The issue of the classification of civil obligations according to sources has triggered controversies over time, in doctrinal, but also jurisprudential terms, due to the need to establish the specific conditions of each category of obligation relationships. The current Civil Code has abandoned the classical classification of the sources of obligations into contracts, quasi-contracts, delicts and quasi-delicts, aligning with the orientation of modern civil codes, stating that the sources of obligations are legal acts and facts, which in their turn, legal facts can be legal or illegal. From the category of lawful legal facts - sources of civil obligations, business management is characterized by the intervention of the manager in the affairs of another person, called „gerat", consisting in the conclusion of legal acts with third parties or the execution of material acts, voluntarily, disinterestedly and without having received an assignment or a mandate in this regard. The legal mechanism is triggered by the creation of the obligation to compensate the manager for the expenses incurred by him in the management of the affairs and interests of the „gerat". The logicallegal reasoning behind the birth of this binding relationship is the idea of equity for covering the losses or expenses incurred by the manager for an altruistic purpose, to help. The study proposes an analysis of the institution of business management, according to the current regulation, in order to emphasize the new aspects, such as the essential condition regarding the opportunity of the manager's intervention, the effects of the management towards third parties or the hypothesis in which the manager acts knowing that the client cannot protect his own interests not having the possibility to appoint a representative. In the introductory part of the paper, we presented considerations regarding legal acts, in general, business management, in particular, with a short historical foray (I). We continued with the exposition of the regulation of business management, from ancient times, from Roman law, to the current Civil Code (II) and its definition in doctrine (III). We analyzed the legal nature of business management to argue that this mechanism is specific to a lawful legal fact, the effects are produced under the law, not being a unilateral (unnamed) legal act (IV). We presented the conditions of business management structured in two categories: objective with reference to the object of business management and the characteristics of legal acts and material acts of management, and subjective, by reference to the attitude and behaviour of people who become or may be bound by the effects or the effect of this mechanism (V). In the final part, we analyzed the effects of business management, primarily between the manager and the managed, in the content of which there are mutual and bilateral obligations, as regulated by the provisions of Articles 1.331-1.335 and Article 1.337 of the Civil Code, and then when the guarantor acts in the interest of the guarantor and has concluded legal acts with third parties, the effects of which also apply to these persons (VI). The present paper proposes the analysis of the dramatic work of Matei Vișniec – a Romanian poet and prose writer, built and validated by the French center as an internationally exportable playwriter, by following the aesthetic-political relationship. I question, above all, the reasons why the parabolic formula is the favorite in the author's dramaturgy – its causes and effects, in relation to the ideological level and the thematization of the trauma of the communist (/totalitarian) regime. The thesis of my article is that, behind the parable (which implies a form of mediation) and the discursive metaphorism, respectively an apparent aesthetic gratuity, there is a political thesis that can be reinterpreted, reframed by both target audiences: Eastern and Western. Thus, the playwright built at the center and imported by the Romanian periphery accumulates symbolic capital from both territories, defined as a successful as a transnational author. This paper aims to do a close reading analysis of the tridimensional narrative experiment found in Sașa Zare’s debut novel Dezrădăcinare [Rootlessness] (2022). The alternation between character, narrator, and author seen at the narrative level of the novel starts a discussion about the autofictional prose written by Romanian contemporary writers, achieving at the same time to go beyond both national and gender boundaries. Frontier experiences, the theme of otherness, the awareness of what separates us and the damaging effects of a homophobic thinking are portrayed in Dezrădăcinare through multiple perspectives that are firstly analyzed by the narrator. Regarding transnational and World Literature, Zare’s discourse overpasses the limits of a debut novel and brings forward an important question How can we define ourselves in relation to the society we live in? If in the beginning the author-character is unsure of what she is doing, until the end of the novel Sașa is going to address problems regarding literature and criticism, misconceptions, patriarchy, and she will outline her idea about what does writing really mean for a contemporary woman writer. With a tradition of economic, political, and institutional settings built on a dynamic based on dominance, animals have been systematically assigned the role of an inferior form of „otherness”, essential, nevertheless, in shaping the anthropocentric mentality and validating the narrative of human exceptionalism. The longevity of such speciesist practices throughout the humanist discourses obliges the post humanist project of creating a post anthropocentric concept of subjectivity to pay special attention to the issues regarding the animals, their representations, and their interactions with ‘us’. This paper stems from Rosi Braidotti’s project of a posthuman subject understood as a hybrid entity integrated through a system of material and informational connections with all forms of existence in the nature culture continuum and follows the implications it has on redesigning our interactions with the non-human beings in a post-anthropocentric context. My purpose is to study how contemporary Romanian poetry reflects this new vision of subjectivity and its impact on reimagining the relations between the human and non-human beings. The analysis on volumes such as val chimic’s umilirea animalelor (the humiliation of animals), Mihók Tamás’s biocharia. ritual ecolatru, Adelina Pascale’s maki for 2, Gabi Eftimie’s Sputnik în grădină (Sputnik in the garden), or Diana Cornea’s Setări avansate de lumină (Advanced lighting settings) confirms the increasing interest of Romanian post millenary poetry in reshaping the depictions of animals and human-animal interactions according to a post anthropocentric perspective. The main aim of this paper is the analysis of how the multi-peripheral position in Ileana Negrea’s poetry is recontextualized in the geotemporality of contemporary Romanian culture, acknowledging her formation in a different language and through the reception and the application of feminist theories and praxis from other spaces, especially from the South American one, that are stratified and inserted in her texts. The analysis focuses on how the inflection point of her marginal identity, gender-queerness-madness, is recomposed in the actual Romanian cultural and geopolitical circumstances and how her texts are perceived accordingly with these. This article aims to explore how multilingualism is explored in Bessarabian literature and the way in which these phenomena can create cultural and identity crisis in the collective imaginary of The Republic of Moldova. Thus, it can be observed that in the Soviet period, but also after the fall of the empire, speakers of “Moldavian” language, afterwards named Romanian, are treated as inferior to Russian speakers, Moldavians becoming a periphery. Approaching multilingualism the way it is presented in Multilingual Literature as World Literature edited by Jane Hiddleston and Wen-chin Ouyang, a second objective of this paper is to investigate the identity crisis of the teenagers of Perestroika and the fall of the URSS, but also of the young adults that were brought up in the unsteady world that followed after these events. In doing so, the way in which the Bessarabian people were peripheral. According to the fact that this type of literature is insufficiently discussed, there will be analyzed three such novels, in order to offer a wider image of Chisinau between the 80’s and the 2000 and its transition: Grădina de sticlă (The Glass Garden) by Tatiana Țîbuleac, Sălbaticii copii dingo (The Savage Dingo Kids) by Vasile Ernu and Perestroika boys by Dinu Guțu. The other aspect that will be explored is the image of Romania and its literature in the Soviet Bessarabia, two neighbour countries that did not have an intercultural dialogue until 1991. This paper makes a case for analyzing the way in which the novel of Communism is approached by Mihai Iovănel in his History of Contemporary Romanian Literature: 1990-2020. This is a topic that was intensely discussed by Romanian literary criticism in Post-communism and represents the weakness of Romanian literature, either by it not being able to give a sufficiently convincing novel, or by not being able to agree upon how this novel should look. Accordingly, the critics had difficulties in labeling any novel that had been published after ‘89s as “the novel of communism.” The first part of the article is a panning of recent discussions about this term in relation to the analysis made by Iovănel in his History. The second part aims to trace out a network of this type of novel in the literatures of Central and Eastern Europe and to try to identify its particularities through a comparative analysis. The last part consists of a study case of the novels Acasă, pe câmpia Armaghedonului [At home, on the Field of Armageddon] by Marta Petreu and Bureți de Fag [Oyster Mushrooms] by Mihai Duțescu. This paper is the fourth part and the final one of a more extensive commentary on Article 5 of the European Convention on Human Rights, which is entirely published in four issues of this law journal. The first part of this study, published in the December 2022 issue, assessed the general features of the right to liberty and security and commented Article 5 § 1 (a) and (b). The second part, published in the January 2023 issue, analysed four other situations in which a person can be deprived of his or her liberty, as stipulated by Article 5 § 1 (c), (d), (e) and (f). The third part, published in the March 2023 issue, commented the rights enshrined in Article 5 §§ 2 and 3. The paper puts forward an analysis of the effects triggered by two decisions rendered by the Constitutional Court, namely the Decision No 279/2015 and the Decision No 405/2016, in relation to one of the suspension of employment cases regulated under Article 52 (1) b) under the Labour Code, which, originally, allowed for the employer to suspend the employment agreement in the event where the latter filed a criminal complaint against the employee for acts incompatible with their position. The conclusion of this analysis is that upon entry into force of the Decision No 279/2015 of the Constitutional Court, which ascertained the unconstitutionality of the provision allowing for the suspension of the employment agreement by the employer in the event where the latter filed a criminal complaint against the employee for acts incompatible with their position, it became mandatory to terminate the effects of the suspension decision, because the legal basis for applying such measure disappeared. Therefore, any ulterior decisions rendered by the Constitutional Court, which decriminalize (in full or partially) a crime for which a criminal complaint was filed against the employee lacks relevance, as Decision No 279/2015 applies with priority. In this paper we explore the exploitation and the discrimination of the feminine other portrayed in contemporary literature as figure of subalternity in the current neocolonial context. Taking into consideration the logic of modernity and that of coloniality as intrisincally interlinked, and the problematics of speaking and acting as a racialized and, at the same time, sexualized woman in the sex industry, we intend to analyse Michel Houellebecq’s Platform from the vantage point of Subaltern Studies in order to showcase how the feminine condition becomes a problem of consciousness and visibility, and how the exploitation of the feminine other is being deepened in a neocolonialist narrative. This paper is the last part of a more extensive commentary on Article 5 of the European Convention on Human Rights, which has been entirely published in three issues of this law journal. The first part of this study, published in the December 2022 issue, assessed the general features of the right to liberty and security and commented Article 5 § 1 (a) and (b). The second part, published in the January 2023 issue, analysed four other situations in which a person can be deprived of his or her liberty, as stipulated by Article 5 § 1 (c), (d), (e) and (f). This paper highlights and explains the contribution of the Romanian Constitution of 1923 to the building of the Romanian ethnocentric (national) constitutional identity and its decisive impact upon the constitutional and political developments along the Romanian 20th century. Grounded in the Romanian constitutional nationalism and xenophobia, this Constitution failed to accommodate the new international liberal standards regarding the protection of national minorities imposed by the system of the League of Nations after the WWI. The Romanian fathers of the Constitution not only refused to enshrine in the constitutional text the positive individual and collective rights recognized to the Romanian ethnic minorities by the Treaty of 19 December 1919, but built the 1923 Constitution as a constitutional cathedral of the Romanian ethnic majority where the ethnic minorities were tolerated as shadow citizens. On a short term, this illiberal ethos made quite easier the passage from the Romanian ethnocentric nationalism to the Romanian racial nationalism of the period 1938-1944. On a long term, the Constitution of 1923 represented a pattern of constitutional identity building strongly cherished by the fathers of the post-communist Constitution (1991). This is why the interwar Romanian illiberalism was widely preserved. On a general survey, neither the Constitution of 1923, nor the Constitution of 1991 succeeded to manage in a coherent liberal spirit the linkage between the national/ethnocultural identity and the constitutional identity in the multi-ethnic Romania. The main thesis of this paper is that the Draft Constitution redacted in 1922 by Constantin Stere on behalf of the Peasant Party's Study Centre (Centru de studii al Partidului Țărănesc) comes closest to the requirements of a rule-of-law-system, and surpasses all similar endeavours carried out at the time. Stere's proposed regulatory solutions on the relationship between municipal law and international legal commitments, especially in the field of minority protection, on basic rights and freedoms - with emphasis on personal freedom and habeas corpus - on election process and parliamentary practice were of such nature as to give efficiency and real substance to the general provisions of the Constitution. The present study proposes an analysis on human affections, considering the preexistent mentality that emotional reactions induce inauthentic experiences. Noting that there is a difference between transient emotional episodes and affections as persistent dispositions, which describe a pattern of reactions and behavior, this paper will show that authentic spirituality involves sacred affections. These affections are interconnected and stand in a relationship of anticipation with the other two elements of spirituality, namely knowledge and practice. We also argue that the biblical model in this respect relies on a religion based on affections (and knowledge) and is expressed in deeds, which outline an affective understanding of faith related to identity, ministry, pneumatology, and personal soteriology. The paper refers to the current legislation drafting on cultural heritage in Romania, with a view to the amendments regarding museums and public collections. It debates both on the positive and the negative stipulations in the draft Code of Cultural Heritage, published by the Romanian Ministry of Culture early in 2022. The main subjects presented in the paper are: the revision of the definition of national movable cultural heritage, stating that all cultural goods are subject to legal protection, the emphasis on the public interest in protecting the cultural heritage as well as new and needed clarifications on the public property legal regime of cultural goods in the public domain, new centralized inventories and registries, new procedures regarding the classification as "National Treasury" and the new ex lege general protection regime for public collections, accredited museums and religious institutions, new obligations regarding the strategic planning of museum collections management and accessibility for the public. This paper aims to sketch as accurately as possible the moral portrait of one of the recipients of Saint Isidore's epistles. In addition to the 15 letters addressed directly to Bishop Eusebius of Pelusium, we also find explicit references to him in another 54 letters, but also implicit references in several others. Starting from the observations of Pierre Évieux and Constantine Fouskas, this paper goes a little further in the analysis of the letters, systematizing the reproaches made by Saint Isidore in order to recover a series of details regarding the historical context in which he carried out his activity. The present paper presents the research and restoration of an easel painting – a Portrait of a woman signed by Mihail Dan, from the Elena and Anastase Simu collection belonging to the Art Collections’ Museum subordinated to the National Art Museum of Romania. It is a work which reveals the artistic qualities of a refined painter interested in a variety of textures, but focuses on previous restorations which have produced degradations and considerabile modifications of the parts composing the painting, and of the authenticity of the work itself. The paper concentrated upon the adjustment of treatment methods during the restoration, in order to remake the physical and artistical integrity of Mihail Dan’s Portrait of a Woman. The aim of the present paper is to offer a glimpse of the public health system in Transylvania in 1900 and to identify the state medical staff in the provincial administration based on the data contained in the Transylvanian Health Database, a new digital tool dedicated to Transylvanian physicians in the past, currently under construction at the Centre for Population Studies of the “Babeș-Bolyai” University of Cluj-Napoca. In order to outline the framework in which these doctors worked, the study reviews the legislation in the field of public health. Health statistics in Hungary, provided by the Magyar Statisztikai Évkönyv, asses the situation of the public health system at county level in numerical values. The picture is completed by the nominal list of doctors who occupied the main posts in this system in Transylvania in 1900. The paper can also be seen as an introduction to the Transylvanian Health Database as a working tool for research in social history and medical history. [ABSTRACT FROM AUTHOR]

This previously unpublished paper given at the Sever Zotta Institute from Iaşi in the autumn of 2003 is an overview of the Romanian-related sources extant in the Florentine archives. Following on the footsteps of N. Iorga, the author adds a significant amount of new material to the already-known corpus of sources. This archival research starts in the fourteenth century and ends in the mid-seventeenth one. Among the newly-discovered sources the most spectacular are a biography of Pippo Spano, some Florentine merchants' letters (especially the 1564 letter sent by Antonio Pandolfi to Pietro Machiavelli), several writings of the Florentine-born military commanders involved in the Transylvanian affairs, from Castaldo to Bernardo de Aldana, and more than a handful of Florentine informants' reports on a variety of subjects (i.e. Sigismund Báthory's matrimonial projects, anti-Ottoman plans, or the ancient history of the region). In addition to its historical substance, this paper also provides a historiographical testimony, as it echoes some controversies of the day within the Romanian academia. [ABSTRACT FROM AUTHOR]

- Abstract
The purpose of this paper is to describe and discuss the terms used for ‘noise’ in Romanian dialects. The discussed data comes from Romanian Regional Linguistic Atlas. Synthesis I, as well as numerous other dialect atlases, dialectal and folkloric resources. Besides the geographical distribution and etymology of all the registered answers, discussed in the three separate chapters (Dacoromanian terms used in Romania, Dacoromanian terms used outside Romania and terms used in the other dialects of Romanian), the paper includes an onomasiological and lexico-semantic approach of the Dacoromanian terms. The present paper proves the use of a large number of terms, with various etymologies, for expressing the notion of ‘noise’ in Romanian language. - Abstract
Corythucha arcuata, commonly known as oak lace bug, is an invasive alien insect species that was first reported in Europe in 2000, in northern Italy and in Romania in 2015. Given the negative impact and harmful potential that invasive species have, it is necessary to establish detecting methods for C. arcuata to prevent the difficulties encountered by foresters in reporting it. This paper aims to develop working protocols for the early detection of this invasive species taking into consideration both the characteristic attack and the presence of the insect. The results show that the presence of the insect can be easily detected at all stages of development, based on careful investigations made by the observer. However, the methods of detection presented in the paper must be doubled by the establishment of a permanent and rigorous surveillance system. [ABSTRACT FROM AUTHOR]

With this paper we analyze the concept of resilience in context of protection of critical infrastructure. Our starting hypothesis is that in this moment there is absence of national consensus of what resilience means which refl ects negatively on actual protection of critical infrastructure against all types of hazards. In the second part we analyze how the concept of critical infrastructure protection against all types of hazards and what does it mean to have unified/centralized approach towards this issue. In Transilvania, most of the publications mirrored the fight for political unity. The majority of the editors and the collaborators were interested in the unity and unification of the language and suggested concrete ways of accomplishing it by pointing out the common nature of the language, reconsidering its Latin origin, organizing a scientific leadership in the field able to fulfilling the unity of the language at all its levels: vocabulary, phonetics and grammar. This paper aims to illustrate examples of exercises that are used during the practical course of Romanian as a foreign language. The course is entitled Oral and Written Communication I and is taught during the first semester of the preparatory year of Romanian language for foreign citizens at the Technical University of Cluj-Napoca. The exercises address topics pertaining to the first concepts assimilated in any foreign language (family, personal space/home, the university context, daily activities in personal, social or special situations - at the doctor's, travel, etc.), both orally and in writing. The crime victims require a particular attention during the criminal proceedings due to their special status and the danger of their revictimization. The Code of criminal procedure into force states a new criminal procedural position for the crime victims, featured by legal means regarding the activity of judicial examination, both in the investigation and judgment phases of criminal proceeding. In the current paper, I would like to present issues of the criminal procedural means, which define the legal framework of the crimes victims' rights. In this context, the paper aims at analyzing and thoroughgoing study of specific elements in the matter of solving criminal cases by means of exercising judicial examinations, under the main scope to assure the crime victims' rights during the criminal proceedings. In this paper we present the written account of humanist Stephanus Brodericus, who was an eyewitness to the battle of Mohács in 1526. His work can be defined as a historiographical piece, as well as a work of military history. The author uses a fluid narrative, with expressions specific to the era. It includes information about the place of the battle, references to the architectural elements that were on the ground at the time of the confrontation. Despite the shortcomings of the paper, related to the description of military operations, it gives some details about the deployment of troops, but also about the losses suffered as a result of the battle. The 2020's are to be named (if not already) the pandemia times. The present paper does not aim to analyses the changes and consequences that this sanitary crisis has produced, or to determine possible scenarios about how the world (in all its dynamics and layers) will survive in the post-pandemia period. There are other academics and (already) plenty of scientific papers that tackled these issues (the social sciences scientific community has responded almost instantly to the COVID-19 effects). This research paper contains the idea of science that social research encompasses by analysing (from a socio-anthropologist eye and based on professional training) the data circulation vortex during the first semester of 2020. The results and the manner of research (constrained by the urgency and isolation restrictions), respectively the quest for the discrepancies between the information offered by governments and international organisations, and by scientific inquiries and academic sources, represent an original perspective on data legitimacy when used for the public. This paper's main aim is not to achieve the comfortable status of the academic "likes" (converted in citations and indexes).
