This article aims to technically analyze the Degraded Area Recovery Projects (PRADs) submitted in the Regional Environmental Prosecutor's Office of the South Recôncavo of the Public Ministry of the State of Bahia, in progress in February 2020. Conduct Adjustment Term that required PRAD were counted and the date of signature, in order to certify the fulfillment of the deadlines. A technical analysis of the content of the PRADs that had been delivered was carried out, according to the basic requirements contained in the Normative Instruction Brazilian Institute of the Environment nº. 04, of April 13, 2011. Only 4% of the projects fully met the technical requirements for the preparation of PRADs. Environmental recovery through PRADs lacks efficiency, since most of the projects analyzed in this work have not been properly prepared and based on technical form and criteria. Considering the presence, in contemporary society, increasingly expressive of structural disputes characterized by multipolarity, complexity and conflict, it becomes necessary to seek the most appropriate way to resolve such conflicts, which is, therefore, the objective of the present work. The research is justified in view of the importance that the law remains sensitive to changes in society and is able to adequately resolve existing conflicts. In order to do so, it was firts approached the introductory notions about structural disputes and, later, expose the five possible ways of dealing with such conflicts. The deductive method was used from the bibliographic review of important national scholars, documental research through the examination of legislative documents of the Brazilian legal system, as well as research in primary source. In the course of the work, it was found that the term of conduct adjustment has greater potential to resolve structural disputes when compared to the other alternatives. [ABSTRACT FROM AUTHOR]

Behavior Adjustment Term (BAT) has been employed in Brazilian law as a reparation tool for environmental damage. Although it is a fast mechanism for the attribution of environmental civil accountability, it is highly relevant to analyze whether BAT complies with the prevention of new environmental disasters. A research based on the Environmental Disaster Law investigates the preventive function of BAT in environmental disasters using as parameter the terms employed in the cases of dam rupture in Minas Gerais in 2015 and 2019. The preventive function and environmental reparation are underscored through environmental civil accountability. This paper examines the context of corruption and the performance of the Public Prosecutor in combating improbity practices, whose results are not always effective in the social objective, due to costs and slowness, so that it is necessary to use negotiated settlement methods conflicts to guarantee the rights to be protected, which apparently conflicts with art. 17, §1º, of Law 8,429/1992. Thus, it is possible to conclude Terms of Adjustment of Conduct, based on the innovation brought by the MPPR through the Resolution 01/2017 and by the CNMP through the Resolution 179/2017, in order to restrain the commitment of improbity acts. Analyze the possibility of adoption the contract procedure in collective actions. Has verified the purpose of the institute and the space of negotiation present to the transindividual interests. Used the consolidated positions in relation to the Conduct Adjustment Term to the contract procedure. Has observed that the object of negotiation will not be the inalienable substantive law, but the circumstances for the effective protection of transindividual interests. Has included the need to extend the institute to the collective actions, as an instrument of access to justice.
