Objective: Joan McCord was an experimental criminologist who advocated for evaluating social programs for efficacy, benefits, and potential harms to guide crime prevention policy. This paper argues that criminal justice reform should be guided by evidence for effective social programs that guard against unintended harms. Programs that focus on social control are consistent with basic facts of crime and guard against the tail risk of surges in serious crime and violence. This paper discusses the evidence from evaluations of social programs which are based on principals of social control in families, schools, neighborhoods, and the criminal justice system. Methods: This paper draws upon the evaluations of social programs that have been published based on at least one high-quality experiment or two rigorous quasi-experiments, that can be scaled to entire populations, and are sustainable over time. Results: A review of experimental and quasi-experimental evidence found that social programs focused on increasing social control (formal or informal) in families, schools, communities, and by the criminal justice system are effective at preventing serious crime. Some of the social programs with rigorous evidence of preventing crime could be scaled to entire populations for prolonged durations with adequate planning and implementation models. Conclusion: Many contemporary criminal justice reforms have little evidence of efficacy, and run the risk of generating unintended adverse outcomes related to the spread of serious crime and violence. Existing evidence suggests that social programs that focus on social control can act as buffers against the tail risk of serious crime. The social programs with evidence of preventing crime should be expanded, monitored for fidelity in implementation, and continuously evaluated to improve their efficacy and sustainability as effective safeguards against the rise in serious crime and violence. What is required to decolonize policy research in doing knowledge production about Indigenous peoples? Policy studies has been complicit in maintaining a central methodological policy research problem: the ongoing prevalence of hegemonic imperial and colonial knowledge production practices in relation to Indigenous peoples. This problem persists through policy researchers producing anti-Indigenous genocidal native-place-invisibilization in scholarship. Ambiguous relationality is another mechanism through which elimination of the natives takes place in research – it is when researchers deliberately/unintentionally omit naming and visiblizing their positionality in relation to the native-places the researchers are working with. Undoing harms emerging from native-place-invisibilization and ambiguous relationality requires a 'grounded normativity' oriented native place consciousness, naming and visibilization of the native place(s) the researchers work on/with, respecting sovereign Indigenous research jurisdictions, and applying an Indigenous Policy Research Framework (IPRF). Decolonization as a solution to the policy problem being tackled in this paper looks like counter-hegemonic radical redistribution of power back to the community when conducting Indigenous policy research. The IPRF approach is formulated using a literature review methodology and consists of guiding questions and principles to help steward the processes of decolonizing policy research. The aim is to support the emergence of radically restorative research justice practices and repair historically harmful relations between knowledge-producing systems/institutions and the Indigenous communities about whom the knowledge production is done. Recent statistics reveal alarming flaws in the Criminal Justice System's (CJS) handling of rape cases, undermining the pursuit of justice for complainants seeking legal redress. This paper takes a novel approach to explore police rape stereotype use in interviews with rape complainants, utilising critical discourse analysis and conversation analysis and discursive psychology to understand and critique the balance of power within an interview and how this might impact attrition and prosecution decisions. Ten police interviews with rape complainants were analysed with several suspect discursive constructions present throughout, including the interviewer constructing the suspect as misunderstanding, the complainant as miscommunicating non-consent, or agentless and passive talk. A significant and original finding was the way constructions interacted with the spectrum of stranger-to-partner rapes. In stranger rape cases, passive language often obscures the suspect and emphasises the complainant's behaviour. Acquaintance rapes frequently involved misunderstandings centred on visible distress and mixed signals. Partner rapes highlighted issues around consent and coercion, with officers often ignorant of coercive control and domestic abuse. These findings align with Operation Bluestone Soteria (OSB); thus, the recommendations align with those made by OSB's Pillar One. [ABSTRACT FROM AUTHOR]

Background: Traumatic brain injury (TBI) is disproportionately prevalent among individuals who intersect or are involved with the criminal justice system (CJS). In the absence of appropriate care, TBI-related impairments, intersecting social determinants of health, and the lack of TBI awareness in CJS settings can lead to lengthened sentences, serious disciplinary charges, and recidivism. However, evidence suggests that most clinical practice guidelines (CPGs) overlook equity and consequently, the needs of disadvantaged groups. As such, this review addressed the research question "To what extent are (1) intersections with the CJS considered in CPGs for TBI, (2) TBI considered in CPGs for CJS, and (3) equity considered in CPGs for CJS?". Methods and findings: CPGs were identified from electronic databases (MEDLINE, Embase, CINAHL, PsycINFO), targeted websites, Google Search, and reference lists of identified CPGs on November 2021 and March 2023 (CPGs for TBI) and May 2022 and March 2023 (CPGs for CJS). Only CPGs for TBI or CPGs for CJS were included. We calculated the proportion of CPGs that included TBI- or CJS-specific content, conducted a qualitative content analysis to understand how evidence regarding TBI and the CJS was integrated in the CPGs, and utilised equity assessment tools to understand if and how equity was considered. Fifty-seven CPGs for TBI and 6 CPGs for CJS were included in this review. Fourteen CPGs for TBI included information relevant to the CJS, but only 1 made a concrete recommendation to consider legal implications during vocational evaluation in the forensic context. Two CPGs for CJS acknowledged the prevalence of TBI among individuals in prison and one specifically recommended considering TBI during health assessments. Both CPGs for TBI and CPGs for CJS provided evidence specific to a single facet of the CJS, predominantly in policing and corrections. The use of equity best practices and the involvement of disadvantaged groups in the development process were lacking among CPGs for CJS. We acknowledge limitations of the review, including that our searches were conducted in English language and thus, we may have missed other non-English language CPGs in this review. We further recognise that we are unable to comment on evidence that is not integrated in the CPGs, as we did not systematically search for research on individuals with TBI who intersect with the CJS, outside of CPGs. Conclusions: Findings from this review provide the foundation to consider CJS involvement in CPGs for TBI and to advance equity in CPGs for CJS. Conducting research, including investigating the process of screening for TBI with individuals who intersect with all facets of the CJS, and utilizing equity assessment tools in guideline development are critical steps to enhance equity in healthcare for this disadvantaged group. As a first step to improving equitable care, this study assessed existing CPGs for TBI and CPGs for CJS to see if and how (1) evidence regarding individuals who intersect with the CJS is included in CPGs for TBI and evidence regarding TBI is integrated in CPGs for CJS; and (2) equity is considered in CPGs for CJS. What did the researchers do and find?: We used available electronic databases (MEDLINE, Embase, CINAHL, PsycINFO), targeted websites, Google search, and reference lists for CPGs for TBI and CPGs for CJS. We documented their characteristics, reviewed their content, and assessed whether equity was considered using checklists focused on equity and disadvantaged groups. We found that 14 out of 57 CPGs for TBI referenced individuals who are involved with the CJS and 2 out of 6 CPGs for CJS referenced TBI. Practices to ensure that equity is considered, such as the involvement of disadvantaged groups when developing CPGs were lacking in CPGs for CJS. What do these findings mean?: Findings from this review suggest that consideration of equity is lacking in the development of CPGs for TBI for those within the CJS and provide the foundation to consider CJS involvement in CPGs for TBI and to advance equity in CPGs for CJS. The criminalization of young women in care remains an important practice and policy issue in England despite 2018 national guidance and the subsequent development of local authority protocols to reduce the criminalization of care‐experienced young people. This paper contributes to the emerging research on young women whose behaviour challenges professionals, through secondary analysis of case file data and narrative interviews with 24 care‐experienced young women from a national project on care and offending. Analysis focused on young women's pathways through the care, justice and education systems and identified five domains within young women's lives where available risk or resilience factors were significant in directing young women towards prosocial opportunities, to new types of victimization or to criminalization and offending. These domains consisted of placements and caregiver relationships; partner relationships; pregnancy and motherhood; participation in education; and the transition to adulthood through leaving care. The paper concludes with implications for practice for professionals working with young women, in particular emphasizing that how the care, justice and education systems respond to young women can contribute to negative pathways or transform them. This paper discusses the plight of the 'Guapinol Eight,' a group of men who were arrested, detained, and convicted by a Honduran court after defending their right to access clean water. Our analysis is situated within a broader doctrinal conversation on the gaps in the conceptual and theoretical underpinnings of human rights defenders. In particular, we highlight the (lack of) effectiveness of protection mechanisms, the complex connections between activism, repression of activism and risk taking, and the usage of legal and administrative mechanisms for repression of human rights defenders. We find that the Honduran criminal justice system largely fails to protect those who speak up against unfair criminal charges, detention, and convictions, while at the same time fails to condemn private companies or individuals who retaliate against the work of human rights defenders with lawsuits, violence, or murder. In the conclusion of this paper, recommendations are made as to steps the Honduran government can take to redress past wrongs and introduce standards that comply with domestic and international law before a chilling effect ameliorates the voice of human rights in Honduras in the years to come. The lack of explainability of Artificial Intelligence (AI) is one of the first obstacles that the industry and regulators must overcome to mitigate the risks associated with the technology. The need for 'eXplainable AI' (XAI) is evident in fields where accountability, ethics and fairness are critical, such as healthcare, credit scoring, policing and the criminal justice system. At the EU level, the notion of explainability is one of the fundamental principles that underpin the AI Act, though the exact XAI techniques and requirements are still to be determined and tested in practice. This paper explores various approaches and techniques that promise to advance XAI, as well as the challenges of implementing the principle of explainability in AI governance and policies. This paper presents a case study narrative of one woman. Drawing on her storied recollections, from infancy into childhood through young motherhood into adulthood, we trace the interlocking relationship between policies and practices intended to offer welfare support facilitating her criminalization. A collaborative approach to producing knowledge, representing 8 years of narrative, dialogue and reflection surfaces a looming panopticon. The gendered power of the state to intervene across the life course is revealed, as is the failed and harmful nature of this panopticon. Three distinct themes emerge from the analysis: the power to define and the fixing nature of gendered policy and practice narratives; the gendered control strategies that reproduce harms in women's lives; and the lifelong nature of the panopticon for some girls and women. Cutting across these experiences are processes of silencing and ultimately resistance, strategies for surviving the enduring forms of institutional surveillance and intervention. The paper closes with clear implications for the hegemonic trio of social science research and social work and criminal justice policy and practice. This paper acknowledges the progressive efforts under the Constitution of Kenya, 2010, statutes and jurisprudence on the rights of accused persons vis-àvis victim rights under Kenya’s criminal justice system. It conceptualizes the place, scope, and evidentiary weight of victim impact statements by arguing that VISs have evidentiary value especially during court sentencing. Secondly, the paper evaluates what “reasonable access” means in a criminal justice system and whether the discretion of the Court under section 329C(4) of the Kenyan Criminal Procedure Code is constitutional, equitable and promotes access to justice. Thirdly, whereas discretion is a fundamental element of judicial independence, further conceptual and theoretical studies on access to justice are necessary in understanding the intersectionality of different variables under Kenya’s criminal justice system, the need for progressive development of the law. A death that occurs inside a prison cell initiates a distinct set of procedures from those around a death on the outside. When a confined space within a penal institution of total surveillance and control becomes a crime scene, it may reflect the prevailing institutional cultures and the ways in which they react and adapt. This paper analyses the case of Marcos, who was found dead in a Portuguese prison cell which he shared with another individual. From the discovery of the body to the crime scene inspection by the police, and from the autopsy to the trial, the qualitative analysis of the inscriptions produced in this case reveals and highlight the epistemic cultures involved. As each culture is developed from the professional practices and modes of acquiring and using knowledge, the analysis of their logic contributes to an understanding of how forensic evidence is co-produced and appropriated in the Portuguese legal context. We identify five epistemic cultures: institutional defence, hunch, office, bubble, and 'rubber stamp'. We argue that the apparent neutrality of an inquisitorial criminal justice system enables the development of particular ways of producing, understanding and using scientific knowledge and forensic evidence. Understanding the factors that influence domestic violence and abuse (DVA) victims to withdraw from the Criminal Justice System globally continues to be a key focus for professionals and academics working within this area. There is a dearth of extant literature examining the motivations behind victim withdrawal, particularly retraction occurring post provision of an initial statement. This paper examines the phenomenon of retraction, by thematically analysing N = 60 police retraction statements (PRS) collected by police officers in a large suburban police force in the North West of England. In examining these statements, insight can also be garnered from those victims still in an active relationship with their abusers. Findings highlight female victims' motivations for retraction and are framed around victim problem solving including: a) accepting the relationship which resulted in a discordance in proceeding with the prosecution of the abuser b) rejecting the relationship thereby rendering the prosecution as redundant c) engaging in procedural problem solving where alternative measures such as civil actions were sought to substitute a CJS prosecution and d) the effect of children where motivations were split between retracting to return to the complete family unit including the victim as the mother and retracting due to recognising the importance of the father's role without involvement from the mother. Notwithstanding limitations, this paper demonstrates that there is significant value in conducting an analysis of PRSs in furthering the understanding of why victims choose to retract at this point in their prosecution journey. The extracts from this dataset add insight and understanding into DVA female victim motivations to retract post-initial statement provision and highlight the differences within victim populations who retract their original statement. Accessible Summary: What is known on the subject?: Seclusion is a harmful and traumatising intervention for people accessing mental health services.People who are subject to seclusion in inpatient mental health services often first experience this within the first 24 h following admission.There is limited research examining how recent contact with services impacts the likelihood of seclusion when people are admitted to inpatient services. Aim/Question: To identify factors associated with seclusion within the first 24 h following admission into acute inpatient mental health services. Method: A retrospective analysis was undertaken using routinely collected data from Aotearoa New Zealand mental health services. Results: A higher likelihood of seclusion within the first 24 h following admission was associated with: males, Māori, Pasifika, referrals from police/justice services, inpatient transfers, recent contact with crisis assessment teams and clinician perceptions of aggression, problematic substance use, cognitive problems and hallucinations or delusions. Recent contact with community mental health services was associated with a lower likelihood. Discussion: People's cultural needs, referral pathway, recent service contact and HoNOS scores should be considered when working to prevent the use of seclusion in the first 24 h following admission. Implications for Practice: The first 24 h following inpatient admission is a critical period for preventing the use of seclusion. The concept of self-disclosure has been a controversial issue that remains highly debated by current practising social workers and researchers alike. Yet an increasing number of lived experience practitioners or peer support workers are being employed in many human services areas, including mental health, suicide prevention, bereavement services, drug and alcohol recovery, criminal justice, and emergency services, alongside or in complement to, social worker roles. Peer or lived experience roles seek to enhance the recovery journey for clients by sharing lived experience commonality, whereas social workers seek to enhance the recovery journey through psychosocial engagements. Both may have relevant lived experience to their role. The aim of this paper is to explore how sharing lived experiences, also referred to as self-disclosure, between social workers and client/service user can enhance the relationship, with attention paid to safety and recovery. A narrative review of the literature identified that there is a lack of empirical research undertaken exploring how disclosures impact the service users and what decision-making strategies can assist social workers in deciding how and when to share. The current AASW Code of Ethics offers no clear practice standards or ethical guidelines for effective self-disclosure. The analysis of the literature results in a reflective supervision tool for social workers in pre-service training and early career social workers, with the aim of assisting decisions that may prompt lived experience sharing. This article examines the reasons why torture has no place in Zimbabwe’s criminal justice system, focusing on the role of constitutional dialogue and a standalone torture law as the optimal alternatives for protecting constitutional rights. The paper finds that the rejection of torture aligns with principles of constitutional dialogue in safeguarding fundamental rights. Freedom from torture is non-negotiable both nationally and internationally. The methodology used here involved analyzing the case law within Zimbabwe in the light of international law. Rejecting torture reflects a commitment to constitutional dialogue, fostering a legal framework that upholds fundamental rights and constitutional values. Moving forward, considerations of severity and purpose should distinguish thresholds for lawful sanctions, while clarifying the government’s duty to abstain from torture and protect citizens from both public and private agents’ acts of torture. This exposes the necessity for a domestic legislation on torture in Zimbabwe, because mere constitutional prohibition of torture is insufficient in the absence of supporting laws detailing the crime’s gravamen and procedures. The state and federal criminal justice systems in the United States aim to achieve two main goals: retribution and deterrence. However, neither of those goals are being effectively achieved. Retribution is lacking as victims are not able to seek justice on their own terms, offenders are never forced to take accountability for their actions, and society continues to pay the price for the harm done. Criminals are also not being effectively deterred, as recidivism rates are high, and incarceration is not an effective punishment. Three non-traditional justice systems: tribal courts, the South African Truth and Reconciliation Commission, and Rwandan Gacaca courts, have been practicing principles of restorative justice that would be more successful in providing retribution and deterrence than the current United States systems. This paper examines the infrastructure and principles behind the three systems and creates a modified restorative justice system to replace the current retributive system in the United States. This paper provides insights into the predominant styles of political reasoning in England and Wales that inform penal policy reform. It does so in relation to a particular development that constitutes a dramatic, perhaps even unique, wholesale reversal of a previously introduced market-based criminal justice delivery model. This is the 'unification' of probation services in England and Wales, which unwound the consequential privatization reforms introduced less than a decade earlier. This paper draws on in-depth interviews with senior policy makers to present a narrative reconstruction of the unification of probation services in England and Wales. "Technology" and "Criminal law" are usually considered separate subjects. Artificial intelligence in courts has raised questions about criminal procedural law. Investigations and crime perception have changed due to the digital society. Humans have a duty to maintain the law, but the fast digital shift in people's lives is affecting how they do so. Technology and AI are crucial for the criminal justice system (CJS). In the scientific community, methodology, and approaches, AI is defined. It's usually used to describe something that simulates human cognition with a machine. Advances in neuroimaging, AI, and machine learning have led to the development of brain-reading technologies that could be used for lie detection, brain-computer interfaces, and brain mapping in the near future. Politicians, technicians, and lawyers, among others, must collaborate for the good socio-research of society, particularly in the criminal justice system. In this paper, we review and analyse the literature on the use of brain-reading AI for neuroprotection of violence and rearrest to identify opportunities and challenges in the future use of these techniques in the fields of forensic psychiatry and criminal justice, while taking legal implications and ethical concerns into account. More research on AI neuro-prediction techniques is needed, according to the study, to complete the investigation, and it is still important to understand how they might be employed in the field of forensic psychology. The current paper explores the theoretical and empirical capacity of developmental and life-course criminology (DLC) to further our understanding of non-lethal intimate partner violence (IPV) and femicide. Drawing on Sampson and Laub's age-graded theory and Moffitt's dual taxonomy, the paper delves into empirical research that has identified and examined the overlap between general offending and IPV, highlighting how these DLC theoretical frameworks could provide insight into non-lethal IPV and femicide. We also outline the ways in which these DLC perspectives are challenged to fully address the gendered nature of IPV and less able to provide an empirical and theoretical understanding of the role of power and control by men over their women partners. We then place these frameworks within the global impact of the COVID-19 pandemic on gender-based violence, including femicide. While the COVID-19 lockdowns increased vulnerability to IPV and increased homicide in the United States, the expected rise in femicide did not materialize—at least within the United States, prompting questions about the extent to which existing criminological theories are able to provide a framework for these types of crime trends during unprecedented events. We examine the way non-lethal and lethal IPV are shaped by different factors as outlined in Moffitt's dual taxonomy. The pandemic for example did not create increased psychopathy (i.e., affective and personality disorders) associated with the risk for femicide, but the COVID-19 pandemic and the subsequent lockdowns did create increased economic and family stressors, which placed many at-risk women and children in further social isolation, and reduced access to victim services. We conclude a need for further theoretical development surrounding femicide, integrating developmental and life-course perspectives, thereby emphasizing the need for refined frameworks to address the intricate dynamics of violence against women globally. The promotion of the restorative justice (RJ) concept has brought significant changes to China's environmental criminal justice system. However, the lack of empirical study makes it hard to support the existing normative arguments and jurisprudential analysis of environmental RJ practices in China. This study aims to investigate the evolutionary mechanisms of the RJ application in environmental crimes. To achieve this goal, a tripartite evolutionary game model comprising the judiciary, the offenders, and the victims, is established based on evolutionary game theory (EGT). Simulations based on 2022 China's environmental criminal justice data indicate that top-down environmental RJ reforms will face resistance due to insufficient public participation. To reverse this situation, we merge sensitivity analyses of model parameters with critical examinations of classical RJ theories. By analyzing the current status and future scenarios of RJ in China's environmental criminal justice, we suggest that: (1) Maintaining moderate penal intensity is the evolution-stable condition for the offenders to develop an intrinsic legal motivation to repair the environment. (2) To ensure both efficiency and fairness, the use of RJ should be determined based on the statutory length of sentences for environmental offenses. (3) Support for victims should be strengthened to increase their benefits from environmental RJ and reduce their legal costs. This paper is innovative in quantitatively evaluating the evolutionary mechanisms of the RJ application by using EGT, which adds to the body of knowledge on RJ conducted by qualitative research. The findings based on EGT can provide an answer to the persistent debate about the relationship between RJ and traditional justice (TJ). While the argument for replacing TJ with RJ may seem attractive, it is not feasible. This paper expands our understanding of the lived experience of policing by exploring how people describe and analyze one of its salient aspects: its economic consequences. Despite growing scholarship on predatory policing strategies in the aftermath of the Justice Department's investigation of Ferguson, Missouri, we lack an understanding of how these practices are experienced, theorized, and resisted by policed, race-class subjugated (RCS) communities. How do people narrate, make meaning from, or theorize their material relationship to policing? Do policed publics understand such practices as part of broader processes of racialized governance, political power, and community inequality? Utilizing the Portals Policing Project, we collected the largest contemporary database of narratives about policing, including over 850 dialogues that were qualitatively coded. Using a grounded theory approach we analyzed a subset of dialogues that focus on financial aspects of police, court, and carceral encounters to examine how people discussed their experiences with monetary sanctions and their broader meanings and relationships to racialized political economy and geography. When people analyzed the material dimensions of policing and incarceration, four prominent discursive theorizations emerged: (1) Police and courts deploy a variety of techniques (criminalizing public space, strategic application of child support fees, unfair taxation, among others) to structurally control the flow of RCS resources, often toward the state and non-policed White communities. (2) Such resource flows occur in the broader context of municipal prioritization of police and carceral institutions over schools and social services, which permit and sustain RCS community criminalization, extraction, and reproduction of marginalization. (3) Police construct racialized urban spaces and markets, marking informal RCS economic activity as transgressive and delimiting their expansion. (4) Police surveillance is racially embodied and permeates daily life to restrict individual activity and, indirectly, economic potential. Overall, these narratives center the police and carceral state in processes of materialized race-making—the active reproduction of racial economic inequality and dispossession that goes beyond basic racial disparities in state punishment and revenue generation. In most cases, researchers assume that control of corruption, rule of law, accountability, and government expenditure tend to have a positive impact on government effectiveness. Nonetheless, recent theoretical and empirical evidence supports a mixed relationship between these variables. The paper, therefore, seeks to answer the extent to which corruption, the rule of law, accountability, and government expenditure affect government effectiveness. We employed Johansen method of cointegration and vector error correction model to examine the long-run and short-run relationship between the variables under study. By using Sri Lankan data covering the period from 1996 to 2020, we find a significant and positive relationship only between the control of corruption and government effectiveness both in the long run and in the short run. Yet, rule of law has a positive and significant impact on government effectiveness only in the long run. Voice and accountability, and government expenditure affect the government's effectiveness negatively in the long run and positively in the short run. The article demonstrates that weak anti-corruption mechanisms and weak legal and criminal justice systems seem to have a detrimental impact on government effectiveness in developing countries. In recent years, there has been considerable policy and academic interest in the existence of ethnic inequalities in the Criminal Justice System. A large body of sentencing research has been dedicated to exploring whether ethnic minority defendants are treated more harshly than similarly situated white defendants. This paper extends this research utilizing Ministry of Justice linked criminal justice datasets and multilevel models to assess the effect of ethnicity and other defendant case and contextual factors on sentencing outcomes in the Crown Court. The analysis shows that legal characteristics such as plea, pre-trial detention, offence type and severity are important factors determining sentencing outcomes although they do not fully explain disparities in these outcomes between ethnic groups. Ethnic disparities in imprisonment persist and, in some cases, become more pronounced after controlling for defendant case and court factors. In contrast, ethnic disparities in sentence length are largely explained by legal factors, and after adjusting for other predictors of sentencing outcomes, observed differences between most (but not all) ethnic minority groups and the white British disappear. The paper excavates 'implicit criminologies' concerning victims, perpetrators and bystanders from four films by Bosnian director Jasmila Žbanić: Grbavica (2006); On the path (2010); For those who can tell no tales (2013) and Quo Vadis, Aida? (2020). I argue that in criminological terms, Žbanić's work is strongest, and has greatest transformative potential, as an example of cinematic victimology. This is produced through characters who simultaneously encapsulate particular (ethnicized) and universal elements in micro-level stories of the individual in a larger social, political and historical context. Focussing on this form of universalism, I question an ethical standard of inclusivity in atrocity cinema which calls for a single film or director to directly represent victims of all ethnic groups. This paper exposes how colonial ways of knowing and being shape judicial behaviour in Brazil, where pre-trial detention is excessively used against racialised groups. I argue that judges continue to conceptualise and operationalise justice according to colonial logics and thus reveal the coloniality of justice. Drawing on decolonial theory from across South America and from interviews and court observations in Rio de Janeiro, I reveal how judges understand themselves as heroic crime fighters, acting beyond the law in a modern moral crusade. I examine how violence remains a central component of justice and consider how judges deal with the contradiction of neutrality and aggression. Under the assault of disturbing experiences that seem sealed into a bodily discourse, there appears an increased permeability between the dream space and the psychotherapy space. It is in the forensic in-patient hospital environment that I have commonly sat with a calm and compliant patient to find myself grappling with an overwhelming pull toward sleep. Such tiredness in countertransference can be understood as a manifestation of the weight of buried or repressed disturbance which can only seemingly be registered at a bodily level. Forensic patients are usually the subject of vilification from the courtrooms to sensationalist media reports in a system that further bottlenecks their emotional lives. It seems to me that sometimes there can be a fine line between continuing the trend of condemnation and the taking up of clinical responsibility. It is perhaps one of the most helpful aspects of psychoanalytic work, that we consider the projective processes involved in the criminal justice system. That we look to ourselves and our own countertransference for greater clinical clarity, a radar in the darkness. For decades, developing countries have faced international pressure to adopt the techniques and tactics consistent with the drug war. These have had profound and adverse consequences. While cannabis prohibition and drug control generally are topics that lend themselves to established comparative studies, engaging cannabis as a substantive topic engages numerous aspects of criminal justice systems. In this paper, we link cannabis to concepts related to recent formulations of international criminology. Next, we outline how the history of cannabis prohibition requires adopting a more critical global lens and consider the role of legal technical assistance to support countries renegotiating cannabis control in the twenty-first century. Beyond the formal tools and informal techniques commonly used within legal technical assistance, we argue expanding tolerance can disrupt the tendency for reform to expand social control. While embracing tolerance may serve as an antidote to some penal modalities, this must be combined with policies that regulate the aversion many feel toward cannabis and people who use it. Mental health concerns among juvenile-justice-involved youth (JJIY) continue to be a major health crisis in the United States (US). While scholarship has explored mental health concerns among JJIY, and the link to negative life outcomes, there are gaps in the existing research, particularly in effective interventions and models aimed at addressing both the mental health concerns and criminogenic risk contributing to recidivism and other negative life outcomes of this population. In this paper, we present Justice-Based Interdisciplinary Collective Care (JBICC), an innovative framework to address both the mental health needs and delinquent behavior of youth offenders. The model bridges community partners, with the purpose of informing future interventions, implementations, and research in this area. Increased justice-based interdisciplinary collective collaboration between the juvenile justice system and community programs/organizations would be a major benefit to youth offenders and their families. We also focus on the need for cultural responsiveness to be interwoven throughout all aspects of treatment. JBICC offers an opportunity to expanded services outside traditional settings and methods to ensure that youth offenders and their families receive validating and culturally responsive access to services. Delays at court are an everlasting and potentially consequential reality of criminal justice systems, although most would agree that the timely adjudication of cases is needed from both administrative, judicial, and individual perspectives. This paper uses administrative data and a policy reform in Denmark in 2007 to measure the unconfounded association between court delays – or, more specifically, time to adjudication – and criminal recidivism within 5 years. Results show that although court delays do not push more people into recidivism, the delays matter for how many crimes recidivists end up being convicted of. Also, criminality tends to be muted during the period from charge to adjudication (even in a context with low use of pretrial detention and no bail system), whereby court delays also matter for the timing of new crimes – a finding with important theoretical implications. The criminal justice system is enthralled with drug testing. It is a billion dollar industry fueled by drug courts, swift certain, and fair strategies, and the idea that probation is a privilege. It has become so pervasive that even people without an identified drug problem are often tested on a regular basis. While the field has accepted drug testing as a key component, this paper suggests that the data, while limited, is not as pervasive as the practice itself. This paper will explore the current research on drug testing, how effective it is for people without an identified substance use issue, and what are some of the collateral consequences to testing that may offset any perceived or real benefit to the practice. Purpose: The purpose of this paper is to find out what role intermediaries have in facilitating communication with victims and prisoners at Parole Board (PB) oral hearings. Design/methodology/approach: A survey was designed and administered to 39 PB members to find out their perceptions of, and experiences with, the use of intermediaries. Frequency tables and verbatim quotations are used to report the results. Findings: Overall, participants had not experienced any use of intermediaries with victims or family members presenting victim personal statements at an oral hearing. Further, there had been limited use of intermediaries for prisoners attending oral hearings. Nevertheless, there was a good recognition of a range of communication needs that a prisoner might present with at a hearing. There was also general support for the use of intermediaries with some caution about possible delays to procedural fairness. Practical implications: The early identification of communication support needs for prisoners and victims attending an oral hearing is essential. The PB should raise awareness with the PB Membership about the role of intermediaries. The PB should continue to develop guidance and policy surrounding intermediaries. Prison lawyers and HM Prison and Probation Service may require specialist training in identifying communication needs in vulnerable prisoners and identifying when a communication specialist might be required for an oral hearing. Originality/value: To the best of the authors' knowledge, this is the first published paper examining the role of intermediaries at PB oral hearings. While the subject of populism receives increasing scholarly attention from both political scientists and criminologists, so far these two bodies of literature have existed mostly in isolation of each other. This paper aims to connect them by investigating whether parties that political scientists describe as populist are likely to evince positions on criminal justice that criminologists describe as populist. Relying on a secondary data analysis comparing mainstream right-wing and populist right-wing parties for 131 elections in 24 countries since 1973, this paper concludes that the populist right on average expresses slightly more support for penal populism than the mainstream right, but that its positioning is crucially shaped by considerations relating to issues of immigration and multiculturalism. These findings suggest that most contemporary populist parties on the right primarily pursue a nativist agenda and will only invoke penal populism when it fits this overall strategy. Artificial Intelligence (AI) can be very beneficial in the criminal justice system for predicting the risk of recidivism. AI provides unrivalled high computing power, speed, and accuracy; all harnessed to strengthen the efficiency in predicting convicted individuals who may be on the verge of recommitting a crime. The application of AI models for predicting recidivism has brought positive effects by minimizing the possible re-occurrence of crime. However, the question remains of whether criminal justice system stakeholders can trust AI systems regarding fairness, transparency, privacy and data protection, consistency, societal well-being, and accountability when predicting convicted individuals' possible risk of recidivism. These are all requirements for a trustworthy AI. This paper conducted a systematic literature review examining trust and the different requirements for trustworthy AI applied to predicting the risks of recidivism. Based on this review, we identified current challenges and future directions regarding applying AI models to predict the risk of recidivism. This research paper explores the critical issue of resocialization and rehabilitation of convicted individuals within the criminal justice system of the Republic of Kosovo. Crime is a phenomenon that threatens society according to external and internal negative factors. It affected the functioning of security, the social environment, and the economy in modern society for years. State institutions and civil and academic society must be engaged to have activities adequate for the resocialization, and re-education of persons convicted of criminal offenses. At the same time, preventive measures should be taken to avoid criminal behavior for which behavior then only unconditional measures should be taken, which is Prison. The paper proposes evidence-based recommendations for policymakers, correctional institutions, and community stakeholders. The electronic monitoring of offenders is an increasingly popular technique in the criminal justice system. Worldwide, these systems are effectively utilized to monitor individuals on probation as they serve their sentence within the community. The use and significance of electronic monitoring systems are increasing day by day in Türkiye. This paper presents a complete ensemble empirical mode decomposition with adaptive noise and kernel-based meta-extreme learning machine hybrid forecasting model using data on active offenders convicted of different crimes between 2013 and 2021 in Türkiye. Thanks to the proposed model, it is aimed to plan the equipment that will be needed and to provide optimal system management by observing the development of electronic monitoring systems in Türkiye. To validate the proposed model, it is compared with some state-of-the-art models. The superiority of the proposed model is shown using some performance metrics. Moreover, the current status of electronic monitoring systems in Türkiye from the past to the present is shown statistically. Purpose: The UK Mental Health Act (MHA) Reform (2021) on race and ethnicity promotes new governmental strategies to tackle inequalities faced by ethnically racialised communities detained under the MHA. However, there is a scarcity in personality disorder and ethnicity research. This study aims to investigate what is available in the UK in relation to prevalence, aetiology and treatment provisions of personality disorder for ethnically diverse patients, and to understand their interconnectedness with mental health and criminal justice service provisions. Three key areas of investigations were reviewed, (1) UK prevalence of personality disorder amongst ethnically diverse individuals; (2) aetiology of personality disorder and ethnicity; (3) treatment provisions for ethnically diverse individuals diagnosed with personality disorder. Design/methodology/approach: A scoping study review involved a comprehensive scanning of literature published between 2003 and 2022. Screening and data extraction tools were co-produced by an ethnically diverse research team, including people with lived experience of mental health and occupational expertise. Collaborative work was complete throughout the review, ensuring the research remained valid and reliable. Findings: Ten papers were included. Results demonstrated an evident gap in the literature. Of these, nine papers discussed their prevalence, three papers informed on treatment provisions and only one made reference to aetiology. This review further supports the notion that personality disorder is under-represented within ethnic minority populations, particularly of African, Caribbean and British heritage, however, the reasons for this are multi-facetted and complex, hence, requiring further investigation. The evidence collected relating to treatment provisions of personality disorder was limited and of low quality to reach a clear conclusion on effective treatments for ethnically diverse patients. Originality/value: The shortage of findings on prevalence, aetiology and treatment provisions, emphasises the need to prioritise further research in this area. To this purpose, McMillan employs the life experiences and legal struggles of Nova Scotia Mi'kmaw figure Donald Marshall Jr. to shed light onto the traditional tenets of Mi'kmaw legal consciousness and traditional justice principles as an alternative to the Canadian and Nova Scotian legal and justice systems, which are defendant-centered and focus mainly on punitive measures and, therefore, deemed ineffective in addressing the relationship and encounters that Indigenous Canadians have had with the law. I Truth and Conviction i offers an illustration and unique discussion of the Mi'kmaw First Nation's legal consciousness, which is revealed as grounded in traditional values prioritizing the restoration of relationships among all parties involved in a dispute and the healing of the whole community; furthermore, the book outlines the initiatives that the Mi'kmaw First Nation has recently taken to increase its participation in the workings of the Canadian and Nova Scotian justice systems in an attempt to decolonize them. With the recent surge of mob justice in South Africa, this paper investigates whether recourse to mob justice serves a legitimate purpose and especially whether it serves justice or falls within the conceptual meaning of justice. In so doing, the paper undertook a literature review in view first to identify the possible causes of mob justice and whether or not mob justice serves a legitimate purpose in society. The literature reveals that mob justice aims to ensure security and maintain social order due to state inefficiency to provide security to its citizens. Mob justice becomes a mechanism of social control, policing, and society's expression that the criminal justice system has failed. However, the paper could not find any related literature on the question whether mob justice falls within the philosophical concept of justice. It finds that the current discourse on mob justice literature focuses on the social and economic aspects of mob justice, delving into the possible reasons behind the attacks, or the legal aspects of mob justice. The paper is therefore relevant as its objective is to determine whether mob justice meets the conceptual meaning of justice and if there is a place for such conduct within a constitutional society. The paper found that mob justice falls short of the philosophical understanding of justice and is no more than injustice. Purpose: Research on intimate partner violence (IPV) is generally focused on female survivors. However, in Canada, about half of all self-reported victims of IPV are men and 1 in 5 calls to police for domestic violence are for male victims. This paper takes a comparative approach to understanding survivors' experiences of IPV. Methods: Across Canada, 110 female and 45 male survivors of IPV were recruited through media, social media, and listservs for a survey and interviews in 2017. Results: Findings indicate areas of similarity (healthcare needs; difficulty accessing formal support; fear of false accusations) and areas of difference (availability of formal support; types of violence experienced most often; interactions with the justice system). Women and men reported similar types of IPV, with women experiencing higher rates of sexual violence, stalking, and damage to property. Women and men reported similar physical and mental health consequences following IPV. Men were less satisfied than women with the response of the justice system, and both female and male participants encountered gender bias within the justice system. Some women reported being turned away from services that were at their maximum capacity, and men reported difficulty identifying IPV-related services for male survivors. Conclusions: Findings can be used by frontline service providers and the justice system to ensure that services are gender-inclusive and gender-sensitive. [ABSTRACT FROM AUTHOR]

Through a normative juridical approach and qualitative analysis of legal documents and literature, the study underscores the importance of enhancing understanding and skills among law enforcement agencies, particularly the Attorney General's Office, in effectively applying restorative justice principles. By upholding values of justice, decency, and morality, the Attorney General's Office can play a pivotal role in fostering a more humane and efficient criminal justice system that serves the interests of society as a whole. This paper examines the multilayered dynamics behind the drivers of overdose deaths, criminal legal-system involvement, and the drug war infiltration of people's everyday lives—especially for people under community supervision. While incarceration receives more media and academic attention because of its particular cruelty, almost twice as many people—3.7 million, or one in every sixty-nine U.S. adults—are under community supervision. Probation and parole are commonly understood as "alternatives to incarceration" or "lenient sentences," but people on supervision must endure constant monitoring, perpetually under the threat of incarceration. Drug war policies and practices have profoundly shaped probation and parole. Regardless of someone's original sentence, abstinence from drugs, drug testing, submission to warrantless searches, and court-ordered treatment are routine features of supervision. The putative goal of community supervision is to ensure successful reintegration; yet drug war surveillance enacts extensive barriers, while not reducing drug use or drug-related harms like overdose. In order to ensure health, financial security, and overall well-being of those under supervision, policymakers, probation and parole officers, clinicians, service providers, and researchers must work to identify and remove barriers to care, including routine drug testing, substandard or forced substance use disorder treatment, and poor-quality services and support. The First Information Report (FIR) serves as the foundation for criminal trials. The Station House Officer(s) (SHO) of the investigation agency is under an obligation to promptly register an FIR whenever any information regarding the commission of a cognizable offence comes to their knowledge, whether orally or in writing. However, they often refuse to do so or delay its registration. Consequently, victims or informants must resort to courts against this action of SHO. This research paper deals with a very important legal question: whether an SHO can refuse or delay the registration of an FIR in a cognizable offence. It also explores whether an SHO can inquire into the truthfulness of the information without first registering it. This research concludes that SHOs have no discretion in this matter. The informant or victim has the right to register an FIR. This should be accepted by the investigation agency. They need to be trained. Its recognition should be unequivocally declared by police authorities through issuing necessary directions to SHOs. Online FIR system can be a vital solution.
