The minority question has long been a hot topic in Central and Eastern Europe. Whereas most CEE countries guarantee the privileged position of the dominant nation, they also recognize the existence of national minorities and provide special rights for them. Hence there is an apparent contradiction between the values of the nation-states: unity and diversity. This article proposes that to resolve this contradiction, it is necessary to define the concept, scope and limitations of group-specific minority rights, as well as their relationship with other human rights and the nation-state. Constitutional courts are appropriate candidates for this task. However, based on our analysis of the relevant constitutional jurisprudence of five CEE countries – Croatia, Hungary, Romania, Serbia, and Slovenia – it seems that constitutional courts in the region have failed to properly conceptualize minority rights. Instead of developing appropriate tests for assessing the constitutionality of legal regulations, they have only superficially touched upon the conceptual issues of minority rights, using incidental, case-by-case arguments to justify the (un)constitutionality of the legal provisions. Therefore, this article also attempts to outline a constitutionality test that may be suitable for constitutional courts to consistently evaluate submissions that challenge the constitutionality of laws on minority rights. There is a boom in the power of right-wing parties that are becoming government parties in Latin America and Europe. It has been pointed out that these are distinguished from traditional right-wing parties by their common ideology that transcends national contexts, which is why they have been grouped as New Right-wing parties. This article questions whether these parties share ideological themes or whether they are heterogeneous and obey national interests. This study systemizes the New Right-wing parties' programs and classifies them to answer the question. This corpus is then studied through frequency, network, and principal component analysis. Two conclusions are reached from this. First, these parties agree on issues such as provider States and nationalist claims, and, second, their programs have diverse themes that do not show the formation of an identifiable transnational ideological agenda in their programs. Consequently, grouping these parties as an ideologically homogeneous phenomenon can make invisible the fact that they are parties that adjust to particular demands of their political environment, in a logic that obeys more catch-all parties than ideological and dogmatic parties. A response to reviews of the author's book "Liquid Nationalism and State Partitions in Europe" is presented. He explains the considerations to the relations between partitions and nation-state, societal homogenization and civic nationalism. Social exclusion is complex, intractable, and devastating. It occurs where individuals or groups cannot fully participate in the typical activities of the societies in which they live, whether they are excluded economically, politically, or live in segregation. In this review, I highlight recent work in the area of social exclusion and ethnicity, focusing on Europe and Eurasia. Scholarship reveals ethnic hierarchies of exclusion in hiring and housing markets, educational approaches that cloak assimilationist practice in the language of inclusion, a plethora of strategies that minorities use to navigate exclusion, and more. While new research brings innovation and insight, it nevertheless remains fragmented along several dimensions. As scholars work to move the field forward, bridging substantive areas of exclusion, studying the complex dynamic of interactions between majorities and minorities, and collaborating across methodological divides would be particularly valuable. The need to handle ethnocultural diversity and the external pressures of Euro-Atlantic integration have led to the development of complex minority rights regimes in Central and Southeast European states. The aim of this paper is to perform a comparative analysis of the political representation dimension of these regimes, and to investigate how the regulations in this domain are related to the more general attitude of states toward diversity recognition and registration. For this purpose, we classify the states according to a series of variables concerning the manner in which ethnocultural diversity is recognized and portrayed, as well as the regulations concerning the representation of minorities, and identify patterns of their incidence. The formal-legal analysis of the constitutions, minority protection laws and of the electoral legislation of the included countries reveals a clear connection between the general attitude of the state toward diversity and the incidence of autonomies, and a less unequivocal, yet strong relationship in the case of minority representation in the national polity. The vast body of inquiry into nationalism has traditionally seen Europe as a main center for the emergence of nationalism, but scholars of "national indifference" have countered with the idea that nationalism may not matter much at all as a motive for most people. The concept of national indifference calls into question the power of nationalism as a motive for action and the mass appeal of nationalism. Studies of national indifference have constructed an alternative non-national narrative, but face particular challenges accounting for major themes and episodes of discrimination and violence. At its core, national indifference paradoxically both rejects and accepts binary notions of identity and incorporates binary assumptions about motives. It is tempting to resolve the contest between parallel accounts of pervasive, powerful nationalism and national indifference by choosing a victor, but this contrast between models shows the fluidity and dynamism of nationalism. The debate between the now classic accounts of nationalism and the alternative of national indifference points to the importance of often overlooked variables: frames and sense of time. This article is the fifth and final in a Nationalities Papers series providing an overview of the development of Romani political group representation and administration, from the arrival of Roma to Europe up to 1971, the landmark year of modern transnational Romani politics. The article concentrates on the period between the Second World War and 1970 and the emergence of the following phenomena which distinguish this period from those covered in the previous articles: some limited Romani participation in non-Romani mainstream political or administrative structures, an international Romani evangelical movement, reconciliation between Romani political representation and the Catholic Church, national institutions created by various governments to aid the administration of policies on Roma and rapid growth of non-governmental organizations addressing Romani issues. This paper discusses Romani migration to the U.K. from Central and Eastern Europe (CEE) in the closing years of the twentieth century, with particular reference to the Czech and Slovak Republics. These case studies were chosen to illustrate wider points because they are the best documented, particularly with regard to illuminating sociological research on motivations for migration. Comparisons with similar migration to Canada shed further light on the situation. Refugees from these CEE countries have met a hostile reception in the U.K. It is argued here, however, that popular ignorance alone does not provide a sufficient explanation for this hostility: rather, the condemnation of Romani asylum seekers is seen as an expression of a deep-rooted and long-standing anxiety in the U.K. about immigration and its potential consequences. In spite of their relatively insignificant numbers, Roma have acted as convenient motifs in this ongoing discourse, being assigned a prominent symbolic role at a time of heightened political sensitivity. In this article, we show how judgments of the European Court of Human Rights (ECtHR) have provided nationalists with an unexpected opportunity to promote a nationalist discourse that is seemingly in line with human rights while fundamentally at odds with the counter-majoritarian core of human rights. We start our analysis with two judgments in which the Court accepted the arguments of liberal democratic states to infringe fundamental rights of persons belonging to (immigrant) Muslim minorities in the name of "requirements of living together" or "social integration": SAS v France (2014) and Osmanoglu and Kocabas v Switzerland (2017). Strikingly, the justifications by the states for these infringements point to concerns about perceived threats to national identity and culture. We show how nationalist politicians in countries with minority populations, including those in East Central Europe, have used justifications in terms of national self-protection, tacitly or explicitly, to pursue old anti–human rights agendas. This article assesses the analytical value of the “Kohn dichotomy” – the notion that there are two types of nationalism, resting on civic values in the West and on ethnic values outside the West. It begins by outlining the intellectual history of this dichotomy since its origin in the 1860s and by analyzing its main features. It contrasts the state traditions of Central and Eastern Europe and Western Europe in three areas: the geopolitical evolution of the state, the state’s perspective on its own population as reflected in efforts to measure “ethnic nationality” through such instruments as the population census, and divergences in citizenship law. It shows that data from recent programs of comparative survey research, and analysis of nationalist ideology, highlight the variety of forms that nationalism may take in the two parts of Europe. The article concludes that the “ethnic–civic” dichotomy is valuable as an ideal type with the capacity to shed light on the nature of ethnic affiliation, not as a categorical classification system. Different ethnonational groups comprise mixtures of people who use a combination of “ethnic” and “civic” reference points; they do not coincide with global territorial zones that may be identified with any level of clarity. This article provides an introduction to the special thematic section on political mobilization in East Central Europe. Based on a brief presentation of the main arguments of the individual articles, the authors discuss the recent political volatility in East Central Europe. They highlight the tension between fierce political rhetoric and populist policies on the one hand, and low levels of voter turnout and overall political participation in the region on the other. The authors argue that recent cases of successful as well as unsuccessful political mobilization in East Central Europe point to structural re-alignments in the region’s political landscape. In particular, the parties that are successful are those that manage to communicate their visions in new ways and whose messages resonate with nested attitudes and preferences of the electorate. These parties typically rally against the so-called establishment and claim for themselves an anti-hegemonic agenda. The introductory essay also asserts that these developments in East Central Europe deserve attention for their potential Europe-wide repercussions – especially the idea of “illiberal democracy,” which combines populist mobilization and autocratic demobilization and finds adherents also in more established European democracies. Territorial arrangements for managing inter-ethnic relations within states are far from consensual. Although self-governance for minorities is commonly advocated, international documents are ambiguously formulated. Conflicting pairs of principles, territoriality vs. personality, and self-determination vs. territorial integrity, along with diverging state interests account for this gap. Together, the articles in this special section address the territoriality principle and its hardly operative practice on the ground, with particular attention to European cases. An additional theme reveals itself in the articles: the ambiguity of minority recognition politics. This introductory article briefly presents these two common themes, followed by an outline of three recent proposals discussed especially in Eastern Europe that seek to bypass the controversial territorial autonomy model: cultural rights in municipalities with a “substantial” proportion of minority members; the cultural autonomy model; and European regionalism and multi-level governance. During the twentieth century the region of Subcarpathia belonged to several different states: the Austro-Hungarian Monarchy, Czechoslovakia, the independent Carpatho-Ukraine, the Hungarian Kingdom, the Soviet Union and finally to Ukraine. Today it borders four member states of the European Union (Poland, the Slovak Republic, Hungary and Romania), and due to its history several ethnicities and languages, religions and cultures live side by side in this region. However, as a consequence of the different language and minority policies in Subcarpathia, we cannot find a common language that everybody knows regardless of age, gender, education, religion or place of residence. The lack of a lingua franca makes dialogue between ethnicities difficult, sometimes even impossible. In this article we outline the main features of the regional, minority and language policies of the different states that existed at the various historical stages. We believe that the in-depth analysis of the history of this region can help find a model that could be useful not only in the region but also in the wider context of similarly multinational, linguistically diverse, culturally colorful territories in the Carpathian Basin and states in East-Central Europe. South Tyrol (Italy), with its three officially recognized language groups (Germans, Italians and Ladins), is a successful model of how a minority problem can be solved. It is based upon the principle of dissociative conflict resolution, which means separating the language groups as much as possible between themselves, as well as the principle of consociational democracy, which focuses primarily on the cooperation between the language groups' elites. In the last few years it has been observed that while the institutional frame has not changed, society has, thereby starting to undermine the existing political and institutional system from below. This concerns mainly the ethnic division, which is being questioned more and more by civil society, as well as aspects of cooperation between the elites. As a consequence of this process, South Tyrol's autonomy is moving toward further integration, with the latter again translating into strengthening the two factors of territoriality and identity. This contribution looks into nationalization and education in European borderlands in the early post-World War II period. Belonging to Belgium and Poland, respectively, in the interwar years, the Eupen–St. Vith–Malmedy and the East-Upper Silesia regions came under German rule during World War II. Returned to the Belgian and Polish nation-states once the war was over, the regions experienced a pronounced upheaval in the population profile as a result of population transfers and reorientations in education curricula. The aim of these measures was to guarantee the national reliability of borderland inhabitants, with a special role being designated for teachers, who were perceived as crucial in the raising of children as national citizens imbued with certain core values. This contribution compares the methods employed by the authorities in selecting educational personnel for their borderlands, the nationalizing role teachers were to play and the way teachers gave meaning to their professional practices. In the fall of 1918, after over four years of war, the cohesion of Austria-Hungary collapsed. In the aftermath of the Great War, Burgenland (Western Hungary) was part of a pattern of complex territorial issues, though it was actually the smallest disputed territory between Hungary and her successor states. The region became a disputed land after the Allied Supreme Council recommended the transfer of most of it to Austria. The internal crisis in Budapest, the Habsburg restoration attempts and the activities of many militia on the ground led to an extremely dangerous situation. Diplomatic and direct military involvement of the Powers eventually resolved the issue with an agreement providing for a plebiscite on the fate of Sopron and the other smaller towns of the region. At least until 1921 Western Hungary represented an element of destabilization in Europe, while its partition was a significant event in the evolution of relations between the two new states of Hungary and Austria, and a testing ground for European diplomacy. The purpose of this article is to highlight the role of Italy in these complex events and to elucidate the contribution of its military in the formulation of clearer political strategy. In August, a new language law in Ukraine allowed cities and regions to elevate the status of any minority language spoken by at least 10% of their population to "official" alongside Ukrainian. I argue that the law fails to protect genuine linguistic minorities and is likely to further undermine linguistic diversity in certain Ukrainian regions. More important, the law prolongs the vicious circle between Ukraine's lack of democracy and its politicians' reliance on identity cleavages to gather votes. I argue that the continuing exploitation of identity divides is increasing the popularity of extreme right parties and widening the gap in policy preferences between Ukrainian and Russian speakers. However, the current ethno-regional cleavages do not stand for irreconcilable identity attachments and their impact can be mitigated. The EU could contribute to this outcome by providing expert opinions on minority and language rights; demonstrating a commitment to Ukraine's territorial integrity and independence to de-securitize the minority rights discourse; and increasing individual-level contacts between the EU and Ukraine to promote a broader European identity. This article analyzes the discourse of historical legitimacy in the duchy of Schleswig and in the Slovenian-speaking regions of Carniola, Styria, and especially Carinthia in the nineteenth and twentieth centuries. The question as to who had arrived in the area first was never far from the surface, because in an era of national romanticism, duration of stay seemed to allot special claims to possession. Rather than challenging this rationale, all sides tended to focus their efforts on enhancing their local genealogy. Yet the national conflicts of the period were not about political and linguistic history, but about contemporary interests and identities. In both Jutland and the southeastern Alps, national movements tended to focus on select moments in time that corresponded most closely to their modern-day political aspirations. The article discusses the history and significance of the Lahemaa National Park in Estonia. Established during the Soviet era, the park is said to have served as a focus for Estonian nationalism while, paradoxically, inspiring the creation over other such parks throughout the Soviet Union. The tensions between the implicit assertion of Estonian nationhood represented by the Laheema project and the intention of Soviet Communist Party bureaucrats, led by Leonid Brezhnev, to maintain the dominion of the Soviet Union are analyzed.

The article presents an analysis of issues related to Roma ethnic identity and social structures in Europe. Topics addressed include transnational political movements, diversity within the Roma community and discrimination faced by the Roma people. The role of international non-governmental organizations such as the International Romani Congress is discussed, and the efforts of Roma activists to promote the interests of their people are presented. The distinction between these activists and the Roma people as a group is also addressed.

It is well known that the idea and practice of cross-border cooperation have been developed in post-war Europe with the intention of overcoming the economic and social isolation of border regions and reconciling the hostilities between former enemies. But as a precondition for this process the new map of European borders had to be perceived as "final" and "just," and as such it was legitimized on international and national levels. Moreover, it was the universal acceptance of the principle of the invariability of borders which made it possible for national governments to grant border regions more freedom in their contacts with the neighbors. The same applies in principle to the former socialist countries, where cross-border cooperation is supposed to help overcome the post-Cold-War division of Europe.

Intra-state regional differences are a central topic in the study of European and Eurasian politics. In Ukraine, regional differences have proven to be powerful predictors of mass attitudes and political behavior. trolled for. As part of this inquiry, the results of three competing regional frameworks for Ukraine: one with two regions, one with four regions and one with eight regions. While the eight-region framework is uncommon in studies of Ukraine, the decision to examine eight regions is supported by historical, economic and demographic arguments, as well as by the results of the statistical analyses presented in this article. Scholars who have focused on fewer regions in Ukraine may have underestimated the effects of regional differences and missed interesting stories about intra-state variation in Ukrainian attitudes and voting behavior. The results of this study carry important implications not only for the study of Ukraine but also for those interested in intra-state regional divisions across Europe and Eurasia.

This article follows earlier discussions about the current status of Romani refugees and migrants within Europe and the role of human rights in the process of accession of Central European states to the European Union (EU), in the Cambridge Review of International Affairs, Volume 13, Number 2. Romani migration opens up central issues of democratisation in Eastern Europe and of the role played by the EU in shaping that process. Human rights appear to have been accorded secondary importance and were replaced by the political doctrines of accession as efforts to manage and control migration, particularly of so-called undesirable migrants, such as the Roma, have reached a hiatus. The argument offered here is that discrimination of the Roma has been defined as no more than a social problem so that governments, both East and West, can proceed with the political agenda of enlargement. To demonstrate this point, the article reviews some Czech governmental documentation related to the treatment of Roma and places it within the context of the debate around accession within the broader framework of EU harmonisation of immigration policies.
