la ausencia de una reflexión seria sobre la interculturalidad legal (o interlegalidad) crítica. The purpose of this article is to synthesize a critical examination of the relationship between the legal discourse of the development model, national policies on foreign direct investment, and the mining governance, with the demands of Colombian ethnic communities. Therefore, we will mention the Latin American literature that has boosted a critical approach to the development model promoted by the global North’s states and the multilateral agencies they precede. Subsequently, we will make a brief historical account of the correspondence between foreign mining extraction and the Western legal framework that we have inherited and embraced, which is established as the antecedent and background of a legal context that reflects the ineffectiveness of prior consultation to achieve an authentic intercultural dialogue. In this regard, we will demonstrate that the Constitutional Court’s jurisprudence around this mechanism has defended an official truth regime following the metaphor of economic development success and, thereby, has ignored the situated and peripheral knowledge-power of the indigenous, Afro-descendant, and peasant communities in Colombia. This practice has meant the absence of a profound reflection on the critical legal interculturality (or interlegality).

This article analyzes the divergence between, on the one hand, the state's obligation to safeguard the rights of indigenous peoples and, on the other, defend national security. Thus, reference is made to the (inter)nationally recognized indigenous right to self-determination, as well as to norms and practices that regulate military activities in ancestral territories. It is argued that the alternative generally proposed to the absolute primacy of national security is a healthy balance between the aforementioned state obligations. However, what does this mean for indigenous autonomy? Has it always been conceived as "indefinitely limited" by security concerns, or could it be that in the name of national security only a certain type of indigenous autonomy can be recognized: a defenceless autonomy. This paper proposes to demonstrate the need for the adoption of a new inclusive and intercultural paradigm for protecting the human rights of indigenous peoples in Latin America. Th rough a critical analysis of the jurisprudence of the Inter-American Court of Human Rights, the paper will identify some of the advances and limitations in the attempt to construct new alternatives for dealing with indigenous issues in the region. Th is analysis will be conducted through a study of the three fundamental parameters established by Court precedents thus far: the concept of the right to life with dignity, the protection of communal property, and the right of indigenous peoples to prior consultation. L’Amérique latine n’échappe pas à l’exploitation de territoires hier difficilement accessibles. De ce fait, l’offensive de l’industrie extractive, notamment de la part d’entreprises canadiennes, engendre des impacts négatifs multiples sur la vie et les droits des populations (pollution des eaux, alimentation délétère, maladies diverses). Les peuples autochtones, dont le mode de vie et l’identité sont profondément marqués par leur rapport à la terre et à la nature, se retrouvent donc dans un nouveau cycle de luttes pour la protection de leurs territoires et la préservation d’un mode de vie équilibré avec les contingences de la nature. Leurs résistances sont diverses et innovatrices du point de vue de l’émancipation des peuples et de leurs droits. Non seulement questionnent-ils le modèle de développement dominant, mais ils mettent également en cause le pouvoir de décision des États sur le sens du développement, un pouvoir quasi absolu qui se substitue au droit des peuples à disposer d’eux-mêmes et à décider de leur propre développement., Latin America is presently living a huge exploitation of territories that were difficult to reach before. The international extractivist industry’s offensive, where Canada’s enterprises play a decisive role, produces many negative impacts on the life of people and concerning the rights of different populations (water contamination, toxic food, various mdiseases). Profoundly connected to their relation with earth and nature, Indigenous Peoples are especially facing a new phase of struggles to protect their territories and preserve the balanced style of life they wish to handle with nature cycle’s requests. In that respect, from a people’s emancipation perspective, Indigenous battles are several and innovative. Not only they criticize a dominant model of development, but they also question the absolute State’s power over development decisions, beyond the right of self-determination of peoples and their right to freely pursue their economic, social and cultural development., América latina no se escapa a la explotación de territorios primariamente inaccesibles. El asalto de la industria extractiva, y característicamente de la minería canadiense, genera muchos impactos negativos sobre la vida y los derechos de las poblaciones (contaminación de aguas, nutrición deletérea, diversas enfermedades). Basando su vida y su identidad a partir de su relación con la tierra y la naturaleza, en este tiempo los pueblos indígenas enfrentan un nuevo ciclo de luchas para proteger sus territorios y mantener un modo de vida equilibrado con las contingencias de esta naturaleza. Del punto de vista de la emancipación de los pueblos y del de sus derechos, sus resistencias son varias e ingeniosas. Esas resistencias no solo chocan con el modelo dominante de desarrollo, sino plantean además desafíos a la legitimidad del poder de decisión casi absoluto de los Estados en materia de desarrollo; ahora bien, es un poder que se substituye al derecho a la libre determinación de los pueblos, a su derecho de decidir sobre su propio desarrollo.

Violent conflicts between indigenous groups, multinational companies, and governments over the control of lands potentially containing valuable minerals and hydrocarbons are proliferating in Latin America, as well as elsewhere around the world too. In 1989 the International Labor Organization (ILO) approved ILO Convention 169, which mandates the implementation of prior consultation (PC) with indigenous peoples about any project that could potentially affect their territory. Many interpretations regarding the aims and scopes of PC exist. Some environmental sectors see PC as a mechanism to prevent the implementation of ecologically unsustainable projects in indigenous territories. Part of the indigenous rights sector, however, sees PC as a platform via which to negotiate financial resources for indigenous communities. On the side of governments and multinational companies, PC represents a means to diminish violence and advance projects under more stable political conditions. By examining mining and hydrocarbon projects in Bolivia, Peru, and Mexico, the authors compare cases in which PC takes place and ones where it is not applied. A typology of the outcomes in relation to 1) the prevention of industrialized resource extraction on indigenous lands, 2) redistribution of economic benefits produced by extractive projects, and 3) diminishment of the state repression associated with extractive projects is offered. Findings show that in many cases all three of these results are not simultaneously achieved; the authors explain why some outcomes might be obtained in certain instances and not in others. Finally, the article offers an overall assessment of PC results in light of participation theories., La violencia entre grupos indígenas, empresas multinacionales y gobiernos sobre el control de tierras con potencial minero y petrolero se encuentra en aumento en América Latina y en el resto del mundo. En 1989 la Organización Internacional del Trabajo (OIT) aprobó el Convenio 169 de la OIT que establece la obligación de los estados de realizar consulta previa (CP) con sus grupos indígenas antes de llevar a cabo cualquier proyecto que tenga el potencial de afectar sus territorios. Existen diversas interpretaciones sobre los alcances de la CP. Algunos sectores medioambientalistas entienden que la CP es un mecanismo para prevenir la implementación de proyectos ecológicamente destructivos en territorios indígenas. Por otro lado, parte del sector de derechos indígenas, entiende que la CP es una plataforma por la cual los grupos indígenas pueden negociar recursos financieros con el gobierno y/o las empresas ejecutoras. Por el lado de los gobiernos y las empresas multinacionales, la CP representa un medio para disminuir la violencia e implementar proyectos bajo condiciones de mayor estabilidad política. A través del análisis de proyectos mineros y petroleros en Bolivia, Perú y México, las autoras comparan casos en los que la CP tiene lugar con casos en que esta está ausente. Seguido de ello se elabora una tipología de resultados en relación a 1) prevención de extracción industrializada de recursos naturales en territorios indígenas, 2) redistribución de beneficios económicos producidos por proyectos extractivos, 3) disminución de represión estatal asociada con proyectos extractivos. Los hallazgos demuestran que, en muchos casos, estos tres resultados difícilmente son obtenidos simultáneamente; las autoras explican por qué algunos resultados son obtenidos en ciertos casos y en otros no. Finalmente el artículo ofrece un examen general de los resultados de la CP a la luz de las teorías sobre participación.

Uno de los aspectos más polémicos de la consulta previa es el efecto que esperan las partes de ella, o el impacto de los resultados de la consulta en la realización de la medida o el proyecto. El debate oscila entre la posibilidad de los pueblos indígenas de incidir en el proyecto o medida en tanto se tenga en cuenta su opinión o en su posibilidad real de vetarlo en caso de estar en desacuerdo con su realización. Los pueblos indígenas han luchado por lograr que se reconozca la necesidad de contar con su consentimiento previo, libre e informado antes de tomar una medida o realizar un proyecto que pueda afectarlos para que no sólo sean consultados antes de la adopción de dicha medida, sino que, además, ésta no pueda llevarse a cabo sin su aprobación. Así, el lenguaje del consentimiento previo que ha sido incorporado, por ejemplo, en la Declaración de los Pueblos Indígenas y en los pronunciamientos del Foro Permanente, propende por el poder de veto de las comunidades frente a una medida que las afecte. Sin embargo, la mayoría de las fuentes de derecho internacional sobre el tema incorporan el lenguaje de consulta previa, sin exigir que los Estados y terceros logren el consentimiento de las comunidades afectadas, lo que resulta en una ambigüedad sobre el efecto que dichas consultas deben tener en el contenido y la realización de los proyectos y medidas consultadas. Recientemente, en Colombia la consulta previa se ha convertido en uno de los temas más polémicos del derecho constitucional. En efecto, uno de los aspectos más controversiales de la consulta previa se relaciona con el alcance de este derecho, pues no existe un claro derrotero a seguir, cuando lo que está en juego es la ejecución de una medida con la cual los pueblos indígenas no están de acuerdo. Por un lado, existen interpretaciones que identifican a la consulta previa como el derecho de las comunidades a participar y expresar sus opiniones e intereses propios respecto de las medidas de desarrollo que se pretenden realizar en sus territorios, donde el poder de decisión radica en el Estado, y por otro, las que contemplan el derecho al veto, en caso de que la actividad a desarrollar no sea conciliable con las visiones de desarrollo de la comunidad afectada. (texto tomado de la fuente) Prior consultation to indigenous peoples has recently become one of the most polemical issue on constitutional law. Indeed, one of the most controversial matters of prior consultation is related to the scope of this right, since there is no clear course of action, particularly because indigenous peoples do not agree about such scope, and they are stakeholders about what prior consultation means. On the one hand, there are understandings that point out prior consultation as the right of communities to participate and express their own opinions and interests regarding development projects that are intended to be carried out in their territories, under decision by the Government. On the other hand, prior consultation is considered as a right to veto, in case of such projects are not compatible with indigenous peoples’ comprehension about social and economic development. La consulta previa, como una de las herramientas de protección de los derechos de los grupos étnicos más emblemáticas por su talante participativo, presenta sin embargo una construcción normativa y doctrinal que no comulga con la democracia deliberativa, principalmente porque supone, primero, la expresión de intereses individuales por parte de los participantes y, segundo, la posibilidad de que una de las partes ejerza algún tipo de poder sobre la otra para influir en el resultado. No obstante lo anterior, la reformulación del ideal deliberativo clásico por parte de una corriente de pensamiento que ve la posibilidad de hallar en este concepto un espacio para la expresión de intereses individuales y el ejercicio de poder bajo ciertas circunstancias, permite proponer una nueva visión de la consulta previa que la puede conducir a ser un escenario de intercambio cultural, que supere los escollos que esta figura presenta en la práctica cotidiana. Notwithstanding the prior consultation is one of the most emblematic protection tools of the indigenous peoples’ rights; it presents a regulative and doctrinal construction which not sympathizes with the deliberative democracy ideal; firstly, because of the expression of individual interests and secondly for the possibility that one of the parties could exercise some kind of power over the other to influence the result. A direction of thought has reformulated the classic deliberative ideal to allow the possibility of finding in this concept a space for the expression of self-interest and the exercise of power, under certain circumstances. These changes in the concept of deliberation allow us to propose a new vision of the prior consultation, which transforms it in a space for cultural exchange overcoming the obstacles that are present in daily practice.

Objetivo. Exponer el marco de referencia para la intervención desde el Trabajo Social en el derecho a la Consulta Previa. Metodología. Para llevar a cabo el estudio se utilizó la investigación documental. Resultados. Los marcos referenciales son herramientas imprescindibles para la intervención porque permiten conocer y abordar las realidades sociales desde sus diversos componentes. Conclusiones. Llevar a cabo posteriores investigaciones que estudien los procesos de Consulta Previa desde la perspectiva de género y que den cuenta de la especificidad del Trabajador Social en los procesos de Consulta Previa. Reconocer la importancia de fortalecer internamente las organizaciones representativas de los pueblos indígenas. Objective. To explain the frame of reference to the intervention from the Social Work in the right to the Previous Consultation. Methodology. Documentary research was used to carry out the study. Results. Referential frameworks are essential tools for the intervention because they allow to know and to approach the social realities from their diverse components. Conclusions. Subsequent research that study the processes of Previous Consultation from the perspective of gender and that inform the specificity of the Social Worker in the processes of Previous Consultation must be carried out. It is necessary to recognize the importance of strengthening internally the representative organizations of the indigenous peoples.

The objective of this article is to review and analyze the different arguments and legal excuses made by the Government and the private sector in Peru, this for the purpose of that the first-mentioned institution fails or avoids its juridical obligation of execute the preview consultation process for the indigenous peoples in Peru, this whenever the State is going to adopt a legislative or administrative measure susceptible that will affect directly to the indigenous peoples. In summary, this article seeks to analyze about the juridical problems founded at the moment of the implementation of the preview consultation process in our Legal System. If we consider that Convention 169 ILO, and the right to consult has been in force since February 2nd of 1995, and the Constitutional Court established on binding jurisprudence that the Convention in question is a norm that no needs a legislative development for its effectiveness, thus we can conclude that, rather than arguments is about legal excuses. El objetivo del artículo es revisar y analizar los diferentes argumentos y pretextos jurídicos utilizados por el Gobierno y el sector privado en el Perú, para que el primero incumpla o evada su obligación jurídica de realizar el proceso de consulta previa con los pueblos indígenas en el Perú, esto cada vez que el Estado prevé adoptar una medida legislativa o administrativa susceptible de afectar directamente a los pueblos indígenas. En buena cuenta lo que hace el artículo es analizar los problemas jurídicos encontrados al momento de implementar la consulta previa en nuestro ordenamiento jurídico. Si tenemos en cuenta que el Convenio 169 de la OIT, y el derecho a la consulta estaban vigentes, y eran exigibles en el Perú desde el 2 de febrero del año 1995, y que el Tribunal Constitucional ha dicho en jurisprudencia vinculante, que el referido convenio es una norma que no necesita desarrollo legislativo para desplegar sus efectos normativos, podemos concluir, que más que argumentos, se trata de pretextos jurídicos.

In this article, the authors describe how the International Financial Corporation of the World Bank, and the 77 global financial institutions that have signed on to the Equator Principles, have come to the conclusion that social conflict with indigenous communities needs to be resolved through the application of free, prior, informed and consent. Este documento analiza la relación entre los proyectos de desarrollo, los cuales son autorizados mediante licencias ambientales en nuestro país, y los conflictos en relación con el derecho fundamental a la consulta previa que tienen los pueblos indígenas y demás grupos étnicos y los cuales han terminado por ser resueltos ante los estrados judiciales. Este artículo está orientado a establecer los requisitos mínimos que debe tener la consulta previa para su implementación y garantía de los derechos de los pueblos indígenas al territorio, la autonomía, la participación y el desarrollo propio. Adicionalmente, ofrece una mirada al tema del consentimiento previo, libre e informado en el marco de la Corte Interamericana de Derechos Humanos y de la Corte Constitucional a través de una de sus providencias, para terminar sosteniendo que estas temáticas tan complejas, deben ser abordadas desde el enfoque basada en derechos humanos. This document is intended to analyze the relationship among development projects which are authorized through environmental licenses in our country, as well as the conflicts related to the basic right to prior consultation indigenous people and all other ethnical groups have; conflicts which have eventually resolved before courts. This article is focused on establishing minimum requirements a prior consultation should have to be implemented and assured with the right indigenous people have to territory, autonomy, participation, and own development. Besides, the article provides an overview about the prior free and informed consent as established by the Inter-American Court of Human Rights and the Constitutional Court through several sentences which finally stated that these topics are so complex that they should be treated from an approach based on the human rights.

La consulta previa, que es un derecho fundamental, ha sido considerada como un valioso instrumento que permite impulsar el respeto por los derechos de los pueblos indígenas, en especial aquellos que tienen que ver con el territorio, la identidad, la autonomía y la participación, entre otros. Durante los últimos años, de manera reiterada ha sido vulnerada la consulta previa, la cual debe realizarse siempre que se vaya a tomar una decisión de carácter administrativo o legislativo que pueda afectar directamente a los pueblos indígenas y demás grupos étnicos.El presente documento pretende ofrecer una mirada a los principales pronunciamientos efectuados por la Corte Constitucional en relación con la consulta previa, en las medidas legislativas. The previous consultation, which is a fundamental right, has been considered as a valuable instrument which promotes the respect for the rights of indigenous peoples, specially of those rights related with the territory, the identity, the autonomy and the participation, among others. In the last years the previous consultation has been repeatedly violated. It must be exerted every time an administrative or legislative decision that may affect directly these peoples must be taken. The present document expects to take a look at the main statements pronounced by the Constitutio-nal Court regarding the previous consultation related to legislative measures.

El reconocimiento de los derechos de los pueblos indígenas no ha sido un asunto pacífico, sino el resultado de luchas y grandes sacrificios por parte de estas comunidades, en aras de reclamar el respeto de sus condiciones especiales y de la cultura y el territorio que les corresponde. En este marco, la consulta previa es un derecho de especial importancia para estas comunidades y debe originar compromisos ineludibles para el Estado y la sociedad, al tenor de la Constitución de 1991, pues es un mecanismo para garantizar otros derechos de estos pueblos, tales como el territorio, la autodeterminación y la participación. Por lo anterior, la Corte Constitucional ha reconocido a la consulta previa como derecho fundamental en todos los eventos de que trata el convenio 169 de la OIT, pese a lo cual la práctica demuestra falta de garantías para este derecho. (texto tomado de la fuente) The recognition of the rights of indigenous peoples has not been a peaceful affair, but the result of struggles and great sacrifices of these communities, in order to demand respect for their policies and culture and their rightful territory. In this context, consultation is a right of special importance to these communities and should lead to unavoidable commitments to the state and society, under the Constitution of 1991, as a mechanism to guarantee other rights of these peoples, such as territory, self-determination and participation. Therefore, the Constitutional Court has recognized the consultation as a fundamental right in all the events referred to in the ILO Convention 169, although the practice which demonstrates lack of guarantees for this right. Tesis de máster del Máster en Estudios Latinoamericanos, curso 2008-2010, [ES] Esta investigación tiene por objetivo describir el tratamiento de la consulta previa en el Perú, como un mecanismo de participación de los pueblos indígenas en todas las medidas legislativas o administrativas que les afecten directamente. El análisis se realiza tomando como referencia el movimiento social indígena en la Amazonía peruana (2008-2009), debido a que su demanda principal fue la derogación de una legislación inconsulta, que promovía la concesión de recursos naturales ubicados en los territorios indígenas. En tal sentido, se hará una revisión pre y post conflicto: sistematizaremos los mecanismos de participación y consulta vigentes y cómo se han venido aplicando; así como las propuestas de las organizaciones indígenas, los compromisos estatales asumidos y los desafíos pendientes, que han derivado principalmente en la elaboración de una ley de consulta previa. En consecuencia, esta investigación pretende alcanzar cuatro objetivos específicos: 1. Determinar el progreso del reconocimiento constitucional y legal de este derecho; 2. Fijar cuáles son los mecanismos institucionales que se han creado para su ejercicio; 3. Explicar el modo de aplicación del derecho a la consulta previa en el Perú; y 4. Verificar, mediante la revisión de casos, si la aplicación de estos mecanismos han sido eficaces para generar y mantener un diálogo intercultural., [EN] This research aims to describe the treatment of prior consultation in Peru, as a mechanism for indigenous people participation in all legislative and administrative measures that directly affect them. The analysis was performed using as a reference the indigenous social movement in the Peruvian Amazon (2008-2009), since its main demand was a law repeal without consultation, which promoted the concession of natural resources located within indigenous territories. In this regard, we will review pre and post conflict situation: we will systematize actual participation and consultation mechanisms, and the way they have been applied, as well as the indigenous organization proposals, the government commitments that have been assumed and the remaining challenges, which are derived mainly from the prior consultation law elaboration. Therefore, this research aims to achieve four objectives: 1. To determine the progress of constitutional and legal recognition of this right, 2. To fix the institutional mechanisms that have been created to exercise it; 3.To explain how to implement the right of prior consultation in Peru, and 4. To verify, by the use of reviewing cases, if the application of these mechanisms has been effective at generating and maintaining an intercultural dialogue.
