Право на здравствено осигурање представља једно од основних људских права. Систем здравствене заштите ни у ком случају не може изаћи у сусрет свим жељама и потребама пацијената, зато што жеље и потребе пацијената имају стални раст, здравствене услуге постају све скупље, а средстава за финансирање истих је све мање. Пацијенти захтевају и заштиту финансијског ризика од скупих здравствених услуга, односно желе да буду сигурни да ће фондови здравственог осигурања, на основу прикупљених средстава, покрити високе трошкове лечења, уколико се за тим јави потреба услед неке теже болести. Буџетско финансирање не пружа стимулацију у раду лекара и даје лошији квалитет здравствених услуга. Принцип солидарности у систему здравствене заштите, пре свега, зависи од расположивих средстава и одлуке владе везано за расподелу средстава према здравственим установама. С једне стране, овакав систем у данашњим условима отежано функционише, док, с друге стране, систем здравствене заштите одређене земље прати њен развој, те отуда мора одговорити на нове изазове. Циљ докторске дисертације јесте идентификовање и анализа битних елемената система здравствене заштите, његово финансирање, остваривања права из обавезног здравственог осигурања, приказ упоредних решења из искустава других земаља и указивање на недостатке сваког од модела здравствене заштите. Циљ је и да се прикаже да комбиновани систем финансирања (капитација комбинована са плаћањем по услузи и дијагностички сродне групе) обезбеђује повећање физичке и ефективне доступности здравствене заштите за све грађане Србије, доводи до унапређења квалитета здравствене заштите, као и до повећања ефективности и ефикасности у пружању здравствених услуга. Један од циљева рада јесте да покаже да је комбиновани систем финансијски одржив, из разлога што не зависи само од буџетских средстава и да су у таквом систему грађани заштићени од финансијског ризика везаног за здравље, тј. пацијенти не морају да буду у страху да ли ће, услед тешких болести и скупих медицинских процедура, систем покрити високе трошкове њиховог лечења. У комбинованом систему сами даваоци здравствених услуга добрим делом утичу на расподелу прихода, чиме се обезбеђује и стабилност у пружању здравствене заштите. The right to health insurance represents one of basic human rights. The system of health care in any case can`t meet all the wants and needs of the patients because the needs and wants of the patients have a continuous growth, the health institutions become more expensive and the means of financing are becoming smaller. Patients also demand protection from financial risk from expensive health services, with respect to being sure that the health insurance funds, based on the gathered means, cover high costs of treatment, in case a need for it arises due to a serious illness. Budget financing doesn’t provide a stimulus in the doctors’ work and provides a lower quality of heath services. The principle of solidarity in the system of health services, primarily depends on the available means and the governmental decision with regards to the division of means towards the health institutions. On one hand, the system in today’s conditions functions with difficulty while on the other hand, the system of health care of a specific country follows the development, hence needs to respond to new challenges. The purpose of the doctorate dissertation is identification and analysis of important elements of the health insurance system, its financing, relization of mandatory health insurance, showcase of alternate solutions from experience of other countries and exposing the shortcomings of each model of health care. The aim is to show a combined system of financing (capitation combined with paying per service and diagnostic groups) ensures an increase of physical and effective availability of health care for all citizens of Serbia, leading to an advance of quality of health care as an increase of effectiveness and efficiency in providing health services. One of the objectives of the piece is to show that the combined system is financially sustainable, due to it not being dependent on budget allocation and that in such a system the citizens are protected from financial risk related to health i.e. pateient do not have to fear if, in case of serious illness and expensive medical procedures, the system can cover the high expenses of their treatment. In a combined system the providers of heath services significantly effect the division of revenue, which ensures stability in providing health care. During the making of the dissertation, methods were used which are adapted to the problems of the research including: comparative law method, deductive method based on the method of abstraction, which is already developed in the analysis of parallel systems of health insurance in the world and the statistical method. Comparative law analysis is carried out, beginning with the health care system and health insurance of countries whose solutions are characteristic and, as such, functional (Germany, United Kingdom and United States of America), concluded with health systems of countries with which Serbia shares cultural, economic, political and social heritage (Croatia and Slovenia). Besides analysis of the mentioned countries, analysis of the system of Czechoslovakia, because in an earlier period this country had a socially-political arrangement similar to Serbia after World War II. Also, an inductive method was used, which assumes an immediate insight into appropriate data and statistical analysis of documentation. Among used methods, special attention was given was to exemplary analysis of problems of public financing and methods of normative analysis during researching legal solutions in the area. For the analysis of financial indicators of health institutions tertiary health care used the method of deduction, induction methods, methods of analysis and comparison method, to perform the appropriate conclusions.

Иако порез на имовину није ни иновативан, ни издашан порез, због својих особина, последњих година постаје предмет повећаног интересовања, како финансијских теоретичара, тако и креатора пореске политике. Циљ докторске дисертације је идентификовање и анализа битних елемената пореза на имовину, приказ упоредноправних решења, сагледавање позитивноправног режима опорезивања имовине у Републици Србији, као и указивање на највеће дилеме у овој области и покушај њиховог разрешавања. Циљ је и да се српски систем опорезивања имовине оцени путем следећих критеријума евалуације: хоризонталне и вертикалне правичности, неутралности, стабилности, лакоће администрирања, јавне прихваћености, стварања повољне инвестиционе климе, транспарентности, издашности, степена локалне аутономије, неекономских користи, наменског карактера прикупљених прихода и начела флексибилности. Материја која је предмет докторске дисертације биће анализирана детаљно и свеобухватно, како би се у потпуности разумела ова проблематика. Том задатку приступиће се коришћењем више различитих научних метода истраживања. Почетни метод, као и за свако изучавање права, биће правни (догматички, нормативни, егзекетички или формалнологички) метод, како би се открила логичка садржина норми посвећених овој проблематици, односно да би се оне описале онакве какве јесу у пракси. Социолошки метод биће коришћен, како би се објаснили друштвени узроци који су довели до настанка норми посвећених неким аспектима опорезивања имовине у статици, као и њихово дејство на друштво. За сагледавање и разумевање развоја и промена система опорезивања имовине током времена, како у одабраним земљама, тако и у Републици Србији, биће примењен историјскоправни метод. Коришћење аксиолошког метода је неопходно, како би се спознао циљ појединих норми, које се односе на предмет докторске дисертације, и како би се формулисао став у погледу тога да ли испуњавају циљ који им се придаје. Примена компаративног метода је од суштинског значаја за сагледавање решења која егзистирају у упоредном праву, како би се међу различитим приступима пронашао онај који највише одговара за евентуалну имплементацију у Републици Србији. Although property tax is neither innovative, nor abundant, due to its characteristics it has become the subject of increased interest of both financial theoreticians and creators of tax policies in recent years. The goal of the doctoral dissertation is to identify and analyse key elements of property tax, show comparative legal solutions, review legal regime of taxing property in the Republic of Serbia, as well as to point to the greatest dilemmas in this area and try to solve them. The goal is also to evaluate the Serbian system of taxing property by using the following evaluation criteria: horizontal and vertical equity, neutrality, stability, easiness of administration, public acceptance, creating favourable investment climate, abundance, level of local autonomy, non-economic benefits, purpose of collected revenue, and the principle of flexibility. The subject matter of the doctoral dissertation will be analysed in a detailed and comprehensive way in order to completely understand this problem. This task will be approached by using several different scientific research methods. The initial method, like in any other study of law, will be legal (dogmatic, normative, exegetic or formal-logic) method, in order to reveal the logical content of norms dedicated to this problem, i.e. to describe them as they are in practice. Sociological method will be used in order to explain social causes that lead to creating norms dedicated to certain aspects of taxing property in statics, as well as their effects on society. For consideration and understanding of development and changes of the system for taxing property over the course of time, both in selected countries and in the Republic of Serbia, historical-legal method was used. Use axiological method is necessary in order to show the goal of certain norms, which relate to subject of the doctoral dissertation, and in order to determine whether they reach the goal given to them. The application of comparative method is of crucial importance for consideration of solutions that exist in comparative law in order to find, among various approaches, the one that is best suited for possible implementation in the Republic of Serbia.

Право на здравље, право на здравствену заштиту и право на социјално (укључујући и здравствено) осигурање представљају једну од темељних вредности сваког савременог друштва. Финансирање здравствене заштите становништва у савременом свету представља проблем са којим се суочавају како развијене земље тако и земље у развоју. Начини на које се финансирају системи здравствене заштите се деле према обухвату становништва здравственом заштитом, према извору финансирања здравствене заштите и власништву над зградама и опремом у здравству. На основу ових критеријума системи здравствене заштите су груписани у три основне групе: систем националне здравствене службе – тзв. Бевериџов модел, систем обавезног социјалног осигурања – тзв. Бизмарков модел и систем приватног осигурања - тзв. модел независних или суверених корисника. Систем здравственог осигурања у Србији представља модел система обавезног социјалног осигурања, који се у складу са Законом о здравственом осигурању заснива на финансирању путем доприноса који уплаћују сви запослени и њихови послодавци (у износу од 6,15% из бруто зараде и 6,15% на бруто зараду) и у коме постоји државно власништво над зградама и опремом. Основна карактеристика овог система је начело узајамности и солидарности, у коме запослени и послодавац плаћају доприносе према бруто заради запосленог, а осигураник користи здравствене услуге према потребама. У буџету Републике се обезбеђују средства за уплату доприноса за одређене категорије лица (социјално угрожена, лица са повећаним ризиком од обољевања и др. ). Међутим, за разлику од овог нормативног стања, у пракси ствари изгледају другачије, јер постоје многи проблеми у функционисању и финансирању система здравственог осигурања. The right to health, the right to health care and the right to social (including health) insurance represents one of the fundamental values of every modern society. Funding health care in the modern world is a problem faced by both developed countries and also by developing countries. Ways of funding health care systems are divided according to population coverage of the health care; according to the source of financing and the ownership of buildings and equipment. Based on these criteria, health care systems are divided into three main groups: the system of National Health Services - the so-called Beveridge model; the system of Compulsory Social Insurance - the socalled Bismarck model, and the system of Private Insurance - the so-called Independent and Sovereign Users model. The health insurance system in Serbia represents a system of compulsory social insurance, which is in accordance with the Health Insurance Law based on financing through contributions paid by all employees and their employers (in the amount of 6.15 % of gross earnings and 6.15 % in gross earnings) and where there is government ownership of the buildings and equipment. The main feature of this system are principles of reciprocity and solidarity, in which employees and employers pay contributions to the gross earnings of the employee, and the insured uses health services as needed. The budget of the Republic of Serbia provides funds for the payment of contributions for certain categories of persons (socially vulnerable people, people with an increased risk of disease, etc.). However, in contrast to the normative status, things look different in practice. There are many problems in the functioning and financing of the health insurance system. The system in which a health care worker and the insured are deciding on treatment and utilization of health services, regardless of the cost of services that are based on the contributions, can not be sustained even in the countries which are much more developed.

Porez na dohodak graĎana je jedan od poreskih oblika kod kojeg, kako u ekonomskoj teoriji, tako i u praksi, postoji veliki broj otvorenih pitanja, zbog izraţenog trade-off odnosa izmeĎu pravičnosti i efikasnosti. Stoga ne postoji uniformno, najbolje rešenje, već se ocena performansi poreza na dohodak vrši na osnovu definisanih ciljeva oporezivanja i odgovarajućih kriterijuma koji iz tih ciljeva proizilaze, polazeći od vaţećih teorijskih stavova i društvenih preferencija. Tako u savremenoj ekonomskoj teoriji postoji saglasnost da bi ovaj poreski oblik trebalo da bude horizontalno pravičan, da implicira niske troškove primene i umereno poresko opterećenje, jer je ocenjeno da ovaj porez, više nego većina drugih poreza, negativno utiče na ekonomsku efikasnost i dugoročan privredni rast. Često se takoĎe navodi da bi ovaj poreski oblik trebalo da bude i vertikalno pravičan (progresivan), što predstavlja legitiman cilj, ali koji proizilazi iz ličnih vrednosnih sudova, tako da oko njega ne postoji saglasnost. Postojeći sistem poreza na dohodak u Srbiji ne obezbeĎuje zadovoljavajući nivo horizontalne (ni vertikalne) pravičnosti u oporezivanju, alokativno je pristrasan, i relativno sloţen, što izaziva relativno visoke troškove administriranja i primene, zbog čega je njegova reforma neophodna. S obzirom da je reč o porezu koji u velikoj meri moţe uticati na ponašanje ekonomskih agenata, pri čemu ti ekonomski efekti zavise kako od parametrizacije poreza, tako i od strukturnih karakteristika svake zemlje (nivo i struktura dohodaka, nivo poreskog morala, preferencije društva i sl.) za utemeljeno ocenjivanje različitih rešenja neophodno je izvršiti empirijsku analizu osnovnih ekonomskih efekata, na podacima koji se odnose na konkretnu zemlju. Cilj ovog rada je da pruţi pregled relevantnih klasičnih i savremenih teorijskih stavova u vezi sa oporezivanjem dohotka graĎana, da na osnovu analiza iskustava drugih zemalja uputi na opšte zaključke u pogledu ekonomskih performansi alternativnih modela poreza na dohodak, i da na osnovu mikro i makroekonomskih podataka za Srbiju bude izvršena empirijska ocena i analiza osnovnih ekonomskih efekata koji bi u Srbiji bili ostvareni u slučaju primene svakog od razmatranih modela oporezivanja dohotka. In economic theory and practice there are many open questions related to design of personal income tax – probably more than in case of other taxes, due to equity-efficiency trade-off, which is highly related to this tax. Therefore, there is no uniform, single best solution, since the performances of each income tax model are dependent on the defined goals of taxation and respective criteria, which arise from the theory and social preferences. There is a consensus in contemporary economic theory on the need to provide horizontal equity in taxation of personal income, as well as modest administration and compliance costs and low tax burden, since there is empirical evidence that this tax distorts economic efficiency and long term economic growth, more than the most of other taxes. It is often argued that income tax should be vertically equitable (progressive), which is legitimate goal, but stemming from personal judgements, which is why there is no common agreement on this goal. Current personal income tax in Serbia is not horizontally (nor vertically) equitable, neither allocative neutral and rather complex, triggering relatively high administration and compliance costs, which is why its reform is necessary. Since this tax may have large influence on behavior of economic agents, the economic effects being dependent on its parameterization and structural features of each particular country (level and structure of income, tax moral, social preferences, etc.), in order to provide evidence based assessment of different income tax models, it is necessary to perform empirical estimate and analysis of main economic effects, based on the data related to that country. The aim of this paper is to provide insight into relevant classical and contemporary theory of income taxation, to make general conclusions on features of alternative income tax schemes based on the analysis of experience of other countries and to make empirical estimate and analysis of economic effects which would arise in Serbia in case of introduction of each of the alternative income tax models, based on relevant micro and macroeconomic data. In that respect, three revenue neutral income tax reform scenarios for Serbia have been drafted – flat, dual and comprehensive. Each of the reform scenarios is based on respective pure theoretical model.

Odlaganje poreskih plaćanja jedna je od najatraktivnijih kompanijskih strategija na polju upravljanja poreskim opterećenjem, ali iznosi odloženih poreza (kao i odloženih poreskih ušteda) dugo nisu mogli da se sagledaju iz finansijskih izveštaja. Dilema oko toga da li uopšte treba izveštavati o odloženim porezima i u kojoj meri njihovo iskazivanje omogućava realniju procenu performansi poslovanja još uvek je aktuelna. Cilj ove disertacije je da jednim celovitim istraživanjem fenomena odloženih poreza doprinese razrešenju postavljenih dilema... Tax deferral is one of the most attractive tax management strategie, but amounts of deferred taxes (as well as deferred tax savings) could not be perceived from the financial statements for a long period of time. Weather or not deferred taxes should be reported and to what extant they provide better evaluation of firm’s performance is still a question. The purpose of this dissertation is to contribute to answer of this question by providing a comprehensive research of the deffered taxes phenomenon. Deferred taxes result from temporary differences between financial accounting and tax rules of the calculation of periodic results. In order to assess justification for these differences and perspectives of deferred tax, a comparison between objectives and basic concepts of financial versus tax reporting was made, as well as the comparative analysis of the status and tendencies across certain countries with the emphasis on demonstrated advantages and disadvantages of different relationships between one and the other reporting system. It was shown that the compliance of income calculation for accounting and tax purposes would be at the expense of the achievement of objectives for both financial reporting and income taxation, so that the divergence is conceptually founded and desirable. However, this does not mean that ,in the same time, there does exist a possibility of using identical approaches on many issues. The divergence raises reporting costs and it is justified only if it contributes to the increase of expressive power of presented reports. Advantages of divergence over uniform model back up expectations that the differences between accounting and tax rules will keep on occurring, as well as deferred tax. The deffered taxes amount increases with the increase of the temporary differences and tax rates which applied to the temporary differences and give the amounts of of future increase and decrease of tax payments.

Permanentno prilagođavanje tržišnim promenama ukupne turističke privrede Srbije, predstavlja njeno strategijsko prilagođavanje. U tom smislu sagledavane su dimenzije i strukturne odlike turističkog tržišta, a posebno funkcionalne karakteristike tražnje i ponude. Analizirani su faktori konkurentnosti turističke ponude. Posebno su obrađeni procesi i složenost promena na turističkom tržištu kao što su: dugoročne promene u pokretačkim faktorima turističke traženje, dugoročne tendencije i promene u međunarodnom turističkom poslovanju, faktori i efekti globalizacije poslovanja u turizmu. U strategijskom prilagođavanju preduzeća turističke privrede, kao i ostalih učesnika u turističkoj ponudi promenama tražnje, pošlo se od procesa formulisanja strategije a potom od tehnološkog i tržišnog prilagođavanja usluga i ostalih instrumenata marketinga. Zatim je ukazano na prilagođavanje organizacione strukture preduzeća na turističkom tržištu, a posebno na strategijsko i taktičko upravljanje tražnjom. Obuhvaćen je i koncept strategijskog upravljanja turističkom destinacijom. U daljem istraživanju obuhvaćene su strategijske osnove razvoja Srbije kao turističke destinacije. Naročito je ukazano na strategije transformacije preduzeća. Poboljšanje ukupne organizovanosti turističke privrede Srbije podrazumeva unapređenje proizvoda i ostalih instrumenata tržišnog nastupa turističke ponude. To podrazumeva i strategijsko unapređivanje prodajno-promotivnih aktivnosti. Dati su elemnti perspektive razvoja turizma Srbije do 2010 godine, zajedno sa ekološkom komponentom turističkog proizvoda Srbije., Permanent adjusting of the overall Serbian touristic economy to the market changes represent a form of its strategic adjustment. Dimensions and structural characteristics of the tourist market, and especially the functional characteristics of demand and offer have been perceived from that aspect. Factors of competitiveness of the tourist offer have also been analyzed. Processes and complexity of changes on the tourist market such as: long term tendencies and changes in motivating factors of the tourist demand, long-term tendencies and changes in the carrying of business activities in tourism, factors and effects of globalisation of the carrying out of business enterprises in tourist economy, as well as that of the other participants in tourist offer of to do schanges of the demand have been initiated by process of strategy formulation, followed by technological and market adjustments of services and other marketing instruments. At a later stage, adjustment of organizational structure of enterprises to the scanges on the tourist market, and especially strategic and tactical management of the demand have also been pointed out.
