La presente investigación se encamina al estudio de un instrumento novedoso creado por el Estado colombiano, en cumplimiento de un mandato proveniente de un organismo internacional, que puede marcar un hito en el tema de Derechos Humanos; Se busca determinar el cumplimiento y la eficacia de la Ley 288 de 1996, en la cual se establecen instrumentos para la indemnización de perjuicio a las víctimas de violaciones de Derechos Humanos, en virtud de lo dispuesto por determinados órganos internacionales; a raíz del estudio de conceptos y pronunciamientos de la Comisión Interamericana de Derechos Humanos, en lo referente al tema de reparaciones pecuniarias por parte del Estado colombiano a víctimas por violación de Derechos consagrados en la Convención; En diversas actuaciones ha sido condenado por acción directa, acción indirecta o por omisión total de los diferentes organismos estatales que han caído en una revisión al amparo de ésta normativa. Para el desarrollo, inicialmente, se tendrán en cuenta las definiciones y conceptos relacionados con el derecho internacional, la Comisión de Derechos Humanos, y las reparaciones a las víctimas, especialmente en el Estado colombiano, mediante un análisis jurisprudencial en cuanto a la recomendación de reparar a víctimas por parte del Estado sobre aquellas decisiones que provengan de la Comisión, posteriormente se revisará la efectividad de la aplicación de esas reparaciones pecuniarias al instrumento de investigación en el presente trabajo, los hechos cometidos y finalmente se establecerán los resultados de análisis y algunos apuntes al tema a modo de conclusión. The present investigation is aimed at the study of a novel instrument created by the Colombian State, in fulfillment of a mandate from an international organization, which can mark a milestone in the subject of Human Rights; The aim is to determine compliance and effectiveness of Law 288 of 1996, which establishes instruments for the compensation of damage to victims of human rights violations, pursuant to the provisions of certain international bodies; as a result of the study of concepts and pronouncements of the Inter-American Commission on Human Rights, on the subject of pecuniary reparations by the Colombian State to victims for violation of Rights enshrined in the Convention; Since the enactment of this law, in various actions by direct action, indirect action or by total omission of the different state agencies that have fallen under a review under this regulation. For the development, initially, the definitions and concepts related to international law, the Commission on Human Rights, and reparations to victims, especially in the Colombian State, will be taken into account through a jurisprudential analysis regarding the recommendation to repair to victims on the part of the State on those decisions that come from the Commission, later the effectiveness of the application of these pecuniary reparations to the investigative instrument in the present work will be reviewed, the facts committed and finally the results of analysis and some notes will be established to the topic by way of conclusion. In this sense, the present work proposes a theoretical clash between the Right to Development, conceived in the United Nations, and the normative framework that underlies the decisions of the WTO Dispute Settlement Body. The basic argument is that the dispute settlement system should take into account on its decisions the social, labor, economic and environmental aspects of the United Nations normative. On that subject, this paper is structured in four chapters: the first one analyzes the economic model proposed by the Economic Commission for Latin America and the Caribbean (ECLAC) and the history of international economic relations over the last decades. In the second chapter, the fundamentals of the Right to Development are discussed. In the third chapter, the formation of the World Trade Organization and seven controversial cases are studied. In the fourth chapter, possible solutions to the perceived dead-lock are presented. To prove the point, throughout the work an invitation is made for an incursion into the foundations of sustainable development, socio-labor responsibility and economic development - not just economic growth. Such analysis do not exhaust the object of this study; It is plausible to demonstrate that such issues, if addressed at the WTO, would fray environmental and labor dumping, which are violations of fundamental human rights and cause distortions to international trade, undermining the quality of life of the world's population. After posing the hypothesis of an apparent antinomy between the WTO agreements and the human rights frameworks established in international law, the paper points that there is a violation of fundamental human rights in WTO decisions that condemn countries for promoting industrial incentive programs as they do not consider the prevalence of the right to development. The concern and relevance of the theme will be approached from critical historicism and using dialogue, when appropriate, between Economics and Law. A recente decisão da Organização Mundial de Comércio, condenando o Brasil por considerar ilegal o projeto Inovar-auto, com base na alegação de que o governo brasileiro criou um subsídio para fomento do setor automobilístico, preocupa o analista do Direito Internacional. Nesse sentido, o presente trabalho propõe-se a fazer o embate teórico entre o Direito ao Desenvolvimento, tecido na Organização das Nações Unidas, e o marco normativo que fundamenta as decisões do Órgão de Solução de Controvérsias da OMC. O argumento de fundo é que o sistema de solução de litígios deveria levar em consideração em suas decisões os aspectos sociais, laborais, econômicos e ambientais trabalhados nas Nações Unidas. Nesse sentido, estrutura-se em quatro capítulos: no primeiro, analisa-se o modelo econômico proposto pela Comissão Econômica para a América Latina e o Caribe - CEPAL e o histórico das relações econômicas internacionais nas últimas décadas. No segundo, aborda-se os fundamentos do Direito ao Desenvolvimento. No terceiro capítulo, passa-se a estudar a formação da Organização Mundial do Comércio e sete casos polêmicos. No quarto capítulo, possíveis soluções para o percebido impasse são apresentadas. Para comprovar o argumento, ao longo de todo o trabalho, faz-se um convite à incursão nos fundamentos do desenvolvimento sustentável, da responsabilidade sócio-laboral e do desenvolvimento - não apenas crescimento - econômico. Tais análises não esgotam o objeto deste estudo; afirma-se que é plausível demonstrar que tais temas, ao serem tratados na OMC, combateriam o dumping ambiental e o dumping laboral, que são violações de direitos humanos fundamentais e que causam distorções ao comércio internacional, colocando em xeque a qualidade de vida da população mundial. Após ventilar-se a hipótese de haver aparente antinomia entre os acordos que regem a OMC e os marcos de direitos humanos estabelecidos no Direito Internacional, o trabalho aponta que há violação a direito humano fundamental nas decisões da OMC que condenam países por promoverem programas de incentivo industrial, por não considerarem a prevalência do direito ao desenvolvimento. A preocupação e a relevância do tema serão abordadas a partir do historicismo crítico e com recurso ao diálogo, quando pertinente, entre Economia e Direito.

The analysis is justified, above all, because corruption is now a transnational phenomenon that affects all societies and economies. The ultimate success of the fight against corruption depends upon international cooperation of the various actors involved, included the transnational corporations. Initially, it seeks to critically analyze the concepts of global governance and private governance, within the contemporary context of the phenomenon of globalization, both in relation to its establishment and legitimacy. From this analysis, it was highlighted the emergence of the new lex mercatoria, fashioned by a body of norms to conduct the activities within TNCs` supply chain. Such investigations were the starting point for evaluating development and the responses of International Law to this new reality. Next, the research investigates transnational corporations, as a private actors on the rise, and the subject of transnational corruption, concept and effects. Finally, an overview of the International Anti-Corruption Regime was made, to after justify the raise of a Private International Anticorruption Regime of the TNCs, which is inspired by other international and domestic sources, but is sustained through the legitimate exercise of private authority, mainly within their respective supply chain, through contracts and codes of conduct. Rules aimed at regulating, essentially, the supply chain, by acting or not, in accordance with ethical established by the TNC, subjected to penalties. Finally, the petroleum industry's chapter was developed because it is a large-scale industry, essentially transnational, and with a large number of cases of transnational corruption O presente trabalho busca contribuir para fomentar a discussão acadêmica sobre o tema da corrupção transnacional e do exercício da governança privada por meio da regulação, sem qualquer pretensão de exaurir a discussão. A análise se justifica, sobretudo, porque a corrupção é hoje um fenômeno transnacional que afeta todas as sociedades e economias, e que o sucesso do seu enfrentamento depende da cooperação internacional dos diversos atores envolvidos, incluídas as empresas transnacionais. Inicialmente, busca-se analisar criticamente os conceitos de governança global e governança privada, dentro do contexto contemporâneo do fenômeno da globalização, tanto com relação à formação, quanto à sua legitimidade. E, a partir dessa análise, foi destacado o surgimento da nova lex mercatoria e a formação de um corpo de normas para condução das atividades inter e intra cadeia de produção das transnacionais. Tais exames foram ponto de partida para avaliar a evolução e as respostas do Direito Internacional a essa nova realidade. Na sequência, investigou-se as empresas transnacionais, como autoridade privada em ascensão, e o tema da corrupção transnacional, conceito e efeitos. Por fim, fez-se um panorama do Regime Internacional Anticorrupção, para, então, justificar a emergência de um Regime Internacional Privado Anticorrupção das Transnacionais, o qual se inspira nas demais fontes internacionais e domésticas, mas é sustentado por meio do legítimo exercício de autoridade privada, principalmente dentro de sua respectiva cadeia de produção, por meio de contratos e códigos de conduta. Regras que visam à regulação, principalmente, da cadeia de produção, e que contém a exigência de se abster ou de praticar certas condutas, conforme a ética estabelecida pela respectiva Transnacional, sob pena de sanção. Por fim, o recorte temático da indústria do petróleo foi desenvolvido, porque se trata de uma indústria de grande monta, essencialmente transnacional, e com grande número de casos de corrupção transnacional

In order to do it, the thesis starts from a concrete case, Mox de Sellafield , and analyses other similar concrete situations. Afterwards, are shown some doctrinal positions about this theme and some possible soluctions, procedural or not, are evaluated, hypothetically considering International Law´s fragmentation as a problem to be solved. In a following moment, in the absence of complete answers, an investigation of the historical origins of the International Law´s fragmentation begins, starting from the origins of the contemporary fragmentation´s pulse, in which we can perceive a strong correlation between flexible capitalism ecclosion and International Law´s changing, what could suggest a sort of intentionality at that last one. After this, this thesis investigates the historical origins of the systemic view of International Law, even because the concept of International Law fragmentation presupposes the idea of a previous unity. But, it is not because International Law does not constitute a system, in a strict technical sense, that its fragmentation does not brings some matters to International Law previsibility and coherence. Or yet, that International Law cannot be noticed as an existent and autonomous field of Law Science, because of its peculiar configuration. Finally, this thesis goes still back in time, investigating the repetition pulse, that alternates International Law fragmentation and unification, what allows to dismiss the possibility of considering any sort of intentionality as a decisive factor in the International Law fragmentation, taking in account how old and cyclical the phenomena presents itself Esta tese tem por objetivo saber se a fragmentação do Direito Internacional - no que diz respeito, especificamente, ao aspecto do conflito estrutural entre os diferentes meios de solução de controvérsias, de diversos regimes de tratados - é um problema a ser resolvido, se é algo vantajoso ou desejável, ou ainda, se é mero desdobramento de um processo histórico. Para tanto, parte-se de um caso concreto, o Caso Mox de Sellafield , para, em seguida, analisar situações concretas semelhantes. Posteriormente, são expostas as opiniões doutrinárias sobre o tema e avaliadas as possíveis soluções de natureza processual e não-processual, considerada a fragmentação como um problema, hipoteticamente. Em momento posterior, diante da insuficiência de respostas, parte-se para uma investigação das origens históricas da fragmentação do Direito Internacional, começando pelas origens da atual pulsão fragmentadora, na qual se nota uma forte correlação entre o surgimento do capitalismo flexível e a mudança do Direito Internacional, o que poderia sugerir algum grau de intencionalidade nesta última. Em um momento seguinte, é verificada a origem histórica da visão sistêmica de Direito Internacional, porque o próprio conceito de fragmentação pressupõe a existência de uma unidade anterior. Mas o fato do Direito Internacional não ser um sistema, em sentido técnico, não significa que a fragmentação não seja prejudicial à segurança jurídica ou que o Direito Internacional não possa ser percebido como um ramo existente e autônomo da Ciência do Direito, diante de sua configuração peculiar. Por fim, recua-se um pouco mais na História, para pesquisar a origem da pulsão de repetição, que alterna fragmentação e unificação, afastando-se qualquer possibilidade de que a intencionalidade deva ser considerada como um fator decisivo na fragmentação do Direito Internacional, dada a antiguidade e o caráter cíclico do fenômeno

Despite this number, forty million people, by desire or lack of material conditions, remained in their own countries, not crossing any international border, living in precarious and improvised situations the so called internally displaced persons. Although the fact this phenomenon is not recent and the large numbers of the statistics, the internal displacements began to receive attention in the international community only since 1990s, when a protective regime has began to being developed through a number of global governance mechanisms: the Project on Internal Displacement. In the United Nations system, a Special Rapporteur on the Human Rights of Internally Displaced was created within the framework of the United Nations Human Rights Council at the same time two soft law were elaborated: the Guiding Principles and the "Pinheiro Principles". Among the regional human rights systems, the first and only treaty, the Kampala Convention, was celebrated in the African system. Meanwhile, in the inter-American and European systems, despite the absence of a treaty, the international courts have construed its Conventions in the light of those principles. In this way, the human rights of internally displaced persons are being built through rights provided by soft law confirmed by judicial precedents of the regional human rights courts. This issue consolidate the international custom that avoid forced displacement, protect victims its during and, once the causes of displacement ceases, restore as much as possible the whole situation. Therefore, the construction of the human rights of internally displaced persons is made through a postmodern international law in the context of an international community based on the valorization of the human being, on norms of hierarchical superiority, through objective obligations and systems of international responsibility of states and individuals transforming domestic affairs, once restricted to the absolute sovereignty of the nation-state, on transnational issues that can be possible be solved through mechanisms of global governance. Segundo o Relatório do ACNUR (2015): Global Trends Forced Displacement, existem no mundo sessenta e cinco milhões de pessoas que fugiram dos seus lares em razão de conflitos armados, situações de violência generalizada, violações dos direitos humanos ou catástrofes ambientais, que deixaram para trás não só os seus pertences, mas também um projeto de vida. Deste número, quarenta milhões de pessoas por sua própria vontade ou ausência de condições materiais não atravessaram uma fronteira internacional em busca de refúgio ou na condição de migrantes, mas permaneceram em seus países em situações precárias e improvisadas os chamados deslocados internos. Apesar de se tratar de um fenômeno antigo e dos números assustadores, os deslocamentos internos passaram a receber atenção da comunidade internacional somente a partir dos anos noventa, quando começou a ser desenvolvido um regime protetivo por meio de diversos mecanismos de governança global: o Projeto Deslocados Internos. No sistema onusiano foi criada uma Relatoria Especial para os Direitos Humanos dos Deslocados Internos dentro da estrutura do Conselho de Direitos Humanos das Nações Unidas, além de duas normas de soft law: os Princípios Orientadores e os Princípios Pinheiro . Dentre os sistemas regionais de direitos humanos, no sistema africano foi celebrado o primeiro e único tratado, a Convenção de Kampala, enquanto nos sistemas interamericano e europeu, apesar da ausência de um tratado, suas Cortes vêm interpretado as Convenções à luz daqueles princípios. Neste contexto, os direitos humanos dos deslocados internos vêm sendo e por meio de direitos previstos em normas de soft law, confirmadas pelos precedentes judiciais das Cortes regionais de direitos humanos, consolidando assim, o costume internacional de evitar os deslocamentos forçados, proteger as vítimas durante sua ocorrência e, cessadas suas causas, reestabelecer ao máximo possível a situação anterior. Desta forma, a construção dos direitos humanos dos deslocados internos vêm se tornando possível através do direito internacional pós-moderno, onde a existência de uma comunidade internacional baseada na valorização do ser humano, em normas de superioridade hierárquica, por meio de obrigações objetivas e sistemas de responsabilização internacional dos Estados e dos indivíduos pode ser capaz de transformar assuntos domésticos, antes restritos à soberania absoluta do Estado-nação, em questões transnacionais e passíveis de solução através dos mecanismos de governança global.
