Background: Thailand has expressed interest in joining the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), a twelve-country plurilateral trade agreement whose original incarnation included the United States of America (USA). When the USA withdrew from this agreement, key intellectual property clauses relevant to pharmaceuticals were suspended. These could be reinstated should the CPTPP Parties decide to do so. Methods: This study uses two scenarios to cost the impact the CPTPP would have had on Thailand's 2020 hepatitis C treatment regime if Thailand joined the CPTPP and suspended clauses were reinstated. Results: Joining the CPTPP could have increased the cost more than tenfold if suspended CPTPP clauses were reinstated and Thailand was not willing or able to issue compulsory licenses. Based on the 2020 budget, the price for this possible scenario could have reduced hepatitis C treatment coverage by 90%. Conclusions: Acceding to trade agreements such as the CPTPP that require increasing intellectual property protection, could compromise Thailand's hepatitis C program and other national treatment programs reliant on affordable generic medicines. The CPTPP could also prevent Thailand from relying on its own pharmaceutical capabilities to manufacture medicines needed to sustain its treatment programs. [ABSTRACT FROM AUTHOR]

In order to reveal the current status and future trends of lubricant additives, this study analyzes the structured and unstructured data of 77701 lubricant additive patents recorded by Patsnap. The results show that China is the country with the largest number of patents in this field, and the United States is the main exporting country of international technology flow; the current research and development of lubricant additives is dominated by multifunctional composite additives; environmentally friendly additive compositions are the current research hotspot; and more environmentally friendly and economically degradable additives have more development potential in the future. Overall, this study provides a comprehensive understanding of the research and application of lubricant additives and contributes to the future development of the lubricant industry. This article presents an overview of Pfizer v. Sanofi Pasteur, a decision that continues the recent trend of Court of Appeals for the Federal Circuit (CAFC) toward tighter scrutiny of patent claims. The CAFC reaffirmed that an expectation of success in combining and modifying prior art need only be reasonable, not absolute. The results of Pfizer highlights a continued drift by the PTAB and courts toward stricter scrutiny of patent claims, both during prosecution of the claims and during later litigation of the claims. Although Spain was not a leading country in technology, it generated numerous innovations, which must be analyzed in order to understand its particular development trajectory. This paper makes a contribution in this line by quantifying the innovation activity of the country's business elite between c. 1870 and 1970. In addition, we have sought to verify whether some of the well-known debated dynamics of innovation over time are fulfilled in this case. First with a descriptive analysis and then through the VAR technique, it has been found that innovation occurred in waves, as Schumpeter pointed out despite Kuznets; major innovations were followed by incremental advances; process innovations predominated in the early stages of modern development and product innovations gained preponderance later; and that indigenous innovation favored the importation of technology. 'Structural characteristics' are gambling product design features which contribute to the amount of time or money that gamblers spend using them, such as the short pay-out intervals of electronic gaming machines (EGMs). However, it is important to also understand the structural characteristics of current online sports betting products, and how these products may continue to evolve via a forward-looking analysis of utility patents, given the increasing international popularity of this gambling mode. A scoping review of the emergent structural characteristics associated with online sports betting was conducted upon the literature (2015–2022), and of sports betting utility patents. A total of 26 literature records and 8 utility patents were included. Results indicated that online sports betting is instantly accessible, provides rapid and continuous betting opportunities, and offers user-interactivity via features such as 'cash-out' and the ability to instantly deposit funds. Additionally, the online sports betting market has expanded into adjacent industries such as esports. The included utility patents suggest that online sports betting may evolve by incorporating peer-to-peer competitive elements, augmented reality, and highly specific statistics/notifications. Overall, the online environment has transformed sports betting into a faster and more harmful gambling mode that provides a diverse range of features and betting opportunities. Agricultural mechanization plays a pivotal role in transforming the farming sector across the globe. The number of patents granted in the field of agricultural mechanization hold significance as they encourage innovation, protect intellectual property and drive technological advancements. The present study examined patents data collected from XLPAT database, wherein 500,000 records out of which 479,010 patent grants/applications were considered. Trajectory of patents during COVID pandemic showed there was an apparent downturn in both the quantity of patent applications submitted and the number of patents officially granted. Developed countries have exhibited varying trends in agricultural mechanization and patent activities. China, the United States and India stand as examples. China has rapidly adopted mechanization in its agriculture, contributing to higher yields and efficiency. The United States has a long history of mechanized farming, and its advancements in this field have greatly impacted global agriculture. The standardization of reaping and threshing offer better agricultural equipments by agricultural startups. Expansion of patents in farm mechanization has led to increased productivity, resource efficiency, equity for small and marginal holders, affordability, eco-consciousness and food security. The geography of urban innovation in the United States has often been portrayed as dominated by a few large cities. However, emerging perspectives challenge this notion by highlighting the significance of secondary cities for innovation processes. Unfortunately, prevailing narratives and empirical evidence focus on technological invention only, measured by patents. This study aims to reevaluate the geography of urban innovation by considering various phases of the innovation process and incorporating a broader range of innovation types. In addition to conventional patent metrics, this research suggests incorporating trademarks and design rights as complementary data. The findings reveal that large cities still exhibit prominence when examining absolute counts of innovation. Instead, analysing intensities allows the identification of secondary cities that specialise in various innovation activities beyond technological invention only. Overall, the findings provide compelling evidence that urban innovation in the United States is not limited to a few large cities nor is it solely driven by technological invention. Objective: The study aims to evaluate the usefulness of preoperative ultrasonography (US) at the internal inguinal ring level in predicting contralateral patent processus vaginalis (CPPV). Methods: This is a prospective study of patients who presented with unilateral inguinal hernia and underwent laparoscopic hernia repair and contralateral side exploration. The gender, age, initial presenting side, and the preoperative width of the low echoic region at the internal ring (WLIR) of the contralateral side that was determined using US and laparoscopic findings were recorded. The preoperative diagnosis of CPPV was considered if the WLIR is > 4 mm. We compared laparoscopic with US findings. Results: This study included 30 patients with a median age of 3.5 years (range, 25 days to 10 years), with 3 females and 27 males. The preoperative US and laparoscopic diagnoses of the contralateral side were concordant in 19 (63.3%) and discordant in 11 (36.6%) patients. US showed a sensitivity of 50.00%, specificity of 72.22%, and accuracy of 63.3% in diagnosing CPPV. Conclusions: Measuring the WLIR by US was inadequate for an accurate CPPV diagnosis in our study. Synthetic sunscreen offers protection against excessive exposure to ultraviolet (UV) radiation from the sun, and protects the skin from possible damage. However, they have low efficacy against the formation of reactive oxygen species (ROS), which are highly reactive molecules that can be generated in the skin when it is exposed to UV radiation, and are known to play a role in oxidative stress, which can contribute to skin aging and damage. Thus, there is an ongoing search for sunscreens that do not have these negative effects. One promising source for these is natural products. Therefore, the current patent review summarizes topical formulations made from natural compounds that have antioxidant properties and can be used as photoprotective or anti-aging agents, either using a single natural extract or a combination of extracts. The review reports basic patent information (applicant country, type of applicant, and year of filing) and gives details about the invention, including its chemical composition, and the in vitro and in vivo tests performed. These patents describe natural products that can be used to protect the skin and validate their efficacy, and safety, in addition to standardizing their formulations. The compositions described illustrate the consistent innovation in the use of natural products to protect against UV damage and photoaging disorders, a promising field which is receiving growing global recognition. A lion roars just before a film rolls. A doughboy giggles. A giant green man laughs a hearty, "Ho, Ho, Ho." These iconic sounds are all federally registered as trademarks. They identify specific brands and distinguish their products and services from the competition. Human brains treat sounds like these as categorization tools and cognitive shortcuts--ideal trademark symbols. But what about the sounds your favorite toys or electronic devices make? Or those made by a fictional character in the latest blockbuster? This Article tackles these issues and others. We push back against the widely-held belief that all unconventional trademarks--product designs, colors, scents, flavors, and sounds--are conceptually similar and collectively less likely to receive trademark protection. First, we review scientific literature on how humans process sound. Next, we explain how trademark law sorts sounds compared to other unconventional symbols in determining whether they may be protected as trademarks. Third, we empirically analyze the prosecution of sound marks before the United States Patent and Trademark Office over the past four decades, showing how different categories of sound mark applications fared in the federal registration process. Contrary to the common assumption that all unconventional marks face similar barriers to publication and registration, sound mark applications are much more likely to be successful than those for other unconventional marks--approaching the success rates for word mark applications. At the same time, sound marks are not a homogeneous category. They are a large, varied set. Sometimes categories of sound marks succeed with the high frequency typical of word marks, but others must overcome the more exacting standards of product design trade dress. After exploring reasons for this difference and other dynamics revealed in our empirical research, we conclude with recommendations for scholars, practitioners, and policymakers interested in the untapped power of sound marks. Air pollution is caused by the presence of polluting elements. Ozone (O3), carbon monoxide (CO), carbon dioxide (CO2), nitrogen dioxide (NO2), sulfur dioxide (SO2), and particulate matter (PM) are the most controlled gasses because they can be released into the atmosphere naturally or as a result of human activity, which affects air quality and causes disease and premature death in exposed people. Depending on the substance being measured, ambient air monitors have different types of air quality sensors. In recent years, there has been a growing interest in designing drones as mobile sensors for monitoring air pollution. Therefore, the objective of this paper is to provide a comprehensive patent review to gain insight into the proprietary technologies currently used in drones used to monitor outdoor air pollution. Patent searches were conducted using three different patent search engines: Google Patents, WIPO's Patentscope, and the United States Patent and Trademark Office (USPTO). The analysis of each patent consists of extracting data that supply information regarding the type of drone, sensor, or equipment for measuring PM, the lack or presence of a cyclone separator, and the ability to process the turbulence generated by the drone's propellers. A total of 1473 patent documents were retrieved using the search engine. However, only 13 met the inclusion criteria, including patent documents reporting drone designs for outdoor air pollution monitoring. Therefore, was found that most patents fall under class G01N (measurement; testing) according to the International Patents Classification, where the most common sensors and devices are infrared or visible light cameras, cleaning devices, and GPS tracking devices. The most common tasks performed by drones are air pollution monitoring, assessment, and control. These categories cover different aspects of the air pollution management cycle and are essential to effectively address this environmental problem. [ABSTRACT FROM AUTHOR]

This paper proposes to scrutinise the evolution of technological diversification of organisations whose activities are mainly nanotechnologies. We resort to the InnoVue search platform to gather patent information related to the world's largest intellectual property organisations. We apply a five-step analysis on a panel dataset of 16042 distinct patents published between 1985 and 2020 and recorded on June 29, 2021. Text mining has been employed to explore key topics with high-level technological activeness, while a trend analysis has been applied to study diversification characteristics and evolution patterns. Moreover, we initiate spatial autocorrelation modelling to detect spatiotemporal patterns of technical innovation in nanotechnology. Results show that nanobiotechnology and nanophotonics have become new technical hotspots over the last decade. Furthermore, spatial analysis returns a significant clustered pattern among nanotechnology patent distributions and shows that nanotechnology activities were mainly concentrated in Asian countries during the period under study. The number of patents increases quickly, while more and more low-quality patents are emerging. It's important to identify high-quality patents from massive data quickly and accurately for organizational R&D decision-making and patent layout. However, due to low percentage of high-quality patents, it is challenging to identify them efficiently. In order to solve above problem, we reconstruct the existing index system for identifying high-quality patents by adding 4 features from technological strength of patentees. Furthermore, we propose an improved model by integrating resampling technique and ensemble learning algorithm. First, generative adversarial networks (GAN) are used to expand minority samples. Second, Extreme Gradient Boosting algorithm (XGBoost) with Bayesian optimization (BO) is used to identify high-quality patents. For clarity, this model is called a GAN-BO-XGBoost model. To test the effectiveness of above model, we use patent data in field of lithography technology. Tenfold cross-validation is carried out to evaluate the performance between our proposed model and other models. Background. Several studies have assessed the safety and efficacy of acupuncture, but none have reviewed patent trends related to acupuncture as an intervention. This study analyzed trends in patents for the development of acupuncture-related technologies in Korea. Methods. The Korea Intellectual Property Rights Information Service (KIPRIS) was searched for information on acupuncture-related patents registered until August 11, 2021, without any limit on the search period. Only acupuncture and electro-acupuncture were included in this review. The current status, contents, and technological characteristics of the relevant patents were analyzed systematically to identify the overall status of acupuncture-related patents. Results. Overall, 126 patents were identified from the KIPRIS database, of which 93 were unrelated to the research topic and were excluded. Finally, 33 patents were assessed. Interest in the development of acupuncture technology has increased steadily over the past decade. Patent applications reached their peak in 2018 with six instances, while patent registration peaked in 2019 with seven instances. The interval between the application and registration of an individual patent was 14.3 months (449 days). Twenty-two acupuncture-related patents were for acupuncture (66.6%) and 11 for electro-acupuncture (33.3%). The technical specifications for the patents included acupuncture devices (30.3%), acupuncture manufacturing methods and equipment (36.4%), and electro-acupuncture devices (33.3%). Conclusion. Acupuncture-related technology currently focuses on technological advancements for the safe and effective delivery of stimulation. The findings demonstrate trends toward new diverse and complex technological advancements for acupuncture devices, manufacturing methods and equipment, and electro-acupuncture devices. For assessing the overall impact of Artificial Intelligence (AI), it is crucial to continuously monitor large corporations. This paper delves into the examination of 42 corporations that rank among the world's largest investors in R&D, accounting for over one-third of AI patents globally. The focus is on their post-patenting performance, specifically in terms of employment changes, and comparing it with the outcomes of 42 similar companies operating in the same sectors. The latter also recorded substantial levels of R&D expenditures but were not significantly involved in AI patenting. The key findings reveal that, in the medium – and high-tech manufacturing sectors, companies with the highest proportions of AI patents incurred in employment reductions. Conversely, IT services companies experienced substantial employment growth. Along with tentative explanations of these findings, advantages, limitations, and possible developments of this type of analysis are illustrated in the concluding section. [ABSTRACT FROM AUTHOR]

Background: On July 4, 2021, China officially introduced the drug patent linkage system, which has made more localized adjustments than have similar systems in the US and South Korea. This study describes the characteristics and outcomes of China's patent linkage system. Methods: For this study, we used the database of China's patent information registration platform for marketed drugs to capture all listed patents and patent certifications from June 25, 2021, to June 30, 2023. We used descriptive statistics for the above data to assess the impact of patent linkage on branded drug manufacturers, generic drug manufacturers, and the public's access to medicines. Results: During the study period, the patents of 632 branded drugs were listed, and 5058 ANDAs submitted patent certifications to the Registration Platform. Of these 632 branded drugs, 462 (73.1%) drugs were approved before the year of patent registration, and the average number of listed patents per drug was 1.8, with a standard deviation of 1.4. However, of these 5058 ANDAs, P1 certifications accounted for 85.1%, and P3 and P4 certifications accounted for 16% combined. In addition, according to the detailed statistics of P2 certifications, we found that the proportion of patent invalidation cases was 46.4%. The remaining validity of the patents corresponding to P3 certifications was longer, with a median value of 17 months, and the IQR was 10-30.75, ranging from − 2 to 204 months. Conclusions: China's patent linkage aims to promote the balance of multiple interests —innovation, imitation and public health—and has its own system characteristics. Patent listing and patent certification are the key indicators reflecting the implementation effect of the system. From the perspective of system outcomes, ANDAs have been connected to the patent linkage system in an orderly manner, but the growth of patent challenges is not obvious. The most fundamental requirement of patent law is that a patented invention must be new. Given the longstanding, foundational nature of this novelty requirement, one might expect its contours to be well settled. Yet some of its most basic aspects remain unresolved. At the center of these unresolved issues lies what we term "real-world prior art. In patent law, prior art is something that predates an invention and may render it not new. "Real-world" prior art activities involve using or selling embodiments of the invention. Consider a few examples. Suppose Aleida demonstrates her invention to members of the public but does not allow them to touch it. Has she put the invention into "public use," thus preventing others from obtaining a patent? Suppose Aleida keeps her invention secret but uses it to provide a commercial service. Has she put the invention into public use or placed it "on sale"? Or suppose Aleida offers her invention for sale to Charlise, who declines to purchase it. It is black-letter patent law that after one year passes, Aleida cannot patent this invention. But imagine that Bruno independently develops the same invention. Can he obtain a patent? These questions are not outlandish law school hypotheticals--they are central issues surrounding whether an invention is or is not novel. Yet litigation over these issues has resulted in conflicting outcomes and contradictory explanations, leaving lower courts and the Patent Office to flounder. In this Article, we sort through this conceptual confusion and propose both doctrinal and institutional changes to elucidate this area of law. We argue that the value of resolving these questions runs much deeper than determining the answer to particular cases. The answers to these questions depend upon--and reveal--the conceptual superstructure of patent law. They implicate patent law's most central questions: What does it mean for an invention to be new and thus patentable? What policy interests does patent law attempt to achieve, and whose interests does it aim to protect? And what are the conditions under which a party has forfeited the opportunity to obtain a patent? The digitization of the US Patent and Trademark Office's (USPTO) backfile of six million patents undertaken between 1951 and 2001 was a five-decade struggle, featuring several media transitions from print and microfilm to CD-ROMs and, finally, the Web. This mass digitization project is on a similar scale to Google Books and the Internet Archive, but it is rarely discussed within critical digitization scholarship or for its significance as a tool for knowledge production. In this article, I focus on the USPTO's patent document's digital and physical material form and how the current paradigm of access and storage of the digital backfile emerged. Through this case study, I build upon Ian Milligan's distinction between the 'text' and 'platform' layers of a digitization project to demonstrate how historical decisions regarding format and metadata continue to influence how users retrieve and interpret documents, such as patents, online. This article takes 43,753 patents collected in the Derwent database from 2011 to 2020 as data samples and studies the intellectual structure and evolution of the three-dimensional (3D) printing field in two time periods of 2011–2015 and 2016–2020. We compare the performance of the first-inventor patent classification codes coupling analysis and all-inventor patent classification codes coupling analysis in detecting the intellectual structure of the technical domain. We obtain the following findings: (1) Both methods, the first-inventor patent classification codes coupling analysis and the all-inventor patent classification codes coupling analysis, can show the intellectual structure of the 3D printing field. However, the first-inventor patent classification codes coupling analysis outperforms all-inventor patent classification codes coupling analysis in the detection of basic research; while all-inventor patent classification codes coupling analysis is more sensitive in emerging and interdisciplinary topics. (2) Three-dimensional printing has been evolving in the last decade. While the field has retained the research themes of the previous phase in the last 5 years, several new research themes have also emerged. The most prominent feature of this field is the development and integration of the previous phase's topics. (3) The research direction of the top 20 inventors in the average coupling frequency ranking is consistent. The keyword extraction of patents is crucial for technicians to master the trends of technology. Traditional keyword extraction approaches only handle short text like title or claims, but ignore the comprehensive meaning of the description. This paper proposes a novel patent keyword extraction method based on corpus classification (PKECC), which simulates the patent understanding methods of human patent examiners. First of all, a corpus classification model based on multi-level attention mechanism adopts the Bert model and hierarchical attention mechanism to classify the sentences of patent description into four parts including technical field, technical problem, technical solution, and technical effect. Then, the proposed keyword extraction method based on the fusion of BiLSTM and CRF is incorporated to extract keywords from the four parts. The proposed PKECC simulates understanding style of patent examiner by extracting keywords from the description. Meanwhile, PKECC may reduce the complexity of extracting keywords from a long text and improve the accuracy of keyword extraction. The proposed PKECC is compared with 5 traditional or state-of-the-art models and achieves better accuracy, F1 score and recall rate; its recall rate is above 62%, its accuracy reaches over 84%, and the F1 score arrives at 69%. The Inflation Reduction Act of 2022 (IRA) allows the Medicare program to negotiate drug prices beginning in 2024. Based on the guidance in the statute, CMS has selected specific data items to use to adjust initial price offers for 10 drugs in the decision-making process. Although much of the data are publicly available, some of these data items will need to be collected directly from drug companies. A 2019 US House of Representatives Committee on Oversight and Accountability investigative report collected a wide range of data from manufacturers of 12 high-revenue drugs that show what is available from the drug companies, including development costs, marketing, pricing, competition, and patent status. This article focuses on the data obtained for ibrutinib, an oral medication for treating hematologic malignancies, which is one of the only drugs reviewed by the committee that also has been selected for Medicare price negotiation. We examine data that can be obtained only from the drug manufacturer that the IRA has explicitly identified as being used to determine the price and suggest potential negotiation strategies for CMS in response. The production of vaccines for COVID-19 has been far from ideal in terms of meeting world demand, thereby mitigating the infections and deaths caused by the pandemic. Part of the reason production has been inefficient is that those pharmaceutical companies that own the vaccine do not have sufficient productive capacity to meet demand. Resultantly, many have advocated for waiving patent rights to the vaccine so it can be massively produced worldwide. Pharmaceutical companies and their advocates have opposed this waiving of patent rights. In this article, I respond to the arguments that oppose waiving patents and contend that there is a case for temporarily waiving them. Mainly, I present a negative argumentative strategy that upholds the view that patents ought to be waived. Cancer remains one of the primary factors leading to premature death in humans. Conventional therapeutic approaches result in significant harm to normal tissue cells and impede the effective treatment of cancer. In recent years, the benefits of inorganic nanomaterials in cancer research have become increasingly evident, and they are expected to provide new ideas for diagnosing and treating cancer. This study aims to reveal the technological trajectory and important applications of inorganic nanomaterials in cancer diagnosis and treatment better to understand their technological development trends and technical priorities. A patent citation network was constructed to find the milestone patents of inorganic nanomaterials in the field of cancer by main path–derived path analysis, and a citation analysis method based on the PageRank (PR) algorithm was used to identify the high PR value patents of inorganic nanotechnology in cancer. The study found that the overall technological development trajectory of inorganic nanomaterials in cancer is linear, with a focus on enhancing technical aspects such as biological detection and imaging, drug delivery, phototherapy, magnetic hyperthermia, and radiotherapy, progressively enhancing the diagnostic and therapeutic effects, and realizing the integration of diagnosis and treatment. Gold nanomaterials are essential in cancer diagnosis and treatment. Carbon-based nanomaterials, magnetic nanomaterials, upconversion luminescent materials, copper-based nanoparticles, quantum dots, and other inorganic nanomaterials will become significant R&D directions. The citrus essential oil isolation has vast potential to valorize waste from the agro-industrial and food sectors. The objective of this work was to develop a review of patents on essential oil isolation systems from any plant and citrus essential oil isolation systems and/or methods. The technological search was carried out in the patent databases of Espacenet, Patentscope, Scopus, ScienceDirect, Google Patents, LENS ORG, and USPTO from 2000 to 2021. The results highlight that most of the inventions are from China and consist of isolation methods for citrus essential oil. The USA´s inventions stand out as systems that can be produced on a larger scale. The patent shares of the educational and private sectors are 26% and 74%, respectively. About 10.53% of patents protect commercially exploited products. Finally, an opportunity was detected to protect methods and/or systems that integrate renewable energy technologies. Following a request from the European Commission, EFSA was asked to deliver a scientific opinion on the safety and efficacy of Patent Blue V as a sensory feed additive for non‐food‐producing animals. The additive is already authorised for use with non‐food‐producing animals. The applicant has not provided evidence that the additive currently on the market complies with the existing conditions of authorisation. The FEEDAP Panel cannot conclude whether the additive remains safe for the target species due to the non‐compliance with the specifications and the lack of adequate data on the potential aneugenicity of the additive. In the absence of data, the FEEDAP Panel cannot conclude on the potential of the additive to be a dermal and eye irritant nor a dermal and respiratory sensitiser. Since the potential genotoxicity of the additive was not ruled out, the exposure to the additive of the unprotected users should be minimised. It is often said that the standards for patent protection are higher than the standards for copyright protection. Specifically, commentators assert that the copyright requirement of originality is easier to satisfy than the patent requirements of novelty and nonobviousness. And yet, the USPTO regularly grants patents for designs that fall below the low standard of copyright originality set by the Supreme Court in Feist v. Rural. Some may suggest that the existence of these "sub-Feist" design patents is a result of the USPTO abandoning its duty to scrutinize design patent applications. Or they may suggest that it is a result of the Federal Circuit making it more difficult to invalidate designs as anticipated or obvious. This Article argues that sub-Feist designs exist because the standard for "originality" (at least, in the sense of "minimal creativity") is not really "lower" than novelty or nonobviousness--it's just different. This has implications for how we think about the law and theory of copyright and patents as well as specific implications for design patent law and practice. Importantly, this suggests that we should take the word "original"--which is also an explicit statutory requirement for design patents--seriously. We should not assume that a design that qualifies, under the Patent Act, as "novel" and "nonobvious" is also "original" under the Feist standard. And if, as the Supreme Court has held, the Feist originality standard is a requirement of the Progress Clause, we should not let applicants use design patents to evade that requirement. Sustainable intensification (SI) responds to the concurrent challenges of increasing food production while reducing the environmental impacts of agriculture. As an early disclosure of innovation, patents are a useful indicator of technology market potential. However, we lack understanding of the extent to which current agricultural technology patents relate to the goals of SI and which kinds of technologies can potentially address SI. Here, we analyzed the diffusion and focus of more than one million patents issued during the period 1970–2022. We explored the degree to which the patents relate to SI through the co-occurrence of efficiency and environmental friendliness targets. Our results reveal that while the rate of patent issuance has dramatically increased over the past five decades, the rate at which patents diffused to different countries had decreased over time. The USA was the biggest net exporter of patents and had produced by far the most high-impact patents (in the top 1% most-cited patents). Since 1970, only 4% of agricultural patents and 6% of high-impact patents were related to SI targets (i.e., promoting both agricultural efficiency and environmental friendliness), but the attention to SI has increased over time. The most highly cited SI-related patents had become more diverse over time, shifting from digital, machine, and energy technologies in 1980s to the current era of agroecology, information, and computer networking. Our results provide an early indication of promising technologies that may play a greater role for SI in the future, subject to the challenges of market transfer and farm adoption and complemented by non-technological innovations in farm management and institutional support. Scientific papers and patents are reliable sources of knowledge carriers for measuring science and technology advances, predicting technological trends, and formulating technology strategies. Although the idea of entirely using the two knowledge carriers is rapidly emerging in academic discussion, a theoretical framing of the comparisons is still not present in literature. This study conducts bibliometrics on 2986 patent families and 4755 scientific papers related to silicon carbide metal–oxide-semiconductor field-effect transistor (SiC-MOSFET) to identify its technological trends and compare the similarities and differences in knowledge generation and diffusion in science and technology. Our methodological framework consists of a combination of geographic distribution (identifying the research developments and distribution), cooperation networks (analyzing organisation collaboration and individual research cooperation), noun phrase co-occurrence clusters (discovering hot research topics), and the global main path analyses of citation networks (tracking the trajectory of knowledge flows). Ultimately, our results contribute to recent bibliometric paradigms beyond discovering the role of scientific papers and patents in promoting science and technology integration. This study investigates the intangible assets related to the circular economy, defined as 'circular patents', that are classified and measured to be bundled into the innovation capabilities of a firm. The impact of a business's capabilities on its level of circular patent activism is empirically analysed in this study in a theoretical framework of dynamic capabilities. To this end, a model of the cause-and-effect relationship between the circular patents held by firms and their capabilities is designed using partial least squares structural equation modelling (PLS-SEM) and is tested using a sample of 120,406 patents in 2216 Spanish companies. In this analysis, patents that can foster the sharing economy and the circular economy in sensu latu are also considered circular patents, in addition to waste patents and other green patents, offering an enhanced measurement of the intangible assets related to the circular economy. Based on these results, this study provides new insight of how accounting can enable or constrain the transition to a circular economy business model through the measurement and valuation of related intangible assets and the specific business' capabilities in an environmental management framework. Technological development and environmental patents have become one of the policy options to solve the problem of global warming. With the development of technology, waste recycling can be faster and more environmentally friendly, which can contribute to the reduction of greenhouse gasses. The question of which patents and technologies should be promoted for waste management is an important decision-making and research topic. Given the increasing importance of ecological patents and waste disposal for environmental sustainability, this study examines the impact of technological progress on reducing waste-related greenhouse gas (WGHG) emissions in BRIC countries. The study considers energy generation and transmission-related patents (EPAT), patents to prevent pollution in the production process of goods (GPAT), and waste management-related patents (WPAT) as technological progress indicators. Methodologically, the study the applies novel quantile-on-quantile regression (QQ), Granger causality-in-quantiles (GQ), and quantile regression (QR) for the period from 1997m5 to 2019m12. The findings demonstrate that at higher quantiles, (i) EPAT have a dampening effect on WGHG in Brazil and India; (ii) GPAT have a diminishing effect on WGHG in Brazil, Russia, and India; (iii) WPAT have a diminishing effect on WGHG in Brazil, Russia, and India. Overall, technological progress contributes to WGHG emissions reduction in Brazil and India, while EPAT is not beneficial for Russia, and China cannot benefit from patents. This Article exposes a harmful form of advertising that exploits government actions like patent issuances, FDA authorizations, and trademark registrations. By calling upon the symbolic power of such regulatory approvals--i.e., "conjuring the flag"--marketers deceive consumers, distort competition, and undermine administrative agencies. Using machine-learning techniques to analyze hundreds of ads across multiple media formats, this Article offers the first comprehensive analysis of this pervasive practice. The study reveals that it is especially prevalent in industry settings where consumers are likely to seek reassurance that a product is safe and effective. Specifically, the examples examined show that patents are mentioned frequently in ads for supplements, cleansers, cosmetics, insect sprays, and hair products. It also shows that the USPTO contributes to the problem by registering trademarks that incorporate regulatory references. Consumer protection laws and regulations have failed to curb this practice, as advertisers have found subtle and legally permissible ways to manipulate consumer perception. This Article proposes two legal reforms to empower the FTC to address this issue more effectively, and suggests measures to better facilitate class action suits. Evaluation of high value patents is essential for the enterprise's technical layout and innovative product design. The existing research on the patent value needs the support of a large number of professional statistical information and is difficult to directly reflect the technical value. Since technological innovation is the fundamental means to enhance the sustainable competitiveness of enterprises. Therefore, a high-tech value patent evaluation and cultivation method for engineering designers need to be proposed. Firstly, the patent samples based on design methodology are retrieved and the indicators for evaluating technical value are summarized and the rationality of the evaluation indicators is verifier through empirical study based on improved evidence theory. Secondly, based on principal component analysis and factor analysis, a high-tech value patent evaluation and cultivation method is proposed. Finally, the proposed method is applied to identify the high-tech value patents in the cutting machine industry, and structural improvement is made based on this patent to demonstrate the cultivation process of high-tech value patents. The proposed method provides a clear guiding direction for the cultivation of high novelty patents and enterprise innovative product design. Technological upgradation is the driving force of social and economic development. Although technological upgradation is extensively needed, it is characterised as high intelligence, high investment, and high risk. In the face of complex market competition patterns, industrial enterprises urgently need to seek external cooperation and achieve sustainable competitive advantage. However, the current digital systems of patents fail to fulfil efficiency improvement from technology transfer to research and development (R&D) cooperation for industrial enterprise. Nor does it provide adequate support for industrial enterprises' technological upgradation. Therefore, this research proposes a systematic framework that combines nautral language processing (NLP) and machine learning (ML) technologies, including the patent recommendation model, patent transferability evaluation model, and research team detection model. Such a digital system of patents improves the efficiency of technology transactions and R&D cooperation with research institutions for industrial enterprises to identify related authorised patents and locate technology research teams. Objective: The aim of this review is to analyze the patent filings and to systematize the main technological trends in patent protection for the diagnosis and therapeutics for endometriosis. Patent literature has also been explored to identify active inventors and applicants in this field. Methodology: Patent search was carried out in the freely accessible patent search databases namely, patentscope using various combinations of the keywords "Endometriosis OR Adenomyosis" AND "Diagnostic OR Therapeutics" were used along with wildcard search queries in the "Title", "Abstract" and "Descriptions" fields. Results: A patent search revealed 144 patents describing inventions for diagnostic and therapeutic purposes of endometriosis. These patents include 26 patent applications in the diagnostic utility and 116 patent applications under the therapeutic approaches. Out of these 116 patent applications, 43 describe traditional medicines for endometriosis. Two patent applications describe inventions that can fall into both categories. Conclusion: Efforts are being made to improve current diagnostic instruments. Hormonal alteration methods is the most common field of invention, followed by surgical interventions for therapeutics. In 1796, American physician Elisha Perkins patented "metallick Tractors" for the treatment of various ailments, particularly those associated with pain. They were subsequently rapidly and widely disseminated in the United States and Great Britain based on testimonials and deceptive marketing tactics. Dissemination was facilitated by endorsements from prominent physicians, politicians, and clergymen; quasi-theoretical, handwaving explanations of efficacy based on Galvani's then-current experiments; and the procedure's apparent safety and simplicity. However, blinded placebo-controlled trials in Great Britain using sham devices demonstrated that the therapy was ineffective. In response, in the period from 1798 to 1806, Perkinists unleashed a barrage of disinformation (ad hominem attacks, misleading arguments, unethical propaganda tactics, and poetic and graphic satire) to sway public opinion in favor of the fraudulent therapy and against its critics. The disinformation slowed the abandonment of "tractoration", but higher-level scientific argumentation ultimately prevailed. The Perkinist disinformation campaign had antecedents with the Mesmerist disinformation campaign in the mid-1780s. Similar propaganda tactics are still widely employed to encourage the purchase and use of disproven or fraudulent therapies, as evidenced by propaganda from adherents of acupuncture in response to negative clinical trials and from supporters of unsafe and ineffective therapies promulgated during COVID-19. Biosimilar market launch delays are likely costing healthcare systems billions of dollars and preventing patients accessing affordable biologic therapies sooner. Many claim these delays are mostly caused by originator biologics' large patent portfolios asserted during litigation against biosimilar developers, particularly that the manufacturing patents filed after the originator is approved is an important driver of these delays. Our objective was to investigate the accuracy of these claims. We reviewed US Court document submissions for litigation data, including the details of patents asserted against biosimilar owners, and collated biosimilar market launch dates from publicly available databases. We find that, although approximately half of all patents asserted in litigation were manufacturing patents, a greater proportion of composition, active pharmaceutical ingredient, and treatment patents are associated with longer market launch delays, whereas a greater proportion of manufacturing patents are associated with shorter market launch delays. Our results suggest that manufacturing patents were having less of an impact on market launch delays than other types of patents. Our findings have implications for both biosimilar and originator developers, as well as patent policy and its association with healthcare accessibility. • Although it has been claimed that manufacturing patents filed after the originator is approved are a key driver of biosimilar market launch delay, we lack a detailed empirical understanding of the association between the number and types of patents asserted in litigation by originator owners in the United States and how that affects litigation outcome and length of biosimilar commercial market entry delay. • It was found, unexpectedly, that manufacturing patents were having less of an impact on market launch delays than other types of patents, which is contrary to current thinking. • These findings support greater efforts at exploring and addressing biosimilar market launch delays caused not just by manufacturing patents, but also active pharmaceutical ingredient, composition, and treatment patents and the broader implications for patent policy. In recent years, climate change has become more intense for society, and to mitigate this scenario, renewable energy sources have increased their installed capacity. In this context, green hydrogen, which can be obtained through water electrolysis, is considered one of the main alternatives to enable the replacement of fossil energy sources, acting as an energy vector to balance supply and demand for renewable energy. This study aims to mapping trends in direct seawater electrolysis technology by analyzing patents retrieved from the Derwent Innovations Index database between 1963 and 2022. As a result, 138 patent documents were identified and the analysis revealed an increase in patenting between 2016 and 2021 leading by China, South Korea, Japan, the United States, and the United Kingdom. The analysis also showed a trend towards research and development for electrocatalysts for direct seawater electrolysis in alkaline media, using materials not belonging to the platinum group metals. Background: Patent omphalomesenteric duct is one of the birth defects included in the spectrum of vitelline duct abnormalities. It is a rare anomaly with estimated prevalence of 0.13–0.2% in the general population. The most common presentation of patent vitelline duct is yellowish or mucoid type umbilical discharge which is usually noted in neonatal age or infancy. The main stay of diagnosis is clinical and outcome is favorable as long as timely surgical correction is offered. Here we present a 2 years old male child who presented with ileal prolapse through patent vitelline duct which is an exceptional mode of presentation of this pathology. Case presentation: 2 years old Ethiopian male child who was noticed to have umbilical discharge since early infancy presented with protrusion of pinkish mass per the umbilicus of 4 h duration. He had no signs and symptoms of bowel obstruction. Abdominal examination revealed a prolapsed bowel which was viable via the umbilicus which was about 6 cm long. Otherwise, he had no abdominal tenderness or rigidity. He was explored with a smiley incision just above the umbilicus. The prolapsed bowel was reduced gently to the abdominal cavity. The tract of the Patent vitelline duct was identified and completely resected along with a wedge of ileum at its base. Primary repair of the ileal end where the tract was inserted was done in two layers and abdomen was closed in layers. The child had smooth post op course and was discharged on the 4th post-operative day. Conclusion: Prolapse of a bowel through the umbilicus is unusual presentation of a rare anomaly namely patent vitelline duct. This presentation warrants early surgical intervention before bowel ischemia issues. Whey is well known to be nutritive and to provide significant nutritional value when included in foods. Therefore, trying to make this product even more valuable, in 1988, a patent was granted giving rise to microparticulated whey proteins (MWP). In that way, the present work aimed to review the literature on patents that develop and/or apply MWP in food production until December 2022. Keywords, such as "whey", "protein", and "microparticulated" were used in the search for patents in Espacenet (patents database of the European Patent Office—EPO). A total of 60 patents were reviewed in this study which include the MWP as a fat substitute; as an ingredient to improve texture, flavor, and viscosity, or as a stabilizer for food products, like yoghurt, cheese, salad dressings, and acidified drinks, among others. This study investigates South Korea's trials and errors in procuring COVID-19 vaccines from abroad, amid the limitations of a multilateral scheme for global provision through the COVID-19 Vaccines Global Access (COVAX) program via the World Health Organization (WHO) and the discussions on COVID-19 vaccine patent waivers at the World Trade Organization. Using the framework of "self-help" in the international system and country categorization to explicate country behaviors by state-business relations and expertise to explain South Korea's COVID-19 vaccine procurement process, this study argues that in the absence of a global mechanism that guarantees adequate and timely vaccine provision, countries are left to the sole option of depending on their own capabilities: expertise, budget, and policy planning by consolidating public and private capacities to acquire vaccines for the public. To support the argument, an in-depth case investigation of South Korea's Vaccine Procurement Task Force is presented. The case study focuses on the policy assessment of critical elements in South Korea's vaccine procurement and rollout on facing obstacles to sufficient procurement through COVAX: decision-making impacting the timing and dosage of procurement, diplomatic and business channels to sign bilateral contracts, setup of a smart-factory vaccination hub, and indigenous vaccine development for WHO approval. Firm's inter-regional investments are crucial carriers of capital flows between cities, transforming information resources into innovation capabilities. Based on the listed companies' inter-regional investments data and patent data in China during 2009-2018, the mechanism of the inter-regional investments in technological catch-up and the heterogeneity in different samples have been investigated via the two-stage least squares regression. The results show that: (a) Inter-regional investments enhance the innovation capability, narrow the technological distance, and play a more significant role than foreign capital; (b) Technological catch-up is achieved through independent innovation, the transmission mechanism of imitative innovation does not hold; (c) When there is no market segmentation, the role of inter-regional investments on technological catch-up is realised entirely through independent innovation. Segmentation hinders the technological catch-up process; (d) The partial mediating effect of the manufacturing industry on technological catch-up holds, while in non-manufacturing industries, it is not significant. Innovations in precision agriculture continue to increase in both number and significance. Contemporaneously, given their expanding scope and application, the growing pool of technologies is increasingly complex. Although some recent attempts have been made, a knowledge gap remains in respect to the evolution of precision agricultural innovation. Synthesized, such knowledge should inform the untapped opportunities for innovation. This paper narrows this gap by conducting a network analysis of patent applications in areas concerning precision agriculture. Spanning the years from 1960 to 2021, the analysis shows an annual average growth in patent applications of 15.1%. During the last decade, this growth is almost entirely attributable to China and the USA. Priority innovation themes have been dynamic. Its phases can be characterized as 'motorized mechanization' (1960–1999), 'mechanical automation' (2000–2009), 'digital mechanization' (2010–2019), and 'digital automation' (2020–2021). The significance of information communication technology has grown in association with other innovation clusters, but a lag time has persisted in introducing innovations based on such technologies. Background and Objectives An aging population creates fertile ground for devising innovations for older adults. By using patents as a proxy for inventive activity, this study sets the stage for understanding the latest innovations being designed for the older population. Insights will pave the way for a better understanding of inventions that could render society more age-friendly on the innovation front. Research Design and Methods To identify the latest innovations targeted at the older population, we collected all patents (N = 326) issued in 2021, specifically those issued between January 5th and December 28th. Upon removing irrelevant data, 120 patents were retained in the data set. Both inductive and deductive modes of reasoning informed our content analysis of the data. Results Three themes surfaced. About half (49.2%) of the patents focused on "Preventive Health, Safety, and Independence" (Theme 1). About 38.3% pertained to "Anti-Aging" (Theme 2) and 12.5% were about the "Pathologization of Old Age" (Theme 3). Discussion and Implications This is the first study that evaluates the state of innovations for an aging population. While there are inventions aimed at optimizing the well-being of older adults, there are also those designed due to beliefs that see old age as a problem to solve.
