The problem that we seek to face with this study concerns the potential identity crisis that the 1988 Constitution has been going through since 2013, going through key moments that include the impeachment of Dilma Rousseff, the enactment of Constitutional Amendment no. 95/2016 and the election and first year of Jair Bolsonaro's government. Based on a review of the legal literature and comparative case-law, which takes Indian, Colombian and European experiences as a paradigm, a concept of constitutional identity is sustained, the content of which involves substantial decisions and values - the basic commitments and projects of a constitutional community. -, procedural - decisions about the exercise of constitutional government - and relational - the position of the constitution in relation to other constitutional experiences. In terms of characteristics, it is maintained that constitutional identity is plural, socially and historically constructed, and changeable. As for its functions, it is proposed that the constitutional identity operates a constitutive function of the constitutional community; a normative function in the broad sense that allows social criticism of attempts at constitutional rupture; and a normative function in the strict sense that produces its own legal efficacy that invalidates acts contrary to the constitutional identity and extracts positive commands directed to the State in order to effect such an identity. As for formation and transformation, we analyze the foundational and constructivist theories of constitutional identity and we argue that constitutional identity is formed and transformed by a process of struggle for the constitution, understood based on the idea of struggle for recognition developed by Axel Honneth and of struggle for the right presented by Rudolf Von Ihering. It is maintained that the struggle for the constitution involves a struggle for constitutional or constitutionalized narratives, meanings and rights and that it is developed by different institutional or non-institutional agents throughout different social spaces. It is proposed that once formed, constitutional identity is subject to incremental and foundational transformations, which deepen and alter its meaning, sometimes through diffuse acts, sometimes at identifiable moments in constitutional history, institutionalized by different mechanisms: interpretation and constitutional change, the constitutional amendment, and the new constitution. It is proposed that the transformations can also be triggered by crises in which the constitutional community challenges the content of the constitutional identity, opening the way sometimes to the deepening of the constitutional project, sometimes to the rupture of the project. It is proposed to analyze the phenomenon from the Brazilian perspective, initially having as a paradigm the LGBT and black movements in the Constituent Assembly and after 1988 as demonstrations of the transformations that the emancipatory identity of the 1988 Constitution went through. The potential identity crisis that started in 2013 is analyzed, concluding that it is possible that Brazil is facing a constitutional crisis and therefore proposing measures to overcome it A tese trata do conceito de identidade constitucional a partir de três perspectivas: o conceito de identidade constitucional, o processo de formação e transformação da identidade constitucional, e o fenômeno da crise de identidade constitucional. O problema que se busca enfrentar a partir deste estudo diz respeito à potencial crise de identidade pela qual passaria a Constituição de 1988 desde 2013, perpassando momentos-chave que incluem o impeachment de Dilma Rousseff, a promulgação da Emenda Constitucional n. 95/2016 e a eleição e primeiro ano de governo de Jair Bolsonaro. A partir de uma revisão da literatura jurídica e da jurisprudência comparada, esta tendo por paradigma as experiências indiana, colombiana e europeia, sustenta-se um conceito de identidade constitucional cujo conteúdo envolve decisões e valores substanciais – os compromissos e projetos básicos de uma comunidade constitucional -, procedimentais – as decisões acerca do exercício do governo constitucional – e relacionais – a posição da Constituição diante de outras experiências constitucionais. No plano das características, sustenta-se que a identidade constitucional é plural, construída social e historicamente, e mutável. Quanto às suas funções, propõe-se que a identidade constitucional opera uma função constitutiva da comunidade constitucional; uma função normativa em sentido amplo que permite a crítica social às tentativas de ruptura constitucional; e uma função normativa em sentido estrito que produz eficácia jurídica própria que invalida atos contrários à identidade constitucional e extrai comandos positivos voltados ao Poder Público no sentido de efetivar tal identidade. Quanto à formação e transformação, analisa-se teorias fundacionais e construtivistas da identidade constitucional e sustenta-se que a identidade constitucional se forma e transforma por um processo de luta pela Constituição, cuja compreensão parte da ideia de luta por reconhecimento desenvolvida por Axel Honneth e de luta pelo direito apresentada por Rudolf Von Ihering. Sustenta-se que a luta pela Constituição envolve uma luta por narrativas, significados e direitos constitucionais ou constitucionalizados e que é travada por diferentes agentes institucionais ou não institucionais dos diversos espaços sociais. Propõe-se que uma vez formada, a identidade constitucional está sujeita a transformações incrementais e fundacionais, que aprofundam e alteram seu sentido ora por meio de atos difusos, ora em momentos identificáveis na história constitucional, institucionalizando-se por mecanismos diversos: a interpretação e mutação constitucional, a emenda constitucional, e a nova Constituição. Propõe-se que as transformações podem ser deflagradas também por crises em que a comunidade constitucional põe em xeque o conteúdo da identidade constitucional, abrindo caminho ora para o aprofundamento do projeto constitucional, ora para a ruptura do projeto. Propõe-se analisar o fenômeno a partir do caso brasileiro, inicialmente tendo por paradigma os movimentos LGBT e negro na Assembleia Constituinte e após 1988 como demonstrativos das transformações pelas quais passou a identidade emancipatória da Constituição de 1988. Analisa-se a potencial crise de identidade constitucional deflagrada a partir de 2013, concluindo-se pela possibilidade de que se esteja diante de uma crise constitucional e propondo, então, medidas para sua superação

Through a bibliographical research, analysis of documents produced by the social movements studied and semi-structured interviews conducted in field work in the year 2017 at the National Lesbian Seminar (Senale,1996-2010) that were the study-case and guiding line for the memory elaboration on the activism and militancy of lesbian and bissexual women in Brazil. Specially the seminar that took place in 2010 (Porto Velho-RO) changing its name to National Seminar on Lesbians and Bisexual Women (2010-); and, in particular the seminar held in 2014 (Porto Alegre-RS), where its acronym changed from Senale to Senalesbi (2014 -...). The 2016 Seminar (Teresina-PI) have special analytical importance in this dissertation, but all of them are considered of pivotal importance as gravitational centers in the political organization of bisexual women. The three of these seminars (2010,2014,2016), with significant presence of bisexual women, arose some conflicts around the name change of the event enhancing how, pragmatic and symbolic politically, can the disputes be amongst the identities lesbian and bissexual woman . Essa pesquisa é uma exploração inicial da construção da bissexualidade como uma identidade política entre mulheres. Através de pesquisa bibliográfica, análise de documentos produzidos pelos movimentos sociais estudados e entrevistas semiestruturadas realizadas em trabalho de campo ocorrido no ano de 2017, toma-se o Seminário Nacional de Lésbicas/Senale (1996-2010) como caso e fio condutor da elaboração de memória no Brasil sobre o ativismo e a militância de mulheres lésbicas e bissexuais. O seminário ocorrido em 2010 (Porto Velho-RO) que efetivou a mudança de seu nome para Seminário Nacional de Lésbicas e Mulheres Bissexuais (2010-) e em especial os seminários ocorridos em 2014 (Porto Alegre-RS), que alterou a sigla de Senale para Senalesbi (2014-...), e em 2016 (Teresina-PI) têm especial importância analítica nesta dissertação, sendo considerados como centros gravitacionais na organização política de mulheres bissexuais. Esses três seminários (2010,2014,2016) tiveram expressiva presença de mulheres bissexuais e neles se manifestaram os conflitos em torno da alteração do nome do evento, evidenciando disputas políticas pragmáticas e simbólicas entre as identidades lésbica e mulher bissexual .

In order to do this analysis, at the beginning of the study some key concepts related to the LGBT will be emphasized and it will be demonstrated how this plural movement developed worldwide and in Brazil. Then, a historical and criminological approach will be made to show that the penal system selectively captures the deviants including the deviant sexualities , modulates subjectivities and propagates stigmas since its creation. At the end of the thesis, the travestility will be studied according to the reality shown by the Estate Mechanism of Prevention and Fight Against Torture in its report Women and Girls in Deprivation of Liberty Situations. Moreover, it will be demonstrated by critical arguments and organized data how and why the public policies - mechanisms of protection for transgender people included - are inefficient in the protection of human rights. Essa dissertação é uma análise dos mecanismos protetivos para pessoas transgêneros em privação e liberdade no sistema penal do Rio de Janeiro. Para fazer essa análise, no início do estudo serão enfatizados alguns conceitos-chave relacionados ao movimento LGBT e será demonstrado como esse movimento plural se desenvolveu mundialmente e no Brasil. Então, uma abordagem histórica e criminológica será feita para mostrar como o sistema penal captura seletivamente os desviantes incluindo as sexualidades desviantes , modula subjetividades e propaga estigmas desde sua criação. No final da dissertação, a travestilidade será estudada de acordo com a realidade mostrada pelo Mecanismo Estadual de Prevenção e Combate Contra à Tortura em seu relatório Mulheres e Meninas em Situações de Privação de Liberdade. Além disso, será demonstrado por meio de argumentos críticos e dados organizados como e por que as políticas públicas incluídos os mecanismos de proteção para pessoas transgêneros - são ineficientes na proteção dos direitos humanos.

This analysis pretends to spotlight how this identity device marked the perspective of this struggle for rights and citizenship, corroborating in subjective modeling. Bibliography and documents were searched about the course of these movements, relating them to the life histories of four Rio de Janeiro's militants interviewed, who has had a long experience in this activism and intrinsic experience in the changes of this trajectory. The methodology consisted of cartographic clues to be traversed, guided by a genealogical perspective, and considering the affectation, crossing out this researcher as an activist of this movement for the construction of these clues. The analysis showed that the processes of constitution, emergency, transformation and achievements of the LGBT Movement were constituted by heterogeneous and multifaceted lines of force, determined by problems related to the social differences produced by the norms of sex and gender, as well as by social markers of difference of social classes, race, generation, among others; Leading activists to articulate themselves through possible strategies and negotiations, according to social and historical contexts presented, showing that the(ir) identities are the epicenter of well-behaved mechanisms of power, through which they articulate ways of perpetuating existing power and hegemonic A presente pesquisa consiste em percorrer memórias da emergência e a trajetória do Movimento LGBT, desde o Movimento Homossexual Brasileiro, analisando como os processos de subjetivação de ativistas e demais sujeitos envolvidos foram atravessados por uma corporificação das suas identidades de sexo e gênero, dissidentes da heterocisnormatividade, a partir da concepção da identidade como um dispositivo, pois localizada e histórica, imbricada em tramas heterogêneas de discursos e práticas sustentadas em saberes e articuladas por poderes. A partir dessa análise problematizar como esse dispositivo identitário marcou as perspectiva dessa luta por direitos e cidadania, corroborando em modelizações subjetivas. Foram pesquisados bibliografia e documentos sobre o percurso desses movimentos, relacionando-os às histórias de vida dos quatro militantes do Rio de Janeiro de Janeiro entrevistados, que possuem experiência antiga nesse ativismo e vivência intrínseca (n)as mudanças dessa trajetória. A metodologia se constituiu em pistas cartográficas a serem percorridas, guiando-se por uma perspectiva genealógica, e considerando a afetação e atravessamento desta pesquisadora enquanto ativista desse movimento para a construção dessas pistas. A análise mostrou que os processos de constituição, emergência, transformação e conquistas do Movimento LGBT se constituíram por linhas de força heterogêneas e multifacetadas, determinadas por problemáticas vinculadas às diferenças sociais produzidas pelas normas de sexo e gênero, assim como pelos marcadores sociais de diferença de classe, raça, geração, dentre outros; levando @s ativistas a se articularem por estratégias e negociações possíveis, de acordo com contextos sociais e históricos apresentados, evidenciando que (su)as identidades são o epicentro de mecanismos de poder bem engendrados, por meio dos quais articulam formas de perpetuar o poder vigente e hegemônico

Nowadays, in its XIII edition, the ENUDS gathers groups and collectives that articulates themselves around the Gender and Sexuality theme and aims to reinforce itself as a space of academic and political discussion. Therefore, this research seeks rebuild the social-anthropological path of the ENUDS, in order to analyze all the dynamics and nuances that occur inside its space, along with the means of political organization, the insertion of new subjects and identities and the dialog with de academy . The first part of the research will take the effort to the historical rebuilt of the editions. In that direction, to tell the ENUDS s History, materials and brochures from the past editions collected on the field along with semi-structured interviews with participants and ex- participants will be used. The second part of the research intends to analyze the categories that came up on the field, such as: group/collective , activist/militant , institutionalized/non- institutionalized and horizontality . In the third part of the thesis, it s explored how it is manifested the ideals of sexual liberation, hierarchy and gender convention dissolution and the political praxis of fechação in the ENUDS spaces, from a central category on the field: the experience . Therefore, I look for the arguments that justify this living , in addition to the limit points and tensions of those idealideas. O Encontro Nacional Universitário da Diversidade Sexual (ENUDS) surgiu no ano de 2003 como espaço de ação política contra casos de homofobia e machismo no ambiente universitário, além de se constituir como lugar de debate sobre o tema da diversidade sexual . Hoje, já na XIII edição, o ENUDS reúne grupos e coletivos que se articulam em torno da temática sobre gênero e sexualidade e visa se consolidar como espaço de discussão acadêmica e política . Em vista disto, a pesquisa busca reconstruir a trajetória sócio- antropológica dos Encontros de modo a analisar as dinâmicas e nuances que se processam dentro de seu espaço, como as formas de organização política, a inserção de novos sujeitos e identidades e o diálogo com a academia . A primeira parte do trabalho se dedicará à reconstrução histórica das edições. Assim, para percorrer as edições do ENUDS, serão utilizados materiais colhidos do evento em campo sobre as Edições passadas e informações oriundas das entrevistas semiestruturadas com participantes e ex-participantes. A segunda parte do trabalho se propõe analisar as categorias que surgem no campo como: grupo/coletivo , ativista/militante , institucionalizado/ não-institucionalizado e horizontalidade . Na terceira parte desta dissertação é explorado como se manifestam os ideais de liberdade sexual, dissolução da hierarquia e convenções de gênero e a prática política da fechação nos espaços do ENUDS a partir de uma categoria central no campo: a experiência . Procuro, portanto, explorar as argumentações que justificam essa vivência , bem como os momentos de limites e tensões dessesideais.

The aim of this work is to describe the trajectory of the Brazilian lesbian movement, from 1979, when it was created in São Paulo, until 2001, when occurred the IV National Lesbian Seminar (SENALE). In this study, we analyzed the demands, specificities, challenges and guidelines of the lesbian movement in Brazil, by investigating the groups and NGOs, as well as the lesbians' relationships both with themselves and with the feminist and LGBT movements. We analyzed the discourses from documentation produced in the period, and we made a historical recovery through oral narratives, in order to trace the trajectory of the lesbian movement in Brazil, which had a essentially feminist character. We also tried to consider the changes in the work of lesbian movement since 1980, when modifications began to occur in the relationship between the state and the social movements, in order to investigate the social transformations that came to be possible or not possible in that context. To develop this study, we interviewed three lesbian activists, who have a relevant work in the history of the Brazilian lesbian and gay political activism. Documents relating to events, newsletters, newspapers and magazines produced by lesbian groups were also analyzed. It is necessary to write about the lesbianism in Brazil, recognizing the resistance and the existence of activists, militants and groups, in order to record the history, so it not forgotten A invisibilidade das lésbicas na sociedade, mais que um mero acaso, é vista pelo movimento de lésbicas como uma forma de manutenção da norma social da heterossexualidade. O objetivo do presente trabalho é descrever a trajetória do movimento de lésbicas no Brasil, no período de 1979, ano de seu surgimento em São Paulo/SP, até 2001, ano em que ocorreu o IV Seminário Nacional de Lésbicas (SENALE). Neste estudo, foram analisadas as demandas, especificidades, dificuldades e pautas do movimento de lésbicas no Brasil, através dos grupos e ONG´s, bem como as relações das lésbicas entre si e com os movimentos LGBT e feminista no Brasil. Através da análise do discurso produzido na documentação do período, bem como através da recuperação histórica através da oralidade, buscamos traçar a trajetória do movimento de lésbicas no Brasil, que teve caráter essencialmente feminista. Ainda, buscou-se contextualizar o movimento de lésbicas nas transformações ocorridas a partir dos anos 1980 na relação do Estado com os movimentos sociais e as transformações sociais decorrentes de tal relação. Para o desenvolvimento deste estudo foram realizadas entrevistas com militantes lésbicas, que têm uma trajetória junto à militância política lésbica e LGBT em âmbito nacional. Também foram analisados documentos relativos aos eventos, boletins, jornais e revistas produzidos pelos grupos de lésbicas. Escrever a lesbianidade do Brasil através da resistência e existência das ativistas, militantes e grupos se faz necessário para registrar a história, para que não seja esquecida
