The author's clinical experience with the Child Protection and Mental Health Care systems informs this brief practice-focused paper. The author posits that Secondary Traumatic Stress and Vicarious Trauma are central to understanding the impact of relationally traumatic material and the experience of individuals, families, team and the wider ecology of care systems. In particular, the author hypothesises that the tendency of systems to become fragmented in operation, with silos of sub-parts working parallel to each other, may be a natural adaptation to the ways in which traumatic experience ripples across system boundaries. This ‘ripple effect’ may lead to increasing emotional and relational reactivity, and survival-oriented inward focus of energies and efforts. The metaphor of the brain and nervous system is used to explore ideas of connection and integration in care systems. Trauma-informed leadership by individuals and teams is also touched upon in relation to reducing fear-driven clinical practice.

With attention focussed on child abuse and measures for child protection in many countries around the world, efforts have been made to understand something of the nature and dimensions that lie behind abuse. Now the time has come to look at domestic violence in its other manifestations - not only parent to child as in child abuse, but also husband to wife or cohabiter to cohabiter. What, however, has been missing from this widening of concerns has been a focus on parental behaviour toward their children which involves the use of physical punishment in child rearing but which may fall short of the legal definition of abuse. This gap is about to be considered with the emergence in Australia of the EPOCH campaign in which Oz Child is to be a leading participant.

This paper throws a spotlight on the systemic disadvantage experienced by parents who have their children removed from their care. With data drawn from the annual reports of the Legal Aid of Western Australia, the child protection agency in Western Australia, and the Productivity Commission, the authors illustrate the disconnection between the agency’s policy to reunify children once removed from their birth parents; the resources made available to support families to overcome their difficulties; and how the gap is further widened when parents without financial means and who are disempowered face legal proceedings on their own. We profile the increasing numbers of infants who are removed, the decreasing numbers of these infants who are discharged from care, and the shortfall of grants of legal aid that are provided to parents when they go to court. For this group of parents, permanent loss of their children is a reality. The aim of the paper is to capture the extent to which there is a fundamental blemish on the principles of due process and fairness, and once statutory processes are triggered, the best interests of the child and the support of parents are contingent, with poverty being the key mediating factor.

Child sexual abuse (CSA) is a serious scourge that affects all countries globally. While there are myriad factors contributing the prevalence of CSA in Zimbabwe, poverty is arguably one of the major underlying issues and root causes of most of these factors. Over the past two decades, Zimbabwe has gone through an unprecedented economic meltdown; fewer resources are being channelled towards child protection leading to the decline in standards of living for children. Consequently, children are left vulnerable to poverty which exposes them to the risk of CSA. This paper discusses a number of poverty-related factors that are contributing to CSA in Zimbabwe. A qualitative study approach was adopted, and data were collected from 38 participants and four key informants who were selected using theoretical and purposive sampling, respectively. In addition, 300 court files of CSA cases were also reviewed. Notwithstanding other circumstances leading to CSA, findings showed that poverty-related vulnerabilities, such as adverse living conditions, rurality, child labour and migration, exposed children to CSA. The paper ends by discussing the policy and social work practice implications and recommendations in view of the findings.

This paper presents a scoping review of the literature on child participatory research in Australia published in academic journals between 2000 and 2018. The review focused on research designed to engage with children and young people in the development, implementation and evaluation of services. A total of 207 papers were identified and distributed across eight service sectors: child protection and family law, community, disability, education, health, housing and homelessness, juvenile justice and mental health. The papers were reviewed against Shier’s participation matrix, demonstrating that almost all of the identified papers included children only as participants who contributed data to adult researchers. Only a small number of papers involved children and young people in the other phases of research, such as designing research questions, analysis and dissemination. There is a clear interest in the engagement of children and young people in service design and decision-making in Australia. This paper is intended to serve as a catalyst for discussion on where there are gaps and where further Australian research is needed.

This paper is a reflective commentary that highlights some of the issues that impacted upon my thinking and perspectives as a social worker working in the child, youth and family sector. The paper takes the form of a narrative with some accounts of incidents that were memorable and challenged the ways I thought about myself and issues we face in the sector. My concerns are that, while there are many aspects of the work done in this sector in the past that we don't want to repeat, there are also features of service delivery that we overlook in the contemporary tendency to want quick solutions and pursue trends. The conclusions I have come to include the need for community-based, co-located services for parents and children who need supports and out-of-home care responses (OOHC).

The purpose of this paper is to familiarise readers with a new social innovations programme at the University of Melbourne. MABL is an abbreviation for Mobilising change Alliance for Better Lives. The paper outlines the rationale for establishing MABL and describes the processes and principles it uses to generate, design, test and scale novel solutions to improve the safety and wellbeing of vulnerable children and adolescents. Information on how to join the change Alliance and/or invest in solving a better lives challenge is provided.

Thousands of hours of evidence of trauma, pain and culpability presented to the current Royal Commission into Institutional Responses to Child Sexual Abuse have left no doubt that organisations have always been and continue to be responsible for enacting a culture that ensures that their own staff and volunteers do not harm, abuse or exploit children who are involved directly or indirectly with the activities or services provided by the organisation. In the past 6 years, through its Safeguarding Children Accreditation Program, the Australian Childhood Foundation has worked with more than 100 organisations nationally and internationally to strengthen their capacity to protect children and young people. Our experience has highlighted that substantial confusion exists about how to construct a child protection policy that frames the expectations and responsibilities of individuals who work, volunteer or use the services/activities of an organisation. In this paper, the authors offer a blueprint for considering the critical elements of a child protection policy that organisations can use to evaluate and possibly reconfigure or formulate their own. The paper outlines the function of the child protection policy in an organisation; the principles for constructing the policy; and an example of content for a child protection policy. The authors conclude that, if constructed with heart and sensitivity, a child protection policy can shape and define the very narrative about what the organisation stands for in relation to the safety of children and the responsibilities of adults to fulfilling the rights of children and young people more broadly.

While there has been a plethora of international and Australian research and inquiries into child protection and, to a lesser extent, foster care, there is a paucity of Australian research undertaken with the parents of children in care. While these parents are stakeholders in a system that has had a profound effect on their lives, their views are not generally canvassed. This paper discusses key findings of a community welfare Honours study which explored the experiences of six women whose children had been removed into foster care. The paper focuses on two core themes: firstly, the mothers' sense of betrayal when their pleas for help ultimately led to them losing their children, and, secondly, despite the resultant loss, grief and anger, their compulsion to do whatever it takes to have contact with, and to be reunited with, their children. The paper concludes with key messages and recommendations for practice.

The title encapsulates the argument advanced in this paper. The author argues that the associative link between child protection concerns and poverty, although well accepted, is not incorporated into practice with families. The paper presents the results of a small scale qualitative study undertaken in the two North Queensland regional cities of Townsville and Mackay. The author undertook interviews with ten (10) Family Services Officers (FSOs) in the Department of Families (DoF).Interviews revealed that FSOs agreed that family poverty is a stressor for child maltreatment. Participants differed in the extent to which they ascribed personal or societal responsibility for these family circumstances. The paper concludes with four recommendations to deal with family poverty in a child protection practice and policy context. The paper argues that more can and should be done to help children and families in this regard.

In child protection, ‘status indicators’ typically describe the status of children in care in regard to reason for coming into care, length of time in care, racial or ethnic identity and whether specific bureaucratic milestones have been reached. With Indigenous children, status indicators are broadened to encompass explicit requirements arising from the Aboriginal and Torres Strait Islander Child Placement Principle. Our contention is that this approach serves administrative decision-making and not the needs of Indigenous children.We propose a different process for evaluating the effectiveness of foster care for Indigenous children that considers their well-being rather than their status as cases. This paper examines ‘well-being indicators’ for Indigenous children in care that emphasise foster family capacity to fulfil basic developmental, health, educational, social, cultural, spiritual, housing (Fisher, Pecora, Fluke, Hardin & Field, 1999) and economic needs. The paper concludes with recommendations for practice research on well-being indicators in Indigenous families.

This paper discusses the increasing similarity between Australia’s states and territories in their child protection legislation. The paper deals mainly with the principles underlying child protection laws, definitions of abuse and neglect, and the way legislation deals with the likelihood and severity of harm to the child. The trend is towards adopting a common set of principles, and definitions which are relatively precise in targeting particular ‘types’ of abuse and eliminating status offences. However there are significant differences even between states which broadly adopt this type of legislation, and some states adopt quite different approaches. There is still little consensus on how likelihood and severity of harm are dealt with. The paper, in welcoming the principle of common legislation, notes a wide range of issues in the developing legal paradigm which have been subject to little or no public debate. It is not clear that the increasing ‘homogenisation’ of child protection laws is enshrining the kind of legislation required.

This paper provides an introduction and background to the Family Decision Making project which was piloted in the Department of Community Services Cumberland/Prospect area of NSW, in partnership with Burnside (an agency of the Uniting Church NSW). The paper outlines the core features and values of the DoCS/Burnside project with the aim of promoting discussion as to Family Decision Making’s wider application as a best practice model of working with children and families.

The Aboriginal and Torres Strait Islander Child Placement Principle has been the policy guiding the placement of indigenous children in most Australian child protection jurisdictions for around fifteen years. The Principle requires the involvement of Aboriginal and Torres Strait Islander community representatives in decision making concerning indigenous children, and ensuring that alternative care placements of Aboriginal and Torres Strait Islander children are with Aboriginal and Torres Strait Islander careproviders.Most Jurisdictions still have a significant number of Aboriginal and Torres Strait Islander children placed with non-indigenous careproviders, and community based Aboriginal and Islander child care agencies continue to express dissatisfaction about the nature and level of consultation which occurs when welfare departments are taking action to protect indigenous children.This paper, which was presented at the IFCO conference in Melbourne in July 1999, examines why there has been such limited improvement in Child Placement Principle outcomes. Work undertaken in Queensland to address the over representation of Aboriginal and Torres Strait Islander children in the child protection system will be outlined from both a departmental and community perspective. The paper argues that if strategies for addressing these issues are not located within a framework of self determination for Aboriginal and Torres Strait Islander people, then they will not work.

The theme of this paper is the central role of consumer groups in promoting greater accountability in child protection systems. In recent years, numerous Australian authors have drawn attention to the failings of our State child protection systems. Particular concern has been expressed about the potential ‘systems abuse’ of children in care, and the failure of statutory systems to engage or adequately consider the perspectives of biological parents. One of the principal reasons for these deficits appears to be the absence of formal consultation mechanisms with consumers of protection services. This paper considers the recent rise of consumer groups of both young people in protection and care, and their parents/caregivers, in relation to the above concerns, with particular reference to Victoria. Attention is drawn to both the strengths and weaknesses of the better known groups such as the Australian Association of Young People in Care and their State affiliates, and the Parent Inquiry into Child Protection. The author believes that the role of consumer groups as a ‘watchdog’ will become even more important with the intended privatization of some State child protection systems.

The concept of Good Enough Parenting, introduced by Winnicott in 1965, has been useful to distinguish between care of children which is not ideal, and care which warrants removal of children from a family. There have been various attempts to turn the concept into practice guidelines, most notably by the British Agencies for Adoption and Fostering (Adcock & White 1985). However there is a dearth of Australian material and little which is concise.Barnardos Australia believed that it was necessary to produce a short practice paper to address this critical issue in child protection practice. This paper was developed through a series of workshops with Barnardos workers which focused on their practice needs. It was designed to assist in decisions about parenting standards which are difficult, not the most obvious situations of neglect or abuse. The paper suggests ways of thinking about good enough parenting and practical questions to bear in mind in family assessment.

This paper traces the history of child welfare in Victoria, from the formation of the Children's Welfare Department to the present time. It draws principally upon the Annual Reports of the responsible state government department, to illustrate trends in out-of-home placement for children and young people admitted to care. It describes substantial shifts in direction to the institutions in the 1960s, deinstitutionalisation of the 1980s, and the re-emergence of home-based care as a favoured, economical option.The paper traces the ebbs and flows in numbers, periods of overcrowding and the current reduced number of children and young people in care. It notes events impacting on evolving child welfare history in Victoria, the child migration program, building projects, the establishment of family group homes, regionalisation, external review, the Children and Young Persons Act (1989), and mandatory reporting legislation. Themes emerging include: early child welfare as a period of rescue and reform; the monitoring of standards and re-entry of the department to residential care; the building of institutions and rising numbers in care; redevelopment and the emergence of a community focus; the expansion of child protection; and the phasing out of old models and the search for cost efficient alternatives.A challenge for the 1990s is the need for deliberate and planned monitoring and evaluation as institutional and residential care give way to home-based care, and numbers of admissions decrease. The paper aims to provide useful, historical material for readers with an interest in child welfare work which would benefit from a descriptive review of the past.

This paper outlines the parameters of the national out-of-home care data collection managed by the Australian Institute of Health and Welfare. The paper discusses the need for national data, what is included in the national data collection and the current data collection process. In addition possible developments to the national collection are outlined, in particular the proposal to collect the data electronically in unit record format. The benefits of this would include greater flexibility of the data and the ability to analyse how children move through the child protection and out-of-home care systems.

The maintenance of the physical and emotional safety of children about to be returned to their families following serious abuse is a complex and significant problem. This paper describes a treatment offered to such families which makes use of a residential setting, and which involved intensive work over the period of a week. This approach was cost effective, allowed for greater creativity by child protection workers, and impacted significantly on the lives of the families. This paper offers a philosophical as well as practical framework for treating at risk families in which a child is about to be returned.

This article examines child protection practice when the Department of Communities and Justice in New South Wales takes the view that an injury to a child is non-accidental. The position taken in this paper is that once a child protection caseworker takes the position that an injury is non-accidental, then a strict liability or absolute liability approach is adopted. In effect, any of the child’s parents or caregivers are identified as persons who may have caused the injury or harm. What follows is the decision that a child must never be restored to the parents or caregivers, unless a person confesses to causing the harm and completes specific child protection counselling. Our concern is with the process of investigation, the reliance on one medical opinion in a context where the parents or caregivers are not in a financial position to obtain a second opinion, the failure to observe the rules of evidence when considering medical opinion, and the manner of substantiation of the non-accidental injury. In addition, we argue that there is a lack of knowledge about the factors that influence a paediatrician’s decision-making and that the guidelines for judicial decision-making derived from case law need to be examined further.

Child protection work is one of the most difficult and complex areas of human services practice. Working within a trauma-laden environment often means that practitioner susceptibility to trauma-related mental health issues is an occupational hazard. However, many practitioners are reluctant to seek support when they start to experience symptoms of traumatic stress. This paper considers current literature relating to child protection workers’ exposure to work-related traumatic material, resulting traumatic stress symptomology and organisational responses to practitioner distress. Results from a recent doctoral study that explores the experiences of child protection practitioners based in Queensland will be presented. Findings from the study were derived from qualitative in-depth, semi-structured interviews. The study findings indicate that the organisational culture within statutory child protection agencies creates an environment where practitioners are labelled as incompetent or not suitable for child protection work when they disclose experiencing symptoms of traumatic stress. The experience of bullying and retribution by supervisors and colleagues and the fear of rejection by the workgroup were also found to be significant barriers for workers seeking support.

Aboriginal children in Australia are over-represented in both the child protection and juvenile justice systems. Using Western therapeutic models of practice with Aboriginal people who live in remote communities can be highly problematic. Moreover, the historical legacy of past and present legislation, government interventions and racist service provision needs to be acknowledged and addressed prior to any service implementation. This paper presents a therapeutic model of practice that incorporates Aboriginal concepts of healing and spirit within a creative therapeutic framework. It will demonstrate how the model works through principles of community engagement and capacity building, enabling the provision of a culturally derived therapeutic intervention that involves a synergy of both Aboriginal- and Western-based healing practices. The findings from the implementation of the TeaH model affirm the need to incorporate Aboriginal concepts of healing, spirit and creative therapies into mainstream practice with Aboriginal people.

This paper reports on recently completed research which explores the key question of whether public child protection practice requires a vision embedded in family empowerment. The principle objective of the study was to promote our understanding of the experiences families have with child protection services. The project progressed in two different phases. In phase one, a qualitative in-depth interviewing method was applied to explore the experiences and views of the families. The findings were then thematically analysed through a critical theoretical process. For the second phase, we developed an empowerment framework to analyse and map the key themes from the findings, which outlines the families’ difficulties to engage with, and their alienation from, the services in all stages of interventions. The mapping outcomes indicate a link between the process of empowering the families and the process of improving the child protection service.

The paper reflects on developments in leaving care policy and practice in Western Australia (WA) and nationally from the mid-1990s. The review of national and some international literature suggests that current Australian policy and practice shows a ‘systems stuckness’ that requires a more potent form of annual auditing and reporting of jurisdictional leaving care outcomes. The review of mostly Australian publications focusing on leaving care and the risk of homelessness includes reflections on recent developments in leaving care services in England, which recognise and restore relationship-based services for care leavers. Finally, the history, vision and initial impact of the Living Independently for the First Time (LIFT) Project, a case study of learning by doing, is outlined. The authors and their colleagues from the Department for Child Protection and Family Support (Midland District), Swan Emergency Accommodation (now known as Indigo Junction) and the Housing Authority of WA have collaborated to design and develop the LIFT Project. This initially unfunded action-research strategy involves inter-agency policy and practice designed to prevent homelessness of vulnerable care leavers.

Across the eight jurisdictions of Australia, mandatory reporting obligations and thresholds for reporting vary. Teachers are one group of the professionals who are mandated to report child maltreatment, yet some teachers are still reluctant to make such a report. This paper examines the barriers that discourage teachers from reporting child maltreatment and also whether teachers consider it necessary to question a child about the maltreatment before they decide if a report should be made. Thirty semi-structured interviews with Victorian primary school teachers were thematically analysed and revealed that inadequate and inconsistent mandatory reporting training, the need for certainty before initiating a report and the ambiguous concept of neglect were barriers to teachers identifying and reporting child maltreatment. Analyses further revealed that teachers gather evidence to confirm or disconfirm their suspicions of maltreatment by questioning the suspected child victim. The consequences of this practice are discussed along with recommendations to help overcome the barriers to making a formal report when child maltreatment is suspected.

Removing a child from parental care is an important and difficult decision to make. There are far reaching consequences for the child and family. Whilst there is a plethora of literature in relation to child protection practice generally, research on decision making is minimal. In this practice paper, I present 12 decision-making criteria to assist practitioners make decisions about child removal. It is important for child protection practitioners to apply the same set of principles and consider the same factors when making these decisions. These criteria are as follows: the severity of the abusive incident; the presence of cumulative harm; whether the perpetrator has access to the child; the functioning of the parent; whether the perpetrator has been responsible for child abuse or intimate partner violence in the past; the cooperation of the parent; the intent of the perpetrator; the age of the child; the functioning of the child; the voice and expressed wishes of the child; protective relationships available to the child and the statutory requirement to cause no further harm. Referring to these criteria will assist practitioners be clear and explicit about how they reach a decision, and result in greater consistency of outcome for children and families.

The Royal Commission into Institutional Responses to Child Sexual Abuse has uncovered evidence that organisations sometimes provide opportunity for the sexual abuse of children. How do organisations go about preventing this? The authors of this paper consider the case of an out-of-home care (OOHC) agency which failed to protect children. By identifying gaps in practice and culture in this case, the authors suggest that protecting children in OOHC requires a “weave” of organisational structures, staff development and cultural competence. In this case, the Chief Executive Officer (CEO) of the organisation was able to create an opportunity for access to vulnerable young people by using strategies we can now identify as grooming behaviours. He did this by using his positional power. He ignored standards, isolated protective adults and therefore children and young people, rewarded compliance, discouraged reflective practice, used his culture to avoid scrutiny from funding and oversighting agencies, and created an organisational culture of fear and secrecy. In effect, he used culture to trump safety. Even in the stressful conditions of managing an OOHC service, good practice is important, not only because it meets the standards and legislation, but because this is how services maintain the safety of children and young people in care.

In Australia, many researchers and policy makers believe that statutory child protection systems are overburdened and ineffective. The way forward, they suggest, is a public health model of child protection. A public health approach comprises four steps: (1) collecting surveillance data; (2) establishing causes and correlations; (3) developing and evaluating interventions; and (4) disseminating information about the effectiveness of intervention activities to the public health community. However, in Australia there are no reliable surveillance data. There is no information about ‘person’. Information is not collected about the characteristics of children (e.g., ethnicity) and parents (e.g., mental illness) reported to child protection services. Data are not comparable across place. This is because the states and territories have their own child protection legislation, definitions and data recording methods. Data are not comparable over time. This is because many jurisdictions have introduced new data recording systems over recent years. This paper concludes that it is essential to develop an effective child protection surveillance data system. This will ensure that services are located in areas and targeted towards populations in greatest need. It will enable large-scale evaluation of the effectiveness of prevention and intervention activities.

The globalisation of the economy and the increasing ease of travel have led to the internationalisation of families. Bi-national couples and families relocating from one country to another are now commonplace. The international element of family life often leads to complex legal situations – such as international parental abduction – when these families are facing a crisis. However, the scope of legal issues arising from the internationalisation of families and affecting children is wider than the abduction problem and can relate to relocation, access rights, urgent protection measures or transborder placement, to name only a few. This paper aims to present the 1996 Hague Convention on the International Protection of Children which establishes a comprehensive framework ensuring the effectiveness of the rights of children involved in a crossborder situation.

This paper describes the collaboration between an Aboriginal community and Western Australia's (WA) Department for Child Protection (DCP) in designing and operating a residential child care facility in a predominantly Aboriginal community. Research literature has established that the effective operation of child protection systems in remote Aboriginal communities requires practitioners and policy-makers to have awareness of local and extra-local cultural, historical and contemporary social factors in nurturing children. This ethnographic case study describes how a newspaper campaign heightened public and professional awareness of child abuse in the town of Halls Creek, in WA's Kimberley region. With its largely Aboriginal population, Halls Creek lacked the infrastructure to accommodate an inflow of regional people. Homelessness, neglect and poverty were widespread. Within a broader government and local response, DCP joined with community leaders to plan out of home care for children. Detailed are the importance and complexities of negotiating between universal standardised models of care and local input. Strategies for building positive relationships with children's family while strengthening both parenting capacity and community acceptance, and use of the facility are identified. Key to success was the development of a collaborative ‘third-space’ for threading together local and professional child protection knowledge.

This article, which is built on media discourse analysis, provides an insight into how public opinion on the work of courts has developed into a discourse of disapproval. The discourse of time is often used to evaluate the work of courts and tends to meet with disapproval when related to sentencing and when the Family Court fails to deliver equal parental access to children. The Family Court is also the subject of discourses of fear within the media, with stories often focusing on child abuse and horror stories of neglect designed to attract and recruit an audience to media outlets. In addition, the discourses facing the Family Court are now firmly tied to time as a major aspect of decision-making. Because of this contested view, child protection may be reduced to a secondary perspective. This paper recommends a change to discourses surrounding courts by all parties in order to facilitate better understanding. Refereed/Peer-reviewed

The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction is a multilateral treaty that seeks to protect children from the harmful effects of abduction and retention across international boundaries by providing a procedure to bring about their prompt return. The ‘Child Abduction Section’ provides information about the operation of the Convention and the work of the Hague Conference in monitoring its implementation and promoting international co-operation in the area of child abduction. There are currently 58 member countries and 22 non-member countries. Australia signed the Convention five years after its introduction. The Family Law (Child Abduction) Regulations 1986 enshrined in Australian law the principles espoused in the Convention which came into force in 1987. The Regulations are to: (a)secure the prompt return of children wrongfully removed to or retained in any contracting state, and(b)ensure that rights of custody and access under the law of one contracting state are effectively respected in the other contracting states. This paper shows that the failure of Family Courts to take account of the effects of their actions on the development and best interests of children whose return is secured can add to the psychological abuse of those who were removed from their home countries to avoid sexual abuse and violence. It suggests that the exceptions in the regulations that allow a child to remain in the new country with the primary caregiver are being ignored.

Permanency, stability and continuity are essential components of quality out-of-home care. Permanency planning is a case planning process designed to promote stability and long-term connections for children subject to child protection intervention. This paper outlines findings from a small qualitative study that explored perceptions of permanency planning held by child protection practitioners, carers, and the parents of children in care in Queensland, Australia. Findings show that each group emphasised different aspects of permanency. Practitioners tended to focus on placement arrangements, carers focused on relationships and security, and parents were concerned about the quality of care their children received. Everyone involved in permanency decisions – whether children and young people, parents, carers or child protection practitioners – has ideas, theories and knowledge that they draw upon in expressing their views. Understanding these perspectives is useful for the decision-making process, as each stakeholder communicates with others about what they think is most important for the child. Implications for child protection practice include having a clear practice language and approach to permanency planning, exploring the unique areas of importance to different stakeholders on permanency planning, and ensuring quality participatory practice.
