Who the client is in a forensic rehabilitation evaluation has been the source of confusion and much debate among expert witnesses for many years. In an attempt to clarify the issue, several leaders within the rehabilitation forensic practice setting met in Las Vegas, Nevada on November 4, 2007 to review the various definitions of client among the codes of ethics to which forensic certificants or professional members adhere. The goal of the work group was to identify and define the intent of the relationship among the parties in a legal matter and to offer definitions to clarify those relationships utilizing terminology that might be universally accepted by certification and membership bodies to which many rehabilitation expert witnesses belong. This white paper addresses the history of the issue, the conflict caused by competing definitions, and offers a definition that has been accepted and ratified by the American Board of Vocational Experts, the Commission on Rehabilitation Counselor Certification, and the International Association of Rehabilitation Professionals. The authors of this article write that, as college teachers, they continue to confront their own timidity, and fear of risk. They have had to ask themselves when, in lip service to academic rigor, they are just taking the safe way out. They say that they worry at times while admonishing students to think for themselves, come up with new ideas, and take intellectual risks if they have failed both in the design of their assignments, and in their assignment methods. Over the past few years, the two of them have experimented, played, and tried to push themselves away from their comfort zones to challenge themselves and their students in new ways. In the two sections presented here, these two authors discuss their attempts to encourage honors college students to take risks and to engage with course material in creative ways that develop their critical thinking skills. Kate Wintrol discusses her struggles in an introductory survey course to design creative assignments, that encourage critical thinking while Maria Jerinic analyzes her efforts in an upper-level seminar to encourage students to produce creative products that deviate from standard academic research assignments. They offer experiences in response to the public conversation surrounding the nature of U.S. education at all levels.

Libertarian "exit" imaginaries project new social, political, and economic structures separate from existing institutions in which "sovereign individuals" can opt-in to the governing system that fits their ideals. This paper traces libertarian exit imaginaries through a variety of territorial and technological projects. Demonstrating how these imaginaries evolve, it describes a recent proposal to build a semi-autonomous, blockchain-based smart city in Nevada. Reflecting on these projects, the paper highlights (1) their inevitable failure as they confront reality, (2) their role as spectacle, spreading libertarian ideology, and (3) their real-life impacts on distinct places and communities even when they fail or never materialize. The impact of the Great Recession and its aftermath has been devastating in Nevada, especially for public education. This article discusses the budget shortfalls and the impact of the economic crisis in Nevada using case study methodology. It provides a review of documents, including Governor Gibbon's proposals for the public K-12 education system and the Nevada state higher education system (NSHE) for 2009-2011, together with the legislative response. It then outlines Governor Sandoval's 2011-2013 budget proposals and responses from the NSHE and K-12 public education in the state in the two largest cities, Reno and Las Vegas. The final section includes an update to the tumultuous years of uncertainty in Nevada, with the surprising Nevada Supreme Court decision that waylaid a budgetary impasse. Data sources included documents available in the field and participant observation. When possible, data were triangulated to identify trends and outcomes. The focus throughout was on education finance in school districts and higher education institutions, and how they were affected. (Contains 5 tables and 55 endnotes.)

Background/Context: Performance funding finances public higher education institutions based on outcomes such as retention, course and degree completion, and job placement rather than inputs such as enrollments. One of the mysteries of state performance funding for higher education is that despite great interest in it for over 30 years, only half of all states have ever adopted it. Purpose/Objective/Research Question/Focus of Study: This study examines the political forces that have driven the development of performance funding in some states but not others. To do this, the authors draw on theories of policy origins such as the advocacy coalition framework, the policy entrepreneurship perspective, and policy diffusion theory. Research Design: This study contrasts the experiences of six states that established performance funding for higher education (Florida, Illinois, Missouri, South Carolina, Tennessee, and Washington) and two that have not (California and Nevada). These states differ considerably in their performance funding programs, higher education governance arrangements, and political and socioeconomic characteristics. Data Collection and Analysis: Our study is qualitative, drawing on documentary records and extensive interviews with higher education officials, legislators and staff, governors and advisors, business leaders, and other actors. Findings and Results: Our study finds that many of the actors and motives cited by the prevailing perspective on the origins of performance funding did operate in the six states that have established performance funding, including state legislators (particularly Republicans), governors, and business people pursuing performance funding in the name of greater effectiveness and efficiency for higher education. However, the prevailing perspective misses the major role of state higher education coordinating boards and individual higher education institutions (particularly community colleges) that pursued performance funding to secure new funds in an era of greater tax resistance and criticism of higher education. Our findings further move beyond the prevailing explanation by examining how policy entrepreneurs mobilized support for performance funding by finding ideological common ground among different groups, identifying policies that those groups could support, and taking advantage of political openings to put performance funding onto the decision agenda of state elected officials. Conclusions and Recommendations: This examination of the origins of performance funding policies sheds light on factors that facilitate and frustrate the development of such policies. For example, our research highlights the important role of higher education opposition and the presence of certain political structures and political values in frustrating the development of performance funding.

The article focuses on the comparison of in-situ aircraft measurements of carbon dioxide (CO²) Greenhouse Gases Observing Satellite (GOSAT) data measured over Railroad Valley, Nevada. This paper presents the initial vicarious radiometric calibration results for Landsat 9 OLI using a combination of ground-based techniques and test sites located in Nevada, California, and South Dakota, USA. The field data collection methods include the traditional reflectance-based approach and the automated Radiometric Calibration Test Site (RadCaTS). The results for top-of-atmosphere spectral radiance show an average ratio (OLI/ground measurements) of 1.03, 1.01, 1.00, 1.02, 1.02, 1.01, 0.98, and 1.01 for Landsat 9 OLI bands 1–8, which is within the design specification of ±5% for spectral radiance. The results for top-of-atmosphere reflectance show an average ratio (OLI/ground measurements) of 0.99, 0.99, 1.00, 1.02, 1.01, 1.02, 1.00, and 1.00 for Landsat 9 OLI bands 1–8, which is within the design specification of ±3% for top-of-atmosphere reflectance. This note focuses on super‐priority liens (SPLs), which allow homeowner associations to foreclose a property over its mortgage. Twenty‐two states have so far implemented such liens, hoping to balance the interests of mortgage creditors and homeowner associations. The state of Nevada has been facing more challenges from both mortgage creditors and homeowner associations regarding the constitutionality of non‐judicial foreclosure than other states. This paper summaries the cases since 2000 and discusses the three major decisions that the Supreme Court of Nevada made involving SPLs' non‐judicial constitutionality, tender‐extinguishing SPLs, and federal creditors' role in SPLs. The article reports that documents relating to the safety of the proposed nuclear-waste repository at Yucca Mountain in Nevada may have been falsified. A hydrologist at the U.S. Geological Survey (USGS), who was studying how water flowed through the mountain, faked documentation on the times and dates at which certain geological samples were taken from the site. The water data are crucial because the repository's safety depends heavily on how wet it is likely to get inside, and on how long it takes for water to escape from the mountain rock into surrounding river systems.

The Fires, Asian, and Stratospheric Transport–Las Vegas Ozone Study (FAST-LVOS) was conducted in May and June of 2017 to study the transport of ozone (O 3) to Clark County, Nevada, a marginal non-attainment area in the southwestern United States (SWUS). This 6-week (20 May–30 June 2017) field campaign used lidar, ozonesonde, aircraft, and in situ measurements in conjunction with a variety of models to characterize the distribution of O 3 and related species above southern Nevada and neighboring California and to probe the influence of stratospheric intrusions and wildfires as well as local, regional, and Asian pollution on surface O 3 concentrations in the Las Vegas Valley (≈ 900 m above sea level, a.s.l.). In this paper, we describe the FAST-LVOS campaign and present case studies illustrating the influence of different transport processes on background O 3 in Clark County and southern Nevada. The companion paper by Zhang et al. (2020) describes the use of the AM4 and GEOS-Chem global models to simulate the measurements and estimate the impacts of transported O 3 on surface air quality across the greater southwestern US and Intermountain West. The FAST-LVOS measurements found elevated O 3 layers above Las Vegas on more than 75 % (35 of 45) of the sample days and show that entrainment of these layers contributed to mean 8 h average regional background O 3 concentrations of 50–55 parts per billion by volume (ppbv), or about 85–95 µ g m -3. These high background concentrations constitute 70 %–80 % of the current US National Ambient Air Quality Standard (NAAQS) of 70 ppbv (≈ 120 µ g m -3 at 900 m a.s.l.) for the daily maximum 8 h average (MDA8) and will make attainment of the more stringent standards of 60 or 65 ppbv currently being considered extremely difficult in the interior SWUS. This paper discusses a dual approach of case study and research survey to investigate the complex factors in sustaining academic library digitization programs. The case study involves the background of the University of Nevada, Las Vegas (UNLV) Libraries' digitization program and elaborates on the authors' efforts to gain staff support for this program. A related survey was administered to all Association of Research Libraries (ARL) members, seeking to collect baseline data on their digital collections, understand their respective administrative frameworks, and to gather feedback on both negative obstacles and positive inputs affecting their success. Results from the survey, combined with the authors' local experience, point to several potential success factors including staff skill sets, funding, and strategic planning. [ABSTRACT FROM AUTHOR]

Context: Topographic ruggedness has been examined in thousands of ecological studies and is a popular variable for characterizing habitat selection. Despite widespread adoption, ruggedness metrics are often applied uncritically and require systematic and thorough testing using both artificial landscapes and real-world applications. Objectives: In this paper we introduce a technique that removes the correlation of topographic ruggedness with curvature in order to more accurately represent fine-scale surface ruggedness. Methods: We test our modified version of several ruggedness metrics against traditional ruggedness metrics using three ideal ruggedness criteria in artificial landscapes. We further tested our modified ruggedness measures using 449 real mountain ranges in Nevada, USA. Using desert bighorn sheep as a case study, we tested both modified and uncorrected ruggedness measures and slope in a multiscale context in order to examine habitat selection by female bighorn sheep. Results: The modified versions of the metrics passed all three criteria of the ideal ruggedness test and was able to accurately capture surface ruggedness. Modified versions of ruggedness differed from uncorrected versions by containing fewer highly rugged cells along ridgelines and drainages. Habitat relationships of desert bighorn sheep with ruggedness were scale-dependent, such that female sheep selected for steep slopes at fine spatial scales and ruggedness at moderate spatial scales. Conclusions: We demonstrate that there are three components to ruggedness: elevation variation, aspect diversity, and surface ruggedness representing first, second, and third generation ruggedness indices. Our technique for removing underlying topographic variation provides an improved mapping of surface ruggedness and augments the other two generations of ruggedness metrics. [ABSTRACT FROM AUTHOR]

This article presents information about research papers published in this issue of "The Journal of Social Issues." The research paper called "The Impact of Legalization on Illegal Gambling Participation," examines the effects of legalization on illegal gambling participation using a multivariate analysis to adjust for the influence of demographic variables. In addition, the incidence of illegal gambling in a nationwide sample was compared with the incidence reported by Nevada residents. Another research called "State Conducted Lotteries: History, Problems, and Promises," report that lotteries have played an important role in American finance through much of this Nation's history. This paper begins with an account of the abuses that led to the prohibition of the privately run lottery during the nineteenth century. It then goes on to analyze the promise and performance of the state run lotteries that have been created during the last decade. "The Changing Structure of American Gambling in the Twentieth Century," examines some of the factors that altered the economics and control of policy and numbers gambling, bookmaking, and casino gambling from 1900 to 1950.

Underwater and inundated prehistoric archaeology is usually celebrated because it highlights unique cultural behaviors (e.g., Windover and Old World bogs), preserves organic materials exceptionally well (e.g., Little Salt Springs and Bouldnor Cliff), or identifies early human presence (e.g., Page Ladson and Hoyo Negro). However, as research has progressed, it is increasingly clear that underwater archaeology is an essential tool for understanding how humans adapt to changing landscapes and the water/land boundaries around them. When appropriate, archaeologists should consider the dynamics of changing water levels, where nearby human occupations may preserve, and whether terrestrial or inundated landforms may help answer research questions. In the Great Basin USA, Nevada's Walker Lake is an ideal location for applying this approach. As a lake that has undergone repeated rise and fall over the last 15,000 years, research on human behavior and regional adaptations must consider landforms that have been subject to inundation and are now above and/or below the current waterline. This paper discusses identification and analyses of sites around Walker Lake, investigations revealing intact buried terrestrial landforms under the lake, and how this research provides an improved picture of human behavior and landscape adaptations in the Western Great Basin. The energy equation is an expression of the first law of thermodynamics or the law of conservation of energy. According to the first law of thermodynamics, the externally applied work to a system is equal to the sum of dissipation energy and Helmholtz free energy of the system. However, most of the currently available stress–dilatancy relationships are based on the energy equation of Taylor-Cam Clay type, which hypothesizes that the applied plastic work is equal solely to the frictional dissipation energy. The Helmholtz free energy has been completely neglected. Recently, observed from acoustic experiments, it has been recognized that Helmholtz free energy can be caused by deformation mechanisms other than friction between particles. Thus, it is necessary to include additional terms in the energy equation in order to correctly model the stress-dilatancy behavior. This paper addresses the issue regarding the balance of this energy equation. Analyses of experimental results are presented. Specific forms of the frictional energy and Helmholtz free energy are proposed. The proposed energy equation is verified with the experimental data obtained from Silica sand, Ottawa sand, and Nevada sand. [ABSTRACT FROM AUTHOR]
