Gender-based violence has assumed an increasing and constant position in official data and, therefore, there is an even greater need to promote prevention and coping mechanisms. Given this scenario, the present article intends to verify if the restorative practices in fact promote the realization of the human rights of women who suffer gender violence. In this context, the question is: do restorative practices actually promote the realization of the human rights of women who suffer gender violence? In order to come up with some answers, we sought to conduct a survey of data on the current rates of gender violence in the country; analyze which are the norms that discipline the application of restorative practices in Brazil and, finally, bring some examples of projects that already use restorative practices in situations involving gender violence. Restoration justice and penal abolishment are analyzed within the logic of progress and challenges that the Courts have to face within political policies in the wake of violence against women. Which are the challenges and the progress of the Courts within political policies in coping with violence against women as from the logic of Restoration Justice and penal abolishment? Results show that it is not sufficient to apply the law to mete punishment. Rather, one should prevent and idealize a valorative and philosophical concept of justice that would help people to eradicate violence. In that article devoted to analysis of gender violence over the years in national and international law, which was obtained care to surround the subject with the theoretical framework by proposing a dialogue with the structuralist thinkers like Deleuze, Michel Foucault and Pierre Bourdieu concomitant Simone Beauvoir, Judith Butler under the power of the theory of approach that prevails in human, social and legal relations. There was a concern to rethink the concept of gender, from the deconstruction of its structural elements linked to biological, social and historical condition. In addition to this deconstruction, other concepts were worked out, such as: sex, sexuality and identity. In this initial trajectory it was emphasized that men and women are plural and complex citizens, and in the midst of this is violence that is also the result of conflicts that require this lacking space for dialogue and understanding.
