Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (CAPES) The subsection IV of section III of Kant’s Groundwork of the metaphysics of morals formulates the question, "how is a categorical imperative possible?" For this question to be answered the Groundwork requires a proof of the actual possibility of the supreme principle of morality under human conditions. The question then focuses on the legitimacy of using a principle of pure practical reason, that is: to submit the categorical imperative to transcendental deduction. In the Critique of Practical Reason, Kant dispenses with a deduction and states that the task of asking about the possibility of the moral law is vain, since it is presented as a Faktum der Vernunft that would legitimize, by itself, the human will. Therefore, what was previously, in GMS, indispensable: (to prove the legitimacy of the pure use of an a priori practical principle), ceases to be so in the KpV, with the introduction of an a priori fact that would be the consciousness of the moral law. The introduction of the concept of Faktum der Vernunft was criticized by some interpreters and philosophers. Schopenhauer, for example, accuses Kant of having turned the categorical imperative into a "hyperphysical fact within the mind." Such objections, which see irreconcilable positions or tension between the GMS and the KpV fail to take into account that Kant's goals are distinct in each of the works with regard to reflection on morality: the supreme principle of morality (which needed a deduction of its legitimacy that would prove that morality is not an illusion, in the GMS) is not left behind by a Faktum inherent in human reason, as can be found in the KpV. Awareness of the moral law is a Faktum of reason, and the categorical imperative is the supreme principle of morality. Distinct things. It requires, in order to think the Kantian reflection on morality in two distinct moments, to investigate the following points: (i) how the deduction of the categorical imperative is developed in section III of the GMS and its implications; (ii) what is the Faktum der Vernunft and why a deduction of the moral law would not only be dispensable, but it would not even make sense to expect there to be one in the KpV, since the GMS had already settled the question about the possible synthetic use of pure practical reason; (iii) Kant does not ask about a deduction of the moral law, but only of the categorical imperative. These points contribute to support the thesis we defend here: to show that, although a deduction exists only in GMS, the moral law, which is secured through a Faktum, is, under human circumstances, the categorical imperative itself. This means that even if the human being is conscious, a priori, of the moral law, he must also want to act morally: hence the moral obligation provided only by a categorical imperative comes in. A subseção IV da seção III da Fundamentação da metafísica dos costumes formula a questão: “como é possível um imperativo categórico? ”. Para que essa questão seja respondida a Fundamentação exige uma prova da possibilidade real do princípio supremo da moralidade sob condições humanas. A questão se concentra, então, na legitimidade do uso de um princípio da razão prática pura, quer dizer: submeter à dedução transcendental o imperativo categórico. Na Crítica da razão prática, Kant dispensa uma dedução e afirma ser vã a tarefa de perguntar sobre a possibilidade da lei moral, pois ela se apresenta como um Faktum der Vernunft que legitimaria, por si só, a vontade humana. Portanto, aquilo que antes, na FMC, era indispensável: (provar a legitimidade do uso puro de um princípio prático a priori), deixa de sê-lo na CRPr, com a introdução de um fato a priori que seria a consciência da lei moral. A introdução do conceito de Faktum der Vernunft foi criticada por alguns intérpretes e filósofos. Schopenhauer, por exemplo, acusa Kant de ter transformado o imperativo categórico em um “fato hiperfísico dentro da mente”. Tais objeções, que veem posições irreconciliáveis ou tensão entre a FMC e a CRPr não levam em conta que os objetivos de Kant são distintos em cada uma das obras em relação à reflexão sobre a moralidade: o princípio supremo da moralidade (que precisou de uma dedução de sua legitimidade que provasse que a moralidade não é uma ilusão, na FMC) não é deixado para trás por um Faktum inerente à razão humana, como se pode encontrar na CRPr. A consciência da lei moral é um Faktum da razão, e o imperativo categórico é o princípio supremo da moralidade. Coisas distintas. Exige-se, para pensar a reflexão kantiana sobre a moralidade em dois momentos distintos, investigar os seguintes pontos: (i) como se desenvolve a dedução do imperativo categórico na seção III da FMC e suas implicações; (ii) o que é o Faktum der Vernunft e por qual motivo uma dedução da lei moral seria não só dispensável, como sequer faria sentido esperar que houvesse uma na CRPr, pois a FMC já havia resolvido a questão sobre o uso sintético possível da razão prática pura; (iii) Kant não pergunta sobre uma dedução da lei moral, mas apenas do imperativo categórico. Esses pontos contribuem para sustentar a tese que aqui defendemos: mostrar que, apesar de uma dedução existir somente na FMC, a lei moral, que é assegurada mediante um Faktum, é, sob circunstâncias humanas, o próprio imperativo categórico. Isso significa que mesmo que o ser humano seja consciente, a priori, da lei moral, ele também tem de querer agir moralmente: daí que entra a obrigação moral proporcionada somente por um imperativo categórico. 88882.426641/2019-01

In this paper, I first explain Slajov Žižek’s analysis of the grounds of Kant’s categorical imperative. I show how Žižek considered the grounds of the categorical imperative to be an example of irrationalism that ran counter to the spirit of the Enlightenment, of which Kant was, ironically, a major proponent. The irrationalism in Kant’s moral law makes him vulnerable to moral skepticism. I go on to counter this interpretation by drawing from Kant’s practical philosophy. I counter the moral skeptic by arguing from moral phenomenology to the existence of a reason that is independent of empirical motivations and so objectively determining. Whatever is objectively determining logically supersedes that which is based on a particular context. The moral law is rooted in the ontology of an independent faculty of reason capable of issuing a universal law. The place of evidence regarding joint commitment and plural action is mostly reserved for documents and explicit linguistic expressions. This paper considers the problem of evidence in cases of engaged (jointly committed) social acts where there is no explicit expression or binding document, yet can still be ascribed to a plural subject. The argument rests on the double meaning of the term factum as fact (factum brutum) and deed (factum practica), as well as contemporary debates about the topic of fact of reason in Kant. The text seeks to show that in certain cases, the execution of an act or the obligation produced by it can be considered evidence of a plural subject. Thus, these facts deserve a special position in relation to scientific evidence.

The purpose of the present study is to analyze the distinction between the concept of freedom in a negative sense and that of freedom in a positive sense, also emphasizing the concepts Kant uses as a basis for morality under the idea of freedom in a positive sense. In the first chapter we analyze the Kantian thesis that only through a good will would there be the possibility of acting morally. Kant holds good will as a principle of volition, which must be determined in itself and which must be independent of any driving force mobile. This independence in relation to the empirical and contingent allows Kant to base morality on formal principles; in other words, reason formulates a priori unconditional moral laws, which determine the human will to act through duty. An action practiced through duty does not mean simply submission of reason to the a priori law, but renders the freedom of the will effective, for the will as a faculty of reason, upon formulating laws for itself, recognizes its freedom in the laws. In the second chapter of this work, we analyze the difference between acting in accordance with duty and acting through duty. Acting in accordance with duty always expresses an action that is not in keeping with the basis of morality. But an action practiced through duty requires that the will be determined by purely formal principles, that is, principles that must contain legislation that could never be extracted from the world of phenomena. The morality of an action lies in the unconditional character of the law and in the a priori form of the moral law. Thus, from the practical point of view, every human action must be commanded according to an internal need, free of any influx of experience. This need must be imposed by a purely rational law, of an unconditional character. In the third chapter, we seek to analyze the distinction between freedom in a negative sense and freedom in a positive sense. Based on this distinction, we proceed to analyze what properties of freedom are required for a universally valid morality. Once the properties of autonomy, of a priori and of the unconditionality of law are understood of freedom in a positive sense, Kant seems to indicate the possibility of demonstrating the objective reality of freedom, namely moral law. For if the will must be compelled by a categorical imperative, it must likewise be possible to indicate the existence of the law whose principles must be valid for all rational beings. O presente trabalho pretende analisar a distinção entre o conceito de liberdade em sentido negativo e o de liberdade em sentido positivo, enfatizando, também, os conceitos que Kant utiliza para fundamentar a moral sob a idéia da liberdade em sentido positivo. No primeiro capítulo analisamos a tese kantiana de que somente mediante uma boa vontade haveria a possibilidade de agir moralmente. A boa vontade é tida por Kant como um princípio do querer, que deve ser determinado por si mesmo e que deve ser independente de qualquer móbil. Esta independência em relação ao empírico e ao contingente permite a Kant fundamentar uma moral segundo princípios formais, ou seja, a razão formula a priori leis morais incondicionais, que determinam a vontade humana a agir por dever. A ação praticada por dever não significa apenas uma submissão da razão à lei a priori, mas a efetivação da liberdade da vontade, pois a vontade como faculdade da razão, ao formular leis para si mesma, reconhece nas leis a sua liberdade. No segundo capítulo deste trabalho analisamos a diferença entre agir conforme o dever e agir por dever. Agir conforme ao dever sempre expressa uma ação que não condiz com o fundamento da moralidade. Mas uma ação praticada por dever exige que a vontade seja determinada por princípios puramente formais, isto é, os princípios que devem conter uma legislação que jamais poderia ser extraída do mundo dos fenômenos. A moralidade de uma ação reside no caráter incondicionado da lei e na forma a priori da lei moral. Ora, do ponto de vista prático, toda ação humana deve ser comandada segundo uma necessidade interna, livre de qualquer influxo da experiência. Esta necessidade deve ser imposta por uma lei puramente racional, cuja propriedade deve ser incondicional. No terceiro capítulo procuramos analisar a distinção entre uma liberdade em sentido negativo e uma liberdade em sentido positivo. A partir desta distinção, passamos a analisar quais as propriedades necessárias da liberdade, as quais são exigidas por uma moralidade universalmente válida. Uma vez compreendidas as propriedades de autonomia, de a priori e de incondicionalidade da lei, de uma liberdade em sentido positivo, Kant parece indicar a possibilidade de demonstrar a realidade objetiva da liberdade, a saber, a lei moral. Pois, se a vontade deve ser coagida por um imperativo categórico, deve-se, igualmente, ser possível indicar a existência da lei cujos princípios têm de ser válidos para todos os seres racionais. It is often thought that Kant abandoned his argument for the justification of morality in the Groundwork of the Metaphysics of Morals for a radically different argument in the Critique of Practical Reason. In the Groundwork, Kant appears to try to justify our commitment to the moral law on the basis of our freedom, but in the Critique, he tries to justify that commitment on the basis of what he calls the fact of reason. I assess and reject influential interpretations of both arguments as being philosophically unsound, and I propose, what I take to be, a novel and promising account of the fact of reason.
