- Abstract
After having analysed the original forms of the rite of Monastic Profession, the study takes into consideration the Profession itself in the Benedictine tradition (professio super altare); Religious Profession in Canonical and Mendicant Orders (professio in minibus) and in the Company of Jesus (professio super hostiam), until analysing the Ordo Professionis Religiosae of the Second Vatican Council. While the ritual of the professio in manibus clearly expresses the character of the profession as a contract between the Religious and the community that receives them (in effect the characteristic gesture of the immixtio manuum has the purpose to adequately illustrate the two aspects of the profession: offer of the hand and the clasp of the hand, that is, the promise and societas). The super-altar professions, on the other hand, contain only a promise from the candidate intended for the community. In the Benedictine tradition, the monastic community does not offer any restipulatio to the novice stipulation (stipulatio); he is offered only a house where he can fulfil his desire to follow Christ more closely. Finally, the super hostiam professio becomes the expression of a strongly individualistic devotion. [ABSTRACT FROM AUTHOR]

Historia Liturgii Św. Benedykt z Nursji pozostawił w swojej regule wytyczne dotyczące przyjmowania braci i profesji mniszej. Od VIII wieku wytyczne te były wzbogacane licznymi rytuałami, modlitwami i gestami podkreślającymi znaczenie profesji monastycznej. Przykładem są obrzędy przewidziane przez XVIII-wieczny ceremoniał tyniecki obowiązujący w Kongregacji św. Krzyża w Polsce. Należą do nich obrzędy odprawiane przed przyjęciem do nowicjatu, obrzędy ślubów zakonnych, zarówno uroczystych, jak i prostych, oraz włączenie do pełnej komunii z braćmi profesami. Ważnym elementem profesji zakonnej było odczytanie dokumentu z przysięgą, podpisanie go znakiem krzyża i złożenie go na ołtarzu. Oznaką oddania się Bożej służbie było zaśpiewanie wersetu: „Podtrzymaj mnie według swojej obietnicy, bym żył; nie zawiedź mojej nadziei!” (Ps 119 [118]: 116), podczas którego towarzyszyły gesty wskazujące na pełne oddanie neoprofesa Bogu. Nieznanym obrzędem według reguły benedyktyńskiej było pełne włączenie do wspólnoty mniszej dopiero na trzeci dzień po ślubach uroczystych. Ceremoniał tyniecki jest cennym źródłem poznania liturgii benedyktynów w Polsce w XVIII i na początku XIX w. In his rule, St. Benedict of Nursia left guidelines for the admission of brothers and the profession of monks. Since the 8th century, these guidelines have been enriched with numerous rituals, prayers and gestures illustrating the meaning of the monastic profession. An example of this are the rites set out in the 18th-century Tyniec Ceremonial used by the Congregation of the Holy Cross in Poland. These include rites celebrated for admission to the novitiate; rites for religious vows, both solemn and simple; and inclusion into full communion with the professed brothers. An important element of the monastic profession was the reading of the document with an oath, signing it with the sign of the cross, and placing it on the altar. A sign of dedication to the service of God was the singing of the verse “Sustain me by your promise that I may live; do not disappoint me in my hope!” (Ps. 119[118]:116) accompanied by gestures showing the complete dedication of the newly professed to God. An unknown rite of the Benedictine Rule was that of full inclusion into the community three days after the vows were made. The Tyniec Ceremonial is a valuable source for learning about the liturgy of the Benedictines in Poland in the 18th and early 19th centuries.

W dotychczasowym piśmiennictwie nie podejmowano prób zbadania profesji wieczystej ubóstwa przez pryzmat prawa cywilnego. Nie ulega jednak żadnej wątpliwości, iż ignorowanie kwestii skutków profesji ubóstwa na gruncie prawa cywilnego nie odpowiadałoby powadze tej instytucji prawa kanonicznego. Prawodawca kościelny wyraźnie – choć „w miarę możliwości” – zobowiązał profesa i zapewne (w domyśle) także i instytut zakonny do tego, aby wieczysta profesja ubóstwa wywoływała zamierzone skutki także w prawie cywilnym. Zgodnie z logiką prawa kanonicznego za optymalne należałoby więc uznać rozwiązanie, które zapewniałoby, że zrzeczenie się przez zakonnika dóbr w konsekwencji ślubów ubóstwa wywoła skutki również w polskim prawie cywilnym. Jednak wobec braku w prawie polskim instytucji analogicznej do kanonicznego zrzeczenia się dóbr pozostaje poszukiwanie instytucji zbliżonych, które (choćby częściowo) pozwolą uzyskać skutek zamierzony przez prawodawcę kościelnego i nie ma wątpliwości, że najbardziej użyteczna dla osiągnięcia tego celu może się okazać umowa darowizny. W dobie powszechnego uczestniczenia przez kościelne osoby prawne, a także księży i osoby zakonne, w stosunkach prawnych, omawiany problem nabiera zresztą istotnego znaczenia praktycznego. Kontynuowanie dotyczących tego analiz jest więc w pełni uzasadnione i konieczne. Pozostaje mieć nadzieję, że zwrócenie w niniejszym opracowaniu uwagi na podstawowe elementy tytułowej problematyki będzie pomocne we właściwym wyznaczeniu kierunków dalszych badań. Until now, no attempts have been made in the literature to examine profession of poverty in the light of civil law. However, there is no doubt that ignoring the civil law effects of vows of poverty does not correspond to the importance of this institution. The Church legislator clearly obliged – albeit “as far as possible” – professed monks and possibly also (implicitly) religious institutes to ensure that perpetual vows of poverty have the intended effects also under civil law. Therefore, in accordance with the logic of canon law, it would be optimal if the renounciation of goods by a monk as a consequence of profession has effects also under Polish civil law. However, as Polish law does not have an institution corresponding to the canonical renunciation of goods, it remains to seek comparable institutions which would (even partially) produce the effect intended by the Church legislator, and the most useful instrument to achieve this objective can undoubtedly be a gift deed. In an era of wide participation of ecclesiastical legal persons as well as priests and religious persons in legal relations, this problem has in any case become of great practical importance. It is therefore fully justified and necessary to continue research in this direction, and it is hoped that the essential problems delineated in the present paper will help provide avenues for further explorations.

É nossa intenção, por um lado, perceber e contextualizar a existência e os usos dados a essas adições e, por outro, compreender de que modo as referidas adições permitem um melhor conhecimento dos mosteiros cistercienses femininos e da forma pela qual o Mosteiro de Alcobaça exerce a sua jurisdição sobre os mesmos nesse período.This article concerns four liturgical codices copied in the scriptorium of the Monastery of Alcobaça between the mid-fifteenth and the seventeenth centuries. The late textual additions that concern rituals specific to Cistercian nunneries will be examined with the aim of understanding the uses of such additions in their context, and of determining their impact on our knowledge of female Cistercian monasteries and on Alcobaça’s jurisdiction over the women under its wing during this period. publishersversion published
