Purpose: The UK Mental Health Act (MHA) Reform (2021) on race and ethnicity promotes new governmental strategies to tackle inequalities faced by ethnically racialised communities detained under the MHA. However, there is a scarcity in personality disorder and ethnicity research. This study aims to investigate what is available in the UK in relation to prevalence, aetiology and treatment provisions of personality disorder for ethnically diverse patients, and to understand their interconnectedness with mental health and criminal justice service provisions. Three key areas of investigations were reviewed, (1) UK prevalence of personality disorder amongst ethnically diverse individuals; (2) aetiology of personality disorder and ethnicity; (3) treatment provisions for ethnically diverse individuals diagnosed with personality disorder. Design/methodology/approach: A scoping study review involved a comprehensive scanning of literature published between 2003 and 2022. Screening and data extraction tools were co-produced by an ethnically diverse research team, including people with lived experience of mental health and occupational expertise. Collaborative work was complete throughout the review, ensuring the research remained valid and reliable. Findings: Ten papers were included. Results demonstrated an evident gap in the literature. Of these, nine papers discussed their prevalence, three papers informed on treatment provisions and only one made reference to aetiology. This review further supports the notion that personality disorder is under-represented within ethnic minority populations, particularly of African, Caribbean and British heritage, however, the reasons for this are multi-facetted and complex, hence, requiring further investigation. The evidence collected relating to treatment provisions of personality disorder was limited and of low quality to reach a clear conclusion on effective treatments for ethnically diverse patients. Purpose: The purpose of this paper is to find out what role intermediaries have in facilitating communication with victims and prisoners at Parole Board (PB) oral hearings. Design/methodology/approach: A survey was designed and administered to 39 PB members to find out their perceptions of, and experiences with, the use of intermediaries. Frequency tables and verbatim quotations are used to report the results. Findings: Overall, participants had not experienced any use of intermediaries with victims or family members presenting victim personal statements at an oral hearing. Further, there had been limited use of intermediaries for prisoners attending oral hearings. Nevertheless, there was a good recognition of a range of communication needs that a prisoner might present with at a hearing. There was also general support for the use of intermediaries with some caution about possible delays to procedural fairness. Practical implications: The early identification of communication support needs for prisoners and victims attending an oral hearing is essential. The PB should raise awareness with the PB Membership about the role of intermediaries. The PB should continue to develop guidance and policy surrounding intermediaries. Prison lawyers and HM Prison and Probation Service may require specialist training in identifying communication needs in vulnerable prisoners and identifying when a communication specialist might be required for an oral hearing. Originality/value: To the best of the authors' knowledge, this is the first published paper examining the role of intermediaries at PB oral hearings. Understanding the factors that influence domestic violence and abuse (DVA) victims to withdraw from the Criminal Justice System globally continues to be a key focus for professionals and academics working within this area. There is a dearth of extant literature examining the motivations behind victim withdrawal, particularly retraction occurring post provision of an initial statement. This paper examines the phenomenon of retraction, by thematically analysing N = 60 police retraction statements (PRS) collected by police officers in a large suburban police force in the North West of England. In examining these statements, insight can also be garnered from those victims still in an active relationship with their abusers. Findings highlight female victims' motivations for retraction and are framed around victim problem solving including: a) accepting the relationship which resulted in a discordance in proceeding with the prosecution of the abuser b) rejecting the relationship thereby rendering the prosecution as redundant c) engaging in procedural problem solving where alternative measures such as civil actions were sought to substitute a CJS prosecution and d) the effect of children where motivations were split between retracting to return to the complete family unit including the victim as the mother and retracting due to recognising the importance of the father's role without involvement from the mother. Notwithstanding limitations, this paper demonstrates that there is significant value in conducting an analysis of PRSs in furthering the understanding of why victims choose to retract at this point in their prosecution journey. The extracts from this dataset add insight and understanding into DVA female victim motivations to retract post-initial statement provision and highlight the differences within victim populations who retract their original statement. The current paper explores the theoretical and empirical capacity of developmental and life-course criminology (DLC) to further our understanding of non-lethal intimate partner violence (IPV) and femicide. Drawing on Sampson and Laub's age-graded theory and Moffitt's dual taxonomy, the paper delves into empirical research that has identified and examined the overlap between general offending and IPV, highlighting how these DLC theoretical frameworks could provide insight into non-lethal IPV and femicide. We also outline the ways in which these DLC perspectives are challenged to fully address the gendered nature of IPV and less able to provide an empirical and theoretical understanding of the role of power and control by men over their women partners. We then place these frameworks within the global impact of the COVID-19 pandemic on gender-based violence, including femicide. While the COVID-19 lockdowns increased vulnerability to IPV and increased homicide in the United States, the expected rise in femicide did not materialize—at least within the United States, prompting questions about the extent to which existing criminological theories are able to provide a framework for these types of crime trends during unprecedented events. We examine the way non-lethal and lethal IPV are shaped by different factors as outlined in Moffitt's dual taxonomy. The pandemic for example did not create increased psychopathy (i.e., affective and personality disorders) associated with the risk for femicide, but the COVID-19 pandemic and the subsequent lockdowns did create increased economic and family stressors, which placed many at-risk women and children in further social isolation, and reduced access to victim services. We conclude a need for further theoretical development surrounding femicide, integrating developmental and life-course perspectives, thereby emphasizing the need for refined frameworks to address the intricate dynamics of violence against women globally. Purpose: This paper aims to remove the self-evidence of the concept of severe and multiple disadvantage (SMD) by drawing upon a historical as well as a critical perspective to show its contingency. Design/methodology/approach: This paper will introduce the concept of SMD by examining how it has come to be understood in the way that it has. This paper does so by exploring key texts which have informed the development of the concept as well as its conceptual near neighbours such as "multiple needs". This paper traces some advancements of the concept within practice and further research with a focus on the Fulfilling Lives programme and the Lankelly Chase Foundation. Finally, the author reflects critically upon the concept and the manner in which the concept has become operationalised. Findings: This analysis demonstrates how a particular definition of SMD has come to dominate over the past few years because of the research and practice of key organisations. On the one hand, this has further marginalised alternative definitions and ways of working, but on the other hand these stakeholders have been able to influence the way in which UK policy has taken up the concept within its governmental priorities. Originality/value: To date, research has taken the term SMD for granted which limits the ability to critique its definitions and applications. This is an important and timely contribution because concepts are all-too-often taken for granted and at a pivotal moment when SMD has become nationalised through policy, critique is a political, potentially transformative, act. Purpose: Expert consensus is that people with an intellectual disability are over represented across the criminal justice setting (CJS). Primary research studies have been conducted in police stations and prisons, but little is known about the prevalence of this population in the court setting. The purpose of this paper is to conduct a literature review to find out more about the prevalence of defendants with an intellectual disability in court. Design/methodology/approach: A literature review was conducted using standard systematic review methodology (Julian et al., 2011) and the PRISMA reporting guidelines (Moher et al., 2009). Findings: Two papers met the inclusion criteria and were critically appraised. The papers reported prevalence findings ranging from 10%–20%. Research limitations/implications: Differences in study design, sampling, recruitment and diagnostic criteria affect the ability to make comparisons or synthesise findings. Practical implications: It is important that future primary and secondary research studies standardise operational terms to enable true comparison between studies, systematic reviews and evidence syntheses. Social implications: Defendants with an intellectual disability need to be identified to enable criminal justice professionals to make reasonable adjustments to proceedings and consider diversion and alternative disposal options. This will likely improve outcomes for this population and reduce recidivism. Originality/value: This literature review contributes to the growing evidence base about meeting the criminal justice needs of people with a learning disability and recognition of the increased prevalence across the CJS and specifically within the court setting. Purpose The purpose of this paper is to explore the origins of the Jimmy Savile Scandal in which the former BBC entertainer was accused of a series of sexual offences after his death in 2011. The case has had a massive impact on UK policing and criminal justice policy and on care work, with implications for due process and public expenditure in responding to reports of sexual abuse.Design/methodology/approach The paper draws on an Economic and Social Research Council funded project to collate data on the Savile case. It is based, primarily, on interview material from former pupils and staff members from Duncroft School, from whence initial allegations against Savile emanate, contrasting these with media accounts.Findings The research provides a very different picture of Duncroft and the contemporary policy context to that presented in media accounts. A questioning account of the origins of the scandal emerges. The findings may lend themselves to a moral panics analysis but also point to the power of dominant stories in influencing public policy.Research limitations/implications This paper is based on only a very small sample of interviews. The material is ethically sensitive in that it may be claimed or used to cast doubt on accounts of abuse.Social implications The implications of the wider project from which it draws are potentially profound, casting doubt on the origins and detail of the Savile scandal.Originality/value The paper addresses one of the major socio-cultural episodes in recent British history, which has had a profound effect on the workings of the criminal justice system, signalling a shift away from a presumption of innocence. The Council of Europe Convention on Action Against Trafficking in Human Beings stipulates a 'non-punishment principle' which provides for the possibility of not imposing penalties on victims for crimes they were compelled to commit. This paper investigates the UK's iteration of this principle: the statutory defence provided by section 45 of the Modern Slavery Act. Drawing on extant literature and relevant case law, this paper investigates current understandings of the statutory defence and the insights these provide into broader understandings of criminal exploitation. It demonstrates that while practitioners understand the processes of the legislation surrounding the defence, they are less knowledgeable about the nuances of modern slavery which therefore impacts the use and effectiveness of the defence. This paper challenges the basis upon which criminal law is applied, and its analysis makes an original contribution to recognising how misunderstandings of criminal exploitation can affect fairness in the criminal justice system. Although it is known that businesses report cybercrime to public authorities at a low rate, and this hinders prevention strategies, there is a lack of research on companies' decisions to report cyber victimisation. This paper analyses the UK Cyber Security Breaches Survey to explore factors associated with cybercrime reporting by businesses. Results indicate that the type of cybercrime is relevant to the reporting decision, and that the likelihood of reporting increases when cybersecurity incidents generate negative impacts and when the company places high priority on cybersecurity. However, we find no association between having cybersecurity insurance and reporting. Finally, while having outsourced cybersecurity management is associated with reporting to anyone outside the organisation but not to public authorities, in-house cybersecurity teams seem more inclined to report to public authorities. The regulation and governance of labour exploitation is a well-researched area across numerous disciplines. Common approaches towards regulating labour exploitation in businesses and supply chains include state interventions to tackle organised crime via the criminal justice system. However, due to strict criminal-legal definitions, these interventions are only possible when targeting severe exploitation. This emphasis means that a large amount of non-criminalised exploitation risks being overlooked. The purpose of this paper is to argue that non-state regulation is an important element in preventing routinised forms of labour exploitation, whereby a criminological perspective would help to understand and better prevent such practices. The paper examines state regulation, self-regulation of businesses, and trade union activity, which together addresses a wider range of labour exploitation. Semi-structured interviews from workers and supply chain stakeholders in the UK agri-food industry are used to inform this discussion. The governance of labour exploitation in relation to business activities has broader implications for the disciplinary areas of regulation and (corporate) criminology, whereby the former tends to prioritise restorative and persuasive approaches, whereas the latter focuses on deterrence and coercion. Ultimately, drawing together different strands of regulation into a hybrid approach is useful not only due to socio-political processes, but is arguably the most helpful in addressing routinised exploitation. Incidents of police brutality are an increasing concern around the world. South Africa faces its own excessive use of force by police exemplified by the case(s) of Khosa v Minister of Defence and Military Veterans 2020 7 BCLR 816 (GP) as well as that of Nathaniel Julies. Countries such as the United Kingdom (UK) and the United States of America (US) have seen positive results from leveraging advancements in technology to provide detailed, firsthand accounts of what happens during a police encounter. In light of the fourth industrial revolution, which brings together with it advancements in data processing and storing, the purpose of this paper is to investigate what value can such advancements in technology can bring to the South African criminal justice system and what possible barriers there could be in its implementation. This paper analyses the effects of Body-Worn Cameras in UK and US jurisdictions on improved police-citizen encounters and overall quality of policing. Body-Worn Cameras have been found to have value in improving police-citizen encounters. Background: Youth violence and knife crime is increasing dramatically, so much so it has been described as a global epidemic. The social, economic and political forces fuelling this rise mean that minority groups are particularly affected. Aim: This paper reviews the literature primarily from a UK perspective, and illustrates the disparate factors that are influencing the rise in youth violence and knife crime and illustrates the complexities of integrating the perspectives of different disciplines into coherent intervention strategies. Method: We conducted a systematic review of the literature that explores both the causes of increasing youth violence and knife crime as well as some of the interventions that have attempted to deal with the problem. Results: A complex interplay of social, economic, mental health and political factors underpin the increase in youth violence and knife crime. An uneasy tension exists between a traditional criminal justice system-based approach based upon deterrence and punishment, and a more liberal preventative model focusing on adolescent mental health. None of the interventions thus far have been particularly effective. Conclusion: Youth violence and knife crime is a global social issue that causes untold suffering to individuals, families and communities as well as fear that reverberates through society. Interventions have often been devised through the lens of particular disciplines or ideologies. Integrating these perspectives into a coherent approach that is actually effective demands greater co-operation, dialogue and mutual understanding between disciplines and agencies, as well as a robust framework for the evidence-based assessment of outcomes. This paper presents an empirical study of femicide and intimate partner violence (IPV) in Israel during 2020, the first year of the COVID-19 pandemic compared to previous years. Studies worldwide found elevated IPV during 2020 and a mixed picture of femicide, as both increases and decreases were reported, depending on the country. In Israel, the media reported a growth in IPV and femicide. However, no comprehensive empirical comparison of femicide and IPV during the lockdown months in 2020 in comparison to previous years was conducted. The current study fills this gap, comparing the 2014–2020 period in terms of IPV and femicide to determine whether the first pandemic year was unusual in terms of femicide and IPV. Data were collected from news websites, the Knesset (Israeli parliament) report, and annual public police reports to break down case-by-case femicide reports. The findings show a growth in femicide and IPV in the pandemic's first year, compared to 2019. However, compared to previous years, 2020 was not unusually high in terms of femicide. However, IPV was higher in 2020 than that in previous years. Hence, the media claims about the pandemic's elevated risk of femicide and IPV are only partially true. [ABSTRACT FROM AUTHOR]

During the COVID-19 pandemic, stay-at-home restrictions significantly changed people's daily lives around the world. Opportunity and strain theories predict this would lead to an increase in intimate partner abuse (IPA), including intimate partner homicide (IPH). This paper applies an alternative theoretical framework—situational action theory (SAT)—to explain mixed findings regarding changes in IPA and unexpected findings regarding (a lack of) changes in IPH. It is argued that SAT may contribute to explaining the impact of stay-at-home restrictions on IPA and IPH in three important ways: 1. by addressing the fact that motivation is necessary but not sufficient for explaining action and better specifying how motivation translates into IPA and IPH; 2. by addressing the fact that people perceive different alternatives for action and better specifying why some people come to see IPA and IPH as acceptable action alternatives; 3. by addressing the fact that exposure affects people differently and better specifying how stay-at-home restrictions shaped people's activity fields and, in turn, their perceptions and action choices. This paper considersmethodological standards in public law scholarship, showing the perils of current issues with access to relevant data and the promise of what can be achieved using better data and computational methods. It focusses on the effectiveness of Cart challenges – the largest group of claims for judicial review in the High Court – and discusses how the empirical question of the effectiveness of judicial review is linked with the normative question of what counts as 'success'. The article demonstrates the perils of inattention to data limitations in the analyses of Cart claims by the Independent Review of Administrative Law and by the government and shows the promise of better data and computational methods through an unprecedented empirical study of Upper Tribunal decisions that followed Cart judicial reviews. Topics discussed include specific reference of the book "A Christmas Carol" by Charles Dickens, the launch of the Criminal Justice System Strategy and Action Plan by Great Britain's Ministry of Justice in 2013 and the views of Dervla Simm, an associate at the law firm Hogan Lovells International LLP, regarding the same.

There is a need to improve a) identification and monitoring of people with mental illness on probation and b) understanding of the impact of interventions on mental health outcomes for the probation population. If data were routinely collected using validated screening tools and shared between agencies, this could inform practice and commissioning decisions, and ultimately it could improve health outcomes for people under supervision. The literature was reviewed to identify brief screening tools and outcome measures that have been used in prevalence and outcome studies conducted with adults on probation in Europe. This paper shares findings from the UK-based studies in which 20 brief screening tools and measures were identified. Recommendations are made based on this literature regarding suitable tools for use in probation to routinely identify a need for contact with mental health and/or substance misuse services and to measure change in mental health outcomes. Purpose: This paper aims to provide an overview of current suicide prevention across the UK criminal justice system (CJS). It considers shortcomings in current provision and how improvements could be made by drawing on international practice. Recommendations for practice going forward and suggestions for future research are made based on the literature. Design/methodology/approach: This paper provides an overview of suicide prevention research to date. Relevant literature was identified through a basic journal article search, including terms such as "probation", "criminal justice system", "suicide", "suicide prevention", "UK" and "suicide theory". Findings: This paper highlights opportunities to improve practice based on the current evidence base, making several recommendations and suggestions for practice, including improving multi-agency cooperation through clearer distribution of responsibilities, simplifying data sharing and investing in trauma-focussed suicide training for staff. Practical implications: This paper considers how research and psychological theory has informed suicide prevention practice in the UK. Limitations and challenges in applying theory to practice are explored, in the context of research with frontline staff who use such policies. This review proposes potential improvements to suicide prevention implementation to reduce suicide across the wider CJS. Originality/value: This article represents an overview of the existing literature as well as possible future ideas for policy. In keeping with many countries the UK has moved the problem of sexual offending up the political agenda. On the criminal justice side sentences have been increased and supervision periods extended. On the civil side a raft of new measures have been put in place to regulate the behaviour of sex offenders in the interest of community safety and child protection; this paper examines these measures and, in particular takes the sex offender ‘register’ as a case study to show how political imperatives have been brought to bear with little reference to the research or professional views of practitioners in this area. It is contended that under these political pressures, what starts life as a preventive, regulatory measure can easily become a more punitive measure in its own right; as such it may be liable to challenge by those subject to it for failing to fulfil its primary purpose and for straying across a line between the civil and criminal aspects of intervention. Sport is often framed as a panacea for social disharmony, especially within the context of marginalised youth populations, and is widely promoted as a mechanism through which a multiplicity of social policy objectives can be achieved. Yet while political rhetoric has long pointed towards sport's transformative abilities, the basis for such claims remains unproven. Theory-based approaches to evaluation have been posited as a useful device to explore the impact of specific initiatives and indicate where best practice may operate. The aim of this paper is to highlight one such theory-based framework that has been devised by practitioners in recent years around the operationalisation and evaluation of sporting interventions in criminal justice settings and which has come to be adopted as the dominant 'theory of change' across sport and criminal justice practitioner settings in the UK, but has, as yet, eluded academic scrutiny. To address this omission, the present discussion offers an in-depth analysis of this framework with the aim of discerning more clearly 'what might work' within sport and criminal justice contexts. In turn, the paper aims to stimulate further academic debate around the instrumental role of sport within criminal justice and the value of such frameworks for both policy and practice. From a position of near parity in 2005/2006, by 2012/2013 recorded search rates in Scotland exceeded those in England/Wales seven times over. This divergence is intriguing given the demands placed on the police, and the legal capacity to deal with these are broadly similar across the two jurisdictions. The aim of this paper is to unpack this variation. Using a comparative case-study approach, the paper examines the role of structural 'top-down' determinants of policing: substantive powers of search, rules and regulations, and scrutiny. Two arguments are presented. First, we argue that the rise of stop and search in Scotland was facilitated by weak regulation and safeguards. Second, we argue that divergence between the two jurisdictions may also be attributed to varying levels of political and public scrutiny, caused, in part, by scrutinising stop and search almost exclusively through the prism of 'race'. In Scotland, the significance of these factors has been made evident by dint of organisational developments within the last decade; by the introduction of a target driven high-volume approach to stop and search in Strathclyde police force circa 2007 onwards; and the national roll-out of this approach following the single service merger in April 2013. The salient point is that the Strathclyde model was not hindered by legal rules and regulations, nor subject to policy and political challenge; rather a high discretion environment enabled a highvolume approach to stop and search to flourish without challenge. Police attempts to engage with communities and involve the public in decision-making within co-governance meetings has a long history in the UK. This paper examines the most recent initiative for such engagement, exploring the potential and problems for community empowerment in meetings set up as part of the development of neighbourhood policing in the UK. The paper contributes to existing research by offering a more nuanced understanding of how cogovernance is constructed in meetings, drawing on a longitudinal ethnography of the experience of these meetings in advantaged and disadvantaged communities. Our findings demonstrate the complex reality and practice of co-governance meetings between the police and community members and the paper explores three key themes in relation to these meetings. First, in examining the potential for community empowerment, we show that while these meetings may have some regressive effects, core attendees fully embrace them and seek to establish an active citizen identity. Secondly, we offer some support for a radical communitarian thesis, demonstrating how residents even in disadvantaged communities are able to have their voices heard. Finally, the research demonstrates that while the police attempt to control these meetings, this control is not uncontested with frequent challenges against police and partner (in)actions. Purpose: This study aims to present a case study about the Team Around Me (TAM) model of case coordination which was developed by Fulfilling Lives Islington and Camden (FLIC) as an action experiment. The model is a standardised tool for running case conferences for clients experiencing multiple disadvantage (MD). Design/methodology/approach: Deploying a case study approach, this study explores why a TAM-coordinated approach is beneficial for people experiencing MD. Findings: The authors explore why the need for effective case coordination is integral for clients experiencing MD, and how current structures fail to facilitate effective case management. The authors put forward an argument for the four core principles underpinning the TAM model: strengths-based, action-focussed, systems thinking and client involvement. The barriers to embedding and upscaling this approach are discussed, alongside the obstacles presented by the wider system that prevent wider implementation. Originality/value: The TAM model is a new approach to case conferences, designed and upscaled by FLIC, and has since been adopted across two London boroughs, and training has reached services across the UK. This paper highlights the need for innovative approaches to case coordination that centre client involvement, promote a strengths-based approach and recognise system blockages as a key barrier to client progress. In 1918, the British War Office introduced Regulation 40D as an amendment to the Defence of the Realm Act (DORA). The short- lived regulation allowed the state to remand and imprison a woman for the transmission of venereal disease to a member of His Majesty's armed forces. This paper examines discourses on national security and female promiscuity surrounding the enactment of Regulation 40D and the prosecutions under this controversial measure. The paper argues that the regulation was merely symbolic, and that it empowered magistrates to assess, judge and ultimately control women's sexual behaviour in the name of national security. This paper utilises the concept of 'hate relationships' in conversation with the literature on geographies of encounter to explore experiences of racism for those entrapped by racist encounters with those who are familiar. In so doing, we attend to the uneven and harmful risks involved in some forms of everyday urban encounter. We draw upon case notes collated by a hate advocacy service in North East England, UK, to illustrate the cumulative damaging force of enduring hate relationships. By drawing parallels with work on domestic violence, we suggest hate relationships evident in our data exhibit distinct temporalities of routinisation, whereby harmful 'low level' violence, often under the radar of the criminal justice system, gains force through repeated neighbourhood-based encounters. In so doing, we also highlight both the situated and relational spatialities at work; localised encounters marked by familiarity, racialised territoriality and experiences of fear and immobility, but also relations of entrenched disadvantage and institutional failures that sustain harm. Concerted acts of resistance look to confront and/or escape these relationships, but as forms of resolution, where additional burdens are placed on victim/survivors, these are constrained by the same violent conditions through which such relationships are allowed to take shape. Following the introduction of National Intelligence Model (NIM) in 2004, this paper explores whether crime analysis has been integrated into policing practice. Fieldwork was conducted in one UK police force with both analysts and police officers. Findings from the analysis of semistructured interviews and focus group discussions suggest that while crime analysis is acknowledged as being central to the business of everyday policing, police officers' general lack of understanding of how analysts work and their capability leads to underutilisation of their skills. The research uncovered knowledge and process gaps, deepened by cultural constraints, budget cuts and resource reallocations, which inhibited incorporation of analysis into the heart of policing practice. Findings also indicated that analysts lack the resources, time, and sometimes, motivation to undertake sophisticated analysis, and often feel frustrated when officers' opinions override analytical wisdom. The paper argues that at least in the UK, better training and cultural change are necessary for creative utilisation of analytical resources and for bridging the knowledge and process gaps in the organisation. Various police and partnership schemes claim to address vulnerability, either as an end in itself, or as a means of crime reduction. However, project staff do not articulate always what is meant by 'vulnerability,' or relate it necessarily to victimization risk. This paper considers what the notions of 'vulnerability' and 'risk' mean, and how they are tackled and prioritized. Some lessons are provided from the UK Reducing Burglary Initiative. The paper argues that un-evidenced assumptions of vulnerability and risk need to be avoided. The Police are located at the façade of Criminal Justice System in virtually all countries in the globe and the efficacy of democratic system of government lies on the functional police as well as other related agencies of the Criminal Justice System or law enforcement agencies. Since the return of democratic rule in 1999, the Nigerian Police Force (NPF) has allowed politicians in government to use them against opposition. The paper examined the role of the Nigerian Police Force (NPF) from the revival of democratic rule in Nigeria from 1999-2015. The paper adopted political economy theory and Weberian approach as theoretical triangulation and content analysis in the methodology. In the sixteen years of Peoples Democratic Party (PDP) rule before it was defeated at the 2015 general elections, the NPF has systemically impeded the process of political gatherings, mobilization and campaigns by the opposition politicians and political parties. The handling of political activities by the NPF shows that they often take side with the ruling party and the resultant effect is that the Police has lost its neutrality and respect before the citizens. The palpable fear is that Nigeria witnessed the dress rehearsal in the use of the Police Force as a repressive tool to distort and disrupt the beleaguered Nigerian democracy which signifies a gloomy future for democratic governance. It has been settled that the police usually engage in reckless harassment of civilians they perceived opposed then the ruling party. The paper found out that police in most countries are arguably the central public service of the modern state and as such are required by the citizens to display high sense of civility in their national callings. They are ought to protect the essential freedoms of the citizens and have monopoly over the use of legitimate force. The police in Nigeria since the period of British colonialism had been willing accomplice of the ruling class and the elite, perpetuating and abetting impunity that are detrimental to democratic mores and traditions. This paper explores the meaning of the word 'felony' in thirteenth and fourteenth century England, i.e., during the first two centuries of the English criminal trial jury. To compile a working definition of felony, the paper presents examples of the language of felony drawn from literary and religious sources, in addition to considering the word's more formulaic appearance in legal records. The paper then analyzes cases ending in acquittal or pardon, highlighting the factors that might take a criminal case out of the realm of felony. It suggests that the very definition of felony and felonious behavior-and thus the essence of criminal responsibility-may be bound up with the idea of mens rea during this period. The paper aims to uncover broader societal understandings of the nature of guilt and innocence, and to highlight connections and disconnections between the formal criminal law of felony, with its heavy emphasis on capital punishment, and popular and ecclesiastical understandings of culpability. Background This paper reviews the early work of Griffith Edwards and his colleagues on alcohol in the criminal justice system and outlines the direction of research in this area in the Addiction Research Unit in the 1960s and 1970s. The paper outlines the link between that work and work undertaken in the more recent past in this area. Methods The key papers of the authors are reviewed and the impact of this work on policy and practice is discussed. Conclusions There is a rich seam of work on deprived and incarcerated populations that has been under way at the Addiction Research Unit and subsequently the National Addiction Centre, Institute of Psychiatry, London. This paper explores the impact of cuts and continued fee stagnation on publicly funded criminal defence in England and Wales. In so doing, we take an explicit focus on Wales, which has been neglected in socio-legal scholarship on criminal justice matters. Drawing on 20 interviews with criminal defence lawyers in south Wales, we examine how they have experienced the changes to criminal legal aid in recent years. The lawyers in this study largely considered underfunding as a key political issue, with criminal legal aid identified as an easy target, also highlighting concerns around the impact of underfunding on their practice and how they can work for clients. As such, lawyers queried whether there is a viable future for criminal legal aid. These findings have implications for Wales, and the whole England and Wales jurisdiction, as we will discuss throughout. [ABSTRACT FROM AUTHOR]

A growing number of jurisdictions treat 'hardcore' cartel conduct as crime, in the belief that the threat of incarceration is necessary for deterrence. The significant economic harm caused by cartels is generally undisputed, but there is disagreement over whether cartel conduct is morally offensive enough to justify criminalisation. Critics argue that it is another example of 'over-criminalisation', seeking to regulate an activity that is morally ambiguous. Those in favour have sought to formulate normative justifications for why cartel conduct should be crime. Many of these rely on the assumption that members of society expect markets to be competitive and believe cartels are undesirable. This paper makes a significant contribution by testing this question empirically. Public surveys from the UK, Germany, Italy and the US are used to critically analyse the extent to which normative justifications for cartel conduct have empirical backing. [ABSTRACT FROM AUTHOR]

The engagement of young people has been a neglected area in youth justice and drug policy and practice. This paper explores the concept of 'engagement' in relation to drug interventions in custodial and community settings in different European countries. Interviews were undertaken with young people (aged 14–25 years) in contact with the criminal justice system who use illegal drugs and with practitioners involved in the delivery of interventions for our target group in Denmark, Italy, Poland, and the UK. The key techniques to engage young people were described in similar terms across the countries. These included forming relationships based on trust, honesty, and empathy, setting goals collaboratively, and employing practitioners with lived experience and understanding. The objectives and activities on offer are often constrained by criminal justice contexts. Despite the differences between the countries in terms of criminal justice systems and the structure of drug interventions, there were remarkable similarities in the ways young people and practitioners described effective engagement. Strong emphasis on operational engagement to ensure positive relationships between young people and practitioners was important in the design and delivery of interventions. Practitioners working in criminal justice contexts need to have flexibility and autonomy to work creatively to find ways to engage, connect, and inspire young people. [ABSTRACT FROM AUTHOR]

This paper provides an account of young people's experiences of and perspectives on help and support in drug reducing interventions. It is based on interviews with young people age 14–25 who were in contact with the Criminal Justice System (CJS) and, at the same time, participated in a drug reducing intervention. The interview data forms part of the EU funded EPPIC project. Two main themes emerged from the young peoples' accounts that cut across different types of interventions and social systems in both countries. The first revolves around the 'system' of welfare, criminal justice, health and educational services and the barriers young people encountered in navigating the system to find help. The second revolves around the young people's experiences with professionals, including what they appreciated and what they found problematic in professionals' approach to them. Basing our analysis on data from two different countries, we are able to emphasize similarities in the young peoples' perspectives, despite being enrolled in different drug reducing and CJS interventions. The insights gained indicate a need for systems and service changes that can facilitate a better balance between building individual resilience and providing appropriate, timely and adequate support within a 'resilience-building' environment. Based on research undertaken as part of the EU funded EPPIC project, this paper aims to update and elaborate on the relationship between drug use and offending behaviours by exploring variations within a cross-national sample of drug-experienced young people in touch with criminal justice systems. Adopting a trajectory-based approach, interviews were undertaken with 198 young people aged 15–25 in six European countries (Austria, Denmark, Germany, Italy, Poland, and UK). Data were analysed by applying the Bennett and Holloway categorization of the drugs-crime link, with a focus on the concept of social exclusion as developed by Seddon. Three main types of mechanisms (economic, pharmaceutical, and lifestyles) are used to interpret the data, showing how the relationship between drugs and offending can vary according to type of substances and over time. Furthermore, it can be associated with very different degrees of social exclusion and needs. The results suggest that while economic inequalities still play key roles in explaining drug use and offending, both behaviours can originate from a state of relative deprivation, resulting from the contradictions inherent in 'bulimic societies' that raise aspirations and desires while providing young people scarce opportunities for self-realisation and social recognition. On the Outside (On the Outside. 2019. Film. Directed by Paul Gray. UK: Good Well Films), is a 42 minute film that is the outcome of a participatory film project involving women serving sentences in HM Prison Polmont, Scotland. Scripts were developed that communicated the women's stories using their exact spoken words and individual narratives were recounted by actors, giving introspective accounts of the women's lives, while challenging preconceived notions of the label 'prisoner.' Representations of the criminal justice system are a highly visible presence on current mainstream platforms. Delineations between fiction and non-fiction narrative are increasingly exercised by film-makers to affect audience expectations, in particular when exploring dramatisations of 'true life' crimes. On the Outside is a project led by Paul Gray, whose practice led research explores the dynamics of such delineations through collaboration with the participants, in their roles as authors of their own narratives. This paper recounts the processes involved in realising the project, which will be discussed in relation to verbatim practices, as well as the underlying methodology used to action participatory video techniques. The aim was to facilitate a production process that best suited the specific voices of those involved, by recognising the significance of anonymity in storytelling, when collaborating with vulnerable individuals and communities. It is often assumed that immigrants in countries such as the United Kingdom will report lower levels of trust in the police. Immigrant communities are thought 'difficult to police', and minority groups frequently experience problematic relationships with police. Yet, there has been little empirical investigation of this issue in the United Kingdom. In this paper, data from the Crime Survey of England and Wales are used to explore the relationship between immigration and trust in the police. Results suggest that trust is higher among immigrants than among the UK-born population, although there is important variation by time since arrival and experience of policing. Trust in the police is also higher in neighbourhoods that have more immigrants. The paper concludes with some reflection on the nature of trust in the police. [ABSTRACT FROM AUTHOR]

Intimate partner violence (IPV) has been highlighted as a priority for UK governments and criminal justice agencies since the 1990s. However, whilst generating significant policy and procedural responses, the overall impact continues to be criticised. This paper examines contemporary approaches to IPV identification and response, highlighting the limitations within victim engagement and empowerment. It then moves on to specific developments and theories in victimology, demonstrating how research into victim engagement is emerging and could be utilised in practice to enhance victim empowerment. It argues that policy and procedure based upon an enhanced victim empowerment approach would be necessary in striving for positive criminal justice outcomes and for increasing victim satisfaction. Purpose The purpose of this paper is to describe the work of HMP Grendon, the only prison in the UK to operate entirely as a series of democratic therapeutic communities and to summarise the research of its effectiveness. Design/methodology/approach The paper is both descriptive, providing an overview of the work of a prison-based therapeutic community, and offers a literature review regarding evidence of effectiveness. Findings The work of HMP Grendon has a wide range of positive benefits including reduced levels of disruption in prison, reduced self-harm, improved well-being, an environment that is experienced as more humane and reduced levels of reoffending. Originality/value The work of HMP Grendon offers a well established and evidenced approach to managing men who have committed serious violent and sexually violent offences. The social policy and criminal justice agenda introduced by New Labour in the UK between 1997 and 2010 was significantly influenced by a communitarian philosophy imported from the USA, where it had come to prominence in during the 1980s and which proposed that the individual rights promoted by traditional liberalism need to be balanced with social responsibilities (Etzioni 1995a, 1995b). Nowhere was this influence more apparent in the UK context than in the flagship criminal justice legislation, the Crime and Disorder Act 1998, the creation of the contemporary youth justice system which signaled a conspicuous departure from its predecessor, and which was all validated by the mantra of then Prime Minister, Tony Blair, "tough on crime, tough on the causes of crime." It was now proposed in terms of the new communitarian orthodoxy that young offenders should take responsibility for their actions while, at the same time, those working in the new system should seek to ameliorate the personal and social conditions that had impacted negatively on their behavior. Critics of the pragmatic implementation of communitarian policies nevertheless detected a progressive authoritarian overemphasis on the responsibilities of individuals to the detriment of their rights. This was to become very apparent with the new youth justice system which came to absorb a worryingly ever increasing number of young people into its widening custodial net (Hopkins Burke, 2008). This theoretically-informed paper considers 1) the notion of communitarianism and its significance, 2) its impact on the contemporary youth justice system introduced in England and Wales in 1998, and 3) the implications and possibilities for a system founded on a radical moral communitarianism (Hopkins Burke, 2014a, 2014b). The paper provides a significant alternative conceptualization of communitarianism informed by notions of consensual interdependency, a fairer and (more) equal division of labor and an appropriate balance between the rights and responsibilities of all citizens in society. It concludes that a radical moral communitarian emphasis on social inclusion, a fairer more equal society, enjoying widespread legitimacy among young people and their significant others, will provide the basis of a much more humane, dispassionate and depoliticized youth justice system, incorporating a much wider us of progressive concepts such as restorative justice which have for too long lingered on the margins of Western youth justice systems. Attitudes toward legal authorities based on theories of procedural justice have been explored extensively in the criminal and civil justice systems. This has provided considerable empirical evidence concerning the importance of trust and legitimacy in generating cooperation, compliance, and decision acceptance. However, not enough attention has been paid to attitudes towards institutions of informal dispute resolution. This paper asks whether the theory of procedural justice applies to the alternative dispute resolution context, focusing on ombuds services. What are the predictors of perceptions of procedural justice during the process of dealing with an ombuds, and what factors shape outcome acceptance? These questions are analyzed using a sample of recent ombuds users. The results indicate that outcome favorability is highly correlated with perceived procedural justice, and both predict decision acceptance. [ABSTRACT FROM AUTHOR]

In this paper I review recent empirical work analysing the determinants of crime. Improved detection rates consistently lower crime while the relation between prison sentences and crime is more complex. Short sentences are found to be counterproductive. Socio-economic factors play an important role but their sign and significance varies across crime types. Given the police funding cuts, the paper suggests that there is a need for rigorous efficiency studies so that less efficient forces can learn from the practices of more efficient forces. What were the consequences of penal transportation to the New World for eighteenth-century British criminal justice? Transportation has been described by scholars as either a replacement of the death penalty responsible for its decline, or a penal innovation responsible for punishing a multitude of people more severely than they would have been punished before. Using data from the Old Bailey Sessions Papers and the Parliamentary Papers, this study examines sentencing and execution trends in eighteenth-century London. It takes advantage of the natural experiment provided by the passage of the 1718 Transportation Act that made transportation available as a penal sentence, thus enabling one to assess the 'effect' of transportation on penal trends. This study finds that the primary consequence of the adoption of transportation was to make the criminal justice net more dense by subjecting people to a more intense punishment. While it was also associated with a small decline in capital sentences for some types of offenders, the adoption of transportation was also associated with an increase in the rate at which condemned inmates were executed. The study closes with a discussion of the conditions that may lead to law's unintended consequences, including the mesh-thinning consequences observed here. [ABSTRACT FROM AUTHOR]

Time banking, a form of community currency facilitating time-based exchanges, developed in the United States during the 1980s before transferring to the United Kingdom in the late 1990s. Whilst now operating in over 30 countries, this paper explores the US–UK link, focusing on time bank practices within criminal justice. Examining time bank theory and the UK/US policy contexts, this paper provides an account of the Time Dollar Youth Court and the UK time bank prisons initiative, to facilitate a discussion of policy transfer and lesson drawing.
