Objective: Tens of millions of individuals with mental health problems interact with the U.S. criminal legal system (including 911, police, jail detention and sentences, courts, and probation and parole) each year. The authors sought to identify recommended mental health practices for criminal legal system-involved individuals and report the percentages of U.S. counties and of the U.S. population living in counties in which each recommended practice is present., Methods: Recommended practices for criminal legal-involved individuals with mental health problems were identified from meta-analyses, reviews, and best practice recommendations. Up to four respondents per county (i.e., jail, probation, community mental health, and community substance use treatment administrators) from 950 counties were asked whether each recommended practice was present for criminal legal-involved individuals. Weighted percentages of U.S. counties using recommended practices and of the U.S. population living in counties with each recommended practice are reported., Results: Fifty-nine recommended practices, including general mental health approaches (e.g., permanent supportive housing, Medicaid continuity) and diagnosis-specific mental health treatments (including medications and psychotherapies), were identified. Weighted data from respondents (N=791 from 519 counties) indicated that each recommended practice was present for criminal legal-involved individuals in only 21.9%-43.0% of U.S. counties., Conclusions: These results inform implementation efforts by indicating the presence of recommended care practices for criminal legal-involved individuals with mental health problems in counties nationwide. There has been a growth of domestic violence courts aimed at increasing offender accountability and victim safety. Although research has examined the effectiveness of these courts compared to typical court processing on recidivism, little is known about the mechanism of judicial accountability. Specifically, judicial review hearings, in which judges have discretion on whether and how to sanction for noncompliance, are common in these courts. This study examines whether incarceration sanctions for noncompliance affect recidivism among a sample of 347 probation review hearings in a Midwestern domestic violence court. Using logistic regression and survival analysis, we find that jail sanctions do not impact likelihood of recidivating but do result in significantly shorter periods of time until recidivating. The findings also signify the importance of addressing substance abuse issues in the prevention of recidivism. Further implications of the findings are discussed.

Objective: The purpose of this study was to examine the prevalence of mental illness, substance use disorders, and access to treatment among individuals from sexual minority groups who have been involved with the criminal legal system., Methods: This study used data from 195,239 heterosexual adults and 14,995 sexual minority adults ages ≥18 years surveyed in the 2015-2019 National Survey on Drug Use and Health. The authors compared mental illness, substance use disorders, and access to treatment between sexual minority and heterosexual adults by using multivariable logistic regression models and controlling for sociodemographic characteristics., Results: Approximately 9% of legal system-involved adults identified as belonging to a sexual minority group. Among legally involved individuals, sexual minority individuals were more likely than heterosexual individuals to have a serious mental illness, suicidal ideation, or depressive thoughts and to use inhalants, hallucinogens, alcohol, marijuana, or cocaine. Legally involved sexual minority individuals were also more likely than their heterosexual counterparts to receive treatment for mental illness or substance use disorders. The increased probability of receiving treatment for mental illness and substance use among sexual minority individuals was also observed when comparing sexual minority and heterosexual adults not involved with the criminal legal system., Conclusions: This study adds new population-based research to a limited body of evidence on the health disparities and mental health needs of legally involved sexual minority populations. More research and programmatic and policy interventions are needed to better support legally involved sexual minority groups in order to achieve mental health equity for this vulnerable population.

This study investigated whether drug dealing juvenile offenders in Belgium differ from non-drug dealers in levels of violent and non-violent offending behaviors, aggression, substance use, and mental health needs. The current study examined data from 226 16- to 17-year-old male juvenile offenders. Information relating to drug dealing, substance use, and mental health needs were collected through self-report questionnaires. A structured diagnostic interview was used to collect information about past violent and non-violent behaviors. Chi-square tests and multivariate analysis of variance compared non-dealers and dealers and explored if hard-drug dealers and soft-drug dealers differed from each other. Relative to non-drug dealers, drug dealers engaged in more violent offending behaviors, exhibited higher levels of aggression, substance use and oppositional defiant problems, and displayed lower levels of anxiety. Soft- and hard-drug dealers did not differ from each other. To conclude, detained drug dealers are characterized by severe antisocial behavior.

This study involved a mixed method evaluation of interpersonal violence and institutional misconduct in the Los Angeles county jail system. Interviews with 52 correctional staff uncovered a widely shared belief that AB 109, Prop 47, and the Rosas decision had all contributed to an increase in violence and misconduct in the jail. Analysis of administrative records indicated there was a rise in the monthly rates of these adverse outcomes from 2010 to 2017. Intervention ARIMA models, however, revealed evidence of a statistically significant increase following only the passage of Prop 47. An examination of inmate characteristics across the 8-year observation period confirmed staff suspicions that jail incarcerates with more extensive criminal histories were being confined following the passage of these policies. If jails are to be responsible for confining higher risk inmates, provisions should also be made to increase the availability of evidence-based rehabilitative programming and other treatment services that can help combat the occurrence of these adverse outcomes.

Severe mental illness, especially psychotic disorders that are worsening, acute or complicated, normally require intensive psychiatric care and treatment that is most appropriately provided in a mental hospital. For criminal defendants, transfer to a forensic security hospital has traditionally been the means of achieving hospital care for mentally disordered defendants who have been found incompetent to stand trial or not guilty by reason of insanity. In recent years, with the shortage of intermediate and long-term hospital beds in the United States, including forensic security hospital beds, jail-based competency restoration programs are being established, seemingly obviating hospital transfer. Potential advantages of and concerns about jail-based, as opposed to hospital-based, competency restoration programs are discussed in the literature. If defendants with severe mental illness traditionally treated in a forensic security hospital for competency restoration are now treated for competency restoration in jail, it is not inconceivable that insanity acquittees could one day be treated in jail for sanity restoration. With the premise that it is better to consider the potential consequences before this becomes a serious proposal and is implemented, this analysis examine the advantages and concerns that have been put forth for jail-based competence restoration programs as they may or may not apply to jail-based sanity restoration programs. Men and women with co-occurring substance use disorders and mental illness are at relatively high risk for becoming involved in the criminal justice system. Programs, such as post-booking jail diversion, aim to connect these individuals to community-based treatment services in lieu of pursuing criminal prosecution. Gender appears to have an important influence on risk factors and pathways through the criminal justice system, which in turn may influence how interventions like jail diversion work to engage men and women in treatment services and reduce recidivism. Different circumstances, levels of engagement, and outcomes by gender may be related to both person-level characteristics and external factors such as availability of gender-specific services and resources. This mixed-methods study identified specific ways in which men and women use services and reoffend after being diverted, and complemented those findings with in-depth insights from program clinicians about how program experiences and resources differ in important ways by gender. We matched and merged administrative records from 2007 to 2009 for 16,233 adults from several state agencies in Connecticut, and included data on demographic characteristics, clinical diagnoses, outpatient and inpatient behavioral health treatment utilization, arrest, and incarceration. Using propensity analysis, the 1693 men and women who participated in the statewide jail diversion program were matched to respective comparison groups of nondiverted men and women. We used longitudinal multivariable regression analyses to estimate the effects of jail diversion participation on treatment utilization, arrest, and incarceration, separately for men and women. We conducted three focus groups with jail diversion clinicians from around the state (n = 21) to gain in-depth insight from them about how circumstances, program experiences, and resources differ by gender in important ways; these subjective clinician insights complement the quantitative analyses of diversion outcomes for men and women. For both men and women, diversion was associated with reductions in risk for incarceration and increases in utilization of outpatient treatment services. For men only, diversion was associated with higher utilization of inpatient mental health care. No differences in treatment or criminal justice outcomes were observed in models that compared men and women directly. Major themes from the focus groups included: the existence of too few inpatient and residential resources for women with co-occurring disorders; different challenges to treatment engagement that men and women face; and a need for more effective, gender-specific services for all program participants. This article examines mental illness among adult, juvenile, male, female, jail, and prison inmates. It also explores the way in which mental health diagnoses impact offending and violent behavior. A review of literature pertaining to differences between the genders and age of offenders suggests that psychiatric disorders are more common among criminal offenders than the population at large. Furthermore, it appears that many mentally ill offenders do not receive sufficient treatment during their incarcerations and that barriers inherent to incarceration prevent adequate treatment of mental illnesses.

Motivated by some recent examples, this paper employs a model of public law enforcement to explain why it may not be in society's interest to send criminals to prison. We establish two main findings. First, independent of the lawbreaker's societal position, imprisonment is suboptimal when the harm from the illegal activity is sufficiently small. Second, for a given level of harm, imprisonment is suboptimal when the lawbreaker is sufficiently important. Objective: This study sought to examine perceived barriers to and facilitators of the adoption, implementation, and sustainability of community-based mental health peer support services for criminal justice-involved individuals, also known as "forensic peer support" (FPS).Methods: Qualitative interviews were conducted with stakeholders (N=14) and peer specialists (N=37) to better understand delivery of peer support services for justice-involved individuals in Pennsylvania. Thematic analysis followed by directed content analysis was used to identify factors in three a priori implementation categories based on the RE-AIM (Reach, Effectiveness, Adoption, Implementation, Maintenance) model: initial facilitators (adoption), barriers (implementation), and facilitators (maintenance) to long-term sustainability.Results: Initial service adoption was facilitated by buy-in from recovery-oriented gatekeepers in the criminal justice system. Unique implementation barriers included the chasm between the orientations of the two systems (recovery vs. punitive) and formal and informal limitations on the employment of individuals with criminal justice system exposure. For services to be sustainable and have an impact over the long term, FPS advocates and workers must develop rapport with on-the-ground employees of the criminal justice system. Funding barriers specific to the criminal justice system limited the adoption, implementation, and maintenance of FPS services.Conclusions: Although many of the factors that affect FPS service implementation were similar to those identified in the broader peer support literature, important differences must be addressed for successful FPS service delivery. Wardens figure centrally as part of the plot in popular culture representations of prisons such as in films (e.g. The Shawshank Redemption ) and television (e.g. Wentworth ). Yet little is known about how wardens are depicted in another form of criminal justice popular culture: the penal history museum. This paper examines representations of wardens observed as part of a study of 45 punishment memorialization sites across Canada. We analyze the symbolism used in these penal history museums, as well as the framing used to curate warden-related objects. Our analysis reveals that positive representations of prison wardens depict them as family-oriented, benevolent men of a strong character, who embody and command respect for authority. We found fewer representations that were critical of warden's work. We conclude by reflecting on the implications of our findings for literature on cultural depictions of penality and justice. Background: Community re-entry from custody programmes facilitate access to community resources, such as cash assistance and food stamps, with the aim of reducing criminal recidivism. Evidence that these programmes achieve is mainly from longer-term prisoners rather than short-term jail inmates.Aim: The aim of the study is to test the hypothesis that facilitating access to community resources while still in jail would reduce re-arrest rates among former jail inmates in the USA.Methods: Community resources offered to the jail inmates participating in this study included Medicaid, food stamps and cash assistance. Participants who opted to sign up for these social services were matched with non-applicants based on date of release (n = 101). Each participant's criminal history was coded prior to release from the jail and at three months, six months and one year after release.Results: Contrary to our original hypotheses, recidivism was not significantly reduced in the applicant group. People released after facilitated access to community assistance had an increase in drug offence severity at six months after release. Recidivism also differed by age and race.Conclusion: The substance offences in the applicant group suggested that cash benefits provided the released offender with the means to sustain their substance misuse. Objectives. We used "hot spotting" to characterize the persons most frequently admitted to the New York City jail system in 2013. Methods. We used our Correctional Health Services electronic health record to identify 800 patients admitted in 2013 who returned most since November 2008. We compared them to a randomly selected control group of 800 others admitted in 2013, by using descriptive statistics and cross-tabulations, including data through December 2014. Results. The frequently incarcerated individuals had a median of 21 incarcerations (median duration 11 days), representing 18 713 admissions and $129 million in custody and health costs versus $38 million for the controls. The frequently incarcerated were significantly older (42 vs 35 years), and more likely to have serious mental illness (19% vs 8.5%) and homelessness (51.5% vs 14.7%) in their record. Significant substance use was highly prevalent (96.9% vs 55.6%). Most top criminal charges (88.7%) for the frequently incarcerated were misdemeanors; assault charges were less common (2.8% vs 10.4%). Conclusions. Frequently incarcerated persons have chronic mental health and substance use problems, their charges are generally minor, and incarceration is costly. Although a far-reaching phenomenon, little is known about youths' understanding of incarceration or offenders. Using mixed methods, this research assessed 106 youths' (M = 11.54 years; 56.6% girls; 78.3% Black) understanding of jail and offenders. Caregivers reported youths' exposure to the criminal justice system through parental arrest (42.5%) and incarceration (32.4%). Factors found to influence youths' understanding include age, gender, and parental involvement in the criminal justice system. Results from the current study offer a snapshot of high-risk youths' understanding of jail and offenders, as well as some factors that influence them. This information may be useful for those who work with children of incarcerated parents, where misconceptions may influence psychological adjustment and the need for targeted interventions is paramount. The conventional wisdom is that offenders have very high discount rates not only with respect to income and fines but also with respect to time incarcerated. These rates are difficult to measure objectively and the usual approach is to ask subjects hypothetical questions and infer time preference from their answers. In this article, we propose estimating rates at which offenders discount time incarcerated by specifying their equilibrium plea, defined as the discount rate, which equates the time and expected time spent in jail following a guilty plea and a trial. Offenders are assumed to exhibit positive time preference and discount time spent in jail at a constant rate. Our choice of sample is interesting because the offenders are not on bail, punishment is not delayed and the offences are planned therefore conforming to Becker's model of the decision to commit a crime. Contrary to the discussion in the literature, we do not find evidence of consistently high time discount rates, and therefore cannot unequivocally infer that the prison experience always results in low levels of specific deterrence. The article offers information about the places in the city of Rome used for detention and execution. The said places include carcer, lautumiae, Saxum Tarpeium, Scalae Gemoniae and the elusive robur. Lautumiae was erected in 184 by Cato the censor. The Romans require carcer and lautumiae because carcer is a solid building in which criminals awaiting trial or execution could be securely held, likewise lautumiae provides hallows or caves where numerous people could be hindered from escaping by a few sentries. A detailed discussion of the history, location, character as well as function of the places is offered.

Most of the available research on jails focuses on large institutions, located in urban areas. In this study we empirically consider whether this emphasis shortchanges our understanding of jails by comparing 2,638 rural and urban jails on four dimensions: jail size and use, inmate characteristics, staff characteristics, and inmate services. Our results reveal several important cleavages between rural and urban jails. Based on our findings and a conception of jails as influenced in meaningful ways by their social, political, and organizational contexts, we suggest avenues for future research on local incarceration. Some researchers suggest that crime pathways are gendered and that different paths may be revealed depending on the point of contact with the criminal justice system. Drawing from the feminist and age-of-onset literatures, we examine the life experiences of a sample of ‘high-risk’ women to assess whether their offending pathways into jail are consistent with those predicted by earlier research.We find substantial overlaps with feminist pathways, but notable differences as well — differences that may lie with which populations are under study (jailed and awaiting trial/disposition versus convicted felons; by racial composition). Sorting the women by onset age (early, adolescent, and adult), we discover a sizeable group of adult onset offenders (54%). The article describes the creation of a jail diversion program for offenders diagnosed with a co-occurring disorder. It explores the factors that led to the explosion of jail diversion programs, which reflects the ease of diverting mental health clients from the criminal justice system. It details the characteristics, progress and outcomes of clients who entered a program in which all services are delivered in-house rather than through a traditional brokerage system.

Despite the increasingly punitive public policies of the past three decades and the concomitant 'get tough' rhetoric aimed at reducing prison and jail amenities, little is known about inmates' perceptions of punishment. Prison and jail administrators often justify their efforts to increase the "pains of imprisonment" for incarcerated offenders on the basis of retribution and deterrence, but these policies appear to be more symbolic than substantive in nature. Using interview data from 232 inmates about to be released from a large county jail renown for its 'get tough' policies, this study examined inmate perceptions of their unusual conditions of confinement. Findings suggest that many of these policies were benign or even counterproductive to the extent that they promoted a defiant response from offenders. [ABSTRACT FROM AUTHOR]

Substance abuse treatment has become the new fashion for reducing recidivism among inmates. But the question is, does this work? Various studies have been done tracking the same cohort of inmates over time to assess the validity of treatment This study assesses one treatment program's success over 5 years to determine if drug and alcohol treatment reduces recidivism among nonviolent, short-term (sentence of less than a year) inmates. Monroe County's drug treatment program demonstrates that for 1 year after receiving the treatment, three different cohorts of nonviolent, short-term inmates (1995, 1998, and 2000) were found to be substantially less likely to be recidivists than control group inmates. Some observers oppose imprisoning nonviolent drug offenders because they view incarceration as costly and such persons as generally benign. The career-criminal literature has established that perpetrators, including drug violators, commit an array of offenses. The current study merges these debates using a sample of 500 arrested adults selected from an urban jail in the western United States. Drug offenders amassed a much more extensive arrest history than other suspects net the effects of age, race, sex, prison history, and arrest onset. The study examined the utility of hair analysis for determining the prevalence of cocaine use in a high-risk population. Personal interviews and scalp hair specimens were obtained from 121 male youths who had been in jail in New York City and were followed-up in the community after their release. Using the standard cutoff, 51% of the hair specimens were classified positive for cocaine at a mean concentration of 87.6 nanograms per 10 milligrams of hair. Using the detection limit of the test, 67% were positive for cocaine. Only 23% of the youths reported any use of cocaine or crack during the previous 3 months and only 36% reported any lifetime use, indicating a substantial rate of underreporting. Associations were found between cocaine in hair and several behavioral variables: number of prior arrests (p = .08, trend), rearrest after release from jail (p < .05), not continuing education (p < .01) and no legal employment (p < .01). Hair analysis is a promising new epidemiological tool for obtaining more valid measures of illicit drug use in difficult-to-study populations. [ABSTRACT FROM AUTHOR]

Because of the extreme demands made by continuously escalating offender populations on already scarce prison space and program resources, a number of laissez-faire management approaches have been exposed as deficient. Forcing offenders to adhere to availability-driven models results in frequent misalignment of correctional responses, often with excessive financial and human costs. A developing trend toward data-based, objective approaches and the use of high-quality information systems has direct implications for prison resource management. Decisions regarding both individual offenders and systemwide policy can benefit from these evolving models. However, management ingenuity will not be equal to the task if extraprison forces are not simultaneously examined and modified. [ABSTRACT FROM AUTHOR]

This article examines self-incrimination in Japanese administration of criminal justice prior to the new constitution. As is well known, in the Middle Ages in Europe confession was a prerequisite for guilt, and was called the queen of evidence. The necessity of obtaining confessions for conviction led to miscellaneous kinds of exquisite tortures. The same thing was true of the Japanese criminal procedure under the feudal system. Under the feudal Tokugawa regime there was a distinction between Gimmi-suji or criminal procedure by inquisitorial methods and Deiri-suji or generally civil procedure by accusatorial methods. Bugyo or feudal magistrates had the functions of both judges and prosecutors simultaneously. The torture practice was legalized by customary law in the course of accumulated but not publicized precedents. As was usually the case under the feudal regime, the methods and devices of torture were standardized in their details. Gojin or torture in the broadest sense was broken down into two categories. They are Romon or torture in jail and Gomon in the narrower sense or torture in a special torture-cell. Romon or torture in jail was the first phase of the third degree, to which was subject any offender who refused to admit his offense. Stubborn criminals who withstood the first part of torture were subject to Gomon for the further felonious offenses as murder, arson, robbery, larceny, barrier-breaking and forgery were excused from the heavier torture. The methods of torture were prescribed and illustrated in detail in some of the secret manuals of criminal investigation for the guidance of feudal police investigators.

The authors discuss a project on how to improve the collection of health data among persons involved in the criminal justice system. Topics covered include the implications of the health and medical needs of the large criminal justice-involved population for public health, a table outlining known health data collected on persons in criminal justice systems by agency and country, and social and economic vulnerabilities of justice-involved persons that affect their health.
